COMMERCIAL PASSENGER (ROAD) TRANSPORT (COURTESY VEHICLES) REGULATIONS 2003

The central concept is the courtesy vehicle, which is defined only by implication through the regulatory structure. Regulation 3 defines driver, hiring, and operator, but not courtesy vehicle itself. The term is used throughout as a vehicle used to carry passengers for hire or reward, but regulation 11(1)(b) clarifies that in a hiring the carriage must be provided without payment of a fare. However, the vehicle must be used as an inducement for an agreement for accommodation or recreation. So the core concept is a vehicle offered for free as a perk to secure a paying customer for another service. The concept of hiring is defined specifically as the use of the vehicle to carry passengers for hire or reward. This is confusing because no fare is paid , rather, the reward is indirect, coming from the primary agreement. The regulation effectively treats the entire trip as a hiring even though no fare changes hands. This is a key tension. The concept of operator is someone who operates the vehicle other than only as a driver. This distinguishes a business or entity that arranges or provides the vehicle from the person who physically drives it. Regulation 11(1) creates the central rule: a person must not use a courtesy vehicle for a hiring unless (a) the carriage is offered as an inducement in respect of an agreement for accommodation or an activity for recreation or pleasure, and (b) it is provided without payment of a fare. So the lawful use of a courtesy vehicle is strictly tied to a commercial offer (accommodation or recreation) and the absence of a separate fare. Regulation 11(3) then imposes a positive obligation on the operator to actually provide the courtesy vehicle (or an alternative commercial passenger vehicle) if a person accepts the inducement and enters the accommodation or recreation agreement. This prevents bait-and-switch tactics. The concept of plying for hire in regulation 10 prohibits using the vehicle for the traditional taxi or ride-share practice of waiting or cruising for customers. Regulation 12 prohibits touting or soliciting for passengers for the courtesy vehicle, with a narrow exception for advertising the underlying accommodation or recreation and incidentally offering the carriage as part of that publicity. This is significant: it permits general advertising but not direct solicitation of passengers for the free ride. The liquor purchase prohibition in regulation 16 is unusually broad , it prohibits the driver from agreeing to a hiring that requires them to buy alcohol for anyone, and prohibits both driver and passengers from buying any intoxicating liquor during a hiring. This presumably targets the classic hotel courtesy shuttle that might also serve drinks. Finally, regulation 20 designates courtesy vehicles as a prescribed class under section 74 of the Act, requiring drivers to carry and display an identity card with name, recent photo, expiry date, and authorisation to drive a courtesy vehicle. The Director may approve alternative forms of identification.

The regulations directly affect three categories of persons: operators, drivers, and passengers of courtesy vehicles in the Northern Territory. An operator is defined as a person who operates a courtesy vehicle otherwise than only as a driver. This captures any business or individual that arranges for, provides, or controls the use of a courtesy vehicle. Typically this will be hotels, resorts, tour operators, function centres, caravan parks, and any accommodation or recreation provider that offers free transport as a customer incentive. For example, a resort offering a free airport shuttle to guests who book a package; a tour company providing free transfers to and from a guided hike; or a campground offering a free shuttle from town. The operator bears the heaviest compliance burden: they must maintain written records (regulation 4) covering the vehicle, dates and times of hiring, driver details, each hiring, and anything else the Director requires. These records must be kept at the principal place of business and produced to an inspector on demand. The operator must also, on request from the Director, provide full and correct information about any hiring within a specified time (regulation 5). Further, the operator is under the positive obligation in regulation 11(3) to provide the vehicle (or another commercial passenger vehicle) if a customer accepts the accommodation or recreation offer. Failure to do so attracts 25 penalty units. Drivers , the individuals driving or in charge of the courtesy vehicle , face personal liability for many prohibitions: accepting a fare (reg 11(2)), agreeing to a liquor-purchase hiring (reg 16(1)), buying liquor for themselves or others (reg 16(2)), using the vehicle for an illegal purpose (reg 19), and failing to display or produce their identity card (reg 20). The identity card requirement applies only during a hiring. Passengers are also caught: a passenger must not purchase intoxicating liquor during a hiring (reg 16(3)). That is unusual , most passenger conduct regulation is left to general criminal law, but here it is a specific regulatory offence. The regulations also affect the Director (the regulator under the Act) who has power to require information, impose conditions on licences, and approve alternative forms of identification. Inspectors have powers to demand production of records. Indirectly, the regulations affect anyone who might offer a free ride as a marketing tool, including small bed-and-breakfasts, Airbnb hosts, wedding venues, and community groups offering recreation activities. Anyone who uses a vehicle to carry people for free as a customer incentive must comply or risk penalties. Because the regulations repealed the licence requirements for operators and vehicles, entry is easier, but the ongoing conduct and record-keeping duties remain non-trivial, especially for small operators who may not have dedicated administrative staff.

The regulations impose a series of clear duties and confer limited rights. The most significant duty is on the operator to maintain written records under regulation 4. This is not a discretionary good practice , it is mandatory with a maximum penalty of 25 penalty units for failure. The records must include the courtesy vehicle itself (likely registration or identifier), the dates and times of each hiring, the driver's full name, residential address, and driver licence number, and each hiring made. The Director may also impose additional record-keeping requirements as a condition of the operator's licence. Note that while the regulations themselves no longer require an operator licence (former rr 6-9 were repealed), the Act under which the regulations are made may still require a licence for the operator. The regulations are silent on that point, so one must read them together with the Act. The records must be kept at the operator's principal place of business and produced to an inspector whenever required. This imposes a significant administrative burden, especially for operators with multiple vehicles or frequent short trips. The operator also has a duty under regulation 5 to furnish information to the Director on request, within the time specified, about any details of any hiring. This expands the Director's investigatory power beyond routine inspections. For drivers, the key duty is under regulation 11(2) not to ask for or accept a fare. This is absolute: no negotiation of payment, even if a passenger voluntarily offers money. The driver must also comply with the identity card display and production requirement under regulation 20(3): the card or an approved alternative must be displayed conspicuously while driving and produced to any passenger or inspector on request. This gives passengers a specific right to request and see the driver's identification. Similarly, an inspector has a right to demand production of records from the operator under regulation 4(2)(b). The driver also has a duty not to purchase intoxicating liquor during a hiring (reg 16(2)), and the operator has a duty not to agree to a hiring that requires the driver to buy liquor for others (reg 16(1)). The operator also has a duty under regulation 11(3) to provide the courtesy vehicle (or substitute commercial passenger vehicle) when a customer accepts the inducement. This creates a contractual right for the customer to receive the free transport, enforceable through the Director or potentially through private action if loss arises from non-provision. The only explicit right for a person who wants to tout is the exception in regulation 12(2): a person does not commit an offence for touting or soliciting if they are publicising the accommodation or recreation activity and as part of that publicity they offer to carry passengers in a courtesy vehicle as an inducement. This is a limited defence, not a positive right. Importantly, there is no right of review or appeal mentioned in these regulations. Any dispute over the Director's requests, conditions, or approvals would have to be pursued under the Act or general administrative law. The regulations provide no mechanism for the operator to challenge a request for information as unreasonable.

Each offence in these regulations carries a uniform maximum penalty of 25 penalty units. Under the Northern Territory's Penalty Units Act, as at 2026 a penalty unit is approximately $190 (subject to indexation), making 25 penalty units around $4,750 per offence. This is a significant sum for a small business or individual driver, especially when multiple breaches could be charged for separate trips or separate omissions. The penalty applies to both operators and drivers for distinct conduct. For example, an operator who fails to maintain records (r 4(1)) and also fails to produce them to an inspector (r 4(2)) could face two separate charges. Similarly, a driver who accepts a fare (r 11(2)) and also buys liquor (r 16(2)) during the same hiring commits two offences. The enforcement mechanism is not spelled out in these regulations. They refer to an inspector, but do not define that term; it is presumably defined in the Act. The Director (also a term from the Act) has the power to request information under regulation 5 and to set conditions under regulation 4(1)(e). Penalties are recovered through the ordinary courts, likely the Local Court for summary offences. There is no provision for infringement notices or on-the-spot fines; the regulations only mention maximum penalties, so any prosecution would require laying charges and proving the elements beyond reasonable doubt. However, the burden on the operator to produce records is strict, and the duty to furnish information under regulation 5 is triggered simply by a request from the Director. Failure to comply is an offence regardless of whether the information would incriminate the operator. This raises the potential for regulatory self-incrimination issues, though the regulations do not address this. The most easily enforced prohibition is likely the plying for hire ban (r 10) and touting ban (r 12), as these can be observed by inspectors or police without needing to access records. The liquor purchase prohibitions (r 16) might be harder to detect unless an inspector is present or a complaint is made. The penalty exposure for operators is compounded by the record-keeping duty. If records are not made or are lost, an inspector or Director can demand information under regulation 5, and if the operator cannot produce it, they face up to 25 penalty units per request. The regulations do not specify a limitation period for prosecutions, so the general criminal limitation under the Criminal Code (possibly 12 months for summary offences) would apply, unless the Act provides otherwise. The enforcement approach appears to be primarily complaint-driven or based on random inspections, not systematic audits. There is no requirement for the operator to file records with the Director; they are kept at the business and produced on demand. This reduces the regulatory footprint but increases the risk of selective enforcement and uncertainty for operators about whether they are fully compliant.

These regulations are made under the Commercial Passenger (Road) Transport Act 1991 (NT) and must be read in conjunction with that Act. The regulations explicitly reference the Act in several places: regulation 20 prescribes courtesy vehicles for the purposes of section 74 of the Act (driver identity cards); regulation 19 references the Act by incorporating the general prohibition on illegal purposes; and regulation 11(3) requires that provision of the alternative commercial passenger vehicle be subject to the Act and any regulations under the Act. Any operator of a courtesy vehicle must also comply with the Act, which may impose licensing requirements for operators and vehicles that were removed from these regulations but may remain in the Act itself. The regulations also interact with the Motor Vehicles Act 1949 (NT), because regulation 4(1)(c) requires recording the driver's licence number issued under that Act. This presupposes the driver holds a valid driver licence under Territory law. The Liquor Act 1978 (NT) or equivalent likely overlaps with regulation 16: purchasing intoxicating liquor during a hiring is prohibited, but the liquor itself is regulated under separate legislation. Compliance with both is required. The Criminal Code (NT) would govern the definition of illegal purpose in regulation 19 , using the vehicle for an illegal purpose is an offence, and the term illegal purpose would draw on the general criminal law. There is no interaction with Commonwealth laws noted in the instrument, though if the courtesy vehicle crosses state or territory borders, separate regulations would apply. The regulations also interact with consumer protection laws: the inducement offer under regulation 11(1)(a) could be considered a representation under Australian Consumer Law (ACL). If an operator fails to provide the courtesy vehicle under regulation 11(3), that could also be a breach of the ACL for false or misleading representations, leading to additional liability beyond the 25 penalty units. The regulation 11(3) obligation is strict , the operator must provide the vehicle or another commercial passenger vehicle. If the operator cannot, they face both regulatory penalty and potential ACL exposure. The regulations also interact with the Interpretation Act 1978 (NT) which governs the construction of regulations. Note that the endnotes refer to general amendments of a formal nature made by the Interpretation Legislation Amendment Act 2018 to regulations 1, 2, and 4. There is no interaction with criminal record or disqualification provisions, but convictions under these regulations could affect operator licence status under the Act.

The Commercial Passenger (Road) Transport (Courtesy Vehicles) Regulations 2003 were originally made as SL No. 49, 2003, notified on 1 October 2003 and commencing on the same day. The commencement depended on the commencement of Part 5B of the Act, which occurred on that date per Gaz G38, 24 September 2003. The first substantive amendment came through the Fees and Charges (Transport) Amendment Regulations 2012 (SL No. 45, 2012), which amended regulation 21 (since repealed) regarding fees, effective 1 January 2013. Then the Penalties Amendment (Miscellaneous) Act 2013 (Act No. 23, 2013) amended regulations 4, 5, 6-9, 10-12, 13-15, 16, 17-18, 19, and 20, increasing penalties from lower amounts to the current 25 penalty units across the board. The 2013 amendment standardised the penalty level, effective 28 August 2013. The most structurally significant change came with the Commercial Passenger Vehicle Legislation Amendment Regulations 2017 (SL No. 34, 2017), effective 1 December 2017. This amendment repealed regulations 6-9 (operator licence), 13-15 (vehicle licence), 17-18 (vehicle standards or conditions), and 21 (fee regulation). This effectively deregulated the licensing side of courtesy vehicle operations, removing the requirement for a courtesy vehicle operator licence and a courtesy vehicle licence. The 2017 amendment thus shifted the regulatory framework from a pre-approval licensing model to a pure conduct-and-record model. Then the Statute Law Amendment (Territory Economic Reconstruction) Act 2022 (Act No. 5, 2022) amended regulation 20, effective in part from 25 May 2022 and in part from 25 May 2023. The precise amendment to regulation 20 is not specified in the list of amendments beyond a reference to Act No. 5, 2022, s 67, but it likely updated references or approved forms of identification. The most recent amendment is the Transport Legislation Amendment Act 2025 (Act No. 23, 2025), assented 12 September 2025, which amended regulation 1 (citation) as per the list, and parts 2, 4, 5, and 6 commenced 21 January 2026. The exact effect on the regulations beyond the citation is not detailed in the source, but the Act likely made consequential amendments to align with other transport changes. The instrument as reprinted on 21 January 2026 incorporates all these amendments. The repeal of licensing provisions in 2017 is the most important structural change, reducing entry barriers but imposing the same conduct duties and penalties.

The source text does not cite any case law, nor does it reference any judicial decisions interpreting these regulations. No litigation history is apparent from the instrument itself. Given the regulations have been in force since 2003 with a major structural change in 2017, it is plausible that few or no court proceedings have arisen under them. The penalties are modest (25 penalty units), so matters would likely be dealt with in the Local Court without reported decisions. The absence of litigation could indicate that the regulations are straightforward and largely complied with, or that enforcement is rare. However, the lack of judicial interpretation means significant uncertainties remain. For example, the meaning of hire or reward when no fare is paid has not been tested. The boundary between lawful publicity under regulation 12(2) and unlawful touting under 12(1) may be unclear. The requirement to provide another commercial passenger vehicle under regulation 11(3) when the courtesy vehicle is unavailable might be subject to arguments about reasonableness or impossibility, but no case law clarifies. The prohibition on purchasing intoxicating liquor during a hiring (reg 16) has not been tested against possible defences, such as a passenger purchasing for personal consumption only. The Director's power to require information under regulation 5 is not limited by relevance or reasonableness; no court has considered whether such a request could be challenged on grounds of oppression or fishing. The identity card requirement in regulation 20 was amended in 2022; no decision has interpreted what constitutes a conspicuous place. Practitioners should treat the regulations as largely untested in court and advise caution accordingly, as any novel defence will be first-impression. The absence of litigation also means there are no guidelines on sentencing for these offences, no definitive interpretation of the maximum penalty, and no precedent on whether multiple hirings could be charged as multiple offences or as a single continuing breach.

Several provisions create traps for the unwary practitioner. First, the definition of hiring in regulation 3 is the use of the courtesy vehicle to carry passengers for hire or reward. But regulation 11(1)(b) says the carriage must be provided without payment of a fare. So the passenger pays nothing directly. The reward is indirect: the value of the free trip is bundled into the price of accommodation or recreation. This means any time a vehicle is used to carry someone for free in connection with a paying service, it is a hiring. The trap is that a business might think they are providing a free shuttle, not a hiring, and therefore ignore all record-keeping duties. Wrong. The regulations apply the moment the vehicle moves for that purpose. A second trap is the record-keeping requirement in regulation 4. The operator must record the dates and times during which the vehicle is operated for hiring. That includes not only the trip itself but also the period the vehicle is available for hire. If a courtesy vehicle is parked at a hotel awaiting a guest booking, that might fall within the period of operation. The record must be made, not just maintained. An operator who forgets to log a trip will be strictly liable. Third, regulation 11(3) imposes a positive obligation to provide the courtesy vehicle or another commercial passenger vehicle if a person accepts the inducement. If the vehicle breaks down, the operator cannot simply cancel; they must have a backup. Failure is an offence regardless of fault. Fourth, the liquor purchase prohibition in regulation 16 applies to passengers as well. A guest who buys a beer or wine during a courtesy vehicle hiring commits an offence. This includes buying for themselves. Tourists accustomed to drinking on a shuttle will be surprised. The operator and driver have no obligation to prevent passengers from buying liquor, but the passenger is directly liable. Fifth, regulation 20 requires the driver's identity card to be displayed in a conspicuous place while driving the courtesy vehicle during a hiring. If the driver stops for a break and the card is not visible, is that an offence? The regulation says during a hiring, so only while passengers are being carried or the vehicle is used for that purpose. But the card must be displayed while driving; if the driver parks and exits, the card may no longer be displayed. If a passenger then requests identification, the driver must produce it. If the card is in a bag, the driver must retrieve it. Sixth, the touting exception in regulation 12(2) is narrow: the person must be publicising the accommodation or recreation activity, and the offer of carriage must be part of that publicity. Advertising a free shuttle without naming the accommodation or activity would not qualify. Tailoring a Facebook ad to say free transfers as part of a resort stay falls within the exception; a sign on the street saying free ride in this vehicle does not. Seventh, the penalty of 25 penalty units applies per offence. An operator with a fleet of ten vehicles could face ten sets of record-keeping obligations. Each failure to record a trip could be a separate offence. There is no provision for continuing offences, so each day of non-compliance might be a new offence. Eighth, the regulations do not specify a limitation period. Under the Criminal Code (NT), summary offences generally have a 12-month limitation, but the Act may provide otherwise. Practitioners must verify. Ninth, the regulations do not provide for any right of review or merits appeal from Director decisions, such as refusal of an identity card approval or a request for information. This may leave operators without recourse. Finally, the repeal of former vehicle and operator licence requirements in 2017 may give a false impression that no authorisation is needed. The Act itself may still require an operator licence or vehicle registration. The regulations cannot override the Act. Checking the current Act is essential.

Compliance requires a systematic approach. First, determine whether your operation falls within the definition. If you offer any free transport as an inducement to customers paying for accommodation or a recreation activity, you are operating a courtesy vehicle. Even if the transport is occasionally provided to non-paying guests, the moment it is linked to the primary commercial offer, the regulations apply. The key is that the carriage must be provided without payment of a fare, but be offered as an inducement. If the transport is purely incidental or free to anyone regardless of any other purchase, it may not be a courtesy vehicle under these regulations, but check the Act carefully. Assuming you are an operator, establish a structured record-keeping system. Regulation 4 requires a written record for each courtesy vehicle, each day of operation. The record must include: the vehicle identifier (registration number), the dates and times the vehicle is operated for hiring (i.e., in service, even if no passengers), the full name and residential address of each driver during those periods, the driver's licence number under the Motor Vehicles Act, and each hiring made. A hiring includes each trip carrying passengers. Record the journey, passenger names (if possible, though not explicitly required , but the regulation says each hiring made, so at least the time, origin, destination). Also include any other matter the Director requires as a condition of the operator's licence. Keep these records at your principal place of business in a safe place. Ensure they can be produced to an inspector within minutes. Digital records are acceptable if they are accessible and can be printed on demand. The operator must also be prepared to respond to a Director's request for information under regulation 5 within the specified time. Have a dedicated contact person and process. Second, the driver must have an identity card issued under section 74 of the Act or an approved alternative. The card must display the driver's name, recent photograph, expiry date, and indicate they are authorised to drive a courtesy vehicle. Display this card conspicuously while driving the courtesy vehicle during a hiring. A visible location on the dashboard or sun visor is typical. Also, produce the card when requested by a passenger or inspector. Ensure the driver carries the card at all times when on duty. If the Director has approved an alternative form of identification, ensure that is used instead. Third, the driver must not ask for or accept any payment for the trip. Even a tip given voluntarily might be construed as payment; advise drivers to politely refuse. If a passenger insists, the driver should explain it is prohibited and, if necessary, contact the operator. Fourth, the driver and operator must not agree to a hiring where the driver is required to purchase intoxicating liquor for anyone. Driver must not purchase liquor for himself, a passenger, or anyone else during a hiring. Passengers must be warned not to purchase alcohol during the trip. This could mean no stops at bottle shops or bars. Fifth, the operator must honour the offer of carriage. If the courtesy vehicle is unavailable, provide another commercial passenger vehicle (such as a taxi hired for the purpose) at no extra cost to the customer. Have a backup plan. Sixth, avoid any conduct that could be plying for hire (r 10) or touting (r 12). Do not cruise for passengers or solicit individuals on the street. Advertising the accommodation or recreation activity with the free shuttle offer is allowed, but the advertisement must primarily promote the underlying service, not just the free ride. Seventh, ensure the courtesy vehicle is not used for an illegal purpose (r 19). This is a catch-all; if the vehicle is used to transport stolen goods or commit an offence, both operator and driver are liable. Finally, review the principal Act for any residual licensing requirements and ensure you hold any necessary operator licence or vehicle authorisation. Maintain insurance as required under the Motor Accidents (Compensation) Act or similar. Compliance is an ongoing duty, not a one-off setup. Regular internal audits of records and driver conduct are advisable. If uncertain, seek legal advice specific to the Northern Territory. The low penalty of 25 penalty units may seem small, but repeated offences and prosecution costs can be substantial, and a conviction may affect any licence under the Act.
