557 Compensation orders

> > (1) Compensation for damage suffered The Supreme Court may order a person to compensate a co-operative for damage suffered by the co-operative if—
> >
> > > (a) the person has contravened a civil penalty provision in relation to the co-operative; and
> >
> > > (b) the damage resulted from the contravention.

> > The order must specify the amount of the compensation and may be made under this subsection whether or not a declaration of contravention has been made under section 554.

> > (2) Damage includes profits In determining the damage suffered by the co-operative for the purposes of making a compensation order, profits made by any person resulting from the contravention or the offence are to be included.

> > (3) Recovery of damage A compensation order may be enforced as if it were a judgment of the Supreme Court.
