228 Record‑keeping requirements—quotation of OTN

Scope (1) This section applies if: (a) a person (the supplier) supplies an amount of natural gas, liquefied petroleum gas or liquefied natural gas to another person (the recipient); and (b) the recipient quotes the recipient’s OTN in relation to the supply. Record‑keeping requirements (2) The supplier must retain: (a) the statement by which the quotation was made; or (b) a copy of that statement; for 5 years after the quotation occurred. (3) The recipient must: (a) make a copy of the statement by which the quotation was made; and (b) retain that copy for 5 years after the quotation occurred. Civil penalty (4) Subsections (2) and (3) are civil penalty provisions.

Note: Part 17 provides for pecuniary penalties for breaches of civil penalty provisions.
