COMMERCIAL PASSENGER (ROAD) TRANSPORT (TOURIST VEHICLES) REGULATIONS 1992

The Regulations rest on a small number of core concepts and statutory terms that structure duties and compliance responsibilities.

• Operator and driver roles. The Definitions at r 3 set the central actor categories. “Operator” is expressly limited to a person who operates a tourist vehicle otherwise than only as a driver, which separates someone who merely drives from the person responsible for commercial operation, record keeping and compliance obligations (r 3). “Driver” is defined as the person driving or in charge of a tourist vehicle (r 3). The regulatory obligations flow from these role definitions: Part 2 addresses operator duties, Part 3 addresses driver duties.

• Record keeping. Regulation 4 imposes a detailed record duty on operators. An operator must record: each tourist vehicle they operate; the name and residential address of each driver they engage or employ and the number of that person’s licence issued under the Motor Vehicles Act 1949 (r 4(1)(a)-(b)); a general description and date(s) of each journey and the driver’s name and address for the journey (r 4(1)(c)); and “any other matter that the Director requires as a condition of the operator’s licence” (r 4(1)(d)). The operator must keep the record at the principal place of business in a safe place and produce it to an inspector on request (r 4(2)(a)-(b)). The regulation attaches a maximum penalty of 60 penalty units for contraventions of r 4(1) and r 4(2).

• Relief vehicle and journey completion. Regulation 5 creates a two‑stage duty. First, if a tourist vehicle cannot proceed due to mechanical or other failure and the driver is unable to complete the journey under any agreement with passengers, the driver must notify the operator (r 5(1)). Second, on receiving that notification the operator must either make another vehicle available for completion under the terms of the arrangements with passengers, or make other arrangements by agreement with passengers who wish to complete the journey (r 5(2)(a)-(b)). The operator may not use a replacement vehicle for more than four days without the Director’s approval (r 5(3)).

• Driver conduct obligations. Part 3 includes three core duties. Regulation 7 requires the driver to convey passengers in accordance with the operator’s instructions. Regulation 8 requires the driver to ensure the number of passengers does not exceed the maximum permitted on the tourist vehicle and that no passenger is carried in parts of the vehicle not designed for passenger seating. Regulation 10 prohibits use of the tourist vehicle for an illegal purpose or permitting its use for an illegal purpose. These duties are stated without separate penalty amounts in those regulations; r 14 sets a general penalty where a specific regulation does not specify a greater penalty.

• Fees. The Schedule (referred to in r 12) sets prescribed fees: $550 for a tourist vehicle licence or renewal and $50 for each endorsement on a licence in a calendar year. The Fees and Charges (Transport) Amendment Regulations 2012 and later instruments amended the Schedule (see endnotes).

• Enforcement architecture. The Regulations specify production to an “inspector” (r 4(2)(b)) and reference the “Director” both in permit/condition contexts and in approving extended use of relief vehicles (r 4(1)(d); r 5(3)). The Regulations rely on the parent Act for the definitions, powers and processes attaching to those roles.

These concepts structure compliance duties: operators keep and produce records, ensure contingency arrangements for journey completion, and follow Director conditions; drivers follow operator instructions and vehicle seating/capacity rules; fees are payable as specified; and general offence exposure applies across the Regulations with specified maximum penalties. The instrument is short and tightly focused on operational obligations rather than broad regulatory standards.

The text identifies two principal categories of persons: operators and drivers (r 3). By definition, an operator is a person who operates a tourist vehicle otherwise than only as a driver. Practical groups affected therefore include:

• Commercial tourist vehicle operators (legal persons, sole traders, companies or other entities) that engage drivers or operate tourist vehicles. Those persons bear the record‑keeping obligations in r 4, the relief vehicle and journey‑completion obligations in r 5, the duty to comply with any conditions specified by the Director (r 4(1)(d)), the duty to keep records at the principal place of business (r 4(2)(a)), and exposure to the specified 60 penalty unit maximums for failures under r 4.

• Drivers, defined as the person driving or in charge of a tourist vehicle (r 3), who must notify their operator if a vehicle cannot proceed due to mechanical or other failure (r 5(1)); must carry passengers according to operator instructions (r 7); ensure passenger numbers do not exceed the vehicle’s maximum and that passengers occupy parts of the vehicle designed for seating (r 8); and must not use the vehicle for an illegal purpose (r 10).

• Passengers are affected indirectly: regulation 5 requires operators to make arrangements to complete journeys or to obtain passenger agreement to other arrangements (r 5(2)(b)). The text positions passengers as contracting parties whose agreement matters when the operator arranges alternatives.

• Inspectors and the Director. While not “persons affected” in the same compliance sense, the Regulations create legal interactions with officials: an inspector may require production of operator records (r 4(2)(b)); the Director may impose conditions as part of an operator’s licence (r 4(1)(d)) and must approve use of a relief vehicle beyond four days (r 5(3)). The mode and scope of their decision‑making are not set out in detail in these Regulations but are referenced.

• Licensing and administrative bodies. The Schedule prescribes fees payable for tourist vehicle licences and endorsements (r 12 and Schedule). Entities responsible for licensing will collect fees and enforce conditions; the Regulations thereby affect fee collection and administrative processes.

The Regulations also refer to licence numbers issued under the Motor Vehicles Act 1949 (r 4(1)(b)), which implicates holders of motor vehicle licences and the agencies that issue those licences. The text does not directly address owners who operate as drivers only, but the definition of operator excludes someone who operates only as a driver, which may exclude an owner who both owns and drives but does not “operate otherwise than only as a driver”; practitioners will need to determine whether particular business models fall within the operator definition in r 3.

Finally, the endnotes list a sequence of amendments and subordinate instruments (see endnotes 2-4). Those amendments affect fee amounts and formal drafting, so businesses and compliance officers must track those changes against their licensing and operational obligations.

The Regulations articulate several specific duties and a small number of procedural rights tied to administrative roles.

Key duties

• Record creation and retention (r 4(1)-(2)). Operators must create and maintain a record containing the identity of each tourist vehicle they operate (r 4(1)(a)), the name, residential address and Motor Vehicles Act licence number of each driver they engage or employ (r 4(1)(b)), a general description and dates of each journey with the name and address of the driver for each journey (r 4(1)(c)), and any additional matters the Director requires as a licence condition (r 4(1)(d)). Operators must keep those records in a safe place at their principal place of business and produce them to an inspector on request (r 4(2)(a)-(b)).

• Notification and journey completion obligations (r 5). Drivers must notify the operator if a tourist vehicle cannot proceed due to mechanical or other failure and the driver cannot complete the journey (r 5(1)). On notification, the operator must either make another vehicle available to complete the journey under the terms of the arrangement with passengers, or make other arrangements for completing the journey by agreement with passengers who wish to complete it (r 5(2)(a)-(b)). Operators may not use a replacement vehicle for more than four days without the Director’s approval (r 5(3)).

• Obedience to operator instructions (r 7). Drivers must convey passengers in accordance with the instructions of the operator of the tourist vehicle. This grants the operator scope to direct routeing, carriage terms and conduct within the vehicle subject to the operator’s instructions.

• Passenger safety and capacity (r 8). Drivers must ensure the number of passengers does not exceed the maximum permitted to be carried and that no passenger is carried in a part of the vehicle not designed for passenger seating.

• Prohibition on illegal use (r 10). Drivers must not use the tourist vehicle for an illegal purpose, nor cause or permit it to be used for an illegal purpose.

• Payment of fees (r 12 and Schedule). Fees set out in the Schedule are payable in relation to the matters specified in the Schedule: $550 for a tourist vehicle licence or renewal; $50 for each endorsement on a licence in a calendar year (Schedule, reg 12).

Rights and procedural authorities

• Production and inspection (r 4(2)(b)). Operators must produce records when required by an inspector; the inspector’s power to require production is the procedural mechanism by which compliance is verified.

• Director’s conditional authority (r 4(1)(d) and r 5(3)). The Director may impose conditions on an operator’s licence by requiring “any other matter” to be recorded (r 4(1)(d)). The Director is also the decision‑maker who can approve use of a relief vehicle beyond four days (r 5(3)). These references confer decision‑making discretion to the Director, although the Regulations do not set out particulars of decision processes, timeframes or review rights; such mechanisms are likely found in the parent Act.

• Fee obligations are straightforward entitlements of the licensing authority; payment buys statutory licensing or endorsement rights as prescribed.

Enforcement and penalty provisions

• Specific penalty amounts apply where given. Regulation 4 includes maximum penalties of 60 penalty units for contraventions of the record obligations (r 4(1) and r 4(2)). Elsewhere, regulation 14 establishes that a person who contravenes or fails to comply with a provision of the Regulations commits an offence and is liable to a maximum penalty of 25 penalty units (r 14). Practitioners must therefore note the specific higher penalty in r 4 and the general penalty in r 14.

Interdependencies and operational implications

• Licencing conditions imposed by the Director may expand record content beyond the items listed in r 4(1)(a)-(c) (r 4(1)(d)). This creates a duty for operators to monitor licence conditions and maintain records accordingly.

• Driver obligations to follow operator instructions (r 7) interact with the operator’s obligation to arrange journey completion after a failure (r 5). The operator’s instructions may guide how drivers handle contingencies; operators must ensure drivers are aware of and follow arrangements required by r 5.

All duties are stated in mandatory language; the Regulations attach criminal or quasi‑criminal sanctions for non‑compliance (see Penalties and enforcement). Rights of appeal, review or internal administrative processes are not set out here and are likely controlled by the parent Act or administrative procedures.

The Regulations specify two categories of penalty exposure and indicate the administrative enforcement interfaces, but do not themselves set out procedural enforcement steps beyond production to an inspector and Director approvals.

Penalty quantum

• Regulation 4 sets maximum penalties of 60 penalty units for the offences created by r 4(1) and r 4(2) (r 4(1) ends with “Maximum penalty: 60 penalty units.” and r 4(2) likewise). Those provisions make record creation, safe storage at the principal place of business, and production to an inspector mandatory with the higher specified maximum.

• Regulation 14 establishes a general offence for contravention or failure to comply with a provision of the Regulations with a maximum penalty of 25 penalty units (r 14). The text places that provision in Part 4. Where a particular regulation specifies a maximum penalty (such as r 4), that specified maximum applies for that regulation. For other regulations that do not specify a higher maximum, the general r 14 cap will govern criminal liability under the Regulations.

Enforcement interfaces

• Inspector production powers. Regulation 4(2)(b) requires the operator to produce the records whenever required by an inspector. The requirement to produce documents to an inspector creates a primary point of contact for enforcement. The Regulations rely on the concept of an “inspector” without detailing appointment, powers beyond production, or procedural limits; those matters are likely contained in the parent Act.

• Director decision and approval roles. The Director can require additional matters to be included as a condition of an operator’s licence (r 4(1)(d)). The Director also must approve the use of a replacement vehicle for more than four days (r 5(3)). Those roles suggest that administrative enforcement involves licence conditions and approvals, which operate alongside criminal liability.

Scope of criminalisation and likely enforcement practice

• Routine compliance items (records, seating, capacity). The offences focus on administrative and safety‑related conduct, such as record keeping and ensuring passengers are properly seated and not exceeding capacity (r 4 and r 8). The relatively modest general penalty (25 penalty units) and the higher penalty for record failures (60 units) indicate priority on accurate operational records; the text suggests enforcement emphasis may be on documentation and the Director’s licence conditions.

• No civil sanctioning regime in the Regulations. The text does not create civil penalties, infringement notices, or administrative fines within these Regulations themselves; only offence maxima are stated. The enforcement toolkit therefore appears to be criminal prosecution under the Regulations and administrative licence conditions exercised by the Director. Other enforcement mechanisms could arise under the parent Act, but those are not contained in this statutory text.

Practical evidentiary consequences

• Record requirements and production obligations create a documentary trail that enforcement authorities can use to prove offences. Failure to keep or produce records is separately penalised at a higher level (r 4). Operators should therefore anticipate that regulatory investigations will request the r 4 records and that failing to produce them is a distinct offence with a higher maximum penalty.

• Driver obligations may be enforced against individual drivers (r 7-8, r 10) under the general r 14 penalty where no higher penalty is specified. The Regulations do not specify whether prosecutions will be brought against companies, individual operators or drivers; the text imposes duties that can be tied to natural persons and corporate operators depending on role definitions.

Limitations and ambiguity in enforcement detail

• The Regulations do not specify enforcement procedures (infringement notices, internal review, timeframes, evidence thresholds), nor do they set out how an inspector’s request must be made, or whether refusal or obstruction attracts separate sanctions beyond the offence provisions. The Director’s decision‑making criteria and review rights are also absent from the Regulations. Those procedural matters will be found in the parent Act or administrative law generally.

• The endnotes show that penalties and formal drafting have been amended at various times (see endnotes 2-4). Tracking those amendments is necessary to confirm current penalty levels and procedural arrangements.

In short, enforcement is a mixture of documentary compliance checks by inspectors and licence condition decisions by the Director, combined with criminal penalty exposure for breaches. Practitioners should draft compliance processes that prioritise the r 4 records and ensure drivers comply with r 7-8 and r 10, and should consult the parent Act for the enforcement process and powers of inspectors and the Director.

The Regulations explicitly cross‑refer to and depend upon several other statutory instruments and administrative structures. The interaction is primarily referential rather than substitutive.

Parent Act and administrative roles

• The Regulations are made under the Commercial Passenger (Road) Transport Act 1991 (see title and opening lines). They therefore operate as subsidiary legislation pursuant to that Act. The Regulations reference the Director and inspectors (r 4(1)(d), r 4(2)(b), r 5(3)), roles and appointment powers that will be defined and elaborated in the parent Act. Any procedural rules, powers to appoint inspectors, criteria for Director decisions, and review or appeal rights are likely to be found in that Act rather than in these Regulations.

Motor Vehicles Act 1949

• Regulation 4(1)(b) requires operators to record “the number of the driver’s licence issued in relation to that person under the Motor Vehicles Act 1949.” That cross‑reference imports a requirement to record a licence number as issued under the Motor Vehicles Act. The Motor Vehicles Act will therefore be a source for licence types, issuance, and potentially disqualification provisions that affect operational compliance, but the Regulations themselves rely on the Motor Vehicles Act only for the identification of licence numbers.

Fee and charging instruments

• The Schedule of fees and r 12 are internally self‑contained, but the endnotes record that the Schedule was amended by the Fees and Charges (Transport) Amendment Regulations 2012 (SL No. 45, 2012) and by other instruments (see endnotes 2 and 4). Practically, fee levels and charging mechanisms may be adjusted by separate subordinate legislation and statutory instruments in the transport portfolio. Operators must therefore consult the current Schedule and the relevant instruments that amend fees.

Amendments and transitional interactions

• The endnotes list amendment instruments and Acts over a period spanning 1998 to 2025, including the Transport Legislation Amendment Act 2025 (Act No. 23, 2025). Those instruments amended provisions (for example r 1, r 4, r 8). The Regulations as reprinted incorporate formal amendments of a drafting nature effected by the Interpretation Legislation Amendment Act 2018 (Act No. 22 of 2018) to rr 1, 2 and 4 (endnote 3). When applying the Regulations, practitioners must read them together with the amending instruments and any transitional or saving provisions in the amending Acts.

Criminal law and public order

• Regulation 10’s prohibition on using a tourist vehicle for an illegal purpose interacts with general criminal law: activities that are unlawful under general criminal statutes are rendered specifically unusable as purposes for the vehicle under r 10. The Regulations do not define “illegal purpose”; that term takes its meaning from the rest of the criminal code and statutory law. Enforcement of r 10 therefore overlaps with policing and criminal prosecution under general law.

Contract and consumer law

• Regulation 5 requires operators to make another vehicle available under “the terms of the arrangements with the passengers” or to make other arrangements by agreement with passengers (r 5(2)). That language brings contractual obligations and consumer expectations into the regulatory requirement. Operators will need to align commercial terms, booking contracts and refund/compensation practices with the duties in r 5 and with consumer protection obligations under general consumer law, though the Regulations themselves do not create consumer remedies.

Administrative law and natural justice

• References to Director approvals and inspector powers implicate administrative law principles, including procedural fairness, records of decisions and appeals or merits review where provided in other legislation. The Regulations do not set out appeal rights or review processes; those are to be found in the parent Act or other administrative review statutes.

In summary, the Regulations operate in a networked legal environment: they draw on the parent Commercial Passenger (Road) Transport Act for institutional detail; rely on the Motor Vehicles Act for licence identification; interact with fee instruments amended by subordinate legislation; overlap with criminal law for illegal purposes; and touch on contract and consumer law for journey completion obligations. Practitioners must read these Regulations alongside the parent Act and the other cross‑referenced instruments.

The endnotes attached to this reprint record the regulatory and legislative amendments to the Regulations from their original notification onward. The Regulations were originally notified as Tourist Vehicles Regulations (SL No. 55, 1992) on 21 October 1992 and commenced the same day (endnotes 2 and the table of provisions). The reprint includes subsequent amendment entries and formal reprinting notes.

Key amendment events recorded in the endnotes

• Amendment of Tourist Vehicles Regulations (SL No. 61, 1998): Notified 23 December 1998; commenced 1 January 1999 (see endnotes). This instrument amended r 4 (r 4 amd No. 61, 1998, r 2). The endnotes do not provide the textual changes in full; they record the instrument and commencement dates.

• Statute Law Revision Act 2003 (Act No. 12, 2003): Assent date 18 March 2003; commenced 18 March 2003. This Act amended r 8 (r 8 amd Act No. 12, 2003, s 19) and performed formal statute law revision operations.

• Fees and Charges (Transport) Amendment Regulations 2012 (SL No. 45, 2012): Notified 14 December 2012; commenced 1 January 2013. The Schedule was substituted by this instrument (sch sub No. 45, 2012, r 18), indicating a change to the fee amounts or their structure at that time.

• Penalties Amendment (Miscellaneous) Act 2013 (Act No. 23, 2013): Assent date 12 July 2013; commenced 28 August 2013 (Gaz G35, 28 August 2013, p 2). This amending Act revised r 14 (r 14 amd Act No. 23, 2013, s 4).

• Commercial Passenger Vehicle Legislation Amendment Regulations 2017 (SL No. 34, 2017): Notified 29 November 2017; commenced 1 December 2017 (r 2). This instrument amended r 4 (r 4 amd No. 34, 2017, r 84) and repealed several regulations (r 6 rep No. 34, 2017, r 85; r 9 rep No. 34, 2017, r 85; r 11 rep No. 34, 2017, r 85; r 13 rep No. 34, 2017, r 85). The reprint notes indicate those repeals removed provisions that previously existed but are no longer in force.

• Transport Legislation Amendment Act 2025 (Act No. 23, 2025): Assent date 12 September 2025. The Act commenced parts 2, 4, 5 and 6 on 21 January 2026 and remaining parts on 18 November 2025 (Gaz S5, 19 January 2026; Gaz S69, 17 November 2025). The reprint records r 1 as amended by Act No. 23, 2025, s 66 (r 1 amd Act No. 23, 2025, s 66).

Formal drafting amendments

• The Interpretation Legislation Amendment Act 2018 (Act No. 22 of 2018) made general amendments of a formal nature to rr 1, 2 and 4 (endnote 3). These were described as formal, indicating drafting updates rather than substantive policy change.

Reprint table of amendments

• The reprint provides a list of amendments at endnote 4 indicating which specific regulations were amended, repealed or substituted and the instruments responsible. For example, r 4 was amended multiple times (No. 61, 1998; No. 34, 2017) and r 8 amended by the Statute Law Revision Act 2003.

Implications for practitioners

• The Schedule of fees has been amended through subordinate instruments (for example 2012 Regulations); fee amounts in the Schedule of the reprint reflect those changes as at the reprint date (Schedule: $550 licence, $50 endorsement). Practitioners should check for any later subordinate instruments or variation of fees following the dates in the endnotes.

• Several regulations were repealed by the 2017 Amendment Regulations. The current text of the reprint omits those repealed regulations; any historical obligations in repealed regs are no longer live but may be relevant for historical compliance enquiries or transitional issues.

• The 2025 Transport Legislation Amendment Act made further changes; the reprint notes which parts commenced on 21 January 2026. Users should check the Act and its schedules for the precise textual amendments enacted by Act No. 23, 2025.

The endnotes provide the authoritative legislative history recorded within the reprint. For specific prior drafting or the text of repealed provisions, practitioners must consult the relevant amending instruments and past versions, which the endnotes identify by instrument number and commencement date.

The text of the Regulations and the accompanying endnotes supplied in this reprint do not record any court decisions or litigation history that interpret these Regulations. There are no cases named, no reported judicial decisions transcribed in the reprint, and no administrative tribunal determinations cited. The endnotes focus on amendment instruments and statutory revision rather than adjudicative outcomes.

Consequences of absence of litigation in the reprint

• Lack of reported judicial interpretation. Because the reprint does not include case citations, there is no authoritative judicial interpretation of the Regulations contained within this material. Practitioners will therefore rely on the plain text of the Regulations, the parent Act and any administrative guidance or policy issued by the Director or licensing authority for interpretive guidance, unless and until courts or tribunals have considered particular provisions.

• Greater role for administrative practices. The treatment of topics such as what constitutes adequate records, the scope of Director discretion when imposing licence conditions under r 4(1)(d), or when the Director should approve a relief vehicle’s continued use beyond four days (r 5(3)) will often turn on administrative processes and agency practice in the absence of judicial pronouncements. Compliance officers should therefore engage with the licensing authority to clarify expectations.

• Enforcement practice may determine practical outcomes. The Regulations create offences and inspection production obligations; how inspectors exercise their powers, what evidence they seek, and the frequency of prosecutions or administrative action is not discernible from the Regulations themselves. That practical enforcement history will be found in departmental reports, prosecution records or tribunal decisions rather than in the reprint.

Where to look next

• Parent Act and administrative decisions. For interpretive questions and to discover any litigation that may exist, consult the parent Commercial Passenger (Road) Transport Act 1991 for procedural details, and search court and tribunal records for cases that involve the Regulations or their operation.

• Departmental guidance. Licensing authorities commonly publish compliance guidance, approved forms, or policy statements to aid operators and drivers in meeting statutory obligations. The reprint does not include such guidance; operators should obtain official materials from the licensing agency.

• Historical versions. If an issue turns on the text of a provision as it stood at a particular time, consult the amending instruments listed in the endnotes (for example the 2017 amending regulations or the 2012 Fees and Charges amendments) for historical wording and transitional provisions.

In summary, the reprint contains no litigation history; the absence emphasises that interpretive and enforcement issues will be primarily determined by administrative practice and by subsequent jurisprudence not included in this text.

The Regulations are compact, but practitioners and compliance officers should be attentive to a number of concrete implementation traps and operational ambiguities that arise directly from the text.

1. Dual penalty provisions and apparent inconsistency. Regulation 4 prescribes maximum penalties of 60 penalty units for failures to create records and produce them to an inspector (r 4(1) and (2)). Regulation 14 sets a general maximum penalty of 25 penalty units for contravention of a provision of the Regulations (r 14). Operators must therefore identify that r 4 breaches attract the higher 60‑unit exposure while other breaches may be subject to r 14’s 25 units. The Regulations do not provide a reconciliation clause, so practitioners must treat the higher specific maximums as applying where they appear.

2. Definition of “operator” and business form complexity. The definition of operator as a person who operates a tourist vehicle “otherwise than only as a driver” (r 3) creates questions for owner‑drivers and small businesses. If a person both owns and drives but also engages other drivers or organises journeys, whether they are an “operator” for r 4 purposes will depend on whether they “operate otherwise than only as a driver.” The text does not provide a bright‑line test for this phrase. That uncertainty affects who must keep the r 4 records and where the principal place of business is for storage of records under r 4(2)(a).

3. “Principal place of business” and safe‑place obligations. Regulation 4(2)(a) requires records to be kept in a safe place at the principal place of business. The Regulations do not define “principal place of business.” For mobile or informal tourist services, determining which location must hold the records and what constitutes a “safe place” is operationally important and not specified in the Regulations.

4. Director’s condition power is open‑ended. Regulation 4(1)(d) requires an operator to record “any other matter that the Director requires as a condition of the operator’s licence.” That gives the Director a potentially wide and variable information requirement beyond the enumerated items. Operators should be proactive in monitoring the conditions on their licence and in seeking written clarification of what the Director requires to avoid inadvertent non‑compliance with a conditionally imposed record duty.

5. Relief vehicle timing limit and approval process. Regulation 5(3) prohibits use of a replacement vehicle for more than four days without Director approval. The Regulations do not state how the approval is to be sought, timeframes for decisions, or the grounds the Director will consider. Operators relying on temporary replacement vehicles face operational risk if approval processes are slow.

6. Driver obedience to operator instructions versus safety and legal duties. Regulation 7 requires drivers to carry passengers in accordance with the operator’s instructions. That creates potential conflict where an instruction may appear to conflict with a driver’s obligations under other laws (for example road safety or criminal law). The Regulations do not specify priority rules; drivers will need to reconcile operator instructions with statutory duties under other Acts, though the Regulations do not provide a direct mechanism to resolve such conflicts.

7. Journey completion contract interactions. Regulation 5(2) requires making another vehicle available “for the purposes of completing the journey under the terms of the arrangements with the passengers” or making other arrangements “by agreement with the passengers who desire to complete the journey.” That phrasing directly links regulatory duties to contract terms. Operators could face consumer disputes over what the “terms of the arrangements” mean, especially for tours with deposits, staged itineraries, or multi‑day arrangements.

8. Lack of procedural detail for inspectors and Director decisions. The Regulations create production obligations and Director approvals without procedural safeguards, timelines or review mechanisms in the text. Operators and drivers must therefore look to the parent Act or administrative law remedies to understand appeal and review channels.

9. Fees may have changed since the reprint. The Schedule shows $550 for a licence and $50 per endorsement, and the endnotes list fee amending instruments. Practitioners must verify the current Schedule and any subsequent amending instruments to ensure fee compliance.

10. No express penalties for failing to notify the operator under r 5(1). Drivers are required to notify the operator when a vehicle cannot proceed (r 5(1)), but r 5 does not set a specific penalty. In practice, failure to notify may attract the general r 14 penalty (25 penalty units) or be relied upon as evidence of failure to meet other duties; the text is not explicit.

Each of these “gotchas” arises from the language and structure of the Regulations themselves. Practitioners should address them by clarifying roles in contracts and licences, maintaining robust records at identified business premises, and engaging the Director or licensing agency to obtain written guidance on conditional record requirements and the process for relief vehicle approvals.

The Regulations prescribe a concise set of operational compliance steps. Below is a practical checklist grounded directly in the text to reduce penalty and enforcement risk.

Operator compliance checklist (r 3 and r 4)

• Determine whether you meet the definition of operator. If you “operate a tourist vehicle otherwise than only as a driver,” accept operator responsibilities (r 3).

• Create and maintain the r 4 record. For each tourist vehicle you operate, record: the vehicle identity (r 4(1)(a)); the name, residential address and Motor Vehicles Act licence number of each driver you engage or employ (r 4(1)(b)); a general description and date(s) of each journey undertaken by the vehicle, and the name and address of each driver who operated it on the journey (r 4(1)(c)). Maintain any additional items the Director requires as a licence condition (r 4(1)(d)).

• Store records at the principal place of business in a secure location. Regulation 4(2)(a) requires the record to be kept in a safe place at the operator’s principal place of business. An operator should designate a specific physical location or an identifiable electronic repository that is secured and accessible.

• Be prepared to produce records to an inspector. Under r 4(2)(b), produce records whenever required by an inspector. Establish an internal response procedure so that records can be provided promptly on request.

Driver operations and contingency procedures (rr 5, 7-8, 10)

• Notification procedure. Drivers must notify the operator if the tourist vehicle cannot proceed due to mechanical or other failure and the driver cannot complete the journey (r 5(1)). Maintain a documented procedure for immediate driver notification, including contact details and escalation.

• Journey completion arrangements. On notification, the operator must either make another vehicle available to complete the journey under the terms of the arrangement with the passengers, or make other arrangements by agreement with passengers who wish to complete the journey (r 5(2)(a)-(b)). Operators should have pre‑arranged contingency plans and written agreements for substitution vehicles or refund/alternative arrangements to present to passengers.

• Time limit for relief vehicle use. Do not use a replacement vehicle for more than four days without obtaining written approval from the Director (r 5(3)). Seek Director approval promptly if the replacement use will extend beyond four days, and keep written records of the approval.

• Follow operator instructions. Drivers must carry passengers in accordance with operator instructions (r 7). Ensure that operator instructions are lawful and documented; provide drivers with an operations manual and routeing instructions consistent with compliance obligations.

• Ensure legal seating and capacity. Drivers must ensure passenger numbers do not exceed the maximum permitted and that passengers occupy parts of the vehicle designed to provide seating accommodation (r 8). Keep and use seating capacity information from vehicle certification, and train drivers to enforce seating rules.

• Avoid illegal use. Drivers must not use, cause or permit the vehicle’s use for illegal purposes (r 10). Have clear policies to prevent carriage for unlawful activities.

Licence and fee compliance (r 12 and Schedule)

• Pay the licence fee. Ensure payment of the Schedule fee for a tourist vehicle licence or renewal: $550 as stated in the Schedule (Schedule, reg 12). Confirm that no subsequent amending instrument has changed the fee.

• Pay endorsement fees. Pay $50 for each endorsement on a licence in a calendar year as stated in the Schedule (Schedule, reg 12). Make administrative arrangements to renew endorsements and to track calendar‑year cycles.

Record management and auditability

• Maintain audit trail. Keep copies of journey logs, driver licence numbers and contact details, records of notifications and communications with passengers regarding contingency arrangements, and any Director approvals. These documents will be material in responding to inspections or enforcement action.

• Principal place of business clarity. Document and declare your principal place of business (for record storage) within your corporate or sole trader records so that compliance with r 4(2)(a) is demonstrable.

Engagement with the Director and inspectors

• Clarify licence conditions required by the Director. Because r 4(1)(d) allows the Director to require additional recorded matters as licence conditions, operators should request written confirmation of any such conditions upon licence grant or renewal and maintain records accordingly.

• Establish inspection response procedures. Train staff to respond to inspector requests and to produce records promptly. Keep a designated contact person for inspections.

Legal risk management

• Note penalty exposures. Record failures under r 4 attract a maximum of 60 penalty units (r 4). Other breaches attract the general r 14 maximum of 25 penalty units. Maintain compliance policies to avoid either exposure.

• Align contracts with regulatory duties. Set out booking, refund and contingency terms that reflect obligations in r 5 to complete journeys “under the terms of the arrangements with the passengers,” or to make other arrangements by agreement.

• Seek administrative clarification where ambiguous. For operationally significant ambiguities (for example the definition of “principal place of business” or whether a person is an “operator”), seek written guidance from the licensing agency or the Director to reduce enforcement risk.

Record retention and retention periods

• The Regulations do not prescribe retention periods. Adopt retention policies consistent with other legal or administrative guidance and ensure records are available for production when required.

Finally, maintain a watch for legislative or regulatory amendments: the reprint’s endnotes list multiple amending instruments (see endnotes 2-4). Fee levels, conditions and regulatory wording have changed over time; regular review of subordinate legislation and licensing guidance is necessary to ensure ongoing compliance.
