#### 50 Prevention of unauthorised work 50 Prevention of unauthorised work > > (1) If a person is carrying out work without an approval required under Part 3, or carries out work that is not in accordance with such an approval, the Chief Executive may, by notice in writing given to the person, direct the person to cease carrying out that work until the necessary approval is obtained or unless it conforms with the approval. > > > (2) A person who contravenes the notice is guilty of an offence. > > > > Maximum penalty—24 penalty units. > > > (3) The Chief Executive may bring proceedings in the Land and Environment Court for an order to restrain the carrying out of work in contravention of any such notice. > > > (4) If the Land and Environment Court is satisfied that the notice will be contravened unless restrained by order of the Court, it may make such order as it thinks fit to restrain the contravention. > > **s 50:** Am 2024 No 48, Sch 1\[52\].
