What it does
This Ordinance designates a defined area of waters around the Cocos (Keeling) Islands as "partially smooth waters" for the purpose of the National Standard for Commercial Vessels, thereby changing how those waters are categorised for the operation of domestic commercial vessels. Mechanically, the change is effected by section 4, which states the object is "to designate waters for the purposes of the definition of partially smooth waters in the Dictionary in Part B of the National Standard for Commercial Vessels as defined in section 6 of Schedule 1 to the Marine Safety (Domestic Commercial Vessel) National Law Act 2012" (s 4(1)). Section 4(2) then expressly designates "the waters within the area described in Schedule 1" as partially smooth waters.
The Ordinance does not itself set operational rules, standards, offences or penalties for vessels; rather it alters the statutory classification of the waters so that the relevant provisions of the National Standard and the Marine Safety (Domestic Commercial Vessel) National Law Act 2012 will apply to vessel operations within the designated area (s 4(1) and the accompanying note). The area is defined textually in Schedule 1 by a sequence of geographical points and routes between them. The Schedule specifies that the area description is by reference to the World Geodetic System 1984 datum (s 4(3)), and describes the boundary as a line starting at a particular point and running sequentially through the listed items (Schedule 1 introductory paragraph).
The Ordinance was made under the Cocos (Keeling) Islands Act 1955 (s 3). It was made on 27 September 2018 (preamble) and the commencement provision in section 2(1) sets commencement as "the day after this Ordinance is registered", with the table specifying the day after registration as 4 October 2018 for the whole of the Ordinance (s 2(1) and the commencement table). The Schedule includes a technical note defining "loxodrome" (a line of constant bearing, intersecting all meridians at the same oblique angle), and explains how it appears on Mercator-projection hydrographic charts.
