Coal Miners' Welfare Act 1947

This Act rests on a handful of core legal and administrative constructs that determine incentives, compliance risks and governance.

Funded compulsory contributions: Section 6 is the financial engine. It imposes two statutory contribution streams on owners of coal mines. The first, s 6(1), requires payments in January, April, July and October based on the prescribed amount per tonne of output produced in the preceding three months. The second, s 6(1a), requires payments in January and July of 0.4101 cent per tonne on coal sold over the preceding six months, credited to a separate account (s 6(1b)). The Act expressly states the sums are recoverable as a debt due to the Board (s 6(1), (1a)), and that contributions are additional to royalties due under the Mining Act 1978 (s 6(2)).

Separate accounting and earmarking: The Act requires accounting separation between the generic Fund account and the subsection (1a) account (s 6(1b), 16(4)). Section 16(1a) references a separate account, the subsection (1a) account, which holds sums transferred under the Coal Mines Legislation Amendment and Revival Act 1998 and sums paid under s 6(1a). The Board’s ability to spend from that account is circumscribed by a Ministerial approval requirement and a consultation requirement with owners (s 16(1a), (2), (3)).

Corporate Board model with union representation: The Board is a body corporate with perpetual succession, common seal and capacity to hold property and sue or be sued (s 8(2)). Membership is unusual in that two seats are allocated to officeholders of union bodies (President of the Collie Combined Mining Unions Council and President of the CFMEU Mining and Engineering Division, Collie, or such other bodies as prescribed) and the third member is Governor‑appointed (s 9(1)). The chair is the Member from paragraph (a) (s 9(2)). Deputies and temporary Members operate where officeholders are unable to act (s 10). Members may be removed by the Governor on defined grounds, and bankruptcy/insolvency deems cessation (s 11).

Ministerial control and directions: The Board’s function is subject to directions of the Minister, which the Board must give effect to (s 16(2)). The Board may only apply subsection (1a) account moneys with the prior approval of the Minister and on terms and conditions the Minister approves (s 16(1a)).

Broad powers to spend and transact: The Board may acquire and dispose of property, contract, borrow (with Ministerial approval and mortgage or charge Fund property as security), construct and maintain premises and equipment, establish scholarships, and make grants to local governments, societies, clubs and other bodies (s 17). The Board may therefore operate across capital investment, grantmaking and educational spending.

Financial oversight and audit: The Board is explicitly placed within the financial administration and audit regime applicable to statutory authorities by application of the Financial Management Act 2006 and the Auditor General Act 2006 (s 18). That framework will impose reporting, budgeting and audit obligations on the Board.

Inspection and enforcement mechanisms: The Secretary has a statutory power to examine records of any person necessary to determine amounts payable under s 6, and may copy only the records required for that purpose (s 7(1)-(2)). Obstruction of an inspection is an offence (s 7(4)). Non‑payment of amounts due is actionable as a debt and attracts the statutory penalty overlay in s 6(3) (recoverable as part of the Board’s debt claim), while the Act’s general penalty provision establishes a maximum fine of $10,000 for offences not otherwise specified (s 23). Regulations may add further penal consequences up to $5,000 (s 27(3)).

Employee status and public sector exclusion: The Board may appoint officers and employees; those officers and employees hold office during the Board’s pleasure and Part 3 of the Public Sector Management Act 1994 does not apply to them (s 15(1)-(2)). The Act enables the Board to fix salaries and wages with Ministerial approval and charge them to Fund moneys (s 15(3)). The Board may also utilise services of public servants with Ministerial consent (s 15(4)).

Validation and transitional architecture: The Act contains a validation clause for payments from the Fund before the 1968 Amendment (s 22A) and the compilation materials include the Coal Mines Legislation Amendment and Revival Act 1998 Part 3, which revives parts of the repealed Coal Mines Regulation Act 1946 and deals with the Relief Fund, validation, transfer of balances into the s 1a account and reporting (compilation notes and Pt 3). Those transitional provisions can affect historical entitlements and Fund balances.

Regulatory delegation: The Governor may make regulations to prescribe management, administration and use of amenities, conditions for scholarships and grants and impose penalties for breaches (s 27). This is a broad enabling paragraph which can expand operational duties and compliance detail through subordinate law.

Owners of coal mines: The Act directly imposes financial obligations on the owner of every coal mine to pay prescribed amounts per tonne on output (quarterly) and 0.4101 cent per tonne on coal sold (biannually) (s 6(1), (1a)). The Act makes those payments recoverable as a debt due to the Board (s 6(1), (1a)). Owners therefore bear the direct monetary cost of funding the welfare scheme and are exposed to debt recovery and penalties for non‑payment (s 6(3)). Owners also have a consultative entitlement , the Board must consult owners before applying subsection (1a) account money (s 16(3)).

Coal miners and their families: The Act’s statutory objects are to provide or assist in providing amenities and to improve the welfare, education, recreation and conditions of living of coal miners (s 16(1)). Coal miners are beneficiaries of the Fund’s expenditure on amenities, scholarships, bursaries, grants and facilities. The compilation material also records revival provisions for entitlements under the repealed Coal Mines Regulation Act 1946, including benefits to injured employees and entitled relatives via the Relief Fund, and the transfer of surplus Relief Fund money into the subsection (1a) account (Coal Mines Legislation Amendment and Revival Act 1998 Pt 3, ss 8-11).

Union bodies and officials: The President of the Collie Combined Mining Unions Council and the President of the CFMEU Mining and Engineering Division, Collie (or replaced by such other prescribed bodies) occupy two Board seats (s 9(1)(a)-(b)), with the Member under paragraph (a) acting as Chairman (s 9(2)). Deputy Presidents act as deputies (s 10). Union organisations therefore have structural representation in governance, which means union policy priorities and candidate selection can materially influence Board decisions on spending and amenities.

The Board and its officers: The Board is the legal person administering the Fund and is authorised to sue and be sued, hold property and contract (s 8(2)). The Secretary has statutory powers of inspection (s 7) and to take legal proceedings in the Board’s name (s 25). Officers and employees appointed by the Board are employed outside Part 3 of the Public Sector Management Act 1994 (s 15(2)), which affects employment conditions and avenues for dispute.

Minister and Governor: The Minister administers the Act and can give directions of a general character to the Board which the Board must implement (s 5, s 16(2)). The Governor appoints the one Governor‑appointed Member of the Board (s 9(1)(c)), and has the power to remove Members on defined grounds (s 11(c)). The Governor may also make regulations under s 27.

Third‑party recipients: Local governments, societies, clubs, associations and other bodies, whether incorporated or unincorporated, may receive grants under s 17(g). The Board may also operate a home for the aged in Collie (Riverview Residence Incorporated) and provide amenities for non‑miners subject to Ministerial approval (s 16(1a)). These third parties may become users of Fund money and thus subject to conditions imposed by the Board and regulations.

Auditors and financial regulators: By operation of s 18, the Financial Management Act 2006 and Auditor General Act 2006 apply to the Board. The Auditor General and those agencies that administer financial management statutes therefore have oversight over the Board’s reporting, audit and financial controls.

Suppliers, contractors and lenders: The Board’s powers to acquire property, construct premises, contract, borrow money and mortgage or charge Fund assets (s 17(a)-(d)) create commercial counterparties , contractors, lenders and purchasers , who will interact with the Board and depend on Board authority, Ministerial approvals for borrowing and the Board’s capacity to provide security.

Persons whose records are inspected: Section 7 empowers the Secretary to examine records of "any person" required to determine amounts payable under s 6, and to make copies only of records required for that purpose (s 7(1)-(2)). That means suppliers, purchasers, operators, payroll/tonnage accounting services and any person with records relevant to production or sales can be compelled to provide access.

Regulatory compliance actors: Entities subject to any regulations made under s 27, including providers and users of amenities, scholarship recipients and recipients of grants, will be affected by penalties set by regulation and by operational conditions contained in subordinate law.

Obligation to pay contributions and timing: The owner of every coal mine must pay amounts to the Fund in January, April, July and October each year equivalent to the prescribed amount per tonne on output during the preceding three months (s 6(1)). Separately, owners must pay, in January and July, 0.4101 cent per tonne on coal sold from every mine during the preceding six months ending on 31 December or 30 June (s 6(1a)). These payments are credited to separate accounts within the Fund (s 6(1b)). The Act does not specify the unit rate for the quarterly payments in the body of the text; it refers to a prescribed amount, leaving detail to subordinate instruments or prior amendments recorded in the compilation.

Recoverability and penalties for non‑payment: Sums payable under s 6(1) and s 6(1a) are recoverable as a debt due to the Board (s 6(1), (1a)). An owner who fails to pay commits an offence and is liable to pay, in addition to the amount owed, a penalty of one dollar in respect of each dollar, or fraction of a dollar, of the unpaid amount (s 6(3)). All penalties recovered, less recovery expenses, are to be paid into and form part of the Fund (s 6(4)). The statutory formulation produces a penalty equal to 100% of the amount owed, recoverable alongside the principal as part of the Board’s debt claim.

Record inspection and duties to permit access: The Secretary may, at any reasonable time, examine records of any person required to determine the amount payable under s 6 and may make copies only of those records required for this purpose (s 7(1)-(2)). The Board may authorise another person in writing to carry out the Secretary’s functions and that person may exercise the same powers as if they were the Secretary (s 7(3)). Obstruction or attempted obstruction of an examination is an offence (s 7(4)). The Office exercising these powers must confine copying to records relevant to the s 6 calculation (s 7(2)).

Administration, spending and Ministerial control: The Board is charged with administration and application of the Fund for amenities and the improvement of coal miners’ physical, cultural and social well‑being and for education and recreation (s 16(1)). Notwithstanding the Board’s discretion, the Minister may give directions of a general character with respect to the Board’s functions and the Board must give effect to any such directions (s 16(2)). The Board must consult owners before applying money from the subsection (1a) account (s 16(3)). The Board may, with the Minister’s prior approval and on approved terms and conditions, apply subsection (1a) account money to operation of the Riverview Residence (a home for the aged in Collie) and to other amenities for persons including non‑miners (s 16(1a)).

Contracting, borrowing and security: The Board may enter contracts, buy and hold property, sell, lease or exchange property, construct premises and plant, establish scholarships and make grants (s 17(a)-(g)). The Board may borrow money and mortgage or charge any of its property or the Fund as security for borrowed money, with the approval of the Minister (s 17(d)). Ministerial approval is therefore required where the Board wishes to incur secured borrowing, which creates an explicit decision node that could affect the Fund’s balance sheet and risk profile.

Governance and Member rights: Two Board seats are occupied ex officio by union presidents or prescribed substitutes, and one by a Governor appointment (s 9(1)). The Member in s 9(1)(a) is the Chairman (s 9(2)). Deputies are defined so that the Deputy Presidents of the relevant entities are the deputy Members and may act in place of the substantive Member if that Member is unable to act (s 10). A Member may resign to the Minister, may be removed by the Governor for incapacity, neglect or misconduct, ceases to be a Member if absent without leave for three consecutive meetings or becomes bankrupt under the Interpretation Act 1984 s 13D (s 11). Remuneration and expenses for Members are payable as prescribed and charged to Fund moneys (s 13).

Employment and officer powers: The Board may appoint a Secretary as chief executive officer and other officers and employees as it requires and as approved by the Minister (s 15(1)). Board‑appointed staff hold office at the Board’s pleasure and are not subject to Part 3 of the Public Sector Management Act 1994 (s 15(2)). The Board fixes salaries and allowances with Ministerial approval and charges them to Fund moneys (s 15(3)). With the consent of the relevant Minister, the Board may use services of public servants on agreed terms (s 15(4)).

Reporting, audit and financial management duties: The Financial Management Act 2006 and Auditor General Act 2006 provisions regulating financial administration, audit and reporting of statutory authorities apply to the Board and its operations (s 18). This creates duties of budgeting, financial reporting, audit and public accountability consistent with those Acts.

Legal standing to commence proceedings: The Board may take civil or penal proceedings in its name via the Secretary or any officer authorised by the Board; a process averring that the Secretary or officer is authorised is conclusive proof of the authority to take proceedings (s 25(1)-(2)). This provides an expedited evidentiary route for enforcement actions and debt recovery.

Regulatory powers and penalties: The Governor may make regulations to prescribe matters necessary to achieve the Act’s objects including management, administration and use of amenities, conditions for scholarships and grants (s 27(1)-(2)). Regulations can impose a penalty not exceeding $5,000 for contraventions (s 27(3)). For offences without a specific penalty, a person may be liable to a penalty not exceeding $10,000 (s 23).

Validation and continuity rights: Section 22A validates payments made by the Board from the Fund before the 1968 Amendment where those payments were for amenities other than those described in s 16(1), deeming them lawfully made to carry out the Board’s duties and functions (s 22A). The compilation annex covers revival of parts of the repealed Act and handling of Relief Fund monies (Coal Mines Legislation Amendment and Revival Act 1998 Pt 3), which affects historical entitlement resolution.

Recovery as debt and civil enforcement: The Act makes sums payable under s 6(1) and s 6(1a) recoverable as a debt due to the Board (s 6(1), (1a)). That characterization gives the Board a civil route for recovery which can be enforced through courts in ordinary debt proceedings. Section 25 enables the Secretary, or any officer authorised by the Board, to take civil proceedings in the Board’s name and provides that an averment of authority is conclusive proof of the person’s authorisation (s 25(1)-(2)). This approach reduces evidentiary friction for initiating proceedings.

Statutory penalty for non‑payment: An owner who does not pay an amount required under s 6 commits an offence and must pay, in addition to the amount, a penalty of one dollar for each dollar, or fraction of a dollar, of the unpaid amount (s 6(3)). Practically this produces a monetary charge equal to 100% of the unpaid amount as a statutory penalty, recoverable in the Board’s debt claim and paid into the Fund after deduction of recovery expenses (s 6(4)). The Act labels the failure an offence and folds the civil debt and monetary penalty together.

Inspection enforcement and obstruction: The Secretary may examine records of any person necessary to determine amounts payable under s 6 and make copies only of those records required for that purpose (s 7(1)-(2)). Obstruction or attempted obstruction of an examination is an offence (s 7(4)). The Act does not state a specific fine for obstruction; therefore the general penalty provision (s 23) or any regulations made under s 27 that prescribe an offence and fine would apply. The general penalty confers a maximum fine of $10,000 for offences not otherwise specified (s 23), while regulations may create penalties up to $5,000 (s 27(3)).

Regulatory penalties: The Governor’s regulation‑making power under s 27 includes authority to impose penalties for breach of regulations, up to $5,000 for any contravention (s 27(3)). This creates a two‑tier penalty architecture: specific regulatory fines up to $5,000 under the regulations and a general penalty up to $10,000 for unspecified offences in the Act (s 23).

Criminal liability and practical application: The Act uses the term "offence" in s 6(3) and s 7(4) but pairs those offences with monetary consequences recoverable civilly or by fines. The Act does not specify imprisonment as a penalty. Enforcement action will therefore be largely financial and civil by debt recovery, potentially supported by criminal prosecution where obstruction or other conduct may warrant that route, although the Act does not set separate criminal sanctions beyond monetary penalties.

Use of Fund penalties: All penalties recovered under s 6(3), after deduction of recovery costs, are to be paid into the Fund and form part of it (s 6(4)). This means enforcement activity financially benefits the Fund and may create an institutional incentive to recover unpaid contributions.

Borrowing and secured debt protections for lenders: Section 17(d) authorises the Board to borrow money and mortgage or charge the Board’s property or the Fund as security, but only with Ministerial approval. Lenders contemplating security will therefore require evidence of Ministerial approval and will be contracting with a corporate Board (s 8(2)). The Act does not prescribe limitations on types of security beyond Ministerial approval, nor does it set priorities relative to other statutory charges.

Audit oversight: Application of the Financial Management Act 2006 and Auditor General Act 2006 to the Board (s 18) means that the Auditor General has statutory audit powers and reporting obligations in relation to the Board’s finances. Audit findings can precipitate further administrative or legal action, although the Act itself does not specify remedial paths following adverse audit outcomes.

Procedural evidence rules for proceedings: Proceedings brought in the Board’s name by the Secretary or authorised officer require no proof of the Secretary’s appointment or authority; the averment on process is conclusive proof (s 25(2)). That evidentiary rule makes it easier for the Board to commence legal actions for recovery or enforcement.

Interaction with other sanctions: The Act expressly states the contributions are additional to royalties under the Mining Act 1978 (s 6(2)). That creates a potential stacking of financial obligations on mine owners enforced under different statutes, with separate enforcement mechanisms and potential priority implications. The Act does not set priority of Fund claims against other statutory or private charges on mine assets beyond the Ministerial approval requirement for the Board to grant security (s 17(d)).

Mines Safety and Inspection Act 1994: The Act must be read and construed with the Mines Safety and Inspection Act 1994 (s 1(2)). That explicit cross‑reference requires users to consider mines safety and inspection obligations together with welfare obligations when assessing compliance and operational responsibilities. The compilation materials also note the repeal of the Coal Mines Regulation Act 1946 by the Mines Safety and Inspection Act 1994 and subsequent revival and validation by the Coal Mines Legislation Amendment and Revival Act 1998 Pt 3.

Mining Act 1978 royalties: Section 6(2) states that the sums payable under s 6(1) and s 6(1a) are in addition to any royalties payable under the Mining Act 1978. This confirms that owners face both statutory royalties and welfare contributions, which are separate obligations and liable to different enforcement processes under their respective statutory frameworks.

Financial Management Act 2006 and Auditor General Act 2006: By operation of s 18, the Financial Management Act 2006 and the Auditor General Act 2006 provisions regulating financial administration, audit and reporting of statutory authorities apply to the Board. This subjects the Board to the State’s financial governance architecture, including budgeting, reporting, internal controls and external audit. The Board is thus not a private trust; it is accountable within State financial frameworks.

Public Sector Management Act 1994: Part 3 of the Public Sector Management Act 1994 does not apply to persons appointed or employed by the Board (s 15(2)). That creates a divergence in employment governance: Board staff are outside certain public sector employment disciplines, while the Board itself remains subject to financial and audit acts. The Board may, however, use services of public servants with the Minister’s consent (s 15(4)), which creates points of interface.

Interpretation Act 1984 on insolvency: Section 11(d) deems that a Member ceases to be a Member if that person is, according to the Interpretation Act 1984 s 13D, a bankrupt or a person whose affairs are under insolvency laws. The Act therefore imports the Interpretation Act’s outcomes on bankruptcy to govern Member eligibility.

Coal Mines Legislation Amendment and Revival Act 1998: The compilation materials include Part 3 of that Act which revives aspects of the repealed Coal Mines Regulation Act 1946 for transitional purposes, validates prior actions, prescribes the use of the Coal Mines Accident Relief Fund moneys, and transfers any balance of the Relief Fund into the subsection (1a) account of the Fund (compilation notes and Pt 3, ss 8-11). This affects historical entitlements and the Fund’s composition and must be considered where historic claims or Relief Fund balances are relevant.

Regulatory interplay and subordinate law: The Governor’s regulation‑making power under s 27 enables subordinate legislation to fill operational detail for management and administration of Fund moneys, use and control of amenities, and scholarship/grant conditions, including penal provisions up to $5,000 (s 27(2)-(3)). Those regulations will interact with the Board’s duties under s 16 and with the Financial Management Act 2006.

Debt recovery and general civil procedure: The Act frames unpaid contributions as debts to the Board recoverable in civil proceedings (s 6(1), (1a), s 25). Such recovery will proceed under ordinary civil procedure rules of Western Australia, interacting with court practice, limitation periods and enforcement mechanisms outside the Act. The compilation table indicates historic limitation law amendments, which may be relevant to claims over historical periods.

Criminal and penalty statutes: Where the Act uses the term "offence" for obstruction or non‑payment (s 6(3), s 7(4)), the general penalty provision (s 23) and any penalties under regulations (s 27(3)) apply. Other State criminal procedure statutes and sentencing frameworks govern the process if a prosecution is pursued.

Statutory corporations and property law: The Board is a body corporate capable of acquiring, holding and disposing of real and personal property (s 8(2)). Property rights, mortgage and charge arrangements executed by the Board will interact with general property law and security registration regimes. The Board’s power to mortgage the Fund or property with Minister approval (s 17(d)) will involve property law processes and likely registration of interests for third parties.

Validation and transitional legal effects: Section 22A validates certain payments from the Fund before the 1968 amendment, and Part 3 of the 1998 Act validates acts and appointments under the repealed Act. Those provisions affect possible challenges to historic transactions and the continuity of entitlements and administrative acts.

The Act has been subject to numerous amendments since its original enactment in 1947. The compilation table embedded in the Act materials records the principal amendments, with dates of assent and commencement which are relevant to interpreting when particular provisions took effect.

Key historical milestones recorded:

• Original enactment: Coal Miners’ Welfare Act 1947 (70 of 1947), assented 10 January 1948, commenced 1 March 1948 (compilation table).

• 1957 Amendment Act (13 of 1957): amending s 6 and other provisions; commenced 18 October 1957 (compilation table).

• 1961 Amendment Act (16 of 1961): amendments with effect from 23 February 1962 (compilation table).

• Decimalisation and metric conversion era: Decimal Currency Act 1965 and Metric Conversion Act 1972 caused technical adjustments to monetary and measurement references; compilation table notes metric conversion effects effective 1 January 1973 (compilation table).

• 1968 Amendment: Coal Miners’ Welfare Act Amendment Act 1968 (3 of 1968) inserted key provisions including s 16(1a) and s 22A validating certain payments. Section 22A validates payments made by the Board from the Fund before that amendment for certain amenities (s 22A; compilation notes). The 1968 amendment’s Pt 3 also introduced the subsection (1a) account concept that later interacts with the 1998 revival provisions.

• 1985 and 1986 financial and administrative amendments: Acts Amendment (Financial Administration and Audit) Act 1985 (98 of 1985) and Coal Miners’ Welfare Amendment Act 1986 (76 of 1986) adjusted financial administration and certain structural elements; 1986 amendments had staged commencements (compilation table).

• 1994-1996 public sector and consequential amendments: Acts Amendment (Public Sector Management) Act 1994 and Local Government (Consequential Amendments) Act 1996 included consequential changes that affected appointment and employment provisions (compilation table).

• 1998 Coal Mines Legislation Amendment and Revival Act 1998 (59 of 1998): Part 3 revived aspects of the repealed Coal Mines Regulation Act 1946 for transitional purposes, validated prior acts under that regime, prescribed the use of moneys in the Relief Fund and directed transfer of any balance to the subsection (1a) account (compilation notes and Pt 3, ss 7-12). The 1998 Act came into operation on 31 December 1998 and created the revival/validation framework recorded in the compilation notes.

• 2004 Courts legislative changes: Courts Legislation Amendment and Repeal Act 2004 made consequential deletions and changes; the compilation table records commencement of those changes on 1 May 2005 for certain provisions.

• 2006 amendments: Coal Miners’ Welfare Amendment Act 2006 (17 of 2006) inserted new governance and operational provisions including s 7 (inspection of records), s 9 (membership), s 10 (deputy and temporary Members), and adjusted application of financial Acts (s 18 insertion as amended by Financial Legislation Amendment and Repeal Act 2006 s 17). Those changes took effect from 1 January 2007 and 1 February 2007 in relation to the financial legislation application (compilation table).

• 2009-2011 technical amendments: Acts Amendment (Bankruptcy) Act 2009 (18 of 2009) affected s 11(d) by importing the Interpretation Act insolvency references; the Standardisation of Formatting Act 2010 and Statutes (Repeals and Minor Amendments) Act 2011 made formatting and minor amendments (compilation table).

The compilation table records each amending Act, the section amending the Coal Miners’ Welfare Act 1947, and commencement details. Readers should consult the compilation table when tracing the provenance of specific text, for example the insertion dates for s 7 and s 9 introduced in 2006, and the historical origin of the subsection (1a) account rule in the 1968 amendment and its later interaction with the 1998 revival provisions.

The text provided does not cite any judicial decisions interpreting the Coal Miners’ Welfare Act 1947, nor does it reproduce case law. The Act itself contains validation clauses (s 22A) and the compilation materials include statutory revival and validation in the Coal Mines Legislation Amendment and Revival Act 1998 Pt 3, which were legislative responses to legislative repeal and continuity issues rather than judicial rulings. Consequently, there is no specific litigation history recorded in the source material to reference.

Practical areas where litigation or contested proceedings are foreseeable, given the Act’s structure, include:

• Amounts payable and measurement disputes: Section 6 triggers obligations based on "output" for the quarterly contribution and "output ... sold" for the six‑monthly contribution (s 6(1), (1a)). Disputes may arise about the correct measure of tonnes, the period over which output is attributed to a particular owner where ownership changes occur during the reference period, and whether the prescribed amount per tonne has been applied correctly. Such disputes would be litigated as civil debt claims or may involve statutory interpretation.

• Ownership and change‑of‑ownership issues: The Act ties liability to the owner of every coal mine "during the preceding 3 months" or "during the preceding 6 months" (s 6(1), (1a)). Where ownership transfers occur mid‑period, competing claims about liability for the contribution may invite court determination.

• Inspection powers and obstruction: Section 7 gives the Secretary power to examine records of "any person" necessary to determine amounts payable and restricts copying to necessary records (s 7(1)-(2)). A person who obstructs inspection commits an offence (s 7(4)). Litigation might concern the scope of the Secretary’s powers, what constitutes reasonable time for examination, or the legality of copying particular categories of records.

• Recovery mechanisms and evidentiary thresholds: The Act allows the Board to recover unpaid sums as a debt and to commence proceedings in the Board’s name via the Secretary or authorised officer (s 6(1), s 25). The procedural rule that an averment of authority is conclusive (s 25(2)) narrows evidentiary challenges to authority but does not remove substantive defences to debt recovery claims which would be determined under civil procedure rules.

• Application of Fund monies and Ministerial directions: The Board must consult owners before applying subsection (1a) account money and may only apply that money with prior Ministerial approval for certain non‑miner amenities (s 16(1a), (3)). Disputes could arise over the adequacy of consultation, whether Ministerial approval was properly obtained, or whether the Board acted outside its functions when spending from particular accounts.

• Challenges relating to Historic Relief Fund entitlements: The 1998 revival and validation provisions concern historical rights under the repealed Coal Mines Regulation Act 1946 and the Coal Mines Accident Relief Fund, including lump sum payments to entitled relatives and the cessation of injury entitlements upon such payments (Coal Mines Legislation Amendment and Revival Act 1998 Pt 3, ss 9-11). Disputes related to how those returns were handled before the legislative revival may be litigated or administratively reviewed, though the 1998 Act contains extensive validation provisions intended to preclude some challenges.

Because the source text does not reference judicial decisions, practitioners should search relevant legal databases and court records for decisions that interpret s 6, s 7, s 16 and s 17, or that concern the Board’s exercise of its borrowing and property powers, the operation of the recovery provisions, or the application of the Financial Management Act 2006 and Auditor General Act 2006 to the Board. The Act’s evidentiary rules for process (s 25(2)) and the explicit Ministerial direction power (s 16(2)) are likely to feature in any governance‑related disputes.

Timing and dual payment streams: The Act requires both quarterly payments based on output produced in the preceding three months (s 6(1)) and a biannual 0.4101 cent per tonne payment on coal sold over the preceding six months (s 6(1a)). Practitioners should not assume the second payment replaces the first; s 6(1b) requires the two streams to be credited to separate Fund accounts. Confusion about which amounts are due when and which account they feed could lead to under‑payment, debt recovery and penalties.

Penalty magnitude and character: Non‑payment attracts a statutory penalty equal to the amount owing (s 6(3)). That is a 100% monetary penalty, recoverable as a debt. This is not a small administrative fine; it doubles the owner’s liability. Recovery expenses are deducted from penalties before being credited to the Fund (s 6(4)), which may affect claims calculations.

Record inspection and copying limits: The Secretary may examine records of any person necessary to determine amounts payable and may make copies only of records required for that purpose (s 7(1)-(2)). The copying limitation should be read strictly; the Secretary’s right is not a carte blanche. However, the Act also allows the Board to authorise another person to perform the Secretary’s functions (s 7(3)), which may mean third‑party inspectors act under written Board authority. Practitioners should prepare to allow reasonable access but protect irrelevant or privileged material, and seek clarity on the scope of “required” records.

Consultation requirement for subsection (1a) account spending: The Board must consult owners before applying money from the subsection (1a) account (s 16(3)). Consultation is a ringing procedural duty; failure to consult owners before spending subsection (1a) moneys could give rise to administrative challenge or stakeholder dispute. Additionally, s 16(1a) requires Ministerial approval to apply subsection (1a) account moneys to certain purposes; that creates a two‑step constraint: Ministerial approval and owner consultation.

Ministerial directions and Board autonomy tension: The Minister may give general directions that the Board must give effect to (s 16(2)). The Board’s statutory discretion is therefore qualified by political or administrative override, which can affect expectations about independent grant decisions or long‑term investments. Practitioners advising the Board or recipients should be conscious that ministerial directions can alter priorities and approved uses of Fund monies.

Borrowing secured against the Fund with Minister approval: The Board can borrow and mortgage or charge Fund property as security with Minister approval (s 17(d)). That power raises questions about risk allocation and the potential for future claims on Fund assets. Lenders will want to verify Ministerial approval. From the perspective of beneficiaries and owners, secured borrowing may diminish the Fund’s availability for amenities.

Employee status outside public sector employment rules: Persons appointed or employed by the Board are not subject to Part 3 of the Public Sector Management Act 1994 (s 15(2)). That means employment entitlements, disciplinary frameworks and dispute resolution mechanisms may differ from State public sector norms. Boards and practitioners must therefore create explicit employment contracts and policies compliant with relevant employment law.

Prescribed fees and subordinate law gaps: The Act references prescribed amounts without stating the quarterly per‑tonne rate (s 6(1) refers to "the prescribed amount per tonne"). Practitioners must check regulations, gazette notices or other subordinate instruments to find the operative rate. Absence of an up‑to‑date subordinate instrument could cause compliance uncertainty.

Regulatory penalties vs general penalty: Regulations may impose penalties up to $5,000 (s 27(3)); the Act’s general penalty is $10,000 (s 23). Where both exist, understanding which penalty applies to a specific contravention is critical. The general penalty covers offences for which no specific penalty is provided, whereas regulations can create specific contraventions with distinct fines.

Validation clauses and historical entitlements: Section 22A validates certain earlier payments from the Fund for amenities other than those in s 16(1). The compilation material surrounding the 1998 revival includes validation of prior appointments and payments under the repealed Act. Legal counsel analysing historical claims should consider these validation provisions carefully; they can bar challenges to earlier acts and define the current composition of Fund balances.

Evidentiary conclusive averment for proceedings: Section 25(2) states that an averment on process that the Secretary or officer is authorised is conclusive proof. That procedural rule makes it harder to challenge the Board’s locus to sue but does not preclude contesting the merits of the underlying debt or penalty. Defendants must therefore focus on substantive defences rather than procedural ones.

Who controls appointment: Two Board seats are tied to union presidents or prescribed bodies (s 9(1)(a)-(b)); the third is a Governor appointment (s 9(1)(c)). The chair is the Member from s 9(1)(a) (s 9(2)). Stakeholders should note that governance composition is not a mix of employer or government appointees but prominently union represented; that affects decision‑making culture and priorities.

Audit regime complexity: Applying the Financial Management Act 2006 and Auditor General Act 2006 (s 18) brings with it specific budgeting, reporting and audit timing obligations which the Board must meet. Non‑compliance with those Act obligations brings obligations and potential administrative consequences beyond this Act’s own penalty framework.

For mine owners

1. Calculate and pay contributions on schedule. Maintain systems to produce reliable tonne output figures for the quarterly production periods ending 31 December, 31 March, 30 June and 30 September, and to calculate the prescribed per‑tonne charge for those periods payable in January, April, July and October respectively (s 6(1)). Separately, track coal sales for the six‑month periods ending 31 December and 30 June and pay 0.4101 cent per tonne in January and July for coal sold during those periods, crediting the subsection (1a) account (s 6(1a), (1b)).

2. Keep robust, auditable records. Given the Secretary’s power to examine records of any person necessary to determine amounts payable under s 6 and to make copies only of required records (s 7(1)-(2)), maintain production, sales, ownership transfer and custody records that clearly tie tonnes to the relevant owner and period. Ensure records are accessible at reasonable times.

3. Prepare for inspection. Develop internal procedures to respond to a Secretary’s inspection request, identify protected or privileged material, and minimise disruption. Cooperate with authorised persons acting under written Board authority to avoid obstruction liabilities (s 7(3)-(4)).

4. Monitor prescribed amounts and subordinate instruments. The Act refers to a prescribed amount per tonne for the quarterly levy (s 6(1)). Confirm the current prescribed rate in regulations, gazette instruments or Board determinations.

5. Budget for the full liability. Understand that non‑payment triggers a penalty equal to the outstanding amount (s 6(3)). Provision for potential double liability and recovery expenses is prudent.

6. Document ownership changes. Where ownership of a mine changes, ensure transactional documentation records the effective date of ownership and the parties’ agreement about liabilities for the contribution periods, because s 6 attributes liability to the owner during the relevant period.

For the Board and administrators

1. Financial management and audit compliance. Implement budgeting, reporting and audit procedures that comply with the Financial Management Act 2006 and the Auditor General Act 2006 as applied by s 18. Ensure annual reporting, internal controls and audit responses meet statutory requirements.

2. Account separation and ring‑fencing. Operate separate ledgers for the Fund and the subsection (1a) account as mandated (s 6(1b), 16(4)). Track any moneys transferred from historical Relief Fund balances as recorded in the 1998 revival provisions.

3. Ministerial approvals and consultations. For applications of subsection (1a) account funds, obtain prior Ministerial approval and consult owners as required by s 16(1a)-(3). Keep formal records evidencing consultation and approvals.

4. Governance and appointment clarity. Ensure Board membership is consistent with s 9 and that deputy and temporary Member arrangements are documented and used appropriately under s 10. Maintain written appointment instruments and resignation/removal records in line with s 11-12.

5. Debt recovery procedures. Establish procedures for issuing notices of amounts due, commencing debt recovery in the Board’s name via Secretary or authorised officers (s 25(1)), and accounting for penalties which must be paid into the Fund net of recovery costs (s 6(4)). Ensure legal processes record the conclusive averment of authority as permitted by s 25(2).

6. Employment arrangements. Draft employment contracts and policies for Board staff outside Part 3 of the Public Sector Management Act 1994 (s 15(2)). Where borrowing or secondment arrangements with public servants are used under s 15(4), document Ministerial consent and terms.

7. Borrowing governance. If considering borrowing secured on Board property or the Fund, obtain Ministerial approval as required by s 17(d) and ensure legal documentation reflects the Board’s statutory capacity to grant security. Assess the implications for Fund sustainability and beneficiary programs.

8. Grants and expenditure policy. Draft clear grant application, assessment and reporting processes for scholarships, bursaries and grants (s 17(f)-(g)), and tie them to the Board’s statutory objects in s 16(1). Where expenditure may concern non‑miner beneficiaries, secure Ministerial approval and consult owners as required by s 16(1a)-(3).

For legal, compliance and accounting advisers

1. Audit trail and evidence. Advise clients to keep audit‑quality records linking tonnes to owners and sales to accounting entries. Anticipate Secretary inspections and ensure that evidence for both the quarterly and biannual calculations can be produced without disclosing irrelevant documents.

2. Regulatory monitoring. Monitor regulations under s 27 for any prescribed amounts, administrative requirements, or new regulatory offences and penalties. The Act leaves significant operational detail to subordinate law.

3. Transactional drafting for transfers. Where mines change hands, draft transfer agreements that expressly allocate liability for s 6 obligations and preserve indemnities and warranties to prevent disputes about the owner during the reference period.

4. Risk modelling for Fund exposure. If advising lenders or Boards about borrowing secured on Fund assets, model Fund cashflows, likely contribution receipts, potential recovery rates, and the effect of secured debt on available amenities funding. Ensure Ministerial approval processes are observed.

5. Historical entitlements review. If advising on historical claims arising before the 1968 amendment or under the repealed Coal Mines Regulation Act 1946, review the 1998 revival and validation provisions, including the treatment of Relief Fund moneys and the requirement for lump sum payments to entitled relatives (Coal Mines Legislation Amendment and Revival Act 1998 Pt 3, ss 9-11).

6. Dispute readiness. Prepare for disputes by identifying likely defences to debt claims including measurement errors, ownership disputes, and procedural challenges to inspections. Given s 25(2), focus defences on substantive merits rather than on authority to commence proceedings.

Practical checklist summary

• Owners: confirm current per‑tonne rates, calculate quarterly and biannual payments, maintain production and sales records, allow reasonable inspection, budget for penalties.

• Board: maintain separate accounts, comply with Financial Management Act 2006 obligations, seek Ministerial approvals where required, consult owners when required, document decisions and approvals, and set out clear employment arrangements.

• Lawyers and accountants: confirm application of subordinate instruments, draft clear transfer and indemnity clauses for ownership changes, advise on audit responses, and structure grant agreements and borrowing documentation to reflect Ministerial approval processes.

The Act prescribes specific obligations and enforcement routes; compliance requires operational systems for production measurement, record retention, timely payments, and institutional processes to obtain required approvals and to manage the Fund within the Financial Management Act 2006 and Auditor General Act 2006 frameworks.
