Coastal Trading (Revitalising Australian Shipping) Regulations 2022

The regulations operate through a small number of tightly scoped legal concepts that modify or supplement the Act. These concepts determine procedural content for licence applications, define a statutory trigger tied to energy security, and set fees for administrative processing.

Dangerous goods: The regulations adopt the International Maritime Dangerous Goods Code as their definitional source, "as in force at the commencement of this instrument" (reg 5). The effect is to import an external technical classification into the Act's framework and to freeze the applicable edition at the commencement date of these regulations rather than dynamically tying it to later editions. That definitional link matters where an application must state whether cargo will contain dangerous goods (reg 7).

Energy security situation / special circumstances: Reg 6 prescribes the "special circumstances" relevant to paragraph 6(1A)(c) of the Act. The concept is not an open-ended discretion; it is articulated as a conjunctive three-part test: (1) an actual or likely shortfall in liquid fuel supply; (2) the shortfall stems from enumerated unforeseen events (partial or total refinery shutdown; supply failure of gas/electricity/water/steam to refinery or terminal; shortfall from overseas; unsuitable fuel; or severe weather event); and (3) that the shortfall is having, or likely to have, an adverse impact on consumers, the national economy or regional development (reg 6). The provision therefore operationalises a narrowly framed exception allowing temporary licence authorisations that would otherwise be limited by port authorisations.

Temporary licence application content: For temporary licence applications where cargo will be carried, reg 7 prescribes two specific informational items: whether the cargo will contain dangerous goods, and how the cargo will be transported (e.g. bulk, containers, food-grade holds). These requirements focus the applicant’s disclosure on safety and handling modalities.

Emergency licence qualifying emergency: Reg 8 prescribes the type of emergency relevant to subparagraph 64(2)(b)(i) of the Act as an emergency involving severe weather conditions or a natural disaster that both endangers life/property/environment and requires a significant and coordinated response. The regulation supplies examples (cyclone, thunderstorm, flood, earthquake, volcanic eruption) but frames them as illustrative.

Fees: Reg 9 sets the exact monetary amounts payable on application for the various licences or variations identified. The fees are fixed amounts in Australian dollars and tied to specific Act provisions (s 13, s 28, s 43, s 51, s 64) according to the reg 9 table.

Repeal: Schedule 1 gives full repeal effect to the 2012 regulations, so the 2022 instrument is the operative regulation replacing the earlier instrument in its entirety.

Collectively, these concepts narrow certain decision triggers, standardise some application information, and set the administrative charging schedule for applicants. The regulations do not themselves create licence types or decision-making powers; those reside in the Act and the regulations operate by prescribing details for the Act’s operations (reg 3).

The primary, direct actors affected by the regulations are applicants for the licences created by the Act and the administrative apparatus that processes those applications. The regulations specify application content (reg 7), fee liabilities (reg 9), and qualifying circumstances for temporary licence exceptions and emergency licences (reg 6 and reg 8), so applicants for general licences, temporary licences, variations of temporary licences and emergency licences are the payers and information-providers whose conduct is governed.

Specifically:

• Prospective licence applicants: Anyone applying under the Act for a general licence (s 13), a temporary licence (s 28), a variation of a temporary licence or a variation of a matter authorised by a temporary licence (ss 43 and 51), or an emergency licence (s 64) must pay the fees listed in reg 9 and, for temporary licences, provide the information required by reg 7. The regulation explicitly attaches an application fee to each of these application types and prescribes which particulars must be supplied where cargo is expected (reg 7 and reg 9 table).
• Operators moving liquid fuel product: Reg 6 affects vessels and operators seeking to load or unload liquid fuel product at ports not authorised by a temporary licence when an energy security situation exists as defined by reg 6. The availability of that exception is conditioned on a demonstrable shortfall caused by one of the enumerated unforeseen events and an adverse impact on consumers, the national economy or regional development (reg 6). Operators relying on temporary licences to deal with ports not otherwise authorised must satisfy those three conjunctive elements when making or relying on a temporary licence application or authorisation.
• Administrators/decision-makers under the Act: The Minister, delegated decision-makers and administrative staff will apply the prescribed content and definitions when assessing applications. The instrument was made under the authority of the Act (reg 3), so licence decision-making remains a function under the Act, but administrators must apply the prescribed criteria and recordkeeping content required by these regulations (reg 7, reg 8, reg 9).
• Safety and logistics planners: The adoption of the International Maritime Dangerous Goods Code (reg 5) imposes a particular safety standard for identification and handling of dangerous cargo. Those responsible for stowage, handling and transport must apply the version of the Code in force at commencement; consequently, shipping companies, stevedores and ports implicated in carriage of dangerous goods must align their documentation and declared cargo particulars with the Code version referenced in these regulations.
• Parties affected by the repeal: Any party operating under the previous Regulatory instrument (Coastal Trading (Revitalising Australian Shipping) Regulation 2012) must now comply with the 2022 regulations because Schedule 1 repeals the 2012 instrument in full. That affects transitional administrative practice and any standing processes that were structured around the prior instrument.

Indirectly, consumers, regional businesses and the national economy are referenced as potential objects of protection by the energy security special circumstances (reg 6), because those interests are the statutory touchstones that must be shown to be adversely affected (or likely to be) for the temporary-licence port exception to apply. The regulations therefore attach legal significance to impacts on these broader groups in the energy security context.

The regulations do not set out enforcement officers, penalty regimes or criminal offences; those matters are addressed by the Act. The effect is that regulated parties must look to the Act for sanctioning mechanisms, while these regulations determine the information, fee and definitional contours that give effect to licensing practice.

The regulations are largely prescriptive about what applicants must supply and what circumstances qualify for specified licence-related relief. They create procedural duties on applicants, and import definitional rights and constraints.

Duties imposed on applicants:

• Provide prescribed particulars for temporary licence applications where cargo will be carried: applicants must declare whether the cargo will contain dangerous goods and state how the cargo is expected to be transported (reg 7). This duty is explicit and limited to the two items when cargo is expected. The obligation is tied to paragraph 28(2)(h) of the Act as the point of application. The regulation gives an illustrative example that includes bulk, containers or food-grade holds, but the duty remains to state the modes of transport expected.
• Pay application fees: reg 9 prescribes fixed fees for specific types of applications. Applicants must pay $110 for a general licence (s 13), $400 for a temporary licence (s 28), $200 for a variation of a matter authorised by a temporary licence (s 43), $400 for a variation of a temporary licence (s 51), and $400 for an emergency licence (s 64). The duty to pay the specified amounts attaches to the application process for those identified sections of the Act.
• Where the applicant seeks relief under the energy security exception, satisfy the statutory test: to rely on paragraph 6(1A)(c) of the Act (as operationalised by reg 6), the applicant (or decision-maker) must be able to demonstrate (a) that there is, or likely will be, a shortfall in liquid fuel product; (b) that the shortfall results from one or more of the enumerated unforeseen events; and (c) that the shortfall is having, or likely to have, an adverse impact on consumers, the national economy or regional development (reg 6).

Rights and definitional entitlements:

• Right to apply for licences and variations: The regulations confirm the availability of application pathways by providing the content and fees for applications under the Act’s licence provisions (reg 9). The right to submit an application under the Act remains, and the regulations prescribe the technical requirements for those applications.
• Right to rely on prescribed emergency definition: An applicant seeking an emergency licence under s 64 of the Act has the benefit of reg 8 providing an explicit, two-limb definition of the kind of emergency that qualifies: severe weather or natural disaster that (a) endangers life/property/environment, and (b) requires a significant and coordinated response. This gives applicants and decision-makers aligned criteria for qualifying emergencies.
• Right to a settled dangerous-goods standard: By adopting the IMDG Code "as in force at the commencement of this instrument" (reg 5), regulated parties have certainty about which technical standard applies, rather than leaving the definition dependent on a moving target. That is a substantive definitional right that sets expectations for classification and declaration obligations.

Constraints and limitations:

• The regulations themselves do not grant discretion to alter fees, define additional emergencies, or change the Act’s substantive licence powers. They are executed "under the Coastal Trading (Revitalising Australian Shipping) Act 2012" (reg 3), so duties and rights are constrained by the Act’s delegated framework.
• The energy security special circumstances are conjunctive and narrowly specified (reg 6). The right to load/unload at an unauthorised port under a temporary licence is limited to situations that satisfy all three parts of reg 6’s test.

Procedural notes:

• Commencement rules: the instrument commenced on the day after registration (reg 2), recorded as 9 August 2022, so the prescribed duties and fees were in effect from that date.
• Repeal effect: Schedule 1 displaces the 2012 regulations entirely. Any pre-existing administrative practices tied to the repealed instrument are superseded as a matter of instrument law.

The regulations therefore allocate duties to applicants (information, payments) and provide limited, prescriptive rights to rely on defined emergency and energy-security triggers, within the scope authorised by the Act.

The regulations do not themselves create criminal offences, penalties or explicit enforcement mechanisms. They are an enabling, prescriptive instrument made under the Coastal Trading (Revitalising Australian Shipping) Act 2012 (reg 3), setting application content, definitions and fees. Enforcement and penalties remain matters for the parent Act rather than these regulations.

What the instrument does reveal about enforcement-related mechanics is indirect:

• Fee liability: reg 9 prescribes specific amounts for application fees for the licences and variations identified. The practical enforcement of that liability will be administrative: applications submitted without payment would presumably be processed under the Act’s application handling rules, but the regulations do not set procedural consequences for non-payment. The obligation to pay is therefore a statutory precondition embedded in the regulations, but the instrument does not specify sanctions for non-payment.
• Information requirements and compliance risk: reg 7 requires prescribed particulars for temporary licence applications, specifically whether cargo will contain dangerous goods and how cargo will be transported. Failure to provide required information may affect the administrative acceptance of an application or the exercise of licensing powers under the Act, but the instrument does not specify the consequences or sanctions; those are left to the Act’s decision-making and enforcement provisions.
• Qualifying tests for exceptions: reg 6 and reg 8 set the factual tests for special circumstances and qualifying emergencies. Administrative decision-makers will need to apply these tests in the exercise of powers under the Act. Disputed factual findings about whether the conjunctive criteria in reg 6 or the two-limb requirement in reg 8 are met would be matters for administrative review or judicial challenge under the Act’s review and appeals framework, although neither review procedures nor penalties are stated in these regulations.

The instrument therefore leaves enforcement architecture to the Act. Practically, that means:

• Administrators must apply the regulations when making licensing decisions and may refuse or limit licences under the Act if applicants fail to meet information or fee requirements. The regulations do not detail how refusals are to be communicated or appealed.
• Any sanctions (penal consequences, civil penalties, enforcement notices) would need to be found in the Act; the regulations do not create a new sanctioning regime.

For practitioners, the key compliance and enforcement takeaway is that the regulations set precise preconditions (information and fee payment) and definitional gates (dangerous goods as per the IMDG Code, energy security tests, emergency definition), while the Act supplies the enforcement stick. Where the regulations create mandatory content or fixed fees, failure to comply will affect the administrative viability of an application and could influence licensing outcomes, but the specific penalty mechanisms and enforcement procedures must be located in the Act itself.

The regulations explicitly interface with a small number of legal instruments and statutory provisions.

Primary statutory interfacing:

• The Coastal Trading (Revitalising Australian Shipping) Act 2012: The regulations are made under the Act (reg 3) and repeatedly reference particular provisions of the Act when prescribing application content, fees and qualifying circumstances. For example, reg 7 addresses paragraph 28(2)(h) of the Act by specifying the information required for a temporary licence application; reg 8 prescribes the kind of emergency for the purposes of subparagraph 64(2)(b)(i) of the Act; reg 6 prescribes the special circumstances for paragraph 6(1A)(c) of the Act. The regulations therefore operate as subordinate law that gives content to specific decision criteria and application processes the Act establishes.
• Repeal of prior regulations: Schedule 1 repeals the Coastal Trading (Revitalising Australian Shipping) Regulation 2012 in full. The 2022 instrument replaces the 2012 regulatory regime and so is intended to operate in place of it. The instrument does not contain transitional provisions or savings clauses within itself; it effects a straight repeal and substitution.

External technical standard:

• International Maritime Dangerous Goods (IMDG) Code: The regulations adopt the IMDG Code’s definition of "dangerous goods" as it stood "at the commencement of this instrument" (reg 5). This imports an external international standard into the domestic regulatory scheme and fixes the applicable edition at commencement, creating an interaction between domestic administrative law and an international technical code. The effect is that domestic compliance for dangerous goods classification and declarations will be measured against the IMDG Code version fixed at the regulations' commencement rather than a version that updates automatically.

Administrative and statutory procedure:

• Licence provisions in the Act: The regulations do not recreate or displace Act licence types, applications or powers. Instead, they interact with the Act by prescribing particulars required under specified Act paragraphs and by setting application fees tied to particular Act sections (s 13, s 28, s 43, s 51, s 64 as listed in reg 9). The interplay is therefore one of specification: the Act sets the legal powers and decision frameworks; the regulations fill in the details (information, fees, definitional tests).

Absence of express cross-references to other Acts or delegated instruments:

• The instrument does not reference other Commonwealth statutes, state or territory laws, or other delegated instruments beyond the IMDG Code and the parent Act. Any interplay with maritime safety legislation, customs, quarantine, environmental or state port regulations is not addressed in the regulations themselves and would be a matter of operational coordination outside the instrument’s text.

Practical consequences of these interactions:

• Freezing the IMDG Code at commencement means that updates to the Code post-commencement will not automatically alter the domestic definition of "dangerous goods" for the purposes of the Act unless the regulations are later amended. That may create a divergence between current international practice and the domestic legal standard.
• The regulations’ prescribed tests for energy security and emergency licence types constrain how administrators under the Act will assess applications with those categories in issue. Any inconsistent or additional requirements in other regulatory regimes (e.g. environmental approvals, port safety rules) remain separate obligations; the regulations do not displace those regimes.

In sum, the instrument is narrowly focused and its primary legal interaction is downward with the parent Act and laterally with an identified international technical code. It repeals and replaces the prior 2012 regulations but does not reach beyond that parameter to create cross-cutting interactions with other Commonwealth legislation within its text.

This instrument is itself an amending and replacement instrument in the sense that it repeals and supersedes the previous Coastal Trading (Revitalising Australian Shipping) Regulation 2012 in full (Schedule 1). The text of the instrument records the following temporal and amendment facts.

Commencement:

• Reg 2 sets out the commencement mechanics. The table in reg 2 records that "The whole of this instrument" commences "the day after this instrument is registered" and records the commencement date as 9 August 2022. Reg 2(2) further clarifies that any information in column 3 of the table is not part of the instrument and may be edited in published versions without being part of the instrument itself. The instrument therefore came into legal effect on the date shown.

Repeal of prior instrument:

• Schedule 1 contains a single item: the whole of the Coastal Trading (Revitalising Australian Shipping) Regulation 2012 is repealed. The Schedule gives a clear, complete repeal; there are no savings clauses or transitional provisions included in the 2022 instrument text.

Statutory basis:

• Reg 3 states the instrument is made under the Coastal Trading (Revitalising Australian Shipping) Act 2012. The instrument therefore exercises delegated legislative power under that Act. No amending instruments or subsequent amendments to these regulations are recorded in the text provided.

No other amendments recorded:

• The regulations do not themselves contain amendments to other Commonwealth Acts or instruments beyond the repeal noted in Schedule 1. The instrument prescribes definitions, application particulars and fees, but does not purport to amend schedules to the Act or other statutory instruments.

Versioning implications:

• The instrument explicitly freezes the version of the IMDG Code applied to "dangerous goods" at the instrument’s commencement (reg 5). That functionally links the regulations' continued operation to that fixed edition absent later regulatory amendment.
• Because the 2012 regulations are repealed entirely with no transitional provisions, any matters that relied on transitional arrangements under the 2012 instrument would need to be managed administratively or by amendment of the Act or regulations; the 2022 instrument itself does not supply transitional mechanisms.

For legal researchers and practitioners, the amendment history within the instrument is succinct: effective 9 August 2022, this regulation replaced the 2012 regulation in full and set the current requirements and fees. The instrument does not document any subsequent amendments or version changes beyond its own commencement and repeal action.

The Coastal Trading (Revitalising Australian Shipping) Regulations 2022 contain no recorded litigation history, judicial interpretations, or citations to decisions within their text. The instrument does not name any cases and includes no references to prior litigation. As subordinate legislation, the regulations are a rule-making instrument that prescribes content under the parent Act; any litigation that would engage these regulations would arise after their operation in the context of decisions made under the Act.

Potential litigation touchpoints that the text itself makes visible are limited to interpretive or administrative review disputes arising from the regulations' prescriptions:

• Interpretation of conjunctive tests in reg 6: Reg 6’s three-part specification of special circumstances for an energy security situation (shortfall, enumerated unforeseen causes, adverse impact on consumers/national economy/regional development) uses qualitative terms such as "shortfall", "likely", "unforeseen events", and "adverse impact". Those terms may be subject to factual and normative contest in any administrative review or judicial review proceedings challenging a decision to grant or refuse a temporary licence that relies on paragraph 6(1A)(c) of the Act as operationalised by reg 6.
• The IMDG Code reference in reg 5: Because reg 5 adopts the IMDG Code "as in force at the commencement of this instrument", disputes could arise about which edition applied at commencement (e.g. exact date/version), or whether a cargo declaration complied with that edition. That is a narrow technical question but one that could generate evidentiary litigation in a contested administrative decision.
• Qualification of emergencies in reg 8: Reg 8 prescribes the kind of emergency for emergency licences as involving severe weather or natural disaster that both endangers life/property/environment and requires "a significant and coordinated response". The dual-limb requirement and the undefined term "significant and coordinated response" could be subject to legal contest in decisions about emergency licence eligibility.
• Procedural compliance: Reg 7 prescribes required particulars for temporary licence applications (dangerous goods status and transport mode). Litigation could arise if an application is rejected or a licence withdrawn on the basis of missing or allegedly false particulars, particularly where administrative decisions rest on the presence or absence of such particulars.

The instrument itself contains no litigation record or reports of judicial decisions, and the public text here does not evidence any past contentious litigation. Any future litigation would be rooted in (1) administrative action under the Act that relies on these regulations, or (2) disputes about the correct application of the IMDG Code version frozen by reg 5. The regulations supply the textual bases for such disputes but do not themselves adjudicate them.

In short, there is no litigation history recorded in the instrument; the potential points of dispute flow from the interpretive and factual assessments that administrators must make when applying the regs in licence decisions under the Act.

Several technical features and drafting choices in the regulations present practical pitfalls for applicants, administrators and other stakeholders. These are concrete compliance and interpretation risks directly traceable to the instrument’s text.

IMDG Code version frozen at commencement (reg 5)

• The instrument defines "dangerous goods" by reference to the International Maritime Dangerous Goods Code "as in force at the commencement of this instrument". That freezing means subsequent updates to the IMDG Code will not automatically alter the statutory definition. Practitioners should confirm which edition applied on 9 August 2022 and ensure cargo declarations align with that edition. Failure to declare goods correctly under that fixed standard may lead to administrative complications.

Conjunctive three-part test for energy security situations (reg 6)

• Reg 6 requires all three elements to be satisfied to invoke paragraph 6(1A)(c) of the Act. Practically, an applicant must substantiate: the existence or likelihood of a shortfall in liquid fuel product; the shortfall results from one or more enumerated unforeseen events (five categories listed); and that the shortfall is having, or likely to have, an adverse impact on consumers, the national economy or regional development. Administrative decisions will turn on both causal attribution ("result of one or more of the following unforeseen events") and impact assessment ("adverse impact, or is likely to have an adverse impact"). There is a risk that applicants misread the provision as a safety-valve requiring only a single element; the text is conjunctive and requires documentation for each limb.

Narrowly enumerated causes (reg 6(b))

• The enumerated causes are specific: partial/total refinery shutdown; failure of gas/electricity/water/steam supply to refinery or terminal; shortfall in supply from overseas; fuel unsuitable for use; severe weather event. If an actual shortfall stems from a cause not listed, reg 6 does not apply. Applicants should not assume regulatory scope beyond the enumerated causes.

Impact categories limited and phrase-sensitive (reg 6(c))

• The adverse impact categories are limited to "interests of consumers", "the national economy" and "regional development". Parties must frame impact evidence within those categories. Broader or different impacts may not satisfy reg 6(c) even if they are significant.

Emergency licence definition requires two limbs (reg 8)

• Reg 8 is a two-limb test: (a) endangerment to life/property/environment caused by severe weather/natural disaster, and (b) the emergency "requires a significant and coordinated response". Both must be present. The subjective element "significant and coordinated response" could be a point of administrative uncertainty; applicants should collate evidence of official response actions to support claims.

Fees are fixed nominal amounts (reg 9)

• The fees for applications and variations are fixed amounts (e.g. $400 for temporary licences or emergency licences). The regulation does not state whether fees are refundable, nor does it specify when payment is due relative to application lodgement. Practitioners should take notice of the exact amounts and ensure payment procedures align with the administering agency’s practice; absence of a payment may affect acceptance. There is also no explicit indexing mechanism in the text, so fees may remain static until the regulations are amended.

Repeal with no transitional clauses (Schedule 1)

• The instrument repeals the 2012 regulations entirely. There are no transitional provisions in the instrument text. If the 2012 regulations contained transitional arrangements relied on by parties, there is no express saving or transitional regime here; administrators will have to manage any legacy matters by reference to the Act or separate administrative practice.

Notes and non-binding explanatory text (reg 2(2), notes)

• Reg 2(2) explicitly states that column 3 of the commencement table is not part of the instrument and may be edited in published versions. Users relying on published online versions should be careful to distinguish between the instrument's operative text and ancillary publication notes.

Limited scope of prescribed application particulars (reg 7)

• Reg 7 prescribes only two particulars when cargo is expected: dangerous goods status and expected transport method. If an applicant omits other information that decision-makers expect, the application could be delayed. Applicants should treat reg 7 as minimum content and consult procedural guidance under the Act or from the administering agency for other expected supporting material.

No enforcement text in the regulations

• Because the regulations do not specify sanctions, deadlines, or procedural consequences for breaches, parties must look to the Act for enforcement mechanisms. Assuming the regulations themselves create standalone penalty provisions would be incorrect.

These "gotchas" are concrete, textual features of the instrument. Addressing them requires practitioners to verify the IMDG Code version, prepare evidence for conjunctive tests in reg 6, ensure fee payment, and treat reg 7’s particulars as minimum requirements while seeking administrative guidance on procedural expectations.

Compliance with these regulations requires attention to three practical pillars: (1) provide the prescribed information when lodging applications; (2) pay the prescribed fees for the specified application types; and (3) where relying on energy security or emergency exceptions, assemble evidence that meets the conjunctive tests the regulations prescribe.

1. Confirm operative instrument and commencement

• The regulations commenced on the day after registration, recorded as 9 August 2022 (reg 2). Ensure that any application or conduct dated on or after that date complies with the 2022 regulations rather than the repealed 2012 instrument (Schedule 1).

2. Meet information obligations for temporary licence applications (reg 7)

• When lodging an application for a temporary licence under s 28 of the Act, include the prescribed particulars if cargo is expected:
  • State whether the cargo will contain dangerous goods, consistent with the IMDG Code as adopted by reg 5 (see next step).
  • Describe how the cargo is expected to be transported (e.g. bulk, containers, food-grade holds). Use the terminology of reg 7 and the Act when completing application forms.
• Treat reg 7 as the minimum required particulars. While reg 7 prescribes only two items, administrative decision-makers may require additional documentation or operational details under the Act; consult the administering agency’s application guidance to avoid omissions that could delay processing.

3. Apply the correct dangerous-goods classification (reg 5)

• Use the International Maritime Dangerous Goods Code as it stood on the instrument’s commencement date. Verify which edition of the IMDG Code was in force on 9 August 2022 and classify cargo accordingly. Maintain documentary evidence linking your classification to that edition should a compliance check or dispute arise.

4. Prepare for energy security exceptions with documentary evidence (reg 6)

• If relying on paragraph 6(1A)(c) of the Act to permit loading or unloading at a port not authorised by a temporary licence, assemble evidence for each limb of reg 6:
  • Demonstrate the existence or likelihood of a shortfall in liquid fuel product (reg 6(a)).
  • Show causal linkage to one or more of the listed unforeseen events (reg 6(b)(i)-(v)). Provide technical/operational records (e.g. refinery shutdown notices, supply chain disruption notices, meteorological reports).
  • Document the actual or likely adverse impact on consumers, the national economy or regional development (reg 6(c)). Use economic, market or regional impact data as appropriate.
• Remember the conjunctive nature of reg 6; missing evidence on any limb undermines reliance on the exception.

5. Support emergency licence applications with evidence of both limbs (reg 8)

• For emergency licence applications under s 64 of the Act, assemble factual proof that:
  • The event is a severe weather condition or natural disaster that endangers or threatens to endanger life, property or the environment; and
  • The event "requires a significant and coordinated response" (reg 8).
• Evidence can include official emergency declarations, emergency management agency notices, meteorological reports, or documented multi-agency responses. Provide specifics to demonstrate both the danger and the scale/coordination of the response.

6. Pay application fees as prescribed (reg 9)

• Ensure payment of the exact fee prescribed for the application type:
  • General licence application (s 13): $110
  • Temporary licence application (s 28): $400
  • Variation of a matter authorised by a temporary licence (s 43): $200
  • Variation of a temporary licence (s 51): $400
  • Emergency licence application (s 64): $400
• Confirm procedural steps for payment with the administering agency (payment methods, timing, whether fees are receipted or refundable) because the regulations set amounts but do not detail payment mechanics or refund rules.

7. Document and timestamp all application materials

• Given the potential for disputes over which IMDG Code version applies and whether the conjunctive tests in regs 6 and 8 are met, maintain contemporaneous records, supporting technical documentation and dated evidence for submission. This includes operational logs, supply chain communications and official notices.

8. Do not assume the regulations cover other statutory obligations

• The regulations do not displace other legal requirements such as port safety, environmental approvals, customs or quarantine obligations. Seek and secure any required approvals from relevant agencies in addition to complying with the Act and these regulations.

9. Seek administrative guidance where uncertain

• Because the regulations provide precise but limited prescriptions (e.g. minimal particulars for temporary licences, fixed fees, a frozen IMDG Code version), consult the administering agency for application forms, guidance on ancillary documentation, payment procedures and any departmental policies that operationalise these regulations.

10. Monitor for amendments

• The IMDG Code reference is fixed at commencement; if the regulator later amends the regulations, either to update the IMDG Code reference or to modify fees or application particulars, those amendments would change compliance obligations. Track legislative updates and the administering agency’s announcements.

Compliance therefore means meeting narrow, textually prescribed content and payment requirements, and assembling the specific evidence the regulations demand when relying on energy-security or emergency grounds. The regulations are procedural and definitional in scope; successful application will hinge on satisfying both the Act’s substantive licensing criteria and these regulations’ prescribed particulars and evidentiary gates.
