#### 43 Power to enter premises without consent 43 Power to enter premises without consent > > (1) An authorised officer may enter premises or any part of premises (other than premises or any part of premises used as a residence) without the consent of the occupier of the premises. > > > (2) An authorised officer may enter the premises without the consent of the occupier of the premises only at any of the following times— > > > > > (a) at any reasonable time during the day, > > > > > (b) at any other time the premises are open for entry. > > > (3) Before entering premises without the consent of the occupier, an authorised officer must give the occupier reasonable notice of the intention to enter the premises unless— > > > > > (a) notice would defeat the purpose for which entry is required, or > > > > > (b) it is an emergency.
