Coast Protection Act 1972

The Act rests on a handful of organising legal concepts that determine how decisions are made and resources allocated.

Coast (definition). The Act defines "coast" broadly to include (a) the area between mean high and low water marks at spring tides; (b) land above and within 100 metres of mean high water mark; (c) waters below and within three nautical miles of mean low water mark; (d) tidal estuaries, inlets, rivers, creeks, bays or lakes; and (e) areas declared by regulation to be coast for Act purposes (s 4, paragraphs (a)-(e)). That statutory definition fixes the spatial reach of Board powers over land and waters.

Board as decision‑maker. The Board is the statutory actor responsible for coastal protection decisions. It is a corporate entity (s 6) whose functions are set out in s 14. The Board acts under the control and direction of the Minister (s 7) and its membership is a mixed composition of public servants and three ministerial appointees chosen for specified expertise (s 8). Delegations by the Board require Ministerial approval (s 13A(1)), and the Minister may remove appointed members for specified causes (s 8(5)). These provisions locate operational authority within an expert body but under ministerial supervision.

Coast protection districts and management plans. The Governor, on the Board’s recommendation, proclaims coast protection districts (s 19). For each district the Board must investigate and prepare a management plan that sets out measures proposed to protect, restore or develop the coast; the plan must be publicly displayed and advertised, councils and the public may make written representations and the Board must consider them before referring the plan to the Minister and seeking the Governor’s approval by proclamation (s 20(1)-(11)). An approved management plan becomes the blueprint for authorised works (s 21(1)).

Works, sand movement and storm repairs. The Board is authorised to execute works necessary to implement an approved management plan (s 21(1)). It also has specific statutory authority to remove and relocate sand and material along the coast (s 21A), and authority to repair storm or pollution damage (s 21(2)). The powers are framed as enabling the Board to directly intervene in coastal morphology and facilities.

Powers over land: entry, temporary occupation and acquisition. The Board has broad powers to enter land with equipment for survey and works and must give at least seven days’ notice before entering private land (s 23(1)-(2)). It may temporarily occupy coast land for works (s 24), again with seven days’ written notice before occupying private land (s 24(2)), and it may acquire coast land if satisfied such acquisition is necessary or expedient for its purposes, subject to Ministerial approval and the Land Acquisition Act 1969 (s 22).

Financial architecture and cost sharing. The Act establishes a Coast Protection Fund held at Treasury (s 29). The Fund is fed by parliamentary appropriation and monies recovered by the Board (s 29(3)), and is applied to Board administration and works (s 29(4)). The Board may borrow with Treasurer consent (s 30), and the Treasurer may guarantee repayments, making the State potentially liable (s 30(2)-(3)). The Board may grant money to councils for coastal works (s 32), contribute to council land acquisitions (s 32A), and recover contributions from councils for works it carries out (s 33).

Restrictions and enforcement. The Minister may declare restricted areas and impose access prohibitions (s 34). Wardens, including police officers ex officio, may be appointed to enforce the Act’s restrictions; they can require identifying information and to remove persons from restricted areas; various penalties are prescribed for failure to comply or for obstruction, assault or insulting language (ss 34A-34B). Evidence provisions allow certain allegations in complaints to be accepted as proved unless contrary evidence is produced (s 34C).

Regulatory reach and reporting. The Governor may make regulations for Board procedure, fees and minor penalties (s 37). The Board must report annually to the Minister and through the Minister to Parliament (s 35), embedding parliamentary oversight.

These concepts frame a statutory regime in which an expert board, operating under ministerial control, designs and implements district‑based plans, exercises statutory powers to alter coast form, enter and acquire land, share costs with local councils and enforce access restrictions in specified areas.

The Act creates discrete groups of affected parties, and the text identifies how they are implicated.

Owners and occupiers of private land. The Act explicitly distinguishes "private land" (s 4), and prescribes procedures and limits when the Board needs to enter, temporarily occupy or acquire private land. Private owners or occupiers must receive at least seven days’ notice before entry (s 23(2)) or before temporary occupation (s 24(2)). They have statutory compensation rights for entry or temporary occupation (s 25) and can apply to the Court to require the Board to acquire their interest rather than occupy it (s 24(3)-(4)). Acquisitions are subject to the Land Acquisition Act 1969 (s 22(2)), so owners have the acquisition compensation framework that the Land Acquisition Act supplies.

Councils and the West Beach Trust. The Act treats councils as key partners in coastal management. The Board must consult and take account of council interests when preparing management plans (s 20(2)) and must send copies of plans to affected councils and invite representations (s 20(4)-(7)). Councils can apply to the Board for grants where they propose works (s 32(1)-(2)); the Board may provide up to four‑fifths of costs except storm repairs which may be fully funded (s 32(3)). Councils can also apply for grants to acquire coast land, with the Board able to grant up to one‑half of acquisition costs (s 32A(2)). Conversely, if the Board executes works that benefit a council’s area, the Board may recover contributions as a debt from the council (s 33(1)-(3)). Thus councils may be recipients of grants and simultaneously liable for contributions depending on which party leads the works.

The Board, the Minister and Ministers administering related Acts. The Board is the central administrative actor and is subject to the control and direction of the Minister (s 7). Membership includes public service chief executives or nominees of responsible administrative units (s 8(1)(a)-(c)), and three appointed members with local government, technical or environmental expertise (s 8(1)(d)). For specially protected areas (Adelaide Dolphin Sanctuary, marine parks, River Murray), the Board must take into account and seek to further the objects of the relevant Act and consult the relevant Minister (s 14(3); s 20(12) as substituted). Those cross‑statutory links bring other Ministers and administrative units into the decision chain.

The public and coast users. The Act provides that the Board may prepare and issue bulletins and maps for public information (s 14(2)), and it imposes public consultation requirements for management plans (s 20(4)-(7)), including a minimum representation period of not less than two months after advertisement (s 20(4)(c)). The public is also affected by restricted areas declared by the Minister, with signage required (s 34(3)-(4)) and criminal penalties for contraventions (s 34(5)).

Wardens and police. The Act authorises appointment of wardens, who may be public servants, council officers or other persons (s 34A(1)), with police officers being wardens by virtue of office (s 34A(5)). Wardens have powers to require identification and to remove persons from restricted areas (s 34B(1)-(2)), and are supported by statutory penalties for obstruction, abusive language or assault (s 34B(2)-(5)).

Financial stakeholders and the State. The Treasury, through maintenance of the Coast Protection Fund and potential guarantee of Board borrowings, is implicated (s 29; s 30). The Fund is replenished by appropriation and monies recovered by the Board (s 29(3)). The Treasurer may guarantee Board borrowings and satisfy liability from General Revenue if a guarantee is called (s 30(2)-(3)). Parliament plays a role by appropriating funds and by receiving the Board’s annual report via the Minister (s 29(3)(a); s 35).

Third parties undertaking works. Developers or contractors who perform works authorised by the Board will be engaged through Board operations or council arrangements. The Act gives the Board broad powers to execute works (s 21) and to make use of public service staff (s 13) or delegate functions (s 13A).

Litigation and courts. The Supreme Court is the Court referenced in the Act (s 4 definition of "the Court" as the Supreme Court). The Court intervenes where compensation disputes under temporary occupation remain unresolved after three months (s 25(2)-(3)), and may order acquisition where a person interested in the land seeks such relief (s 24(3)-(4)). The Land Acquisition Act 1969 applies to acquisitions (s 22(2)).

In short, the Act affects landowners and occupiers of coastal land, local councils and their officers, the State (through the Treasurer, Minister and Treasury), Board employees and delegates, wardens and police, and members of the public who use coastal areas. The Act allocates decision rights primarily to the Board and the Minister, and allocates funding flows through the Coast Protection Fund, parliamentary appropriation, Council grants/contributions and borrowings with possible State guarantees.

The Act sets out statutory duties for the Board and associated rights for councils, landowners and the public. Below are the principal duties and reciprocal rights established by specific sections.

Board duties and functions. The Board’s functions are enumerated in s 14. They include protection of the coast from erosion, damage, deterioration, pollution and misuse (s 14(1)(a)); restoration of degraded coast (s 14(1)(b)); development for aesthetic improvement or public enjoyment (s 14(1)(c)); management, maintenance and improvement of coast facilities vested in or under the Board’s care (s 14(1)(ca)); reporting to the Minister on matters referred to the Board (s 14(1)(d)); and carrying out or contributing to research relevant to coast protection (s 14(1)(e)). The Board may publish informational material for the public (s 14(2)). For actions affecting specially protected areas or the Murray‑Darling Basin the Board must take into account and seek to further the objects of the relevant legislation (s 14(3)).

Ministerial duties and powers. The Minister controls and directs the Board (s 7). The Minister appoints three appointed Board members by specifying expertise requirements (s 8(1)(d)), appoints the presiding member (s 8(2)), may appoint deputies and may remove appointed members for causes listed (s 8(4)-(5)). The Minister may require inquiries by the Board (s 36). The Minister declares restricted areas (s 34(1)) and appoints wardens (s 34A(1)). The Minister therefore has significant supervisory and apparatus appointment authority.

Councils’ duties and rights regarding management plans and works. When preparing management plans the Board must consult and take account of councils whose areas include part of the district (s 20(2)). Councils receive copies of draft management plans and may make written representations during an advertisement period of not less than two months (s 20(4)-(5)). Where councils propose works they must apply to the Board for approval to obtain a grant (s 32(1)); upon Board approval, the Board may grant contributions up to specified shares,up to 100 per cent for storm repairs, up to four‑fifths in other cases (s 32(3)). Councils may also apply for grants to assist in acquiring land forming part of the coast (s 32A(1)-(2)). Conversely, if the Board carries out works that benefit a council area, the Board may recover contributions as a debt, up to one half where a coast facility is provided and up to one fifth in other cases (s 33(2)(a)-(b)).

Private landowner rights. Private landowners have notice and compensation rights. Before the Board (or its authorised persons) enters private land for inspection or works, it must give at least seven days’ notice to the occupier or owner (s 23(2); s 24(2)). A person interested in land temporarily occupied can apply to the Court to order acquisition of their interest, with the Court able to make such an order if it is just (s 24(3)-(4)). A person interested in land that is entered or temporarily occupied can file a written compensation claim with the Board within three months of the Board's last occupation (s 25(1)). If the Board and claimant do not agree within three months after notice of claim, either party may refer the dispute to the Court, which determines the compensation and orders payment in accordance with the Land Acquisition Act 1969 (s 25(2)-(4); s 22(2)).

Warden powers and public duties. Wardens may require the name and residence of someone found committing, or suspected on reasonable grounds of having committed, an offence under the Act, and may require a person to leave a restricted area (s 34B(1)). Persons must comply with these requirements (s 34B(2)). It is an offence to hinder a warden (maximum $500), use abusive or threatening language to a warden (maximum $300), or assault a warden (maximum $1 000 or three months imprisonment) (s 34B(3)-(5)). The Act also allows complaint allegations that a specified act took place in a restricted area or that a named person was a warden to be accepted as proved in the absence of contrary proof (s 34C).

Financial duties. The Board must keep proper accounts (s 31(1)), and the Auditor‑General may audit these accounts at least annually (s 31(2)). The Board must supply management plans to councils and, for a fee, to other persons (s 20(11)). The Board administers the Coast Protection Fund and applies it to Board costs (s 29). Borrowing powers and possible Treasury guarantees impose financial duties and linkages to State credit (s 30).

Procedural rights. People and councils have the procedural right to make written representations to management plans during the advertised period and to have those representations considered by the Board (s 20(4)-(7)). Councils may negotiate with the Board for care, control and management of land sold by the Board (s 22(3)(b)).

In summary, the Act sets out duties primarily for the Board to plan, execute and fund coastal protection works and to consult. It affords councils participatory rights and cost‑sharing entitlements, and protects private landowners through notice, compensation and court avenues. Wardens and the public have reciprocal duties to comply with access restrictions and enforcement powers.

The Act establishes a limited enforcement toolkit comprised of criminal penalties, warden powers, evidentiary presumptions and regulatory instruments. The scale of penalties is modest and many enforcement powers are administered via wardens or ordinary legal processes.

Specified offences and monetary penalties. Several offences are created with maximum penalties expressed in dollars. Examples include:

• Interfering with survey marks or wilfully obstructing a person acting under entry powers: penalty not exceeding $200 (s 23(3)).
• Entering or remaining in a restricted area contrary to ministerial prohibitions: penalty not exceeding $200 (s 34(5)).
• Failure to comply with a warden’s requirement (for example to state name and residence or to leave a restricted area): maximum penalty $200 (s 34B(2)).
• Hindering a warden: maximum penalty $500 (s 34B(3)).
• Using abusive, threatening or insulting language to a warden: maximum penalty $300 (s 34B(4)).
• Assaulting a warden: maximum penalty $1 000 or imprisonment for three months (s 34B(5)).

These figures are statutory maxima in the Act; the Governor may, by regulation, prescribe penalties not exceeding $100 for breaches of regulations made under the Act (s 37(2)(d)).

Warden enforcement powers. The Minister may appoint wardens (s 34A). Wardens can require people reasonably suspected of committing offences to give their full name and usual place of residence and can require persons to leave restricted areas (s 34B(1)). Failure to comply or obstruction attracts statutory penalties (s 34B(2)-(3)). Every member of the police force is a warden by virtue of office (s 34A(5)), which means police may enforce restricted area prohibitions under the Act without separate appointment. Wardens must produce an identity card when exercising powers (s 34A(6)).

Evidentiary provision. Section 34C provides an evidentiary rule in prosecutions under the Act: an allegation that an act took place in a specified restricted area or that a named person was a warden shall be accepted as proved in the absence of proof to the contrary. That provision shifts the evidentiary position for certain elements of a complaint, placing a burden on defendants to adduce contrary proof if contesting those specific factual allegations.

Entry, temporary occupation and compensation enforcement. The Board may enter private land and temporarily occupy it for authorised works, but must serve at least seven days’ written notice (ss 23(1)-(2); 24(1)-(2)). Where occupation or entry occurs, landowners have a limited window, three months from last occupation,to serve a written claim for compensation (s 25(1)). If the Board and the claimant cannot agree within that period, either may refer the matter to the Court, which determines compensation in accordance with the Land Acquisition Act 1969 (s 25(2)-(4)). The Court also has jurisdiction to order acquisition of a claimant’s interest if justice requires (s 24(3)-(4)). These are judicial enforcement and redress mechanisms, rather than administrative fines.

Recovery of contributions from councils. The Board may recover contributions as a debt from councils when the Board carries out works within or benefiting a council’s area (s 33(1)). Recovery as a debt means civil enforcement through ordinary debt recovery processes.

Regulatory enforcement. The Governor may make regulations for Board meeting procedures, fees and recovery of fees, and may prescribe penalties for breaches of regulations up to $100 (s 37(2)(a), (c)-(d)). These are delegated law instruments which carry their own enforceability.

Audit as an accountability mechanism. The Auditor‑General has authority to audit the Board’s accounts at any time and must audit at least once per year (s 31(2)). This audit power is an administrative oversight tool, not a criminal sanction, but feeds into financial and parliamentary scrutiny.

Consequence profile and limits. The Act concentrates enforcement authority in wardens and the police for access and obstruction offences and relies on judicial processes for compensation and acquisition disputes. Monetary penalties are relatively small by modern standards and several enforcement powers (entry, occupation, acquisition) are subject to notice and compensation rights. The Minister’s control over the Board and the requirement for Ministerial approval for certain actions (e.g. delegation, acquisitions) add administrative review points that shape how enforcement and implementation proceed (ss 7, 13A(1), 22(1)).

The Act expressly links to, and operates alongside, several other statutes and legal frameworks. These interactions allocate primacy, incorporate other statutory regimes, and impose cross‑Act duties.

Land Acquisition Act 1969. Acquisitions under the Coast Protection Act are subject to the Land Acquisition Act 1969. Section 22(2) states that the Land Acquisition Act shall apply in respect of acquisition of land under s 22(1). Section 25(4) expressly provides that compensation for entry or temporary occupation is to be determined according to the appropriate provisions of the Land Acquisition Act 1969. Practically, this means compulsory acquisition procedures, valuation methods and compensation assessments for permanent acquisition follow the Land Acquisition Act processes and rights.

Relevant Acts for specially protected areas. The Act defines "specially protected area or resource" to include the Adelaide Dolphin Sanctuary, marine parks and the River Murray, and it defines "relevant Act" and "relevant Minister" accordingly (s 4). Section 14(3) requires the Board, when taking action within or in relation to a specially protected area or resource, or when taking any action likely to have a direct impact on such an area, to take into account and seek to further the objects and objectives of the relevant Act. Section 20(12) also requires consultation with the relevant Minister when management plans could affect a specially protected area or resource. Those cross‑references require the Board to align its coastal protection measures with environmental regimes established under the Adelaide Dolphin Sanctuary Act 2005, the Marine Parks Act 2007 and the River Murray Act 2003 as applicable. The legislative history shows those definitions were inserted by later amendments (2003, 2005 and 2007) to create statutory linkages.

Local Government Act 1934 and West Beach Recreation Reserve Act 1954. The Act’s definition of "council" references the Local Government Act 1934 and also the West Beach Trust under the West Beach Recreation Reserve Act 1954 (s 4). This ties council-related duties and entitlements (consultation, grants, contributions, staff secondment) into the local government statutory framework and specific institutional arrangements for West Beach.

Public sector and administrative law changes. The legislative history records amendments through broader public sector reforms (for example Statutes Amendment (Public Sector Consequential Amendments) Act 2009). These changes modified the identity of chief executives and administrative units referenced in s 8 and s 12, and adjusted how Board staff are provided (s 13). The Board’s use of public service staff is authorised under s 13, subject to arrangements established by the Minister administering an administrative unit. That makes interdepartmental administrative arrangements an operational consideration.

Treasurer and General Revenue. The Board’s borrowing powers (s 30) interact with Treasury and State financial law because the Treasurer may guarantee borrowings (s 30(2)), and the Treasurer is authorised to satisfy liabilities under such guarantees from General Revenue without further appropriation (s 30(3)). That creates a potential fiscal link between Board borrowings and State budgetary exposure.

Regulatory instruments and subordinate law. The Governor may make regulations contemplated by the Act or otherwise considered necessary or expedient for its purposes, including prescribing fees and penalties for breach of regulations (s 37(1)-(2)). Regulations can therefore extend and detail the Board’s operating processes and the regime’s compliance mechanics, subject to statutory caps.

Court jurisdiction and evidence. The Act relies on the State Supreme Court for compensation and acquisition matters (ss 24-25). Section 34C sets an evidentiary rule for prosecutions under the Act which affects how restricted area prosecutions are pleaded and the onus for proof. Courts will apply these statutory evidentiary presumptions in adjudicating criminal complaints under the Act.

Other environmental and planning laws. While the Act itself does not list every intersection, s 14(3) demonstrates that management measures touching protected water and wildlife regimes must take account of the objects of related Acts. Management plans may therefore interact with environmental protection, marine park, and water resource regimes, imposing duties to reconcile coast protection objectives with conservation or river basin management objectives.

In short, the Coast Protection Act is designed to operate within South Australia’s broader statutory network: compulsory acquisition law governs landtakings and compensation, public sector arrangements govern staffing and delegation, Treasury rules affect borrowing and guarantees, the local government framework governs council engagement and funding, and environmental Acts constrain or direct actions within specially protected areas. These linkages allocate rights, duties and procedural routes across statutory domains.

The Act has been subject to numerous amendments from 1975 through to 2025. The legislative history appended to the Act lists the principal amending Acts, dates of assent and commencement, and a schedule of provision‑level changes. Key points evident from that history include the following changes and evolutionary trends:

Definition and scope changes. The definition section (s 4) has been amended repeatedly. Notable insertions include "area" and "council" by the Coast Protection Act Amendment Act 1985 (No 22) effective 23 May 1985, which clarified the meaning of council and included the West Beach Trust (see "area" and "council" entries in the Provisions amended list). The definitions for "marine park", "relevant Act" and "relevant Minister" were added by the Marine Parks Act 2007 (Sch 1 cl 5) and related instruments and commenced on 6 November 2008, aligning the Act with newer protected area regimes. The Adelaide Dolphin Sanctuary references were added by the Adelaide Dolphin Sanctuary Act 2005 (Sch 2 cl 5) from 1 July 2005. These changes indicate successive incorporations of other environmental regimes into the Act’s framing.

Operational powers added. Section 21A, authorising removal of sand and other material from one part of the coast to another (for coast protection purposes), was inserted by the 1985 amendment (s 6) and commenced 23 May 1985. That amendment formalised a specific operational capability for the Board that was not explicitly enumerated in the original 1972 Act.

Administrative and governance adjustments. Amendments have updated the Board’s membership, appointment processes and public service interfaces. The Statutes Amendment (Boards and Committees,Abolition and Reform) Act 2015 (No 8) made changes to the appointed member definitions and other board provisions (ss 53-58), effective 1 July 2015. The Statutes Amendment (Public Sector Consequential Amendments) Act 2009 modified references to administrative units and substituted s 12 and s 13 provisions relating to the Secretary and Board use of public service staff, effective 1 February 2010. These reflect broader public sector reorganisations and have changed who sits on the Board and how Board staff are supplied.

Interaction with planning and environmental law. The Statutes Amendment (Planning) Act 1982 and subsequent Planning‑related amendments (1982, 1993) deleted and substituted earlier planning appeal bodies references, and later amendments added obligations in s 14(3) and s 20(12) to consult with Ministers responsible for the Adelaide Dolphin Sanctuary, marine parks, and the River Murray (2003, 2005, 2007 amendments). Those changes integrate coast protection planning with environmental protections.

Technical and miscellaneous changes. Other amending Acts adjusted quorum or voting mechanics (1988), substituted or deleted redundant sections (various years), and updated references to the Supreme Court or other bodies (2019 Supreme Court (Court of Appeal) Amendment Act amendments, effective 1 January 2021). The 2011 Personal Property Securities amendment added s 24(5) (commenced 16 June 2011) , that subsection allows non‑transferability of authorisations for temporary occupation, though the text shows s 24(5) was new then.

Recent entries. The legislative history records a 2025 Biodiversity Act (No 29) with Sch 5 (cl 9) uncommenced at the time of the consolidation. The history also lists the usual reprints at particular dates. The Amendment table beneath the Act highlights the specific provisions varied, substituted or inserted in each amending instrument and gives commencement dates.

Overall trajectory. The amendments show a steady accretion of cross‑referenced environmental regimes, administrative modernisation aligning the Board with contemporary public sector structures, and additions to operational powers (notably sand relocation and specific consultation duties where specially protected areas may be affected). The legislative history is the primary source for exact amendment dates and the specific clauses changed; the Act’s consolidated text incorporates these changes to the extent commenced.

The printed consolidation of the Coast Protection Act 1972 appended a legislative history and lists of amendments, but it contains no internal record of judicial decisions or case law interpreting the Act. The Act’s text names the State Supreme Court as "the Court" (s 4) and defines court roles in compensation and acquisition disputes (ss 24-25), but the statute itself does not catalogue any reported litigation or judicial interpretation.

The Act provides statutory mechanisms that invite judicial resolution on particular issues. Examples of matters that the Court would address under the Act, as specified in the text, include:

• Determination of compensation disputes where agreement between the Board and a claimant is not reached following a compensation claim arising from entry or temporary occupation. If the Board and claimant remain in disagreement after the three month period specified in s 25(2), either party may refer the matter to the Court, which shall determine the compensation and make an order for payment in accordance with the Land Acquisition Act 1969 (s 25(2)-(4)).
• Judicial orders for acquisition of interests. Section 24(3) allows a person interested in land that the Board proposes to temporarily occupy to apply to the Court for an order requiring the Board to acquire the interest if the Court is satisfied it is just to do so. The Court may order acquisition on such terms as it determines and make consequential orders (s 24(4)).
• Enforcement of debts for contributions recovered by the Board as a debt from councils (s 33(1)), where standard civil procedures in the Court would be used to enforce recovery.
• Prosecutions under the Act for offences such as obstruction of Board agents, entering restricted areas, hindering wardens, or assaulting wardens. The Court would adjudicate on guilt and impose statutory penalties as prescribed (ss 23(3); 34(5); 34B).

Because the consolidated Act does not list cases, any litigation history (including decisions on interpretation of the Board’s powers to remove sand s 21A, the application of the Land Acquisition Act to acquisitions s 22(2), or the scope of evidentiary presumptions in s 34C) must be obtained from judicial databases, law reports, or the Court’s records. The Act’s legislative history section documents statutory change but does not record judicial treatment.

Practitioners needing precedent or judicial interpretation should therefore consult external primary sources: South Australian Supreme Court judgments, reported decisions, administrative law rulings where ministerial control or delegation issues have been litigated, and tribunals if relevant. The Act’s text, however, sets out the procedural gateways by which disputes are referred to the Court and the specific legal points likely to be litigated (compensation, acquisition, debt recovery, criminal offences under the Act, and evidentiary presumptions).

The Act contains a number of provisions that create operational or legal traps if overlooked. These are specific, text‑based points that affect rights, timing, burdens and institutional control.

Ministerial control and appointments. The Board is subject to the control and direction of the Minister (s 7). The Minister appoints the presiding member and the three appointed members (s 8(1)(d), s 8(2)) and may remove appointed members for broadly framed causes (s 8(5)). Delegations by the Board require Ministerial approval (s 13A(1)). Consequently, although the Board is presented as an expert body, many significant decisions are under strong ministerial oversight. Practitioners must therefore factor ministerial discretion into timelines and strategy when engaging with the Board.

Short statutory notice periods for entry and occupation. The Board need only serve at least seven days’ notice before entering or temporarily occupying private land (s 23(2); s 24(2)). For owners and occupiers that is a short period to prepare for works, lodge objections, or initiate legal steps. The compensation claim window is also tight: a written claim must be served within three months of the last day the Board or its authorised person was in occupation (s 25(1)). Failure to serve a timely claim could limit recovery. These short timeframes can compress negotiations.

Compensation and Land Acquisition Act linkage. Acquisition under s 22 is carried out pursuant to the Land Acquisition Act 1969 (s 22(2)), and compensation for entry or temporary occupation is to be determined in accordance with the Land Acquisition Act (s 25(4)). The Land Acquisition Act has its own processes and valuation approaches; parties need to be familiar with that Act’s mechanics when negotiating or litigating compensation under the Coast Protection Act.

Ministerial proclamation and Governor involvement for management plans. The Board must investigate and prepare management plans, and after public consultation it refers the plan and summaries of representations to the Minister (s 20(6)-(7)). The Minister may submit the plan to the Governor, and only the Governor by proclamation may declare a management plan to be an approved management plan (s 20(8)-(9)). That multi‑step process means that plans do not become binding immediately on Board completion; they need Ministerial and Governorial actions. Parties should track the plan status carefully , draft, referred to Minister, submitted to Governor, proclaimed , because implementation authority to execute works is tied to an approved management plan (s 21(1)).

Restricted areas cannot include private land or public roads. The Minister may declare restricted areas (s 34(1)) but subsection (2) expressly forbids declarations in respect of private land or public roads (s 34(2)). Restricted area declarations therefore cover Crown or non‑private coastal lands only. Misreading this could lead to flawed enforcement actions.

Evidentiary presumption. Section 34C provides that certain allegations in a complaint will be accepted as proved unless contrary proof is presented. Practitioners should note how this shifts evidentiary burdens in prosecutions where restricted areas or warden identity are elements. The presumption requires defendants to adduce contrary evidence to avoid summary proof of those allegations.

Debt recovery against councils. Where the Board carries out works benefiting a council’s area it may recover contributions as a debt (s 33(1)). That is a direct civil enforcement mechanism and councils may face liabilities of up to one half of expense for coast facilities and up to one fifth in other cases (s 33(2)(a)-(b)). Councils should therefore anticipate liabilities where the Board takes the lead on projects.

Modest penalties for some offences. Several penalties are low (for example $200 for obstruction or entering restricted areas s 23(3); s 34(5)). This may affect enforcement priorities and the cost calculus of non‑compliance for members of the public; however, more serious penalties apply for assault on wardens (s 34B(5)).

Treasurer guarantee and state liability. The Treasurer may guarantee Board borrowings and satisfy liabilities under guarantee from General Revenue without further appropriation (s 30(2)-(3)). That creates potential fiscal exposure for the State. Practitioners advising on large scale borrowing or infrastructure should be alert to the fact that Treasurer consent and guarantee are statutory options, not automatic.

Delegation requirements. Delegations by the Board require Ministerial approval (s 13A(1)), and delegations are revocable and do not derogate from the Board’s power to act directly (s 13A(2)(c)). The requirement for Ministerial approval can slow operational responsiveness and constrains delegation strategy.

Non‑transferability of temporary occupation authorisation. The authorisation under s 24(1) is not transferable (s 24(5), as inserted by the 2011 amendment). Parties expecting to sub‑license or assign temporary occupation rights must note that the statutory authorisation stays with the person authorised by the Board and cannot be transferred.

Fee and regulation penalty caps. Regulations may prescribe fees and penalties for regulation breaches not exceeding $100 (s 37(2)(c)-(d)). That cap constrains secondary legislation enforcement severity and could limit deterrent effect at the regulatory level.

In sum, the Act provides powers and protections but embeds short response windows, Ministerial control points, cross‑Act dependencies and modest financial penalties. Each of these is a practical "gotcha" affecting timelines, remedies and enforcement strategy.

Compliance under the Act is a mixture of proactive and reactive obligations for the Board, councils, landowners and the public. The following is a section‑by‑section practical checklist derived from the statutory text.

For the Board and Board officers

• Governance and ministerial interface: Ensure the Board’s actions are consistent with ministerial directions and approvals. The Board is subject to the control and direction of the Minister (s 7), delegations require Ministerial approval (s 13A(1)), and the Minister appoints and may remove members (s 8). Document ministerial approvals for delegations and acquisitions.
• Management plans: Follow the statutory consultation procedure when preparing management plans. Conduct investigations (s 20(1)), consult affected councils and have plans publicly displayed and advertised for representations with a period of not less than two months (s 20(2)-(5)). Record all representations and the Board’s consideration (s 20(6)-(7)). Submit plans to the Minister for potential submission to the Governor (s 20(7)-(9)).
• Notices for entry and occupation: Serve written notices at least seven days before entering or temporarily occupying private land (s 23(2); s 24(2)). Keep records of service and proof of notice for potential compensation claims or Court proceedings.
• Compensation process: When entering or occupying private land, provide clear information to affected persons about how to claim compensation and the three month limitation period for claims under s 25(1). Maintain fast dispute resolution protocols because unresolved matters can be referred to the Court after three months (s 25(2)).
• Financial controls and audit: Maintain proper accounts (s 31(1)) and be audit‑ready as the Auditor‑General may audit at any time and must audit annually (s 31(2)). Ensure the Coast Protection Fund is properly administered at Treasury (s 29).
• Grants and contributions: Apply the statutory cost‑sharing caps: grants to councils for works may cover the whole cost for storm repairs and up to four‑fifths otherwise (s 32(3)); grants for council land acquisition may be up to one‑half of cost (s 32A(2)); contributions recovered from councils where Board conducts works may be up to one‑half for coast facilities and up to one‑fifth otherwise (s 33(2)). Document approvals, cost apportionments and agreements with councils.
• Special areas: Where actions affect specially protected areas (Adelaide Dolphin Sanctuary, marine parks, River Murray), consult the relevant Minister and act to further the objects of the relevant Act (s 14(3); s 20(12)). Obtain and record advice.
• Signage and restricted areas: If the Minister declares a restricted area, erect notices to inform the public of prohibitions and restrictions (s 34(3)-(4)).

For councils

• Participate early in plan development: Respond to Board consultation on management plans (s 20(2)-(6)). Ensure submissions are formalised within the public representation period and retain copies of correspondence.
• Grants and budgeting: When proposing coastal works, apply for Board approval for grants (s 32(1)). Prepare budgets that assume the Board may fund up to four‑fifths of non‑storm repairs and the Board may expect councils to meet up to one‑fifth in other cases or up to one‑half for certain Board acquisitions (s 32; s 33). Where the Board initiates works, be ready to receive and fund debt recovery demands (s 33(1)).
• Staff and warden arrangements: If councils provide wardens or officers to be appointed under s 34A, ensure identity card processes and any limitations on powers are properly documented (s 34A(2)-(4)).

For landowners and occupiers

• Monitor notices and Gazette publications: The Board will serve seven days’ notice before entering private land (s 23(2); s 24(2)). Keep an address for service and inspect Board communications and local notices for proposed works or occupation.
• File compensation claims promptly: If occupation or entry occurs, serve a written compensation claim on the Board within three months of the last day the Board was in occupation (s 25(1)). Maintain records of occupation dates and communications.
• Consider Court application options: If you prefer acquisition rather than occupation, apply to the Court under s 24(3) within the statutory and practical timelines.
• Protect property: Where you receive notice of entry or occupation, seek legal advice early concerning compensation valuation under the Land Acquisition Act format (s 22(2); s 25(4)).

For members of the public and coast users

• Observe restricted areas and signage: If a restricted area is declared, signage must be erected (s 34(4)) and entering a restricted area in breach of prohibitions is an offence (s 34(5)). Wardens may require removal and identity details (s 34B(1)-(2)). Non‑compliance carries penalties (s 34B(2)-(5)).
• Interact with wardens lawfully: Respond to identity card requests and removal directions. Obstruction, abusive language and assault have specified penalties (s 34B(2)-(5)). Wardens will produce identity cards (s 34A(6)); where a warden is a non‑uniform police officer, produce certificate of authority.

For contractors and service providers

• Verify authorisations: Authorisation to occupy land under s 24(1) is not transferable (s 24(5)); ensure contracts reflect that the Board’s authorisation cannot be assigned. Confirm that the Board has properly issued notices and permissions before commencing works.
• Documentation: Keep records proving authorisation, notice, and compliance with Board specifications.

Record keeping and audit readiness

• All parties should maintain written records, notices of service, board decisions, ministerial approvals, council consents and financial transactions. The Board’s accounts must be auditable (s 31). Records will be important in compensation, debt recovery, reporting and judicial proceedings.

In short, compliance requires attention to the Act’s notice windows, compensation windows, consultation obligations, prescribed grant and contribution shares, delegation and ministerial approval points, and warden enforcement powers. Procedural readiness is essential because the Act imposes tight timelines and courts become involved where administrative agreement is not reached.
