111 Consent to search (1) Before obtaining the consent of a person for section 110, a police officer must inform the person that the person may refuse to give consent.
Classification of Publications, Films and Computer Games Act 1985 57 (2) A police officer who obtains the consent of a person for section 110 must ask the person to sign an acknowledgment of: (a) the fact that the person has been informed that he or she may refuse to give his or her consent; and (b) the fact that the person has voluntarily given his or her consent; and (c) the date on which, and the time at which, the person gave his or her consent. (3) If it is material, in any proceedings, for a court to be satisfied of the voluntary consent of a person for section 110 and an acknowledgment, in accordance with subsection (2), signed by the person has not been produced in evidence, the court must assume, unless the contrary is proved, that the person did not voluntarily give consent.
