#### 138 Liability transfer certificate—statutory guarantee Scope (1) This section applies if: (a) a company was the holder of a liability transfer certificate throughout the whole or a part of an eligible financial year; and (b) a person consented under subsection 81(3) or 85(4) to the making of the application for the certificate. Guarantee (2) The person is taken to have guaranteed the payment by the company of the following amounts: (a) an amount of unit shortfall charge payable by the company in relation to a unit shortfall for the eligible financial year; (b) an amount payable under section 135 because of the late payment of an amount covered by paragraph (a).
