Combat Sports Regulations 2004

The regulations revolve around a small set of recurrent statutory mechanisms: registration and recognition, medical fitness and risk mitigation, record‑keeping and disclosure, gating of events via permits, financial prescriptions (fees and minimum payments), and staged transition from the former regime. Each mechanism is anchored to specified text in the instrument.

Registration and recognition. The regulations prescribe classes of contestants (reg 5; Schedule 2) and capacities of industry participants (reg 9). They require registers to include particular details for contestants and industry participants (reg 6; reg 10). The regulations also provide that a person registered under an overseas or other State law that “substantially corresponds” to the Act is to be taken to be registered under the Act (reg 6A for contestants; reg 10A for industry participants). That creates an equivalence mechanism that can reduce duplicative registration where the condition is satisfied.

Medical fitness, serology and rest periods. The regulations prescribe medical documents for registration (reg 8A) including a medical certificate of fitness (reg 8A(1)(a)), a serology report for HIV, Hepatitis B and C (reg 8A(1)(b)), and a detailed history of injuries (reg 8A(1)(c)). For persons who have competed overseas, the serology must be within 7 days (reg 8A(2)). Pre‑contest medical certification is specified (reg 14), and resting intervals after knockouts or other contest terminations are prescribed in fixed minimums with medical practitioner discretion to extend (reg 15). There is also a minimum 7‑day restriction after participation in any contest (reg 16). The medical practitioner must endorse the contestant’s record book with relevant non‑participation dates (reg 15(4)), and failure to comply attracts specified fines (regs 15-16).

Record keeping and reporting. The regulations prescribe the contents of the register for contestants (reg 6) and for industry participants (reg 10). Contestant record books must contain specified items (reg 8C) and records of contests must include specified data at weigh‑in and in the record of contest (regs 13, 17A). Contestants participating in contests outside the State must ensure the same entries are made in their record book (reg 17B), with a fine for non‑compliance.

Permits and contest approvals. Promoters must apply for permits for contests with detailed prescribed particulars concerning contestants, venue, safety, insurance, ticketing and officials (reg 17C), and permits granted must contain specified information (reg 17D). Fees for permits depend on the proposed number of tickets and are set in Schedule 3 item 4 (reg 17E).

Financial anchors and minimums. Registration fees and permit fees are set in Schedule 3 (reg 8; reg 11; reg 17E). Minimum fees payable to officials are prescribed in Schedule 4 and apply to referees, judges and timekeepers, with qualified exceptions where an international sanctioning body requires a higher fee (reg 19).

Authority, scope and exclusions. The regulations define and limit scope through definitions (reg 3). They explicitly exclude certain activities from the Act’s definition of combat sport, fencing, paintball and theatrical wrestling (reg 4),and exclude particular light‑contact or grappling exhibitions and certain State Sporting Association events from being “contests” (reg 5A). The Commission retains standard regulatory discretions in relation to the adoption of ratings and sanctioning of titles (regs 17-18), including the adoption of ratings from sanctioning or recognised bodies.

Transitional mapping. The instrument preserves prior registrations and registers under the Professional Combat Sports Act 1987 for continuity, converting them into registrations under the Combat Sports Act with the same conditions and periods as applied immediately before commencement (regs 22-26).

These are the core legal building blocks. Each creates costs, entitlements and decision nodes: registration enables participation but requires proof of fitness and payment of fees; medical endorsements limit participation but aim to reduce harm; permits and venue requirements allocate responsibilities to promoters; minimum fees allocate payment obligations; and Commission discretions determine recognition of credentials and titles.

The regulations directly prescribe obligations and entitlements for identifiable categories of persons and entities. Those affected include the following.

Contestants. Anyone seeking to compete in a regulated contest must be registered as a contestant under the Act (reg 6, reg 8). Registrants must provide prescribed medical information, including a medical certificate and serology report (reg 8A), and must maintain and present a contestant record book containing prescribed entries (reg 8C). Contestants must comply with rest periods after knockouts or contests (regs 15-16) and must ensure that contests outside the State are recorded in the contestant record book (reg 17B). A person registered elsewhere may be taken to be registered under the Act where the external law substantially corresponds (reg 6A), so contesting out‑of‑State has mechanisms to reduce duplication.

Industry participants. The regulations prescribe capacities that must be registered as industry participants: promoter, matchmaker, manager, trainer, referee, judge, timekeeper and second (reg 9). Industry participant registration requires specified particulars to be recorded in the register (reg 10; Table) such as identity documents, experience and accreditation. Fees for registration and renewal are prescribed (reg 11; Schedule 3 item 2). Persons registered under a corresponding law outside the State are taken to be registered for most capacities (reg 10A), though the exclusion for promoters is noted in reg 10A.

Promoters. Promoters must apply for and obtain permits to conduct contests, and applications must include specified information on insurance, safety, ticketing and finances (reg 17C). Promoters pay the permit fees set in Schedule 3 item 4 (reg 17E) and must pay minimum fees to officials as set out in Schedule 4 (reg 19). Promoters are therefore the primary payers for both permit and minimum official fee obligations.

Medical practitioners. Approved medical practitioners play multiple roles: providing medical certificates for registration (reg 8A(1)(a)), certifying fitness before contests (reg 14), endorsing contestant record books with non‑participation dates where rest periods apply (reg 15(4)), and determining post‑knockout or other post‑contest restrictions (reg 15(1)(c) and reg 15(2)). The regulations thus allocate clinical judgement about fitness and rest periods to medical practitioners.

Officials. Referees, judges and timekeepers must be registered as industry participants and have particular particulars recorded (reg 9; reg 10). Minimum fees for officials are prescribed in Schedule 4 (reg 19), establishing baseline remuneration that promoters must observe.

The Commission. Referred to in multiple provisions, the Commission has approval and adoption powers: “approved” is a defined term (reg 3), the Commission may adopt or determine ratings (reg 17), and may adopt sanctioning in writing (reg 18). The Commission also oversees registers and issues permits under the Act sections cited throughout the regulations (for example s 44, s 45 as referenced in regs 17C and 17D).

Recognised bodies and sanctioning bodies. The regulations recognise external bodies as potential sources of ratings and sanctions (reg 17; reg 18). Where a contestant or industry participant holds a registration under an external law that “substantially corresponds” with the Act, the person can be treated as registered under the Act (regs 6A, 10A). Conversely, a number of State Sporting Associations and their national/international parent bodies are specifically treated as conducting non‑contests for certain exhibitions (reg 5A(2)), putting them outside the contest regulation regime in prescribed circumstances.

Spectators and venue operators. While not the primary addressees for registration, these parties are affected indirectly because permit applications must include venue layout, emergency access, medical arrangements, security and ticket numbers (reg 17C). Promoters’ compliance obligations therefore impose obligations on venue operators and security/medical providers as part of an event permit.

Persons conducting light contact or grappling exhibitions and certain State Sporting Associations. The regulations expressly exclude specified light contact or grappling exhibitions from being “contests” where they meet listed criteria (reg 5A(1)), and list particular sporting associations for which contests or exhibitions are prescribed not to be contests (reg 5A(2)). These exclusions change who must register and obtain permits.

Who pays and who decides. Payment obligations fall primarily on contestants (registration fees Schedule 3 item 1; duplicate record book fee Schedule 3 item 3), industry participants and promoters (registration fees Schedule 3 item 2; permit fees Schedule 3 item 4; minimum payments Schedule 4). Decision‑making power is vested in the Commission for approvals, ratings and title adoption (regs 3, 17-18), and in approved medical practitioners for fitness and rest‑period endorsements (regs 8A, 14, 15).

This set of obligations and delegations concentrates administrative cost and event‑safety responsibility on promoters and registered participants, delegates clinical determinations to medical practitioners, and leaves recognition and sanctioning subject to Commission discretion.

The regulations set out explicit duties for particular actors and vest discrete rights and discretions in the Commission and medical practitioners. Below are the principal duties and the legal authorities that create them.

Duties of contestants

• Registration and renewal: Contestants must be registered under the Act before participating, subject to the timelines in reg 7. The triennial registration fee is prescribed in Schedule 3 item 1 (reg 8).
• Medical disclosure: Applicants must provide a medical certificate of fitness and serology for HIV, Hepatitis B and C and a detailed history of injuries as prescribed in reg 8A(1)(a)-(c). For persons who have competed outside the Commonwealth, the serology must be within 7 days (reg 8A(2)).
• Record keeping: Contestants must keep a contestant record book containing specified items (reg 8C) and ensure the record of contests contains the details listed in reg 17A. If they compete outside the State they must enter the same information in the record book (reg 17B).
• Compliance with rest periods: After a knockout, specified minimum non‑participation periods apply (30 days; 60 days; 90 days for successive knockouts) or as determined by the medical practitioner (reg 15(1)). A contestant who loses six consecutive contests must pass a medical examination before entering another contest (reg 15(3)). After participating in any contest, a contestant must not take part in another contest for at least 7 days (reg 16(1)).
• Weigh‑in and pre‑contest information: Contestants must submit to weigh‑in and permit the prescribed particulars to be recorded (reg 13).

Duties of industry participants and officials

• Registration: Industry participants in prescribed capacities must register (reg 9; reg 11), supplying the particulars specified in reg 10 and paying the prescribed fee in Schedule 3 item 2.
• Minimum remuneration: Promoters are required to pay officials at least the minimum amounts in Schedule 4 (reg 19(1)), except where an international body specifies a higher fee (reg 19(2)).

Duties of promoters

• Permits: Promoters must apply for permits for contests and include the particulars prescribed in reg 17C, including insurance, security and emergency medical procedures, ticket numbers and contest details. They must pay permit fees set out in Schedule 3 item 4 (reg 17E).
• Payments to officials: Promoters must pay minimum fees to officials as set out in Schedule 4 (reg 19).

Duties of medical practitioners

• Fitness certification: Medical practitioners must certify fitness to compete (reg 14).
• Determination of rest periods and endorsements: Medical practitioners approve extended rest periods after knockouts or other medical terminations and endorse the contestant record book with dates before which the contestant is not to participate (reg 15(2), reg 15(4)).

Rights and discretions of the Commission

• Approval and recognition: “Approved” is a defined term (reg 3) indicating Commission approval powers. The Commission may adopt external ratings or determine its own ratings for contestants (reg 17) and may in writing adopt the sanctioning of a sanctioning or recognised body (reg 18).
• Registers and certificates: The Commission causes particulars to be entered in the registers (reg 6; reg 10) and issues certificates of registration consistent with the Act (regs 22-26 provide transitional treatment).

Regulatory penalties and compliance rights

• The regulations specify fines for failure to observe rest periods and record obligations (reg 15, reg 16, reg 17B). The instrument does not itself create broad criminal sanctions beyond these fines; for other enforcement and adjudicative mechanisms the Act supplies the primary enforcement framework which these regulations supplement by prescribing particulars and amounts.

Prescriptive timelines and thresholds

• Application timing: Residents must apply for registration not later than 5 days before the contest date, and non‑residents before any weigh‑in (reg 7).
• Age thresholds: Minimum ages for registration in specific classes are prescribed (reg 8B). For example, Mixed Martial Arts (Unified Rules) requires age 18; Brazilian Jiu Jitsu, Taekwondo and Wrestling may be registered from age 6.

Rights of persons registered elsewhere

• Persons registered or licensed under an external law substantially corresponding to the Act are taken to be registered under the Act (regs 6A, 10A), giving them a right to be treated as registered without needing duplication subject to the “substantially corresponds” condition.

Information disclosure duties

• Registers and permit applications demand identifiable information including photographs, identity-document details, criminal convictions or disciplinary measures, next of kin and emergency contacts for contestants (reg 6), and detailed contest and venue particulars for permits (reg 17C). The regulations therefore require collection and recording of sensitive personal and medical information.

In sum, the duties allocate administrative, medical and financial responsibilities across contestants, industry participants and promoters, and vest evaluative discretions in medical practitioners and the Commission. The practical effect is a licensing, medical‑gate and permit regime supported by prescribed fees and minimum payments.

The regulations explicitly prescribe monetary penalties for particular breaches and set administrative gatekeeping that is enforced through registration and permit processes. The principal enforcement modalities in the regulations are fines for contravention of specific rules and the administrative refusal or conditioning of registrations and permits (as channels controlled by the Commission under the Act).

Statutory fines specified in the regulations

• Rest periods after knockouts: A fine of $1,000 is prescribed for breach of reg 15(1) where a contestant participates in a contest in contravention of the prescribed non‑participation periods after being knocked out (reg 15(1); penalty stated in the regulation).
• Other medical‑related restrictions: A fine of $1,000 applies where a contestant participates before the period determined by the medical practitioner under reg 15(2) where the contest was terminated because the contestant was judged unable to continue for a reason other than a knockout (reg 15(2); penalty stated).
• Consecutive losses requirement: A fine of $1,000 applies where a contestant who has lost six consecutive contests enters into a contract to participate in a contest without first passing a medical examination by an approved medical practitioner (reg 15(3); penalty stated).
• Post‑contest restriction: A fine of $1,000 is prescribed where a contestant participates in another contest within the minimum 7‑day period after a contest (reg 16(1); penalty stated).
• Failure to record out‑of‑State contests: A fine of $1,000 applies if a registered contestant does not ensure the information prescribed in reg 17A is entered in the contestant record book when participating outside the State (reg 17B).

Administrative enforcement levers

• Registration and permit gating: The Commission may refuse or condition registrations and permits pursuant to the Act; the regulations prescribe the particulars and documentary requirements the Commission may insist on in register entries (reg 6; reg 10) and permit applications (reg 17C). While the regulations do not set out the full enforcement machinery of refusals, their detailed requirements function as pass/fail criteria in the Commission’s administrative decision‑making under the Act as referenced throughout the regulations.
• Payment obligations: Permit fees, registration fees and minimum official fees (Schedule 3; Schedule 4) create enforceable financial obligations that will necessarily be enforced through permit refusal or regulatory action where payment is a statutory precondition for registration or permit issue. The regulations themselves do not specify late‑payment penalties or the processes for recovery; those enforcement processes are governed by the Act and general administrative law.

Delegated enforcement roles

• Medical practitioners: The regulations allocate determinations about fitness and rest periods to medical practitioners (regs 14, 15). A medical practitioner’s endorsement in the contestant record book is a regulatory instrument under the scheme (reg 15(4)). Failure to comply with a medical restriction is a direct contravention attracting a fine (regs 15-16).
• The Commission: The Commission’s approvals and recognition decisions determine whether external ratings and sanctioning can be used (regs 17-18). The Commission’s control over approvals (reg 3 defines “approved”) is an enforcement node: only Commission approved bodies, rules or persons are effective for regulatory compliance.

Scope of penalties and where to look for enforcement powers

• The regulations themselves prescribe only the specific fines cited above. The Act supplies the broader enforcement and penalty framework, including processes for suspension, cancellation and other administrative sanctions, and those authorities are referenced in the regulations (for example sections cited in the reg headings such as s 44, s 45, s 48, s 49, s 52 and s 62 of the Act). Users should consult the Combat Sports Act 1987 for the comprehensive enforcement and adjudicative mechanisms beyond the fines prescribed in the regulations.

Practical consequences of the penalties

• The fines set in the regulations are unitary amounts ($1,000) for several breaches and are therefore a fixed financial cost for offenders. The more significant compliance threat is administrative: failing to meet registration, medical or permit requirements will expose promoters or contestants to being unable to lawfully conduct or participate in a contest, and may have reputational and commercial consequences beyond the monetary penalties.

In short, the regulations use a mix of prescriptive monetary penalties for defined breaches and administrative gatekeeping through registration and permit processes to secure compliance, with medical practitioners and the Commission as key enforcement nodes under the Act.

The regulations are a subordinate instrument made under the Combat Sports Act 1987 and make frequent reference to provisions of that Act. They also recognise and interoperate with comparable laws of other jurisdictions and with national and international sanctioning bodies. The explicit interactions in the text are the following.

Direct references to the Act. The regulations are drafted to implement and specify details referenced in particular sections of the Act. For instance:

• Registration of contestants is linked to sections 14-19 of the Act as reflected in regs 5, 6, 7 and 8A (see reg 5: “for the purposes of section 14”; reg 6: “for the purposes of section 15(2)(c)”).
• Permit requirements relate to sections 44-45 (see regs 17C-17E which cite s 44(2)(c) and s 45(3)(d)).
• Weigh‑in, medical and record obligations refer to s 48, s 49 and s 52 (see regs 13, 14, 17A). These cross‑references mean the legal operation of the regulations is inseparable from the Act itself; for complete enforcement, powers and sanctions under the Act should be consulted.

Recognition of external laws. The regulations expressly provide for recognition of registrations under laws of other places: reg 6A takes a person registered or licensed under an external law that “substantially corresponds with the purpose of the Act” to be registered under the Act as a contestant. Reg 10A provides an analogous treatment for industry participants except promoters. This creates an interaction with interstate, Territory, Commonwealth or foreign legal schemes that are functionally similar. The operational test,“substantially corresponds” referenced in regs 6A and 10A,derives from the Act (the phrase is not elaborated in the regulations), so determinations about equivalence will engage interpretation of both the external law and the Act.

Interaction with national and international sanctioning bodies. The regulations allow the Commission to adopt ratings or sanctioning by sanctioning bodies or recognised bodies (reg 17; reg 18). They also permit minimum fees to be overridden where an approved international body requires specific payments for officials (reg 19(2)). Thus, international regulatory standards can supersede the minimums where they are imposed by the international body and adopted by the Commission. Permit applications require details of any sanctioning bodies and any titles contested (reg 17C(f)), integrating external bodies into permit decisions.

Exclusions and overlap with State Sporting Associations. The regulations expressly exclude particular exhibitions and certain State Sporting Associations from being “contests” for the Act’s purposes (reg 5A(1)-(2)). That creates an interface between this regulatory regime and the internal governance of recognised sporting associations: where an event falls within the exclusion the Act and these regulations do not apply to it as a contest, even if the activity might elsewhere be considered combat sport.

Transitional interaction with predecessor legislation. The regulations contain specific savings and transitional provisions that map registrations and registers under the Professional Combat Sports Act 1987 into registrations under the Combat Sports Act 1987 (regs 20-26). Those provisions preserve continuity of certificates and registers and specify that such registrations continue under the new Act for their existing period and on the same conditions. This is a direct interaction with the earlier legislative framework.

Interpretation Act savings. Reg 21 expressly preserves the application of the Interpretation Act 1984 Part V except where a contrary intention appears. That ensures that standard rules about the operation of subordinate instruments and transitional provisions are maintained.

Privacy and health law interaction (implied). The regulations require sensitive medical information and serology results (reg 8A(1)(b)) and the recording of conviction and disciplinary information in the register (reg 6(c)). While the regulations do not specify privacy protections or information‑sharing rules, these requirements interact in practice with health‑information law and privacy regimes (for example state and Commonwealth privacy and health privacy legislation). The regulations do not elaborate those interactions; practitioners should therefore consult relevant privacy and health statutes and professional obligations when handling serology and medical records.

Criminal and administrative law. The regulations set fines for particular contraventions (regs 15-16, 17B). Broader enforcement mechanisms, suspension or cancellation of registrations, appeals and adjudication processes are governed by the Act and general administrative law. The regulations therefore operate alongside administrative‑law principles applicable to decisions by the Commission and to medical practitioner determinations.

In short, the regulations are designed to operate tightly with the Combat Sports Act 1987, to recognise equivalent external regimes in defined circumstances, and to accommodate external sanctioning bodies and State Sporting Associations in specific ways. They require intersectional attention to privacy, health law and administrative law because of the kinds of information collected and the decision rights delegated to medical practitioners and the Commission.

The regulations have been amended repeatedly since their initial publication to add, remove and refine provisions. The compilation table and marginal notes in the instrument record the following significant changes and insertion dates.

Original instrument and initial commencement

• The Professional Combat Sports Regulations 2004 were published 11 January 2005 and commenced 12 January 2005 (Compilation table). They have since been re‑titled the Combat Sports Regulations 2004 (note under r 1).

2013 amendments (Professional Combat Sports Amendment Regulations 2013)

• Implemented 1 March 2013 for most provisions (r 2). The 2013 amendments made multiple insertions and amendments across the instrument. Notable insertions and changes in 2013 include:
  • Amendment of reg 1 (citation) and changes to commencement provisions (marginal note).
  • Insertions of several provisions and new definitions, including reg 3 amended (definitions), reg 4 inserted prescribing particular activities not to be combat sport (Gazette 22 Feb 2013 p. 1014), reg 5A inserted to prescribe contests not to be contests (Gazette 22 Feb 2013 p. 1015).
  • Recast of registration and register provisions (regs 5, 6, 7, 8) and insertion of Part headings and Schedule adjustments noted in the marginal notes (Gazette references cited throughout the instrument).

2018 amendments (Combat Sports Amendment Regulations 2018)

• Published 9 October 2018 and generally commenced 10 October 2018 (Compilation table).
• Among the changes was the insertion of Division 1 under Schedule 2 dealing with Boxing, kickboxing and Muay Thai weight classes (Schedule 2 Division 1 inserted: Gazette 9 Oct 2018 p. 4035). These changes updated or clarified the many weight division boundaries for those sports.

2019 amendments (Combat Sports Amendment Regulations 2019)

• Published 17 May 2019, with the substantive regulations commencing 1 July 2019 (Compilation table). The 2019 amendment introduced schedule and fee changes and others:
  • Schedule 3 (fees) was inserted or updated on 17 May 2019 (see marginal note to reg 17E citing Gazette 17 May 2019 p. 1436). Schedule 3 sets registration, permit and duplicate record book fees.
  • Reg 10 and reg 17C were amended (Gazette 17 May 2019 p. 1435 referenced in the marginal notes), affecting register particulars and prescribed permit information.

2020 amendments (SL 2020/111)

• Commenced 4 July 2020 (Compilation table). The 2020 amendment added Division 3 to Schedule 2 prescribing Mixed Martial Arts weight classes (Schedule 2 Division 3 inserted: SL 2020/111 r. 7) and amended rest period provisions (regs 15 and 16 amended: SL 2020/111 r. 4 and r. 8). The marginal notes record these insertions and amendments.

Textual insertions and deletions

• The instrument records deletions and replacements in several places (for example reg 5 had a subregulation deleted; other headings and Schedule 1 are noted as deleted in the marginal notes).
• The Notes section summarises the compilation table and identifies the reprint date and the subsequent amendment instruments.

Practical import of amendments

• The amendments have updated the regulatory detail for weight classes in key sports (2018 and 2020 insertions to Schedule 2), updated fee structures (2019 Schedule 3 insertions), clarified register particulars (2013 and 2019), broadened and/or clarified exclusions from the definition of combat sport and contest (2013, regs 4 and 5A), and adjusted rest periods and medical provisions (2020). The marginal annotations show which regulations were amended by which Gazette or Statutory Instrument, enabling line-by-line history tracing.

Caveat on reliance

• This summary is confined to the amendment history as recorded in the compilation table and marginal notes of the provided text. For the authoritative amendment history and commencement particulars of specific subprovisions, users should consult the Government Gazette notices and the consolidated, dated reprint of the regulations.

The regulations, as supplied, do not record litigation, case law or judicial interpretation. There are no cases or litigation references cited within the text of the Combat Sports Regulations 2004 as presented. The instrument contains only statutory provisions, schedules and a compilation table recording its amendment instruments and commencement dates.

What follows from the absence of litigation in the instrument:

• No cases are named or referenced in the regulations themselves; they are silent on judicial interpretation or precedent.
• Any disputes, appeals or judicial challenges to administrative decisions under these regulations would be resolved under the procedural and substantive legal frameworks of the Combat Sports Act 1987 and general administrative law, but such case law is not recorded in this instrument.
• Practitioners seeking precedent on the application, scope or enforcement of these regulations will need to search databases of Western Australian tribunals and courts for decisions referring to the Combat Sports Act 1987 and these regulations, because the regulations do not contain cross‑references to judicial determinations.

For on‑the‑ground issues (for example, disputes over whether an external registration “substantially corresponds” with the Act, or whether a particular exhibition falls within the reg 5A exclusion), there may be administrative decisions or judicial review applications which interpret the statutory language. Those authorities are not reproduced in the regulations and must be sourced externally.

In short, the regulations supply the prescriptive statutory framework; they do not, in themselves, contain litigation or case law. Any legal practitioners or researchers requiring adjudicated interpretations should consult court and tribunal records and decisions that apply the Combat Sports Act 1987 and these regulations.

The regulations have several features that commonly cause compliance friction or practical uncertainty. Below are concrete items to watch for, each grounded in the instrument’s text.

1. Serology requirements and timing

• Reg 8A(1)(b) requires a serology report for HIV, Hepatitis B and Hepatitis C as part of registration. Reg 8A(2) tightens this for persons who have been contestants overseas: the serology must be prepared within 7 days before the date of the application. That 7‑day window is very narrow and may be operationally difficult for overseas competitors arriving shortly before an event.

2. Age thresholds that allow very young contestants

• The regulations permit registration of contestants as young as 6 years for Brazilian Jiu Jitsu, Taekwondo and Wrestling (reg 8B(a)-(c)). Practitioners should note that the regulatory scheme contemplates child participants in particular classes, and that parental consent, child‑protection and other statutory obligations may be implicated outside the regulations themselves.

3. Exclusions that may be surprising

• Reg 4 prescribes certain combat sports not to be “combat sport” (for example fencing and paintball) and reg 5A(1) excludes light contact or grappling exhibitions that keep no score and have no outcome. Reg 5A(2) designates particular State Sporting Associations and their parent bodies so that events they run as described are not “contests”. A promoter or participant who assumes the Act applies to every fighting spectacle may be mistaken; conversely, assuming an event is excluded without checking the precise criteria set out in reg 5A can be legally risky.

4. Ambiguous drafting: “triennial annual registration”

• Reg 11 uses the phrase “triennial annual registration” when prescribing industry participant registration fees. The instrument elsewhere and in reg 8 uses “triennial” for contestants. This textual inconsistency may cause disputes about whether industry participant registrations are triennial or annual and how pro‑rata renewals should operate. Practitioners should seek clarification from the Commission or rely on the Act’s text and any published administrative policy to resolve the periodicity.

5. Minimum fees versus permit/fee schedule disparities

• Schedule 3 prescribes modest registration and permit fees (for example, promoter registration $334.50 in Schedule 3 item 2(a); permit fees in item 4 for small events at $100). Schedule 4 prescribes minimum fees for officials (for example referees $200-$350 depending on contest). Promoters must budget both sets of costs: permit fees, registration fees and the minimum payments to officials. Low permit fees for small events may not reflect the aggregate cost once officials’ minimums and medical services are included.

6. Out‑of‑State registrations “taken to be registered”

• Regs 6A and 10A treat persons registered under foreign or other State laws as registered under the Act when the external law “substantially corresponds with the purpose of the Act.” The instrument does not define “substantially corresponds” further; therefore, there may be uncertainty about whether a particular overseas licence fits the test, and about who makes that determination (the Commission under the Act). This can create practical uncertainty for interstate or international touring participants.

7. Medical confidentiality omitted from the regs

• The regulations require sensitive medical information (serology results, medical certificates, injury histories in reg 8A and reg 6(f)). The instrument does not set out data‑handling standards or confidentiality protocols for that health data. That leaves operators to observe separate privacy, health records and professional obligations outside the regulations, which creates a compliance coordination task.

8. Penalty amounts are fixed and modest relative to industry risk

• The prescribed fines for contraventions in regs 15, 16 and 17B are $1,000. While not trivial, these fixed amounts may not reflect the full commercial or reputational risk of non‑compliance (for example a promoter running an event despite medical restrictions or a repeat serious injury incident). Users should consider administrative and civil liability risks beyond these fines.

9. Contest types and permitted rules need Commission approval

• Reg 17D(c) requires that the rules approved under s 62A(1) of the Act be stated for the contest permit. As the Commission may approve or adopt rules and sanctioning, promoters must ensure the rules governing an event are approved; otherwise a permit may be refused.

10. Record obligations for out‑of‑State contests

• Reg 17B imposes an affirmative duty on a registered contestant who participates outside the State to ensure the prescribed contest information is entered in their contestant record book, with a fine for non‑compliance. That duty may impose an administrative burden on travelling contestants and on promoters running out‑of‑State events.

These are not abstract risks; they are concrete operational points directly traceable to the text. Addressing them requires practical coordination among promoters, medical practitioners, registrars and contestants before events, and prudent budgeting for fees, medical services and official payments.

Below is a practical compliance checklist, sequenced so that a promoter, contest organiser or participant can follow it against the regulations. Each step cites the controlling regulation or schedule.

1. Determine whether the event is a “contest” subject to the Act

• Check reg 4 and reg 5A for exclusions. If the event is light contact or grappling with no scores, no outcome, or is an event covered by one of the State Sporting Associations listed in reg 5A(2), it may not be a “contest” under the Act.

2. Verify contestant class and eligibility

• Identify the appropriate class in Schedule 2 (e.g. Boxing, Kickboxing and Muay Thai classes; Brazilian Jiu Jitsu and full contact karate classes; Mixed Martial Arts divisions) and confirm the contestant meets the minimum age for that class under reg 8B.

3. Registration of contestants and industry participants

• Contestants: Apply for registration under s 16 of the Act and comply with timing requirements in reg 7: residents must apply at least 5 days before the proposed contest; non‑residents must apply before any weigh‑in. Pay the triennial registration fee in Schedule 3 item 1 (reg 8).
• Industry participants: Identify capacities under reg 9 and provide the particulars specified in reg 10 (proof of identity, experience, qualifications, accreditation and application form particulars) and pay the fee in Schedule 3 item 2 (reg 11).

4. Medical documentation and fitness certification

• Obtain a medical certificate of fitness completed by a medical practitioner within 12 months of the application and a serology report for HIV, Hepatitis B and Hepatitis C as required by reg 8A(1)(a)-(b). If the contestant has been a contestant outside the Commonwealth, ensure the serology is within 7 days (reg 8A(2)).
• Ensure pre‑contest medical certification by an approved medical practitioner under reg 14: the practitioner must certify fitness to compete and, if not fit, specify a date before which the person should not spar or contest.

5. Maintain and produce contestant record book and registers

• Ensure the contestant record book contains name, weight, details of medical exams and serology, and win/loss/titles as required by reg 8C.
• Provide to the Commission the particulars to be entered into the register per reg 6, including contest history, injuries, previous registrations or licences, convictions/disciplinary measures, photograph, identity details, medical information, and next of kin.

6. Apply for a permit to conduct the contest

• Promoters must apply with the prescribed information in reg 17C: applicant and promoter contact details, weigh‑in dates and venues, matchmaker details, insurance, security, emergency medical procedures, financial details including entry prices and rewards or prizes, the proposed number of tickets (reg 17C(ea)), contestant details, officials and their qualifications, medical practitioner details, comprehensive venue layout and emergency access, and details of any entertainment.
• Ensure the permit states the prescribed matters in reg 17D (promoter contact, contest type, approved rules, any sanctioned title and the names of industry participants approved as referees/judges/timekeepers).
• Pay the permit fee in Schedule 3 item 4 according to proposed ticket numbers (reg 17E).

7. Officials’ engagement and payments

• Engage referees, judges and timekeepers who are registered industry participants with particulars recorded per reg 10.
• Pay officials at least the minimum fees set in Schedule 4; if the contest is for an international title sanctioned by an approved international body that prescribes higher fees, then pay the higher specified fee (reg 19(2)).

8. Pre‑contest weigh‑in and record entries

• At weigh‑in record the prescribed information under reg 13 (date and venue, contestant’s weight, opponent, rules, number and length of rounds) and ensure entries are made in contestants’ record books and in the register as required.

9. Observe rest periods and medical endorsements

• If a contestant is knocked out, ensure the contestant does not participate for at least the minimum periods in reg 15(1) (30, 60, 90 days depending on consecutive knockouts) unless a medical practitioner determines a longer or different period; obtain a medical practitioner’s endorsement in the record book under reg 15(4).
• Ensure contestants do not participate in another contest within 7 days of any contest (reg 16(1)).
• For contest terminations other than knockouts, observe the period determined by the medical practitioner (reg 15(2)).

10. Recording contests and out‑of‑State participation

• Maintain the record of contest with the details prescribed in reg 17A and enter the details in the contestant record book for out‑of‑State contests as required by reg 17B.

11. Data privacy and handling

• The regulations require collection of medical and identity information (regs 6, 8A). Ensure compliance with applicable privacy and health record laws when holding serology results and medical histories, even though the regulations do not set out privacy obligations themselves.

12. Transitional matters for existing registrations

• If the contestant or industry participant was registered under the PCS Act immediately before commencement day, note that reg 22-26 preserve those registrations and certificates as registrations under the Combat Sports Act for their remaining period and on the same conditions.

13. Seek Commission approval where necessary

• If relying on a rating or title from a sanctioning or recognised body, confirm whether the Commission has adopted that rating or sanctioning under regs 17-18. Obtain Commission approval for any deviations from standard rules or use of non‑standard contest rules (reg 17D(c) and s 62A(1) references).

14. Budget for fees and contingencies

• Budget for registration fees (Schedule 3 items 1-3), permit fees (Schedule 3 item 4), and minimum official fees (Schedule 4). Factor in medical costs, insurance and potential fines for non‑compliance.

15. Record retention and proof of compliance

• Keep copies of all permits, medical certificates, serology reports, contestant record book entries, register entries and payment receipts to demonstrate compliance if questioned by the Commission or inspectors.

Following the above steps aligns the organiser, industry participants and contestants with the explicit obligations set out in the regulations. Where a regulation is ambiguous (for example, the “triennial annual” phrase in reg 11 or the interpretation of “substantially corresponds” in regs 6A/10A), seek administrative clarification from the Commission and consider obtaining written confirmation for non‑routine cases.
