sec.46 Person who knows or ought to know cannot make assumptions
This Division does not entitle a person to make an assumption, and does not prevent an assertion being made in relation to an assumption, if— the person has actual knowledge that the assumption is not correct; or the person ought to know that the assumption is not correct because of the nature of the person’s connection or relationship with the co-operative.
- (a) the person has actual knowledge that the assumption is not correct; or
- (b) the person ought to know that the assumption is not correct because of the nature of the person’s connection or relationship with the co-operative.
