COMMERCIAL PASSENGER (ROAD) TRANSPORT (MISCELLANEOUS) REGULATIONS 1992

The Regulations organise several recurring legal concepts that practitioners need to map to operational reality.

• Infringement notices and prescribed amounts: Part 2 designates particular contraventions across the Commercial Passenger (Road) Transport Act 1991 and associated subordinate regulations as infringement-notice offences (reg 2(1); Schedule 1). The prescribed monetary amount is expressed as the monetary equivalent of a stated number of penalty units (reg 2(2)). Inspectors may issue infringement notices on reasonable grounds (reg 3). Notices must contain specified particulars and an explanation of expiation versus court election (reg 4). Payment expiates the alleged offence and prevents further proceedings (reg 5); the Director may withdraw a notice within 28 days and before payment (reg 5A). Part 2 does not oblige issuance of a notice nor prevent prosecution in the absence of a notice (reg 5B).
• Fee and penalty architecture: Fees are listed in Schedule 2 and are payable for discrete administrative steps (reg 6; Schedule 2). Penalties for criminal contraventions are set in terms of penalty units across regulations (for example, maximum penalties of 85 penalty units appear in regs 9 and 17). Schedule 1 converts many regulatory contraventions into penalty-unit amounts for infringement notices.
• Definitions and cross-reference: The Regulations import and rely on definitions in other instruments. Key terms such as rideshare platform, rideshare platform manager and rideshare vehicle refer back to the Commercial Passenger (Road) Transport (Ridesharing) Regulations 2017 (reg 1A). GST is defined by reference to the Commonwealth GST Act (reg 8(6)). This creates a web of dependent definitions for compliance.
• Payment-terminal economics: Payment terminals are permitted but their programmed fee for use must not exceed 5 per cent (inclusive of GST) of the fare, and the operator/driver must not use terminals imposing more than that fee (reg 8(1)-(4)). The regulation defines a payment terminal as a device interfacing with payment cards (reg 8(6)).
• Vehicle safety and maintenance duty: Operators must not make vehicles available for hire if unsafe; drivers must not drive if they know a vehicle is unsafe (reg 9(1), (3)). The Registrar may specify minimum maintenance; the operator (or the rideshare driver if the vehicle is a rideshare vehicle) must ensure maintenance per that specification (reg 9(2)). The regulation defines "unsafe" in terms of risk to person, public safety or property (reg 9(4)).
• Social-access rules: No-smoking rules (reg 10) and access for assistance animals (reg 11) regulate behaviour in vehicles. Regulators differentiate between commercial passenger vehicles and rideshare/courtesy vehicles in creating exemptions and prohibitions (reg 10(2)-(3)). For assistance animals, the driver must not refuse a hiring solely because a passenger is accompanied by an assistance animal trained by an assistance animal training institution and used by persons with specified disabilities (reg 11).
• Lift incentive mechanism: The lift incentive (reg 12) allows eligible wheelchair users to offer incentives to drivers through redeemable vouchers, smartcards under the Northern Territory Transport Subsidy Scheme, or Minister-approved electronic methods (reg 12(2)). Acceptance triggers a rule that the hiring commences once the wheelchair is on board and secured and forbids charging for waiting or loading time if the driver accepts the incentive (reg 12(3)). Participation by drivers is voluntary (reg 12(4)), and the Minister may determine eligible classes and incentive amounts by Gazette notice (reg 12(5)). If an operator or communications/dispatch network receives an incentive, it must pass it to the driver in full (reg 12(6)).
• Passenger services levy: The statutory, per-transaction levy of $0.91 applies to each passenger service transaction, defined as the carrying of person(s) for reward in a taxi, minibus, private hire car or rideshare vehicle (regs 14(1)-(2)). Liability differs by vehicle type: licence-holders for taxis/minibuses/private hire cars, and the rideshare platform manager for rideshare journeys (reg 14(3)). Returns and payment are monthly, due by the end of the following month (regs 15-16). Offences cover evasion, failure to provide returns, false or misleading records, destruction of records and failure to retain records for three years (reg 17).
• Enforcement roles: Inspectors may issue infringement notices (reg 3). The Director is the collection and enforcement point for levy receipts and has power to recover unpaid monthly levies as debts in court (reg 15(2)). Director can also withdraw infringement notices within a narrow window (reg 5A).

These concepts create a mix of administrative, criminal and civil compliance obligations that interface with licensing conditions, platform operations and driver conduct; each concept cross-links to other Acts and subordinate instruments for detailed implementation.

The Regulations allocate obligations and liabilities across a range of market participants in commercial passenger transport.

• Operators of taxis, minibuses and private hire cars: Licence-holders are directly liable for monthly passenger services levies in respect of transactions involving their vehicles (reg 14(3)(a)). Licence conditions require operators to lodge monthly returns and pay levies by the due date (reg 16(1)). Operators are subject to the safety duty not to make unsafe vehicles available (reg 9(1)-(2)), must permit assistance animals to board (reg 11(1)), and must comply with lift-incentive pass-through requirements if they receive incentives (reg 12(6)). They also must ensure payment terminals in their vehicles, if used to receive fares, are not programmed to apply charges above the 5 per cent inclusive cap (reg 8(2)-(3)).
• Rideshare platform managers: For rideshare passenger service transactions, the rideshare platform manager is the person liable to pay the monthly levy (reg 14(3)(b)) and must lodge returns and pay the aggregated monthly levy (reg 16(2)). Platform managers must retain records for three years, produce them on request and must not provide misleading returns (reg 17(2)-(6)). The Regulations therefore place reporting, collection and prosecution exposure directly on platform managers rather than individual drivers for levies.
• Drivers of commercial passenger vehicles and rideshare vehicles: Drivers must not drive for hire if they know the vehicle to be unsafe (reg 9(3)). Drivers are prohibited from smoking in commercial passenger vehicles (reg 10(1)) and specifically in rideshare vehicles when available for hire or on journeys (reg 10(3)). Drivers cannot refuse a hiring solely because the passenger has an assistance animal (reg 11(1)). For payment terminals installed in a commercial passenger vehicle, drivers must not use a terminal if it is programmed to charge over the 5 per cent cap (reg 8(2)).
• Passengers with assistance animals and wheelchair users: The Regulations protect the right of passengers to be carried with an assistance animal and create an incentive mechanism to facilitate wheelchair carriage (reg 11; reg 12). The lift incentive is designed for an "eligible person" requiring wheelchair capability; the Minister can set eligible classes and amounts by Gazette (reg 12(1), (5)). The scheme affects passengers who rely on accessibility: they may offer incentives to drivers for wheelchair-capable vehicles, and the rules limit chargeable time if the driver accepts the incentive (reg 12(3)).
• Communications and dispatch networks; operators or platform technology providers: Entities that manage the system under which a payment terminal is programmed are treated as imposing a terminal fee for the purposes of reg 8(4) (reg 8(5)). Operators, communications or dispatch networks that receive lift incentives must pass them to drivers in full (reg 12(6)). These entities therefore carry compliance responsibilities and potential exposure for fee-capping breaches and incentive pass-through.
• Regulators and enforcement officers: Inspectors can issue infringement notices where reasonable grounds exist (reg 3). The Director is the receipting and enforcement body for levies, has power to recover unpaid levies as debts in court (reg 15(2)), and may withdraw infringement notices under limited circumstances (reg 5A). The Registrar of Motor Vehicles can specify minimum maintenance requirements (reg 9(2)).
• Businesses that provide payment terminals or payment-processing: The cap on terminal fees applies to the person who manages or administers the terminal system (reg 8(5)-(6)). Entities supplying terminals will need to ensure configuration does not allow operators/drivers to apply fees in excess of the 5 per cent (incl. GST) cap and must account for the GST-inclusive ceiling in pricing and programming (reg 8(6)).

Who pays: the Regulations are explicit that levy liability falls on licence-holders for traditional vehicles and platform managers for rideshare transactions (reg 14(3)), while prescribed monetary penalties apply where infringement notices are used (reg 2; Schedule 1) and maximum penalty units apply for various breaches (e.g., reg 9 and reg 17).

The Regulations set out a compact of specific duties for operators, platform managers, drivers and service providers, and they create rights for certain users.

Duties

• Duty to avoid unsafe operations: Operators must not make a commercial passenger vehicle available for hire if it is unsafe (reg 9(1)). The driver must not drive for hire if the driver knows the vehicle is unsafe (reg 9(3)). The operator or, where the vehicle is a rideshare vehicle, the driver must carry out maintenance in accordance with any minimum maintenance specified by the Registrar of Motor Vehicles (reg 9(2)). The Regulations define "unsafe" by reference to likely endangerment of persons, public safety, or property (reg 9(4)). Maximum penalties are 85 penalty units for contravening reg 9.
• Duty on payment terminals and fee caps: Drivers and licence-holders must not use or permit use of a payment terminal programmed to charge more than 5 per cent (inclusive of GST) of the fare for terminal use (reg 8(2)-(3)). A person who manages or administers the system under which a terminal is programmed must not impose a fee above 5 per cent inclusive (reg 8(4)-(5)). These duties expose operators, drivers and terminal managers to penalties up to 25 penalty units (reg 8).
• Duty to accept assistance animals: Drivers cannot refuse hiring or boarding solely because a person is accompanied by an assistance animal trained by an assistance-animal training institution and used by a person who is blind, deaf, or has another form of disability requiring assistance (reg 11(1)-(2)). Penalty: 30 penalty units.
• Duty to comply with levies, returns and recordkeeping: Relevant operators and rideshare platform managers must pay the monthly levy aggregated across passenger service transactions for each calendar month by the end of the following month (reg 15(1)). Operators and platform managers must lodge returns in an approved form and pay the levy as a licence/approval condition (reg 16). They must keep records necessary to ascertain liability, produce records on request, retain records for three years and avoid false or misleading returns or records; destruction of records is an offence (reg 17(2)-(7)). Maximum penalties: 85 penalty units for many of these offences.
• Duty to comply with lift-incentive pass-through: If an operator or communications/dispatch network receives a lift incentive, they must pass it on to the driver in full (reg 12(6)). The Minister may determine eligible classes and amounts via Gazette notice (reg 12(5)).

Rights

• Right to expiate via payment: A person who receives an infringement notice may expiate by paying the prescribed amount within 28 days of the notice being given, thereby avoiding further action (reg 4(2)(a); reg 5).
• Right to elect court proceedings: The person may instead elect court determination by completing a statement of election and not paying the prescribed amount (reg 4(2)(b)-(3)).
• Director's withdrawal: The Director may withdraw an infringement notice by written notice within 28 days after the notice is given and before payment (reg 5A). The person thereby has a limited administrative safeguard.
• Driver voluntariness for lift incentives: Drivers are not obliged to accept a lift incentive; if they decline, they may charge for waiting and loading time (reg 12(4)).
• Ministerial discretion and notice processes: The Minister may define eligible classes and amounts for lift incentives by Gazette notice (reg 12(5)). This is a right of the executive to configure the scheme but not an individual right; users can rely on the publicly available Gazette determinations.

Process rights and formal requirements

• Infringement notice content and processes are specified: the inspector must include name/address, date/time/place of offence, description, prescribed amount and enforcement agency, and the notice must provide the option to elect court process or pay to expiate (reg 4(1)-(3)). If the Fines and Penalties (Recovery) Act 2001 applies, enforcement may proceed under that Act if the person does nothing in response (reg 4(2)(c)). These procedural obligations create predictable steps for recipients.

These duties and rights form a compliance scaffolding that assigns operational responsibility (vehicle safety, recordkeeping, terminal fee control) primarily to operators and platform managers, while granting regulated persons limited administrative remedies (expiation, election to proceed to court, and Director withdrawal).

The Regulations combine administrative expiation, civil recovery and criminal penalty mechanisms. Enforcement roles are shared between inspectors and the Director. Key enforcement mechanisms and penalty amounts are:

• Infringement notice procedure (Part 2): Inspectors may issue infringement notices where reasonable grounds exist (reg 3). Schedule 1 lists the number of penalty units prescribed for specified provisions; reg 2(2) converts the number into a monetary amount equal to the penalty-unit value. The infringement notice must specify the prescribed amount and the enforcement agency (reg 4(1)(e)-(f)). Payment within 28 days expiates the offence and bars further proceedings (reg 4(2)(a); reg 5). The Regulations also permit the Director to withdraw a notice in writing within 28 days and before payment (reg 5A).
• Criminal penalties in the Regulations: Several offences carry specific maximum penalties expressed in penalty units. Examples include:
  • Safety duties: operator/drivers failing to avoid unsafe vehicles or failing to carry out maintenance as specified, and driver knowingly driving an unsafe vehicle, carry maximum penalties of 85 penalty units (reg 9(1)-(3)).
  • Levy-related offences: evasion of the monthly levy, failure to lodge returns, failure to keep or produce records, retention failures, false or misleading returns/records and intentional destruction of records all attract maximum penalties of 85 penalty units (reg 17(1)-(7)).
  • Payment terminal fee breaches attract up to 25 penalty units for drivers and licence-holders and general persons imposing fees (reg 8(2)-(4)).
  • Smoking contraventions incur a maximum penalty of 30 penalty units (reg 10).
  • Refusal to accept assistance animals attracts up to 30 penalty units (reg 11).
• Schedule 1 list of infringement amounts: Schedule 1 cross-references many provisions across the Act and subordinate regulations and assigns prescribed amounts in penalty units for infringement notices (Schedule 1; reg 2(1)). The Schedule includes items ranging from fractional units (0.5) to tens of units for various contraventions. Schedule 1 therefore sets the quantum for expiation payments where infringement notices are issued.
• Debt recovery and civil enforcement: If a monthly levy is unpaid by the due date, it becomes a debt due to the Territory recoverable by the Director in a court of competent jurisdiction (reg 15(2)). The Director is the specified enforcement agency for levy collection (reg 4(1)(f) and reg 15).
• Interaction with Fines and Penalties (Recovery) Act 2001: The infringement-notice process notifies the recipient that if the Fines and Penalties (Recovery) Act applies, enforcement action may be taken under that Act if the person does nothing in response to the notice (reg 4(2)(c)). Thus, expiation non-payment can trigger statutory recovery processes.
• Administrative constraints on withdrawal: The Director’s power to withdraw an infringement notice is constrained by time and condition: withdrawal must be in writing, within 28 days after the notice was given and before payment (reg 5A(1)-(2)).
• Inspectorial discretion and multiple notices: Part 2 permits multiple infringement notices for the same offence to be given and allows expiation under any of the notices (reg 5B(2)-(3)). Part 2 does not preclude criminal proceedings where no notice issued or where a notice is not expiated (reg 5B(2)(b)).

Practical enforcement implications: enforcement pivots on capacity to detect and substantiate contraventions (inspectors issuing notices), the Director’s administrative collection facilities, and courts for recovery of unpaid levies. Penalty units are the determinant of monetary amounts specified in Schedule 1 and in maximum penalties; the Regulations do not state the monetary value of a penalty unit, which is set elsewhere. The combination of criminal penalties up to large multiples of penalty units (85 units is the top number in several provisions), civil debt recovery for levies and administratively low-cost expiation by payment creates layered enforcement incentives for compliance.

The Regulations are explicitly cross-referential and interact with multiple other instruments and Act provisions, creating a web of statutory dependencies and enforcement linkages.

• Parent Act relationship: These Regulations are made under the Commercial Passenger (Road) Transport Act 1991 and expressly designate various offences under that Act as infringement offences in Schedule 1 (reg 2(1); Schedule 1 entries referencing provisions of the Act). Licence and approval conditions created by reg 16 tie compliance to the parent Act’s licensing regime, thus linking administrative sanctions in the Act to the subordinate instrument’s duties.
• Ridesharing Regulations 2017: Several definitions directly import terms from the Commercial Passenger (Road) Transport (Ridesharing) Regulations 2017, including rideshare platform, rideshare platform manager and rideshare vehicle (reg 1A). The Part 5 levy liability allocation puts rideshare-platform managers on the hook for levies generated by rideshare trips (reg 14(3)(b)), hence interacting operationally with the ridesharing regulatory framework.
• Criminal Code and Sex Industry Act: Regulation 7 prescribes various Criminal Code offences (listing numerous sections) and certain offences under the Sex Industry Act 2019 as "disqualifying offences" for the parent Act’s s 3(1) definition of disqualifying offence. This cross-linking means criminal convictions under the Criminal Code or the Sex Industry Act can affect licensing and accreditation status under the transport legislation (reg 7).
• GST Act (Commonwealth): The payment-terminal fee cap is expressly stated as inclusive of GST and reg 8(6) defines GST by reference to the A New Tax System (Goods and Services Tax) Act 1999 (Cth), importing Commonwealth tax definitions into the cap calculation. That means terminal fee compliance requires computation inclusive of federal GST rules.
• Fines and Penalties (Recovery) Act 2001: The infringement-notice content must advise recipients that enforcement may proceed under that Act where it applies (reg 4(2)(c)). Non-payment of an infringement notice could therefore result in recovery under that Act, linking Territory administratively issued penalties to statutory recovery machinery.
• Registrar of Motor Vehicles: Regulation 9(2) permits the Registrar of Motor Vehicles to specify minimum maintenance requirements for commercial passenger vehicles, which creates an administrative delegation point for technical maintenance standards that operators or rideshare drivers must follow.
• Northern Territory Transport Subsidy Scheme and ministerial Gazette powers: The lift incentive can be paid by smartcard issued under the Northern Territory Transport Subsidy Scheme and the Minister has Gazette power to determine eligible classes and amounts (reg 12(2), (5)). This integrates subsidy infrastructure and ministerial discretion into the incentive design.
• Subordinate regulations and vehicle-specific legislation: Schedule 1 references a wide range of subordinate instruments,e.g., Commercial Passenger (Road) Transport (Taxis) Regulations 1992, (Minibuses) Regulations 1998, (Private Hire Cars) Regulations 1992, (Limousines) Regulations 2003, (Ridesharing) Regulations 2017, etc.,and assigns infringement notice penalty-unit amounts to contraventions in those instruments. Those links mean that compliance across the variable vehicle classes is harmonised through the Schedule.
• Penalty unit and monetary calibration: The Regulations use penalty units and refer to monetary equivalents without stating the monetary value of a penalty unit (reg 2(2) and numerous references to penalty units). The applicable value of a penalty unit is determined by other legislation and must be checked when calculating the exact monetary exposure.

Practical cross-jurisdictional implication: platform managers and operators must coordinate compliance not only with these Regulations but also with the ridesharing instrument, the parent Act, the Registrar’s maintenance notices, GST rules, the Territory’s fines recovery regime, and any ministerial Gazette notices. The web of references concentrates operational implementation risk on those who hold licences or operate platform infrastructure and requires them to map multiple statutory sources to compute levies, set terminal fees and comply with maintenance and recordkeeping obligations.

The instrument includes a detailed amendment record in its endnotes. Key mechanical changes and their dates, as recorded in the source, include:

• The original instrument: Commercial Passenger (Miscellaneous) Regulations 1992 (SL No. 60, 1992), notified and commenced 29 October 1992.
• Amendments through the 1990s and 2000s, including a 1994 amendment (SL No. 22, 1994) and amendments notified 23 December 1998 that commenced 1 January 1999 (SL No. 57, 1998).
• Statute Law Revision and various structural amendments in 2000 and 2003 (Statute Law Revision Act 2000; SL No. 44, 2003; SL No. 50, 2003). The 2003 amendments introduced multiple changes, some commencing 1 October 2003 and others earlier in that year (Endnotes list those notifications and commencements).
• Insertion of regulation 7 by the Commercial Passenger Vehicles Legislation Amendment Act 2006 (Act No. 3, 2006), which brought forward the concept of disqualifying offences (Endnotes show s 17 insertion).
• Further amendments via Statute Law Revision Act 2007, and sector-specific regulation changes in the late 2000s and 2010 (e.g., Taxis Amendment (Wheelchair Passengers and Other Matters) Regulations 2008; Security Cameras Regulations 2010).
• A set of amendments in 2016-2017 that respond to changes in the sector, including the insertion of new parts and regulations for ridesharing: Commercial Passenger Vehicle Legislation Amendment Regulations 2016 (SL No. 33, 2016) and 2017 instruments including Ridesharing Regulations (SL No. 35, 2017) and related amendments. These amendments added Part 4 provisions, Part 5 passenger services levy, and definitions referencing the Ridesharing Regulations (see list of amendments showing ins No. 35, 2017, r 27, etc.).
• Subsequent incremental amendments, including the Commercial Passenger (Miscellaneous) Amendment Regulations 2018 (SL No. 10, 2018), Transport Legislation Amendment Regulations 2019 (SL No. 11, 2019), and further Acts touching related legislation. The Sex Industry Act 2019 and Criminal Code Amendments 2022 and Criminal Justice Legislation Amendment (Sexual Offences) Act 2023 are listed as having commenced at various times and having amended cross-referenced provisions (Endnotes list).
• Most recently, the Transport Legislation Amendment Act 2025 (Act No. 23, 2025) made a suite of changes with assent on 12 September 2025 and parts commencing 21 January 2026. The list of amendments identifies that pts 2, 4, 5 and 6 of that Act commenced 21 January 2026 and various regulations were substituted or amended by that Act (Endnotes and list of amendments: Act No. 23, 2025, s 20-23).

The reprint’s "List of Amendments" (Endnotes 4) itemises which regulations or parts were inserted, substituted or repealed by each amending instrument, providing a chronological map of how the instrument’s structure evolved, principally to fold in ridesharing rules (2017 Ridesharing Regulations), introduce the passenger services levy and to consolidate safety, accessibility and fee-cap provisions across vehicle types.

What the record shows politically and administratively: over the period 1992-2026 the Regulations have been incrementally updated to address new business models (ridesharing), social access (wheelchair passengers and assistance animals), technology (payment terminals), and revenue collection (the passenger services levy). Amendments were effected by subordinate legislation (SL) and by Acts, with the most recent Transport Legislation Amendment Act 2025 adjusting multiple parts of the regulatory framework and commencing in January 2026.

The text of the Regulations supplied contains no reported litigation history, judicial interpretations or case citations. The schedules and endnotes list statutory amendments and cross-references but do not record any court decisions or litigation outcomes that have interpreted these Regulations.

Consequently, the source provides no case law that construes the particular provisions, defines the scope of inspector discretion, or settles disputes about the interpretation of terms such as "passenger service transaction", "unsafe", "payment terminal", "lift incentive" or the procedural adequacy of infringement notices. Practitioners seeking precedent-driven answers will need to consult external case law repositories, court databases or the decisions of administrative tribunals to determine how courts have applied these or closely analogous provisions; none are provided in the instrument itself.

In regulatory practice, absence of litigation in the statutory text means that enforcement and compliance expectations rest on the express wording of the Regulations, the parent Act and guidance issued by the administering agency, rather than settled judicial interpretation recorded in the instrument. For contested matters, such as whether a rideshare transaction is properly characterised as a passenger service transaction for levy purposes, or whether a given fee constitutes a payment-terminal fee exceeding the 5 per cent cap, litigation or administrative review outside this instrument may yet be necessary to resolve ambiguities.

The Regulations contain several detail-level traps where operational practice can produce unintended compliance exposure or financial liability if not precisely managed. These "gotchas" are mechanics-based and derive strictly from the text.

• Penalty-unit conversion not in the Regulations: Many prescribed amounts and maximum penalties are expressed in penalty units (reg 2(2), regs 9 and 17, Schedule 1). The monetary value of a penalty unit is set by separate legislation, not in these Regulations. Failure to convert properly will miscalculate exposure and expiation amounts.
• Rideshare platform manager liability: For rideshare trips, liability for the passenger services levy sits with the rideshare platform manager (reg 14(3)(b)), not the driver. Platform managers must therefore maintain counting, reporting and payment systems. A platform that assumes drivers will remit levies risks municipal debt recovery by the Director, recordkeeping offences, and possible 85-penalty-unit penalties (reg 17).
• Counting "passenger service transaction": The levy applies per passenger service transaction defined as carrying a person for reward in specified vehicle types (reg 14(2)). The Regulations do not further define edge cases such as pooled trips, multi-leg or cancelled journeys. Platforms must design counting rules that align with the statutory definition; absent further administrative guidance this is a source of audit risk.
• Payment-terminal cap is GST-inclusive: The 5 per cent cap on payment-terminal fees is inclusive of GST (reg 8(2)-(4), (6)). Terminal managers or operators who set fees at 5 per cent exclusive of GST risk breaching the cap once GST is added. The Regulations treat the manager who programs or administers the terminal system as the person imposing a fee (reg 8(5)), broadening liability beyond merely the operator or driver.
• Payment-terminal programming and indirect fees: The Regulations prohibit terminals programmed to apply fees above 5 per cent when used to receive a fare (reg 8(2)-(4)). Systems that apply separate convenience fees, dynamic surcharges or add-ons may effectively push the total fee above 5 per cent. Operators, platform managers and terminal vendors must ensure combined surcharges do not exceed the statutory ceiling.
• Timing and enforcement of monthly levies: The monthly levy is due by the end of the following month (reg 15(1)). Delay turns the unpaid levy into a debt recoverable by the Director (reg 15(2)). Platform managers must be able to aggregate transaction counts, generate returns in the approved form and make timely payments. Failure to file returns, keep records or produce them on request attracts 85-penalty-unit maximums (reg 17).
• Director withdrawal window for infringement notices: The Director can withdraw an infringement notice only within 28 days after it was given and before payment (reg 5A). If a recipient pays an expiation promptly, they lose the ability to benefit from a late withdrawal; conversely, payment triggers expiation and bars further proceedings (reg 5). Practitioners must advise clients about the timing stakes of payment vs election.
• Multiple infringement notices: Part 2 permits issuing more than one infringement notice for the same offence and allows expiation under any notice (reg 5B(2)-(3)). This creates potential confusion about which notice governs and which prescribed amount applies; recipients should check notice particulars and prescribed amounts (reg 4).
• Lift incentive rules and charging time: If a driver accepts a lift incentive, hiring commences only after the wheelchair and occupant are on board and made secure and the driver must not charge for waiting or loading time (reg 12(3)). Drivers who accept incentives then bill for that time contravene the rule; operators who receive incentives must pass them to drivers in full (reg 12(6)). The driver’s right to decline exists (reg 12(4)), so operators must be clear in policy whether incentives are offered and how to handle accepted vs refused incentives.
• Interaction with other laws and instruments: Several definitions and enforcement mechanisms are located in other laws (Ridesharing Regulations 2017, GST Act, Fines and Penalties (Recovery) Act). Gaps or inconsistencies across instruments (for example, difference in definitions of a rideshare journey) can create compliance uncertainty unless reconciled.
• Record retention and destruction offences: The duty to retain records for three years and the criminalisation of intentional destruction (reg 17(5)-(7)) mean that data retention policies and technical backups must be robust. Destruction, even accidental, could attract significant penalties if intentionality is alleged.

In sum, these are enforcement and operational friction points that require procedural controls: accurate penalty-unit conversion, counting algorithms for transactions, contractual allocation of levy and fee responsibilities, payment-terminal programming validation (GST inclusive), and clear record retention and reporting protocols.

Compliance for the principal affected parties (operators, rideshare platform managers, drivers, communications/dispatch networks and terminal providers) requires discrete operational, technical and recordkeeping steps, mapped to the specific regulatory provisions.

For operators of taxis, minibuses and private hire cars

• Levy accounting and returns: Build an accounting process to count passenger service transactions per calendar month, prepare the approved return and pay the aggregated monthly levy by the end of the following month (regs 14(1)-(3); 15(1); 16(1)). Reconcile with transaction logs and supplier/platform records.
• Licence condition integration: Ensure that licence compliance systems incorporate the requirement to lodge monthly returns and evidence payment of the levy because reg 16 treats these as licence conditions (reg 16(1)(a)-(b)).
• Safety and maintenance: Implement a preventative maintenance program aligned with any maintenance standards the Registrar specifies. Keep maintenance logs and schedule inspections so operators are not in breach of reg 9(1)-(2). Train drivers to report safety defects and instruct drivers not to drive if they know a vehicle is unsafe (reg 9(3)).
• Payment terminals: Where terminals are installed, ensure programming does not apply a fee exceeding 5 per cent inclusive of GST. If you do not manage the terminal programming, require contractual warranties from the terminal provider and audit receipts for any terminal-related charges on fares (reg 8(1)-(6)).
• Assistance animals and lift incentives: Adopt policies to permit assistance animals and ensure drivers are trained on their obligations (reg 11). For lift incentives, if the operator receives incentives, pass them to drivers in full and adopt procedures to account for incentives separately; ensure drivers who accept incentives understand the prohibition on charging for waiting and loading time in that circumstance (reg 12(3), (6)).
• Recordkeeping: Maintain records necessary to prove levy liability and retention for at least three years, and be ready to produce documents on request by the Director (reg 17(3)-(5)). Implement secure backup and audit trails to avoid accusations of intentional destruction (reg 17(7)).

For rideshare platform managers

• Levy and reporting systems: Implement a transaction-counting mechanism and monthly reporting pipeline to produce returns in the approved form and pay the monthly levy by the due date (regs 13-16). Map platform transaction semantics (pooled trips, multi-leg charges, cancellations) to the statutory definition of passenger service transaction (reg 14(2)) and document your counting methodology.
• Contractual and operational clarity with drivers: Given that platform managers are liable for the levy, ensure contractual terms with drivers cover how platform-level levies affect driver payments, receipts, or fare splits. Maintain transparent records to withstand audit or dispute with the Director.
• Records and retention: Keep electronic records sufficient to establish levy liability and retain them for three years; put in place processes for producing records on request. Avoid providing misleading returns and ensure QA checks before lodgement (reg 17(2), (6)).
• Terminal fee compliance: If the platform supplies or configures in-car payment terminals, ensure programming cannot create fees above 5 per cent GST-inclusive. Require vendors to warrant compliance and maintain logs showing fee percentages charged (reg 8).
• Integration with Ridesharing Regulations: Ensure platform operations conform to definitions and obligations in the Ridesharing Regulations 2017, referred to in reg 1A, to avoid divergence between platforms and regulatory definitions.

For drivers

• Vehicle safety and reporting: Know and act on the duty not to drive if the vehicle is unsafe (reg 9(3)). Report defects promptly and ensure the operator has maintenance records in line with any Registrar notice (reg 9(2)).
• Payment terminal usage: Do not use a payment terminal programmed to apply fees exceeding 5 per cent inclusive of GST (reg 8(2)). If a terminal shows a different effective fee, refuse its use and report to the operator/platform.
• Assistance animals and lift incentives: Do not refuse hiring solely because the passenger has a trained assistance animal (reg 11). Drivers may accept lift incentives but are not obliged to do so; if they accept, they must not charge for waiting or loading time (reg 12(3)-(4)). Keep records of incentives accepted or refused as part of normal bookkeeping.

For payment-terminal vendors and administrators

• Programming guarantees and GST inclusivity: Ensure terminal configurations cannot create fees above 5 per cent inclusive of GST when used to receive fares and provide certification or contractual indemnities to operators/platforms (reg 8(2)-(6)). Maintain logs and audit trails to demonstrate fee settings.
• Liability mapping: Understand reg 8(5) that a person who manages or administers the system under which the terminal is programmed is treated as imposing the fee. Draft customer agreements and warranties to allocate compliance responsibility and set pricing to account for GST-inclusive ceilings.

Practical compliance checklist

• Confirm the monetary value of a penalty unit from the relevant Act before calculating expiation amounts and exposure.
• Implement monthly reporting and payment calendars keyed to the "end of the following month" deadline for levies (reg 15(1)); automate aggregation and reconciliation.
• Maintain three-year retention and immediate production capability for records concerning passenger service transactions and levies (reg 17(5)).
• Audit payment-terminal configurations and ensure fee percentages are GST-inclusive in calculation; update terms with terminal suppliers accordingly (reg 8).
• Institute training for drivers on acceptance of assistance animals and the mechanics of lift incentives and ensure policies on charging time align with reg 12.
• Establish legal and operational controls with platform managers and communications networks to pass lift incentives to drivers in full and to segregate incentive accounting (reg 12(6)).
• Prepare to respond to inspectors and the Director: ensure notices are tracked, check prescribed amounts on any infringement notices (Schedule 1), and advise clients about the 28-day expiation window and the Director’s limited withdrawal power (regs 4-5A).

Following these steps aligns daily operations with the Regulations’ express duties and creates paperwork and technical evidence that will be critical in the event of inspection, levy audit or an infringement notice.
