COMMERCIAL PASSENGER (ROAD) TRANSPORT (PASSENGER BUSES) REGULATIONS 1992

The Regulations revolve around a small number of regulatory concepts that determine who has duties, what must be recorded and disclosed, and what is enforceable.

• Operator as regulatory subject. The term operator is the central regulated actor. The instrument defines operator as "a person who operates a bus otherwise than only as a driver" (reg 3). This definition differentiates a person who only drives a bus from an operator who has broader operational responsibility. The regulatory duties in Part 2 are expressed as obligations on the operator (regs 4, 6, 7).

• Record keeping and production. Regulation 4 mandates a structured record for each operator (reg 4(1)(a)-(d)) and prescribes both storage location and production on demand by an inspector (reg 4(2)(a)-(b)). The Director may also require additional matters to be recorded as a condition of licence (reg 4(1)(d)). The records are not merely advisory; a failure to comply attracts a maximum penalty of 60 penalty units (reg 4(1) and (2)).

• Director's informational power. The Director has a broad information‑request power under reg 6 to require "full and correct information of any kind that relates to journeys undertaken by a bus as is specified by the Director". The operator’s duty to comply carries a maximum penalty of 60 penalty units for non‑compliance (reg 6).

• Public information duties and display. Operators providing route services must make certain operational information available to the Director or any other person on request, including route, stops, approximate times, fares and bus class; must amend timetables when requested by the Director; and must display particulars inside and outside the bus as required by the Director (reg 7(1)-(3)).

• Driver conduct obligations. Drivers are required to limit passenger loads to the maximum permitted and to ensure passengers are only carried in parts of the bus designed for passengers (reg 8). Drivers also must not use a bus for illegal purposes (reg 12). These are direct duties on the driver, separate from operator responsibilities.

• Fees and licensing. The Schedule prescribes specific dollar fees for licensing actions: issuing or renewing a licence ($550), endorsement on a licence ($66), application to extend a pioneer route declaration ($60) and an urban service area licence ($60) (reg 16 and Schedule).

• Offence structure. The instrument contains both provision‑specific penalty figures (for example regs 4 and 6 set maximums of 60 penalty units) and a general offence clause that states a person who contravenes or fails to comply commits an offence with a maximum penalty of 25 penalty units (reg 20). The coexistence of specific and general penalties is a structural feature of the text.

• Cross‑legislative references. Definitions and obligations reference other legislation. The definition of bus stop is tied to the Traffic Act 1987 and driver licence numbers are to be those issued under the Motor Vehicles Act 1949 (reg 3; reg 4(1)(b)). The Regulations themselves are made under the Commercial Passenger (Road) Transport Act 1991 (front matter).

These concepts allocate the principal obligations to operators and drivers, concentrate information‑gathering authority in the Director, provide inspection powers for enforcement, and fix explicit fees and penalties in the Schedule and specific regulations.

The Regulations specify who has duties and who is subject to enforcement. The principal affected parties are operators, drivers, passengers and the Director and inspectors as enforcement actors. The instrument also implicates licence issuers and the public who request timetable and fare information.

• Operators. Defined as "a person who operates a bus otherwise than only as a driver" (reg 3). Operators bear the bulk of administrative duties: creating and retaining records about buses, drivers and daily routes (reg 4(1)(a)-(c)), producing those records on demand to inspectors (reg 4(2)), responding to the Director's requests for journey information (reg 6), supplying route, stop, time, fare and class information to the Director or any person on request and updating timetables when required (reg 7(1)-(2)), and displaying particulars on the buses as required by the Director (reg 7(3)). Operators are also the party required to pay fees set out in the Schedule (reg 16 and Schedule).

• Drivers. Defined as the person driving or in control of a bus (reg 3). Drivers hold three specific duties: to ensure passenger numbers do not exceed the maximum permitted on the bus; to ensure passengers are only carried in parts designed for passenger carriage (reg 8(a)-(b)); and to refrain from using or allowing the bus to be used for an illegal purpose (reg 12). These duties apply at the point of operation and are enforceable offences under the instrument.

• Passengers. Defined broadly as any person travelling on a bus other than the driver (reg 3). Passengers are indirectly affected because the Regulations impose limits on where and how they may be carried: drivers must not carry passengers in parts not designed for passengers, and operators must display places or areas where passengers may not be taken up or set down if the Director requires those particulars to be displayed (reg 7(3)(d)).

• Director. The Director is the administrative decision maker within these Regulations. The Director may require additional record matters as licence conditions (reg 4(1)(d)), request journey information from operators (reg 6), request amendments to timetables (reg 7(2)), and require the form and placement of displayed particulars on buses (reg 7(3)). The text places substantial informational and display discretion with the Director.

• Inspectors. Inspectors are empowered to require production of records kept under reg 4 by operators (reg 4(2)(b)). The instrument thus enables front‑line inspection and verification.

• Third parties and the public. Reg 7 requires operators to make route, stop, timetable, fare and class information available to "the Director, or any other person" on request (reg 7(1)). This imposes an obligation to supply public‑facing information on demand.

• Licensing authorities. While the issuing authority is not described in detail in the Regulations, fees for issuing or renewing licences, and for endorsements, are specified in the Schedule and are payable in relation to the matters in that Schedule (reg 16 and Schedule). The Schedule lists monetary amounts for these licensing transactions.

• Cross‑referenced statutory participants. The Regulations reference the Motor Vehicles Act 1949 for driver licence numbers and the Traffic Act 1987 for the definition of bus stop (reg 3; reg 4(1)(b)). Those Acts therefore indirectly interact with these Regulations by supplying definitional or documentary anchors.

Who pays: operators pay the fees in the Schedule and bear administrative compliance costs (records, signage, timetable amendment). Who decides: the Director decides what additional record matters are required, what information to request, and the manner of displayed particulars; inspectors decide when to request production of records (reg 4(1)(d), reg 6, reg 7(2)-(3), reg 4(2)(b)). What behaviour changes: operators must institute record‑keeping and information systems and accommodate inspections and Director requests; drivers must manage passenger numbers and avoid unlawful uses.

This section distils the operative obligations and the procedural rights embedded in the Regulations and cites the relevant provisions.

Operator duties

• Record creation and content. Operators must create and maintain a record of each bus they operate, the name and residential address of each driver engaged or employed and that driver’s licence number under the Motor Vehicles Act 1949, a general description of the route on each day of operation, and any additional matters the Director requires as a licence condition (reg 4(1)(a)-(d)). The duty to record is mandatory and carries a maximum penalty of 60 penalty units (reg 4(1)).

• Record storage and production. The record must be kept in a safe place at the operator’s principal place of business and produced whenever required by an inspector (reg 4(2)(a)-(b)). Failure to comply with these storage and production requirements attracts a maximum penalty of 60 penalty units (reg 4(2)).

• Supply of journey information to the Director. On request by the Director, operators must furnish full and correct information of any kind relating to journeys as specified by the Director (reg 6). Non‑compliance carries a maximum penalty of 60 penalty units (reg 6).

• Public availability of operational information. Operators who provide a route service must make available on request to the Director or any person: each route, the bus stops along each route, approximate times a bus will be available on each route, fares payable, and the class of bus provided (reg 7(1)(a)-(e)). This is a proactive information duty to both the Director and members of the public, with consequences for non‑compliance (see reg 20).

• Timetable amendments and display obligations. Operators must amend any timetable when requested by the Director (reg 7(2)). Operators must paint in legible letters or display, in the manner the Director sees fit, in a conspicuous place inside and outside the bus the particulars the Director requires concerning timetable, fares, route and places/areas where passengers may not be taken up or set down (reg 7(3)(a)-(d)).

• Fees. Operators must pay fees for issuing or renewing licences, endorsements, pioneer route extensions and urban service area licences as prescribed in the Schedule (reg 16 and Schedule).

Driver duties

• Limitation on passengers. Drivers must ensure the number of passengers does not exceed the maximum permitted for the bus, and must not carry a passenger in any part of the bus not designed for passengers (reg 8(a)-(b)).

• Prohibition on illegal use. Drivers must not use, cause or permit the bus to be used for an illegal purpose (reg 12).

Enforcement and offences

• General offence clause. A person who contravenes or fails to comply with a provision of these Regulations commits an offence (reg 20). The regulation specifies a maximum penalty of 25 penalty units under reg 20.

Rights and procedural notes

• Director discretion. The Director has authority to specify additional matters as licence conditions (reg 4(1)(d)), to request journey information (reg 6), to require timetable amendments (reg 7(2)), and to determine how particulars are displayed on buses (reg 7(3)). These are administrative decision points that shape the operator’s duties.

• Inspector access. Operators must produce records to inspectors when required (reg 4(2)(b)). The text expressly links production obligations to inspector requests, creating an operational right for inspectors to verify compliance.

Observations from the text

• Parallel penalty figures. The Regulations include provision‑specific maximum penalties (reg 4 and reg 6 each provide a maximum of 60 penalty units) while reg 20 sets a general maximum of 25 penalty units. Both categories appear in the instrument and will be applied according to the specific provision breached and any applicable legal interpretation (regs 4, 6, 20).

• Scope of "operator" and "driver". The definition of operator excludes persons who are only drivers (reg 3). This textual distinction allocates many obligations to persons or entities that operate buses beyond mere driving duties.

The Regulations set out penalties and enforcement mechanisms with a mix of provision‑specific maximum penalties and a general offence clause. The enforcement architecture is administrative and offence‑based.

Specific penalties in the text

• Regulation 4: Record keeping and production. The obligation to make the records listed in reg 4(1) carries a maximum penalty of 60 penalty units. The obligation to ensure records are kept at the principal place of business and produced when required by an inspector also carries a maximum penalty of 60 penalty units (reg 4(1)-(2)).

• Regulation 6: Supply of information to the Director. The duty to furnish full and correct journey information on request by the Director is subject to a maximum penalty of 60 penalty units (reg 6).

• Regulation 20: General offence clause. The instrument declares that a person who contravenes or fails to comply with any provision of the Regulations commits an offence, with a maximum penalty of 25 penalty units (reg 20).

Enforcement actors and mechanisms

• Director. The Director has powers to request information, require timetable amendments and specify display particulars; those decisions are the administrative triggers for compliance or enforcement (reg 4(1)(d), reg 6, reg 7(2)-(3)). The Director’s requests are the basis for the operator’s duty to supply information and amend timetables.

• Inspectors. Inspectors may require production of the records maintained under reg 4. The obligation to produce records "whenever required by an inspector" is explicit and backed by the penalties set in reg 4(2)(b).

• Prosecution of offences. The Regulations make contraventions offences. The text does not in itself set out prosecution processes or specify jurisdictional arrangements, but the existence of maximum penalty figures makes non‑compliance enforceable by whatever prosecution mechanisms apply under the overarching legislative framework.

Practical enforcement notes drawn from the text

• Coexistence of penalty figures. The instrument specifies both provision‑level maximum penalties (60 penalty units) for certain record and information obligations and a separate, lower general maximum penalty of 25 penalty units (reg 4, reg 6, reg 20). The text therefore contains different maximum penalties depending on the regulation engaged. The presence of provision‑level maximums indicates Parliament intended stronger sanctions for specific duties, at least on the face of the instrument.

• Inspector access to records. The obligation to keep records at the principal place of business and to produce them to inspectors on demand concentrates enforcement on document verification (reg 4(2)). Enforcement is likely to proceed by inspection and request for production followed by potential prosecution for failure to comply.

• Fee non‑payment consequences. The Schedule prescribes fees for licensing transactions (reg 16 and Schedule). The Regulations do not spell out separate offences for failure to pay Schedule fees, but non‑compliance with licensing conditions could be captured by the general offence provision or by separate licensing provisions in the Act under which the Regulations are made.

• Driver‑level enforcement. Drivers' obligations (limiting passengers and not using buses for illegal purposes) are explicit; breaches will be contraventions under reg 20 and may also attract higher penalties if specific provisions provide them.

Sections relevant to enforcement and penalties are regs 4, 6 and 20, and reg 16 with the Schedule for fees.

The Regulations expressly cross‑refer to and rest upon other statutes and the underlying Act. The source text names several external Acts and indicates amendment interactions. The practical legal effect is structural and procedural.

Direct cross‑references in the Regulations

• Commercial Passenger (Road) Transport Act 1991. The Regulations are made under the Commercial Passenger (Road) Transport Act 1991 (front matter). The Act is the parent statute that authorises the making of these Regulations; functions such as licensing and the Director’s powers derive from that Act. The Regulations implement operational detail under that enabling statute.

• Motor Vehicles Act 1949. Regulation 4(1)(b) requires the operator’s record to include the number of the driver’s licence issued in relation to that person under the Motor Vehicles Act 1949. The Motor Vehicles Act therefore supplies the primary licensing instrument for drivers and provides the reference identification for driver licences to be recorded.

• Traffic Act 1987. The definition of bus stop in reg 3 is a cross‑reference to the Traffic Act 1987. This ties the geographical concept of a bus stop used by the Regulations to the Traffic Act’s definition and any standards or enforcement mechanisms that exist in that Act.

Amendments and legislative amendments that affect operation

• The endnotes list a sequence of amending instruments and Acts that have altered the Regulations over time, for example Passenger Bus Regulations 1992 (SL No. 56, 1992), amendments in 1998, 2003, 2005, 2008, 2012, 2013, 2016, 2017 and the Transport Legislation Amendment Act 2025 with specified commencement dates (Endnotes 2 and 4). These instruments have amended, repealed or inserted particular regulations across the instrument (see Endnote 4 for a table of affected regulations). The presence of those amendments indicates that the content of the Regulations must be read in the context of later legislative changes listed in the reprint.

• Interaction with licensing regime. The Schedule fixes fees for issuing or renewing a licence and endorsements, and reg 4 refers to "as a condition of the operator's licence" (reg 4(1)(d) and Schedule). This indicates the Regulations are operational within a licensing framework established under the parent Act. Licensing conditions set by the Director under the Act will therefore interact with the record keeping obligations in reg 4.

Administrative and enforcement interactions

• Information flows. The Director can request "full and correct information of any kind" that relates to journeys (reg 6). That information may be used for regulatory oversight, licensing decisions, compliance audits or coordination with other statutory schemes. The text does not limit the use of information, but it does connect operational reporting duties to the Director’s administrative role.

• Overlapping enforcement tools. The Inspector’s power to require production of records under reg 4(2) may interact with enforcement mechanisms in the parent Act or other transport or safety statutes. The insertion, amendment and repeal history in the endnotes suggests that some provisions have been updated to align with other legislative changes (Endnotes 2 and 4).

Limitations and textual anchors

• The Regulations do not themselves restate substantive safety or vehicle standards, nor do they define the Director’s full powers. Instead they rely on the parent Act and referenced statutes for broader regulatory authority (front matter; regs 3 and 4(1)(b)). Practitioners should read the Regulations alongside the Commercial Passenger (Road) Transport Act 1991, the Motor Vehicles Act 1949 and the Traffic Act 1987 to understand the full legal environment in which these duties operate.

• The endnotes identify amendments made by various Acts and statutory instruments, including the Transport Legislation Amendment Act 2025 which commenced selected parts on 21 January 2026 (Endnote 2). These external amendments may have altered the scope of the Director’s powers, inspector functions or penalty regimes; the reprint’s endnotes list which regulations were amended by which instruments (Endnote 4). The Regulations therefore exist in a network of statutory instruments that must be read together.

• Schedule amended No. 60, 1998, r 5; No. 43, 2003, r 5; No. 45, 2012, r 10.

General amendments

• The reprint notes that general amendments of a formal nature were made by the Interpretation Legislation Amendment Act 2018 (Act No. 22 of 2018) to several regulations (rr 1, 2, 3 and 4), reflecting technical or formal updates to the text (Endnote 3).

Practical implications of the amendment history

• The Amendment list shows that the Regulations have been subject to successive and targeted changes to specific provisions over time, including repeals and insertions. The presence of multiple instruments that amended, substituted or repealed particular regulations indicates that practitioners must consult the current printed reprint and the parent Act to ensure they rely on the operative text.

• The Schedule has been amended several times (No. 60, 1998; No. 43, 2003; No. 45, 2012), indicating that fees have been adjusted or restructured on a number of occasions.

• The Transport Legislation Amendment Act 2025 is recorded as a recent amending instrument with parts commencing on 21 January 2026. Those amendments may have altered regulative detail; the reprint’s endnotes identify the commencement dates and affected sections (Endnote 2).

Citations: Endnotes 2, 3 and 4 contain the amendment chronology and mapping.

The reprint and the endnotes supplied with it do not include any decisions, cases or judicial interpretations of these Regulations. The material in the source consists of the text of the Regulations themselves and an endnote record of amending instruments, notification and commencement dates, and which regulations were amended or repealed (Endnotes 2 and 4). There are no cases named, reported or cited within this reprint.

What the instrument records

• No judges, judgments or litigation references appear in the text of the Regulations or the endnotes attached to the reprint.

• The endnotes document legislative amendment history and formal changes but do not include references to court decisions, tribunal determinations, administrative review outcomes or reported disputes that interpret or apply these Regulations.

Practical consequence for practitioners

• The absence of litigation history in this reprint means the authoritative source for the content and interpretation of the Regulations is the statute and the reprint itself. Where legal interpretation is required , for example the interaction of the provision‑specific penalties with the general offence provision, the scope of the Director’s discretion to require records or display particulars, or the definition of "operator" as excluding persons who are "only" drivers , practitioners should consider that those questions are not resolved within the text and may require independent legal research for authoritative judicial commentary.

• Because the reprint does not contain litigation references, practitioners wishing to rely on any judicial interpretation should consult external legal databases, court records or administrative decisions not included in this source to identify relevant case law or contested applications of these Regulations.

Reference: The reprint contains no litigation entries; see the text and Endnotes section for the amendment history and list of instruments.

This Regulations text contains a number of textual features and drafting choices that can produce compliance traps, administrative uncertainty or unintended operational impacts. These are concrete points drawn from the wording of the instrument.

1. Divergent penalty figures

• The Regulations set provision‑specific maximum penalties of 60 penalty units for record keeping (reg 4(1)-(2)) and for furnishing journey information to the Director (reg 6). Separately, reg 20 states a general maximum penalty of 25 penalty units for contraventions of the Regulations. The text therefore includes different maximum penalties applicable to different obligations (regs 4, 6, 20). This creates an obvious drafting mismatch that practitioners should notice when advising on enforcement risk and when a prosecution alleges an offence under the Regulations.

2. Broad Director discretion

• The Director can require "any other matter" as a condition of the operator's licence in relation to records (reg 4(1)(d)), request "full and correct information of any kind" about journeys (reg 6), require timetable amendments (reg 7(2)), and determine how particulars are displayed on the bus (reg 7(3)). The text does not limit or detail the scope of those powers. Practically, this places significant operational discretion with the Director and may give rise to variability in compliance obligations between different licensees.

3. Principal place of business storage requirement

• Records must be kept "in a safe place at the principal place of business of the operator" (reg 4(2)(a)). Operators whose activities are highly mobile, who use multiple depots, or who operate under a home‑based arrangement may face practical difficulties if the "principal place of business" is not clearly defined or if records are kept electronically or offsite. The text does not provide alternative arrangements for remote access or reciprocal production of electronic records.

4. Definition of operator

• The definition excludes persons who "operate a bus otherwise than only as a driver" (reg 3). This wording means a person who serves only as a driver may not be an "operator" for the purposes of these obligations. That distinction can affect who must keep records and who must pay fees. It creates potential ambiguity where a driver has mixed roles or where a small‑scale operator drives and performs some administrative functions.

5. Public information duties on demand

• Operators providing route services must make route, stop, timetable, fare and class information available "to the Director, or any other person, on request" (reg 7(1)). The "any other person" phrasing imposes a potentially onerous public information duty on demand. The Regulations do not set a mechanism for refusing unreasonable or repeated requests, nor do they specify a timeframe for compliance.

6. Display particulars in manner the Director sees fit

• The obligation to "paint in legible letters or display, in the manner the Director sees fit, in a conspicuous place on the inside and outside of the bus" certain particulars (reg 7(3)) gives the Director control over format and placement. Operators must be prepared to alter physical signage on the Director’s instruction, which could impose costs and operational disruptions.

7. Interaction with repealed provisions

• The endnotes show several regulations were repealed across amendments (Endnote 4). Practitioners relying on historical practices or legacy licensing documents should confirm the current text and not assume earlier repealed regulations remain in force.

8. Absence of procedural detail

• The Regulations set duties but do not provide procedural detail such as timelines for producing records after an inspector’s request, standards for what constitutes a "safe place", or what qualifies as "full and correct information". These omissions create compliance uncertainty that may require administrative clarification from the Director or reliance on the parent Act’s procedural provisions.

9. Fees set in Schedule but limited description of consequences for non‑payment

• The Schedule specifies dollar amounts for licence transactions (Schedule; reg 16), but the Regulations do not spell out the consequences for non‑payment or late payment within this text. The practical effect depends on licensing rules and enforcement provisions in the parent Act.

10. Driver prohibition on "illegal purpose"

• Regulation 12 prohibits drivers from using buses for an "illegal purpose" but does not define the term. The breadth of the phrase means that any activity that contravenes criminal law or other statutes could fall within the prohibition, but the lack of a definition creates interpretive uncertainty.

Each of these points derives directly from the text of the Regulations (see regs 3, 4, 6, 7, 8, 12, 16, 20 and the Schedule) and the endnote amendment mapping (Endnote 4). Practitioners should flag these as specific drafting features that will affect compliance procedures, enforcement exposure and administrative planning.

The Regulations impose a compact set of prescriptive duties. This section translates the operative provisions into concrete compliance steps, cross‑referenced to the relevant regulations and the Schedule. The text prescribes no extraneous processes; compliance therefore requires implementing the specific record, information, display and operational steps set out below.

Records and administration (operator)

• Create and maintain the record required by reg 4(1). At a minimum the record must include:

  • each bus operated by the operator (reg 4(1)(a));
  • the name and residential address of each driver engaged or employed and the number of the driver’s licence under the Motor Vehicles Act 1949 (reg 4(1)(b));
  • a general description of the route on which the bus was operated on each day it was operated (reg 4(1)(c));
  • any other matters the Director requires as a condition of the operator’s licence. Confirm licence conditions to identify additional record items (reg 4(1)(d)).

• Store records at the principal place of business in a safe place, ensuring secure but prompt accessibility for inspection (reg 4(2)(a)). Document the principal place of business in administrative records to avoid disputes over location (reg 4(2)(a)).

• Prepare production procedures for inspectors. Establish an internal process to produce the records "whenever required by an inspector" (reg 4(2)(b)). Maintain a log of inspector requests and the documents produced.

Information supply to the Director

• Establish a system to respond to the Director’s requests for "full and correct information of any kind" relating to journeys (reg 6). Identify responsible officers and timelines for compiling and verifying journey information. Keep a record of communications with the Director to evidence compliance.

Public information and timetable duties

• For route services, ensure the following information can be provided to the Director or any member of the public on request (reg 7(1)):

  • each route;
  • the bus stops along each route;
  • the approximate times a bus will be available along each route;
  • fares payable by passengers;
  • the class of bus provided for the route service.

• Maintain current timetables and implement a change control process to amend timetables promptly when the Director requests amendments (reg 7(2)). Document timetable versions and dates of amendments to evidence compliance.

Signage and display

• Prepare inside and outside bus signage templates that can be updated at the Director’s direction. The operator must "paint in legible letters or display, in the manner the Director sees fit, in a conspicuous place on the inside and outside of the bus" particulars regarding timetable, fares, route and prohibited pickup/setdown areas if required by the Director (reg 7(3)(a)-(d)). Design signs to be legible and placed in conspicuous locations both internally and externally.

Driver compliance and operational controls

• Train and instruct drivers to ensure passenger numbers do not exceed the maximum permitted on the bus and that passengers are only carried in parts of the bus designed for passenger carriage (reg 8). Maintain seating capacity information and a clear marking of permitted seating/standing areas.

• Instruct drivers that they must not use, cause or permit the bus to be used for an illegal purpose (reg 12). Provide guidance on identifying and reporting suspected illegal uses.

Fees, licences and endorsements

• Pay fees prescribed in the Schedule (reg 16 and Schedule). The Schedule lists specific amounts:

  • Issuing or renewing a licence: $550.
  • Each endorsement on a licence: $66.
  • Application to extend period of a declaration of a pioneer route: $60.
  • Urban service area licence: $60.

• Ensure licence renewals, endorsements and any pioneer route or urban service area applications are lodged with the appropriate authority and that fees are paid in accordance with procedural requirements set by the licensing body.

Document retention and audit trail

• Keep an audit trail of records created, produced and amended. Note dates of inspections, Director requests, timetable amendments and signage changes. Retain produced documents in accordance with record retention policies aligned to the principal place of business requirement (reg 4(2)(a)).

Risk management and queries

• Where the Director exercises discretion (for example in specifying additional record matters or the manner of display), request written notice or written standards where possible so that compliance steps are documented. The Regulations repeatedly tie obligations to the Director’s requests or approvals (reg 4(1)(d), reg 6, reg 7(2)-(3)); obtaining written directions reduces uncertainty.

• Where a driver’s role and operator role overlap, confirm whether the person qualifies as an "operator" under the definition in reg 3. If a driver performs broader operational functions, record both roles and ensure the legal entity responsible for the licence is the party meeting operator obligations.

Response to inspections and enforcement

• Treat inspector requests under reg 4(2)(b) as immediate and document the production. Have a designated compliance officer authorised to liaise with inspectors and the Director.

• Where there is uncertainty about whether a particular obligation applies, document the rationale for the compliance decision and seek clarification from the licensing authority or the Director.

Practical checklist (summary)

• Maintain required records (reg 4(1)(a)-(d)).
• Keep records at principal place of business and produce to inspectors on demand (reg 4(2)).
• Respond to Director’s journey information requests (reg 6).
• Make route, stop, timetable, fare and class information available to Director or public on request (reg 7(1)).
• Amend timetables when requested by the Director (reg 7(2)).
• Display particulars as required by the Director inside and outside the bus (reg 7(3)).
• Ensure drivers observe passenger limits and lawful use rules (regs 8, 12).
• Pay Schedule fees for licences and endorsements (reg 16 and Schedule).
• Document all communications with the Director and inspectors.

All compliance steps above are grounded in reg 3 (definitions), regs 4, 6, 7, 8, 12 and reg 16 and the Schedule.
