Commission of Inquiry (Children in State Care and Children on APY Lands) Act 2004

Definitions and scope

• Authorised person, Commissioner, evidentiary material, Inquiry and sexual offence are defined at s 3. The Act draws the meaning of "sexual offence" from s 4 of the Evidence Act 1929 (s 3). The Schedules provide specialised terms: "child in State care", "designated Minister" and "relevant Act" for the State‑care inquiry (Schedule 1 cl 1), and "child on the APY lands", "APY community" and "APY lands" for the APY inquiry (Schedule 2 cl 1). The Act treats a "child" as any person under 18 (s 3).

Constitution and composition

• The State‑care commission is constituted by a person appointed by the Governor (s 4(2)). Employment conditions are set by the Governor (s 4(3)). If a Judge or former Judge is appointed, the Act modifies application of the Judges' Pensions Act 1971 to account for service while conducting the Inquiry and for the term’s end (s 4(4)-(5)).
• The APY lands commission is constituted by the same person appointed under s 4 (s 4A(2)), but the Governor must appoint two Assistant Commissioners to assist (s 4A(3)). Those Assistants must include one male and one female and at least one individual of Aboriginal descent (s 4A(3)(a)-(b)). Assistant Commissioners can exercise the Commissioner’s powers under arrangements with the Commissioner and become references to "the Commissioner" when they do so (s 4A(4)).

Powers of investigation and procedure

• The Commissioner is not bound by ordinary rules of evidence or procedure and may inform themselves as they see fit (s 5(1)(a)). The Commissioner may adopt procedures that promote promptness, cost‑effectiveness and thoroughness (s 5(1)(b)), may refer matters to experts (s 5(1)(c)), refer persons to counselling or support services (s 5(1)(d)), and may refer matters not directly relevant to the Inquiry elsewhere (s 5(1)(e)). The Commissioner must take reasonable steps to avoid prejudicing any criminal investigation or prosecution (s 5(1)(f)).
• Witness attendance and production of evidentiary material may be compelled by summons (s 6(1)-(2)). An authorised person may administer oaths or affirmations (s 6(3)).
• If a person refuses to comply with a summons or to take oath or answer relevant questions, the Supreme Court may compel attendance or production on application by an authorised person (s 7(1)). A person who, without reasonable excuse, refuses is guilty of an offence liable to up to $10,000 (s 7(2)).

Confidentiality, publication control and use of identifying information

• Confidentiality obligations under other laws do not inhibit providing information to the Inquiry (s 9(1)).
• The Commissioner may order persons to leave proceedings, may forbid publication of specified evidence or accounts of it, and may forbid publication of the names of witnesses or persons alluded to, either absolutely or subject to conditions (s 9(2)(a)-(c)). Orders can be varied or revoked (s 9(3)). Contravention of those orders attracts a penalty up to $2,000 or imprisonment for six months (s 9(4)).
• The Commissioner must take all reasonable steps to avoid disclosure that might identify victims, alleged perpetrators or informants, if justice or public interest requires (s 9(5)).
• The Commissioner may use coded identifiers and may provide identifying information and other Inquiry information to the Minister or other public officials as the Commissioner thinks fit (s 10(1)). However, s 10(2) requires provision to the Commissioner of Police of any information concerning the commission or alleged commission of a sexual offence against a child unless specified exceptions apply (s 10(2)(a)‑(c)). The Commissioner may, despite a victim’s request for non‑reporting, provide info to police or the DPP if they consider it in the public interest (s 10(2)(c) exception subject to the public interest reserve in s 10(2)).

Limits on findings and temporal scope

• The Schedules state the terms of reference for each Inquiry. Both Schedules state that the person conducting the inquiry must not purport to make a finding of criminal or civil liability (Schedule 1 cl 2(5); Schedule 2 cl 2(6)). Each Inquiry is limited to alleged conduct occurring before commencement of the Act or the Schedule (Schedule 1 cl 2(3); Schedule 2 cl 2(3)).

Legal protections, privileges and exclusion of judicial review

• The Act gives authorised persons the same protection, privileges and immunities as a Judge of the Supreme Court in connection with the conduct of the Inquiry and reports (s 13(1)). Witnesses and legal practitioners have the same protections as witnesses or counsel in Supreme Court proceedings (s 13(2)-(3)). A new subsection inserted by amendment prevents courts and tribunals issuing subpoenas or processes that would require authorised persons, or documents prepared for the Inquiry, to be produced or give evidence about matters within their official capacity (s 13(1a)).
• Section 12 prevents proceedings for judicial review or any declaration, injunction, writ or other remedy that seeks to challenge or question Inquiry proceedings, decisions or reports.

Compulsion and use of compelled information

• Section 14 compels answers even where self‑incriminatory but renders compelled replies inadmissible in criminal or civil proceedings, except proceedings for offences against the Act itself.

Mandatory notification and protection of notifiers

• Section 15 provides additional protections for evidence that would disclose the identity of a person who has notified a government agency under an obligation under the Children's Protection Act 1993. Such evidence cannot be adduced without court permission; the court can grant permission only if the evidence is of critical importance and necessary to avoid prejudice to the administration of justice, or the person concerned consents (s 15(2)). Applications for permission are to be dealt with non‑publicly unless the court authorises otherwise and must protect the information pending determination (s 15(3)).

Reporting and post‑Inquiry obligations

• The Commissioner must deliver their report to the Governor (s 11(4)), the Minister must lay the report before both Houses of Parliament within three sitting days (s 11(5)), and the Minister is required to respond according to the timetable in s 11A (preliminary, full and annual responses for five years).

Amendment structure

• Legislative history shows targeted amendments after the Act’s introduction that added privileges and immunities, an APY lands inquiry, and procedural changes (legislative history and the table at the end of the Act summarise amendments and commencement dates).

Primary public actors and decision‑makers

• The Governor appoints the Commissioner (s 4(2)) and appoints Assistant Commissioners for the APY inquiry (s 4A(3)). The Governor also sets conditions of appointment (s 4(3)) and, in relation to judicial appointees, the Attorney‑General fixes the day on which the term ends by Gazette notice (s 4(5)). These appointment provisions place the initial decision about who will conduct the inquiries and under what conditions with the executive branch.

• The Minister has multiple obligations: appoint or engage staff to assist (a qualified social worker and a senior investigations officer at minimum, s 8(1)); appoint other persons to assist after consultation with the Commissioner (s 8(2)); engage or appoint persons to provide support to prospective witnesses (s 8(3)); and lay the Commissioner’s report before Parliament and respond to it in specified timeframes (s 11(5) and s 11A). The Minister therefore bears the resource and administrative costs of staffing and of following up the Commissioner’s recommendations.

Operational and investigatory actors

• The Commissioner (and, where empowered, Assistant Commissioners) runs the inquiries and decides procedure, confidentiality orders, whether parts of the Inquiry will be public or private, which matters to continue or to treat as frivolous or vexatious (s 5(1)(a)-(f); s 5(3)-(5)). The Commissioner issues summonses and receives evidentiary material (s 6). Where Assistant Commissioners act under an arrangement, references to "the Commissioner" extend to them (s 4A(4)).

Affected persons and groups

• Victims and alleged victims who were children when the conduct occurred are direct subjects of inquiry (Schedules 1 and 2). The Act requires the Commissioner to take all reasonable steps to avoid identifying victims (s 9(5)(a)).

• Persons alleged to have committed sexual offences while a child are also protected by identification‑avoidance measures where the interests of justice require (s 9(5)(b)). However, information concerning alleged sexual offences must be passed to police unless the Commissioner has reasonable grounds to believe it has already been reported and recently considered (s 10(2)(a)), or has determined to give it to the DPP (s 10(2)(b)), or the victim requested non‑disclosure but the Commissioner thinks disclosure is in the public interest (s 10(2)(c)).

• APY communities and children resident on APY lands are specific subjects of the second Inquiry; the Governor’s appointments and the requirement that at least one Assistant Commissioner be of Aboriginal descent attempt to shape the Inquiry’s composition with demographic specificity (s 4A(3)).

Legal actors and courts

• The Supreme Court is the enforcement forum for compulsion orders and is empowered to compel attendance and production if a witness disobeys the Inquiry (s 7(1)). However, s 12 removes the usual means of judicial challenge to Inquiry procedures, decisions and reports by barring judicial review or remedial proceedings that question or challenge those matters.

• The Commissioner of Police and the Director of Public Prosecutions receive communications from the Commissioner (s 10(2)). The Act imposes a duty to provide information to the Commissioner of Police except in tightly prescribed circumstances (s 10(2)).

• Legal practitioners who represent persons before the Inquiry have the same privileges and immunities as counsel in Supreme Court proceedings (s 13(3)), and there are limits on court or tribunal processes compelling authorised persons or Inquiry‑prepared documents to give evidence elsewhere (s 13(1a)).

Government agencies, records custodians and third parties

• Any person or agency that holds information relevant to the Inquiry may be required to produce evidentiary material under summons (s 6(1)-(2)). Section 9(1) expressly removes statutory confidentiality obligations that might otherwise block disclosure for the purposes of the Inquiry. The Commissioner may use staff and facilities of any Crown agency by arrangement (s 8(4)), which affects public servants and agency resources.

Who pays and who bears operational costs

• The Minister is required to appoint, engage and provide support staff (s 8(1)-(3)); the Crown will therefore bear the direct cost of staffing and the administration of the Inquiry. Agencies that are asked for records or assistance will incur compliance costs in providing records, searching archives and supporting the Commissioner’s investigations. Witnesses compelled to appear may bear time and travel costs unless the Inquiry or the Minister provides assistance or arrangements for production to an authorised person (s 6(2); s 8(3)).

Individuals who face legal risk or penalties

• Persons who knowingly make false allegations to the Inquiry with intent to harm face a maximum penalty of $10,000 (s 5(6)). Persons who fail to comply with a summons, refuse to take an oath or affirmation, or refuse to answer questions relevant to the Inquiry without reasonable excuse face criminal penalties up to $10,000 (s 7(2)). Persons who breach non‑publication orders face up to $2,000 or imprisonment for six months (s 9(4)).

In summary, the Act assigns decision‑making authority to the Governor, the Commissioner and the Minister, places practical obligations and record‑production duties on agencies and custodians of information, creates enforcement mechanisms operating through the Supreme Court and criminal sanctions, and affects victims, alleged perpetrators, APY communities and their representatives through both investigative attention and statutory privacy protections.

Duties of the Commissioner and authorised persons

• To conduct each Inquiry in accordance with the terms of reference set out in Schedule 1 (children in State care) and Schedule 2 (children on APY lands) (s 4(1); s 4A(1); Schedules 1 and 2). The Schedules define the scope and restrict the temporal ambit to conduct before commencement (Schedule 1 cl 2(3); Schedule 2 cl 2(3)).
• To adopt procedures that facilitate prompt, cost‑effective and thorough investigation (s 5(1)(b)), to refer matters to experts or other agencies as necessary (s 5(1)(c)-(e)), and to take reasonable steps to avoid prejudicing criminal investigations or prosecutions (s 5(1)(f)).
• To take evidence in private unless the Commissioner considers public proceedings are in the public interest (s 5(2)-(3)), and to comply with any witness request for private receipt of evidence (s 5(4)).
• To exercise powers of issuing summonses (s 6(1)), receiving evidentiary material (s 6(2)), administering oaths and affirmations (s 6(3)), and making confidentiality and non‑publication orders (s 9(2)).

Duties of the Minister and executive

• To appoint or engage specified support personnel after consultation with the Commissioner, including a qualified social worker and a senior investigations officer (s 8(1)); to appoint or engage other persons as required (s 8(2)-(3)); and to make use of public service resources by arrangement with agencies (s 8(4)).
• To ensure the Commissioner’s report is laid before each House of Parliament within three sitting days of receipt by the Governor (s 11(5)).
• To provide staged responses to the Commissioner’s report: a preliminary response within three months indicating which recommendations are intended to be carried out; a full response within six months setting out which recommendations will and will not be carried out and reasons; and annual further responses for five years reporting progress on implementation and explaining changes in decisions (s 11A(a)-(d)). Copies of each response must be laid before each House of Parliament within three sitting days (s 11A(d)).

Duties of persons who receive summonses or are called to give evidence

• To comply with a summons issued under the Act, to take an oath or affirmation when required, and to answer questions relevant to the Inquiry to the best of their knowledge, information and belief (s 6(1) and s 7(1)(c)). Failure to comply without reasonable excuse is an offence punishable by up to $10,000 (s 7(2)).
• To avoid knowingly making false allegations against another person with intent to cause injury while placing evidence before the Inquiry (s 5(6)).

Rights and protections given to witnesses and participants

• Persons providing evidence, or evidentiary material, have the same protection, privileges and immunities as a witness in Supreme Court proceedings (s 13(2)). Legal practitioners representing persons before the Inquiry have the same protection, privileges, immunities and obligations as counsel in Supreme Court proceedings (s 13(3)).

• Compulsion of self‑incriminating answers is permitted, but compelled information or answers are not admissible in criminal or civil proceedings, except for proceedings for offences against this Act (s 14). That is, compelled testimony is inadmissible outside prosecutions for breaches of the Act itself.

• The Act protects notifiers whose identity would be disclosed by evidence of a notification made under the mandatory reporting obligations in the Children's Protection Act 1993. Such evidence cannot be adduced without court permission, and the court must be satisfied either that the evidence is of critical importance and necessary for administration of justice, or the person consents (s 15(1)-(2)). Applications for permission are to be conducted, except as authorised by the court, in private and in a way that protects the information pending determination (s 15(3)).

Statutory immunities and exclusion of external process

• Authorised persons have the same protections, privileges and immunities as a Supreme Court Judge in connection with Inquiry conduct and reports (s 13(1)). A later amendment (s 13(1a)) prohibits courts, tribunals and other authorities issuing subpoenas or processes requiring authorised persons or Inquiry‑prepared documents to be produced or witnesses to give evidence about their official capacity, and voids such processes issued before that subsection’s commencement.

Limits on rights to judicially review or challenge Inquiry work

• Section 12 removes the ability to bring proceedings for judicial review, declarations, injunctions, writs or other remedies to challenge or question Inquiry proceedings, decisions or the preparation or presentation of reports under the Act. That is a primary statutory limitation on judicial oversight of the Inquiry’s functioning.

Duties around confidentiality and disclosure

• Section 9(1) removes statutory confidentiality obligations that would prevent providing information for the purposes of the Inquiry. The Commissioner may impose publication bans or exclusion orders under s 9(2), and must take reasonable steps to avoid disclosure of identifying information about victims, alleged perpetrators and informants where justice or public interest requires (s 9(5)). Contravention of a publication order is an offence under s 9(4).

Duties on the Commissioner to report and to refer to law enforcement

• The Commissioner must, under an arrangement with the Commissioner of Police, provide to police any information concerning the commission or alleged commission of a sexual offence against a child arising during the Inquiry unless specific exceptions apply (s 10(2)). This establishes an affirmative reporting duty, with narrow exceptions where the Commissioner reasonably believes the information has already been reported and recently investigated (s 10(2)(a)), or where the Commissioner has elected to provide the information to the DPP instead (s 10(2)(b)), or where a victim has asked for the information not to be provided but the Commissioner considers disclosure in the public interest (s 10(2)(c)).

Practical interplay of duties and rights

• The Commissioner’s duty to avoid prejudicing criminal investigations (s 5(1)(f)) sits alongside the duty to provide information to police (s 10(2)). The Act balances compelled information and witness protections by requiring answers under compulsion but limiting admissibility (s 14). The Minister’s duty to respond over an extended period (s 11A) imposes continuing administrative obligations and public accountability following the Commissioner’s report.

Penalties expressly provided in the Act

• False allegations: A person who knowingly makes a false allegation with the intention to cause injury or harm when placing evidence before the Inquiry is guilty of an offence. The maximum penalty is $10,000 (s 5(6)).

• Non‑compliance with procedural requirements: A person who, without reasonable excuse, refuses or fails to comply with a summons under this Act, fails to make an oath or affirmation when required, or fails to answer relevant questions is guilty of an offence and liable to a penalty not exceeding $10,000 (s 7(2)). Additionally, s 7(1) gives the Supreme Court power to compel the attendance of a person before the Court to give evidence or to produce evidentiary material if they refuse or fail to comply.

• Breach of non‑publication orders: Contravening or failing to comply with an order under s 9(2) is an offence punishable by a maximum of $2,000 or imprisonment for six months (s 9(4)).

Enforcement mechanisms

• Summonses and administrative compulsion: Authorised persons may issue summonses requiring attendance and production of evidentiary material (s 6(1)). Summonses may instead require production to an authorised person nominated in the summons (s 6(2)). An authorised person may administer oaths or affirmations (s 6(3)).

• Court enforcement: If a person refuses or fails to comply with a summons, to take an oath or affirmation, or to answer relevant questions, the authorised person may apply to the Supreme Court which may compel attendance or production of material (s 7(1)). The Supreme Court therefore acts as the compulsion enforcement mechanism.

• Criminal prosecution: The Act creates offences (s 5(6); s 7(2); s 9(4)) for false allegations, non‑compliance and breach of publication orders. Prosecution for these offences would proceed under ordinary criminal procedures.

Limits on judicial oversight

• Section 12 prevents proceedings for judicial review, declarations, injunctions, writs, orders or other remedies that seek to challenge or question any conduct or decision of the Commissioner, or the preparation or presentation of reports under this Act. Practically, this removes a common enforcement route by interested parties seeking to overturn or restrain Inquiry conduct. The Act therefore limits judicial remedies directed at the Inquiry methodology and outputs, while preserving criminal sanctions for certain conduct and the court’s role in compulsion.

Protections, immunities and exclusion of subpoenas

• Authorised persons enjoy the same protection, privileges and immunities as a Judge of the Supreme Court in connection with Inquiry conduct and reports (s 13(1)). A later amendment (s 13(1a)) bars subpoenas or other processes requiring authorised persons, persons appointed under s 8, or documents prepared for the purposes of the Inquiry to be produced or witnesses to give evidence in external proceedings, and voids any such process issued prior to that subsection’s commencement. These provisions protect authorised persons from external compulsion and limit discovery of Inquiry documents in other proceedings.

Compelled answers and admissibility

• Section 14 compels witnesses to answer questions even if answers would tend to incriminate them, but provides that such compelled answers are not admissible against the witness in criminal or civil proceedings in any court, except in proceedings for an offence against this Act. Thus compelled testimony is insulated from subsequent use in most prosecutions but remains usable if the person is later charged with an offence under this Act (for example, making false statements to the Inquiry).

Court‑permission safeguards concerning mandatory notifiers

• Section 15 adds a court‑permission safeguard for adduction of evidence that would disclose the identity of someone who notified a government agency under a mandatory reporting obligation in the Children's Protection Act 1993. The court can only permit such evidence if it is of critical importance and necessary for the proper administration of justice or the notifier consents (s 15(2)). The application process must, except as authorised, be conducted in private and protect the information pending determination (s 15(3)). These mechanisms constrain the use of certain evidence without court authorisation.

Practical enforcement implications

• The Act creates a mixed enforcement regime: administrative compulsion backed by the Supreme Court (s 6; s 7(1)), criminal penalties for non‑compliance or misuse (s 5(6); s 7(2); s 9(4)), and statutory immunities and exclusions that limit third‑party process and judicial attack (s 13(1a); s 12). Practitioners should note that judicial review options are removed for challenging Inquiry decisions, but the court retains an enforcement role for compulsion and a gatekeeper role under s 15 for protected notifier evidence. The Act also contemplates internal checks , the Commissioner must avoid prejudicing criminal investigations (s 5(1)(f)) while simultaneously having a duty to report alleged offences to police under s 10(2) unless exceptions apply.

Direct cross‑references and overridden obligations

• Evidence Act 1929: The Act defines "sexual offence" by reference to s 4 of the Evidence Act 1929 (s 3). That cross‑reference determines the substantive conduct that will fall within the Inquiry’s purview.

• Children's Protection Act 1993 and mandatory notification: Section 15 provides special protection for evidence that would disclose the identity of a person who has notified a government agency under an obligation arising from the Children's Protection Act 1993 (or corresponding previous enactments). Section 15(1) prevents adducing such evidence in court without the permission of the court, and s 15(2) sets the criteria by which the court may grant permission. Therefore, evidence derived from or exposing mandatory notifiers is subject to an evidentiary screen in other proceedings, aligning the Act with existing mandatory notification protections.

• Judges' Pensions Act 1971: If a Judge or former Judge is appointed as Commissioner the Act adjusts application of the Judges' Pensions Act 1971 so that the person is treated as in judicial service while holding office under this Act and not treated as retired or resigned for pension purposes until the term ends (s 4(4)). The Attorney‑General determines the day the term ends by Gazette notice (s 4(5)). This interacts administratively with judicial pensions and service records.

• Anangu Pitjantjatjara Yankunytjatjara Land Rights Act 1981: Schedule 2 defines "APY lands" as lands vested under that Act (Schedule 2 cl 1). The APY inquiry therefore operates in the statutory regime created for APY lands, and the selection of communities and focus must be consistent with the Schedule’s terms of reference (Schedule 2 cl 2).

• Child Protection Review (Powers and Immunities) Act 2002: Both Schedules state the Inquiry need not relate to matters that have been the subject of the Review under the Child Protection Review (Powers and Immunities) Act 2002, but it may do so if relevant (Schedule 1 cl 2(4); Schedule 2 cl 2(4)). The Act acknowledges potential overlap with that Review and leaves discretion for duplication.

Disclosure and confidentiality interactions

• Section 9(1) expressly states that any law requiring confidentiality or restricting disclosure/publication does not prevent provision of information for the purposes of the Inquiry. That displaces privacy or secrecy obligations that might otherwise bar agency staff or other custodians from supplying records or information. Practically, statutory or common law confidentiality obligations are subordinated for Inquiry purposes, but the Commissioner retains power to manage public disclosure under s 9(2) and s 10(1)-(2). This interplay requires custodians to respond to Inquiry demands even where other statutes might impose confidentiality restrictions.

Police and prosecutorial processes

• Section 10(2) requires that the Commissioner, under an arrangement with the Commissioner of Police, provide to police any information concerning the commission or alleged commission of a sexual offence against a child arising during the Inquiry unless certain exceptions apply. The Commissioner may instead provide information to the Director of Public Prosecutions (s 10(2)(b)). The provision creates a statutory conduit between the Inquiry and criminal justice institutions and sets narrow grounds for non‑referral (already reported and recently considered by police; determination to provide to the DPP instead; or a victim's request balanced by public interest).

Immunities and external process

• Section 13(1) grants authorised persons the same protection, privileges and immunities as a Judge of the Supreme Court, which interacts with judicial functions and protects inquiry actors from external legal process. Section 13(1a) bars subpoenas or other process requiring authorised persons or Inquiry‑prepared documents to be produced in external proceedings. That provision changes the discovery landscape by limiting third‑party access to Inquiry materials in other litigation and constrains conventional evidence gathering in court proceedings related to Inquiry matters.

Exclusion of judicial review

• Section 12 prevents proceedings for judicial review or for declaratory or injunctive relief to challenge or question Inquiry conduct, decisions or the Commissioner’s report. This statutory ouster interacts with the Administrative Decisions (Judicial Review) framework by removing the usual remedies for affected parties seeking to challenge the way the Inquiry has been conducted or its conclusions. Practitioners must therefore treat the Inquiry as largely insulated from attack by ordinary public law processes, although criminal and compulsion enforcement powers remain.

Admissibility and compelled testimony

• Section 14 forces answers even where self‑incriminatory but limits admissibility elsewhere. This interacts with the common law privilege against self‑incrimination and with rules of evidence in subsequent criminal and civil trials by erecting statutory non‑admissibility for compelled testimony, except in prosecutions under the Act. Counsel must be aware that compelled Inquiry testimony will not generally feed into criminal prosecutions, but may be relevant within the Inquiry and potentially for administrative or disciplinary purposes depending on other legal rules.

Temporal scope and existing inquiries/reviews

• Both Schedules confine the inquiries to historical conduct occurring before commencement of the Act/Schedule (Schedule 1 cl 2(3); Schedule 2 cl 2(3)) and allow but do not require the Inquiry to cover matters that have been the subject of the Child Protection Review under the Child Protection Review (Powers and Immunities) Act 2002 (Schedules clauses 2(4)). Schedule 1 also allows the Inquiry to relate to matters that have been the subject of the commission under s 4A (Schedule 1 cl 2(4a)), and Schedule 2 allows the Inquiry to relate to matters that have been the subject of the commission under s 4 (Schedule 2 cl 2(5)). These cross‑references manage the risk of duplication and create legislative space for coordination.

In short, the Act interacts with other laws by: importing criminal definitions from the Evidence Act, overriding statutory confidentiality to allow information flow into the Inquiry while maintaining publication controls, imposing reporting obligations on the Commissioner to police and prosecutors subject to narrow exceptions, creating immunities and process exclusions to limit third‑party access to Inquiry instruments, and ousting judicial review of Inquiry conduct and reports. Practitioners must map these interactions when advising clients on disclosure obligations, protections, potential exposure to prosecution, and limits on external challenges.

Overview from the Act’s legislative history

• The Act was originally enacted as the Commission of Inquiry (Children in State Care) Act 2004 (No 33 of 2004), assented to 5 August 2004 and commenced 18 November 2004 (Legislative history table). Several amendments followed: the Commission of Inquiry (Children in State Care) (Miscellaneous) Amendment Act 2004 (No 43 of 2004) commenced 18 November 2004; Statutes Amendment (New Rules of Civil Procedure) Act 2006 (No 17 of 2006) with certain provisions commencing 4 September 2006; Commission of Inquiry (Children in State Care) (Privileges and Immunities) Amendment Act 2006 (No 18 of 2006) commenced 6 July 2006; and Commission of Inquiry (Children in State Care) (Children on APY Lands) Amendment Act 2007 (No 21 of 2007) commenced 26 June 2007. Historical versions are recorded for 18 November 2004, 6 July 2006 and 4 September 2006.

Key amendments and their effects (with source citations)

• 2004 No 43 (Miscellaneous Amendment Act 2004): Amended s 10(2) (see "Provisions amended" list referencing s 10(2) amended by 43/2004 s 4(1), (2) , commenced 18.11.2004). That amendment likely adjusted the Commissioner’s reporting obligations to police, though the text of the earlier version is not reproduced here.

• 2006 No 18 (Privileges and Immunities Amendment Act 2006): Inserted s 13(1a) (see Provisions amended: s 13(1a) inserted by 18/2006 s 3, commenced 6.7.2006). Section 13(1a) now prevents courts, tribunals or authorities from issuing subpoenas or other process requiring authorised persons or Inquiry documents prepared for the Inquiry to be produced or persons to give evidence about matters coming to their notice in their official capacity. This amendment adds a protective shield around authorised persons and Inquiry documents.

• 2006 No 17 (Statutes Amendment (New Rules of Civil Procedure) Act 2006): Amended s 15(1) and s 15(2) and s 15(3) , see Provisions amended listing s 15(1) amended and s 15(2) and s 15(3) amended by 17/2006 s 62(1-4), effective 4.9.2006. These changes adjusted the court‑permission framework and procedural protections concerning evidence that would disclose the identity of mandatory notifiers.

• 2007 No 21 (Children on APY Lands Amendment Act 2007): This Act substantively expanded the original single Inquiry instrument into two related commissions by inserting s 4A and Schedule 2, substituting s 1 and other textual changes. The 2007 amendment:

  • Substituted s 1 (short title) and s 11(1) (see Provisions amended: s 1 substituted by 21/2007 s 4; s 11(1) substituted by 21/2007 s 7).
  • Inserted s 4A (constitution of commission,children on APY lands) (s 6 of 21/2007).
  • Inserted s 11A requiring Ministerial responses to the Commissioner’s report, including the staged responses and five years of annual updates (s 8 of 21/2007).
  • Inserted Schedule 2,the APY lands terms of reference (s 11 of 21/2007).
  • Inserted Schedule 1 cl 2(4a) to allow the State‑care Inquiry to relate to matters that have been the subject of the APY commission (s 10 of 21/2007).
  • Substituted or deleted other provisions including s 2 and s 11(2)-(3) as set out in the legislative history.

Miscellaneous drafting updates

• The legislative history table records various textual and heading substitutions across the Schedules and defined terms (for example, "authorised person", "Commissioner", and "Inquiry" amended by 21/2007 s 5(1-3)). Clause and heading substitutions in Schedule 1 were effected by the 2007 amendment (Sch 1 heading substituted by 21/2007 s 9; cl 1 amended by 43/2004 s 5).

Practical effect of the amendments

• The post‑2004 amendments incrementally broadened protective immunities for Inquiry actors (2006), refined judicial gatekeeping for protected notifier evidence (2006), and materially expanded the statutory mandate to include a parallel inquiry focused on APY lands with specific representational requirements for Assistant Commissioners (2007). The insertion of s 11A in 2007 created a statutory accountability loop requiring Ministerial public responses and multi‑year reporting on implementation of Inquiry recommendations, changing the Act from a one‑off investigatory instrument to a mechanism that triggers ongoing administrative obligations.

Record of commencement and historical versions

• The legislative history provides the dates of assent and commencement for principal and amending Acts and lists historical consolidated versions (18.11.2004, 6.7.2006, 4.9.2006). The table of "Provisions amended" at the end of the Act specifies which sections were substituted, inserted or amended and the amending instrument and date.

Limitations of the legislative history in the source text

• The legislative history summarises amendments but does not reproduce the precise earlier text in every case; to compare versions a practitioner should consult the historical versions cited (the Act notes the availability of historical versions at particular dates).

Material in the source

• The Act’s text and the legislative history included with the source do not identify any judicial decisions, private litigation, or reported cases that interpret or apply the Act. The document records statutory amendments and commencement dates but contains no list of cases or litigation outcomes.

Implications for research and practice

• Since the Act contains express bars on judicial review and restraints on other proceedings aimed at challenging Inquiry proceedings, decisions or reports (s 12), there are statutory limits on common law‑style challenges. However, the Act does not necessarily make all litigation impossible , courts retain a role in compulsion (s 7(1)) and in granting permission under s 15 for evidence that would identify mandatory notifiers. The insertion of s 13(1a) also alters the potential for external proceedings to compel authorised persons or Inquiry documents. In the absence of reported case law provided in the source, practitioners must consider:
  • Whether litigation exists in unreviewed sources (not included in the Act text) that addresses limits in s 12, practical operation of s 13(1a), or the interplay between compulsion and self‑incrimination protections in s 14.
  • That any challenge to Inquiry conduct and reports is statutorily constrained, and therefore novel constitutional or jurisdictional challenges would likely be the subject of unreported litigation if they exist.

Recommended next steps for locating litigation

• To identify judicial interpretation or litigation that has engaged with the Act, search South Australian superior court reports, unreported judgments, law‑report databases and legal journals for cases referencing the Commission of Inquiry (Children in State Care and Children on APY Lands) Act 2004, or for decisions concerning the operation of s 7, s 12, s 13(1a), s 14 or s 15. The Act’s legislative history indicates no cases in the text; a full litigation history therefore requires external legal database searches.

Statutory ouster of judicial review (s 12)

• Section 12 bars proceedings for judicial review or for declaratory or injunctive relief aimed at challenging or questioning Inquiry proceedings, decisions or the Commissioner’s report. Practitioners should not assume ordinary public law remedies are available to clients seeking to restrain or overturn Inquiry decisions. The practical consequence is that procedural or substantive gripes about the Commissioner’s conduct may not be amenable to judicial correction via standard reliefs. However, the Supreme Court retains compulsion and enforcement powers (s 7(1)), and criminal liability under the Act and other laws remains available.

Broad compulsion with limited admissibility (s 6, s 7, s 14)

• The Commissioner can compel answers and production of documents (s 6), and the Supreme Court may enforce summonses (s 7(1)). Yet compelled self‑incriminating answers are statutorily inadmissible in subsequent criminal or civil proceedings (s 14), except for prosecutions under the Act. This means compelled testimony cannot generally be used by prosecutors in criminal trials , a nuance that creates friction between the Inquiry’s investigatory aims and prosecutorial evidence strategies, and may affect victims’ or witnesses’ decisions to cooperate.

Mandatory reporting conduit to police with narrow exceptions (s 10(2))

• The Commissioner must provide to the Commissioner of Police any information arising concerning alleged sexual offences against a child unless one of three narrow exceptions applies (s 10(2)(a)-(c)). These exceptions are (a) reasonable grounds that police already considered it recently, (b) the Commissioner has determined to provide it to the DPP, or (c) the victim requested non‑disclosure but the Commissioner considers disclosure in the public interest. Practitioners advising victims who wish confidentiality must note that the Commissioner can override a victim’s request if the public interest demands disclosure (s 10(2)(c)). The Act does not define "public interest" here; that leaves substantial discretionary space with attendant legal and reputational risks.

Publication bans and criminal exposure (s 9(2)-(4))

• The Commissioner may forbid publication of specified evidence or the name of witnesses (s 9(2)). Breach of such an order is a criminal offence with potential imprisonment (s 9(4)). Media, researchers and practitioners must therefore be attentive to non‑publication orders because the Act criminalises breaches.

Limits on third‑party access to Inquiry documents (s 13(1a))

• Section 13(1a) forbids courts, tribunals or other authorities from issuing subpoenas or other processes requiring authorised persons, persons appointed under s 8, or Inquiry documents to be produced or witnesses to give evidence about matters in their official capacity. This limits the usual discovery avenues in parallel litigation and may hinder parties trying to obtain Inquiry documents for use in other proceedings.

Protection for mandatory notifiers (s 15)

• Evidence that would identify a notifier under the Children’s Protection Act 1993 cannot be adduced without court permission and the court will grant permission only in strict circumstances (s 15(1)-(2)). Lawyers must plan applications for such evidence carefully; these applications must be conducted in private and protective arrangements must be in place pending determination (s 15(3)). Counsel should anticipate heightened procedural sensitivity and secrecy surrounding applications under s 15.

Temporal limitation and scope (Schedules)

• Both Schedules limit the Inquiry to conduct occurring before the commencement of the Act or Schedule (Schedule 1 cl 2(3); Schedule 2 cl 2(3)). Practitioners must ensure claims or complaints that post‑commencement fall outside the Inquiry’s terms. Also the Commissioner is prohibited from making findings of criminal or civil liability (Schedule 1 cl 2(5); Schedule 2 cl 2(6)), so parties should not expect the Inquiry to deliver legally enforceable findings against individuals.

Conflict between duties to avoid prejudicing criminal investigations and mandatory police reporting (s 5(1)(f); s 10(2))

• The Commissioner is obliged to take reasonable steps to avoid prejudicing criminal investigations (s 5(1)(f)) but also has a duty to report alleged sexual offences to police (s 10(2)) unless exceptions apply. This creates a tension: the Commissioner must balance disclosure to law enforcement against the risk of interfering with criminal evidence and ongoing investigations. That tension introduces discretionary judgment and potential operational risk.

Compelled cooperation but no judicial review of process

• Witnesses can be criminally sanctioned for non‑compliance with summonses (s 7(2)), but parties cannot use judicial review or other equitable remedies to challenge Inquiry process or decisions (s 12). That combination can feel one‑sided to those summoned: compulsion is strictly enforceable, yet avenues to contest the Inquiry’s procedural fairness are constrained.

Ministerial accountability obligations (s 11A) create ongoing reporting obligations

• The Minister must make a preliminary response within three months, a full response within six months, and then annual responses for five years (s 11A). This imposes ongoing administrative effort and budgetary planning for implementation of recommendations. Failure to comply with these timeframes would itself be a public administration failure, although the Act does not specify penalties for the Minister’s non‑compliance.

Privilege and immunity parallels with judicial office (s 13)

• Authorised persons receive the same protections, privileges and immunities as a Judge of the Supreme Court (s 13(1)). This is a strong protection, and counsel should be alert to its implications when attempting to engage authorised persons or Inquiry materials in related litigation.

Checklist for agencies, custodians of records and legal representatives

1. Identification and preservation of records

   • Immediately identify and preserve all records that could be evidentiary material for the Inquiry (s 3 definition; s 6 permitting summons for production). Because s 9(1) displaces other statutory confidentiality obligations where information is provided for Inquiry purposes, do not assume confidentiality laws excuse non‑production. Preserve chain of custody and metadata where possible to ensure evidentiary integrity.

2. Responding to summonses and production requests

   • Treat any summons under s 6 as a statutory compulsion. If a person refuses, the Supreme Court may be asked to compel attendance or production (s 7(1)); refusal without reasonable excuse exposes a penalty up to $10,000 (s 7(2)). Seek timely legal advice when a summons is received, particularly if production raises third‑party privacy or privilege issues.

3. Managing confidentiality and publication risks

   • Monitor for Commissioner orders under s 9(2) that forbid publication or naming of witnesses. Breach of such orders attracts up to $2,000 or six months imprisonment (s 9(4)). Organisations should establish procedures to prevent unauthorised disclosure (media handles, social media policies, staff training) and designate a single legal contact to coordinate compliance.

4. Advice to witnesses and potential witnesses

   • Inform prospective witnesses they may be compelled to answer under s 6 and s 7 and that compelled answers are generally not admissible in criminal or civil proceedings (s 14), except for prosecutions under this Act. Where witness safety or trauma is a concern, request that evidence be received in private (the Commissioner must comply with such requests, s 5(4)) and explore support arrangements under s 8(3).

5. Handling of disclosures and referrals to police

   • Understand that the Commissioner is required to provide information concerning alleged sexual offences to the Commissioner of Police unless exceptions apply (s 10(2)). If an agency learns of information that might surface in the Inquiry, consider whether it has already been reported and recently investigated, or whether referral to police is appropriate to discharge duties. Where an individual requests non‑referral, note that the Commissioner may still provide information in the public interest (s 10(2)(c)).

6. Dealing with mandatory notifier protections

   • If evidence would identify a mandatory notifier under the Children’s Protection Act 1993, do not assume the information can be freely adduced in other proceedings. Court permission is required under s 15(1)-(3). If you need to apply for permission, prepare the application to demonstrate critical importance and necessity for justice, and arrange for the application to be heard privately with protective directions.

7. Coordination with the Commissioner and Ministerial staff

   • Agencies should be ready to enter arrangements with the Commissioner to provide staff, equipment or facilities (s 8(4)). Where the Minister is to appoint staff following consultation (s 8(1)-(3)), maintain channels to coordinate logistics. Expect Ministerial follow‑up obligations under s 11A and plan for potential policy or program changes if recommendations are adopted.

8. Legal strategies where immunity or privilege issues arise

   • Note the breadth of s 13(1) and s 13(1a): authorised persons have judicial‑style immunities and certain external processes are barred. When your client seeks access to Inquiry materials for litigation, anticipate statutory limits and explore alternative evidence routes or negotiated disclosure with the Commissioner if possible.

9. Ensure trauma‑informed and culturally appropriate engagement for APY matters

   • For matters concerning APY lands, the statutory requirement that at least one Assistant Commissioner be of Aboriginal descent (s 4A(3)) signals the need for culturally appropriate processes. Locally tailored support services, interpreters, community consultation and appropriate privacy measures should be mobilised in accordance with Schedule 2 terms of reference and s 5 procedural flexibility.

10. Compliance training and records management

• Implement targeted training for staff on obligations under this Act: responding to summonses, non‑publication orders, preservation and transfer of evidentiary material, and the distinct protections for mandatory notifiers. Update records retention and search protocols to enable rapid response to production requests.

Practical steps for lawyers representing witnesses or alleged subjects

• Advise clients on compelled answer rules (s 14) and explain the limited admissibility of compelled evidence in criminal/civil trials. Consider whether legal privilege or other grounds protect documents or communications, and where privilege is claimed, prepare to assert it formally while recognising s 9(1) permits production for Inquiry purposes.

• Where confidentiality is a concern, seek witness privacy requests under s 5(4) and anticipate non‑publication orders from the Commissioner (s 9(2)). Counsel should also advise clients about the risk of criminal sanctions for breach of non‑publication orders (s 9(4)).

• Prepare for s 15 applications if the disclosure would identify a mandatory notifier. Counsel should assemble a tight evidentiary argument to meet the "critical importance" or consent standard and be ready to request protective hearing procedures.

For Ministers and policy officers

• Establish a project plan and budget to meet the Minister’s obligations under s 11A: prepare to provide a preliminary response within three months, a full response within six months and annual progress reports for five years. Allocate resources to implement recommendations and to track outcomes for annual reporting.

For police and prosecutors

• Expect statutory receipt of Inquiry‑sourced information under s 10(2). Make arrangements with the Commissioner as contemplated by s 10 to ensure efficient transfer, avoid duplication, and clarify protocols for assessing whether an alleged offence has been "recently considered" by police as contemplated by s 10(2)(a). Where the Commissioner elects to provide material to the DPP (s 10(2)(b)), coordinate investigative follow‑up to preserve evidence and avoid prejudicing future prosecutions.

For media and researchers

• Monitor non‑publication orders under s 9(2) carefully and put compliance mechanisms in place. Recognise that subpoenas to compel authorised persons or Inquiry documents are barred under s 13(1a) and plan research approaches accordingly. If relying on public reports, verify whether the Commissioner has authorised publication or redaction.

In all cases, document decisions and obtain written directions or agreements where possible. The Act creates overlapping duties and discretionary choices , logged rationale and contemporaneous records of decision‑making will assist compliance and future accountability given the Minister’s statutory reporting obligations.
