Classification (Authorised Television Series Assessor Scheme) Determination 2008

The Classification (Authorised Television Series Assessor Scheme) Determination 2008 (the Determination) establishes a delegated classification pathway under the Classification (Publications, Films and Computer Games) Act 1995 (the Act). It enables the Director of the Classification Board to authorise individuals as authorised television series assessors who may then prepare assessments of television series films, including all episodes and series-related material, for the purpose of classification applications under section 14B of the Act. The Determination sets out the criteria for authorisation, the grounds on which authorisation may be revoked, and the circumstances in which the Director may issue a barring notice preventing a person from being authorised or from submitting assessments for a period of up to three years.

The core function of an assessment under this scheme is to replace the need for the Board to view every episode of a long-running television series before making a classification decision. Instead, the assessor provides a detailed written analysis that identifies the impact of every classifiable element (themes, violence, sex, language, drug use and nudity), the location of the highest impact elements, the cumulative impact across the entire product, and a recommended classification at the level of the highest impact content. Since the 2014 amendment, the assessment must also include a recommended consumer advice line.

If the Director or the Board disagrees with the recommended classification, the Determination requires the Director to notify the applicant in writing, state the particulars of the disagreement, and invite the applicant to make additional submissions within 14 days before the Board makes its decision. This creates a procedural safeguard but does not guarantee that the assessor's recommendation will be adopted. The Board retains ultimate authority over the classification.

The Determination also provides for review by the Administrative Appeals Tribunal of certain decisions: revocation of an assessor's authorisation, issuance of a barring notice to an assessor, and issuance of a barring notice to an applicant. This ensures that the Director's discretionary powers are subject to external merit review.

The Determination relies on several defined terms from the Act and introduces its own interpretive rules. An authorised television series assessor is a person whom the Director has authorised in writing under section 4 of the Determination. Authorisation is conditional: the person must have completed training approved by the Director, and must not be subject to a barring notice under section 6. There is no provision for authorisation by class or for automatic renewal, so each authorisation is person-specific and the Director retains ongoing control.

A television series film is defined by reference to the Act and includes multiple episodes and series-related material. The concept of assessment is central: it is the written analysis prepared under section 14B of the Act, the required contents of which are set out in section 10 of the Determination. An assessment must address every episode and all series-related material, identify the impact of every classifiable element, the impact and location of the highest classifiable elements, and the cumulative impact. It must include a recommendation on the appropriate classification at the level of the highest impact content, and since the 2014 amendment, a recommendation on consumer advice.

The term barring notice has the same meaning as in paragraph 14B(4)(d) of the Act. It is a written notice from the Director that prevents a person from being authorised as an assessor (section 4(2)(b)) or from submitting further assessments (section 8(3)). A barring notice can be issued to an assessor if the Board revokes a classification of a film that was assessed by that person, or if the person has prepared two or more assessments containing misleading, incorrect or grossly inadequate information. For an applicant, a barring notice requires that the applicant has submitted two or more applications accompanied by assessments containing misleading information, and that the Director has revoked the authorisations of the assessors who prepared those assessments because of that information.

Misleading, incorrect or grossly inadequate information is given specific meaning in subsection 3(2). An assessment is taken to contain such information if classifiable elements are not identified, or if they are identified as having a lower impact than the classification guidelines suggest. The same deeming applies if material is recommended for classification at a lower level than the Board would consider appropriate, but only when combined with one of the two identification failures. This is a strict deeming provision; it does not require proof of intent or negligence, only that the assessment objectively fails to meet the standard set by the classification guidelines.

The Determination directly affects three categories of persons: authorised television series assessors, applicants for classification of television series films, and the statutory office holders (the Director and the Classification Board) who administer the scheme. Indirectly, it affects the producers, distributors, and broadcasters of television series films who rely on the classification outcomes to market, distribute, or broadcast their content in Australia.

For authorised television series assessors, the Determination creates a professional status that is both a privilege and a source of regulatory risk. Assessors must maintain their training (section 5(2)(b)), and their authorisation can be revoked if they produce a single assessment that fails to identify classifiable elements or produces a misleading analysis, even if the Board later classifies the film differently. They are also subject to barring if they produce two or more flawed assessments or if the Board revokes a classification that relied on their assessment. There is no right to a warning or a grace period before revocation; the Director may act as soon as satisfied one of the conditions applies.

For applicants, who are typically production companies or distributors, the scheme offers a faster and potentially cheaper route to classification for long-running series. Instead of submitting every episode for Board viewing, they can engage an authorised assessor to prepare a consolidated assessment. However, applicants bear the risk that the assessor's work is accurate. If they submit two or more applications with assessments that contain misleading information and those assessments lead to the revocation of the assessors' authorisations, the Director may bar the applicant from using the scheme for up to three years (section 8). This creates a powerful incentive for applicants to carefully vet and supervise the assessors they engage, since the applicant's own access to the scheme can be cut off based on the cumulative failures of its chosen assessors.

The Director and the Board are the decision-makers under the scheme. The Director authorises assessors, approves training, decides on revocations and barring notices, and must notify applicants if the Board disagrees with a recommended classification. The Board makes the final classification decision and has the power to revoke a classification under section 21AB of the Act, which can trigger consequences for the assessor. The Determination imposes administrative burdens on the Director: each barring notice and revocation is a reviewable decision, likely requiring formal reasons and procedural fairness before the AAT.

Duties of authorised television series assessors: The primary duty is to prepare assessments that comply with section 10. An assessment must deal with each episode and all series-related material, identify the impact of every classifiable element, identify the impact and location of the highest classifiable elements, identify the cumulative impact, include a recommendation on the appropriate classification at the level of the highest impact content, and include a recommendation on appropriate consumer advice. The assessor must also ensure that the information is not misleading, incorrect or grossly inadequate as defined by subsection 3(2). This duty is strict in the sense that the deeming provision operates regardless of the assessor's intent or care. Additionally, assessors must complete training approved by the Director when requested, and they must cooperate with any barring notice that precludes them from acting.

Rights of assessors: An assessor may apply to the Administrative Appeals Tribunal for review of a revocation decision under section 5(1) or the issuance of a barring notice under section 6(1). This is the only express right; there is no right to be heard before a barring notice is issued, nor a right to continue acting while a review is pending (the notice takes effect from the date specified, per section 6(2)). The right to AAT review is a standard procedural safeguard but does not suspend the Director's decision.

Duties of applicants: An applicant must not submit an assessment with an application for classification if a barring notice under section 8 is in force. This is a prohibition with no exception. The applicant also has a practical duty to ensure that the assessor it engages is competent and that the assessment is accurate, because the applicant's own access can be cut off if the assessor's failures accumulate to the threshold in section 8(1).

Rights of applicants: An applicant has the right to receive a written notice from the Director if the Director or Board disagrees with the recommended classification, stating the particulars of the disagreement (section 11). The applicant then has 14 days after receiving the notice to make additional submissions before the Board makes its decision. This is a procedural right that allows the applicant to correct misunderstandings or provide context. The applicant also has a right to AAT review of a barring notice under section 8(1).

Rights of the Director and Board: The Director has the discretionary power to revoke authorisations and issue barring notices, subject to the conditioning provisions. The Board has the underlying classification power under the Act, which is not modified by this Determination. The Determination does not impose any duties on the Board itself beyond those in the Act; the Board may accept, reject, or modify the assessor's recommendation.

The Determination does not create criminal offences or civil penalties. Its enforcement mechanisms are administrative: revocation of authorisation, barring notices, and the deeming of assessments as misleading for the purpose of those decisions. These are severe in their practical effect because they can permanently or temporarily exclude a person from participating in the scheme.

Revocation of authorisation under section 5(1) can occur if any of three conditions in subsection 5(2) is satisfied: (a) the assessor prepared an assessment and the film contained classifiable elements that were not brought to the Board's attention, or were brought to its attention but the assessment was misleading, incorrect or grossly inadequate; (b) the assessor failed to complete further training requested by the Director; or (c) the assessor has prepared two or more assessments that contain misleading, incorrect or grossly inadequate information. Condition (a) is notable: a single instance of a flawed assessment, even if the deficiency was brought to the Board's attention, can justify revocation. The Director's satisfaction is the only trigger; there is no requirement for a pattern of non-compliance or for harm to have occurred.

Barring notice to an assessor under section 6(1) can be issued if either: the Board revoked a classification of a film that was assessed by the person, or the person has prepared two or more assessments containing misleading information. The barring notice takes effect from the date specified and lasts up to three years. While the notice is in force, the person cannot be authorised as an assessor (section 4(2)(b)).

Barring notice to an applicant under section 8(1) requires a higher threshold: the applicant must have submitted two or more applications with assessments that contained misleading information, and the Director must have revoked the authorisations of the assessors who prepared those assessments because of that information. This links the applicant's fate to the Director's decisions regarding the assessors. The applicant is then barred from submitting assessments with future applications for up to three years. The notice takes effect from the date specified and continues in force for the period specified (not exceeding three years). There is no possibility of lifting the bar early; the Determination does not provide for variation or revocation of a barring notice.

All three decisions are reviewable by the AAT, but the Determination does not provide for a stay or suspension of the decision pending review. This means that an assessor or applicant may be excluded from the scheme for the duration of the AAT process, which could take many months.

The Determination is made under the Classification (Publications, Films and Computer Games) Act 1995, specifically under the power to make determinations about the assessment of films for classification. It operates as a delegated legislative instrument within the framework of the Act. The Act provides the foundational definitions (authorised television series assessor, Board, Director, television series film, classifiable elements, classified) which are adopted by reference in section 3 of the Determination.

Section 14B of the Act is the provision that allows an application for classification of a television series film to be accompanied by an assessment prepared by an authorised television series assessor. The Determination fills in the procedural details: what the assessment must contain, how the Director deals with disagreement, and the consequences for flawed assessments. Without the Determination, section 14B would have no operative effect, since the assessor scheme would not be established.

The classification guidelines made under section 12 of the Act are the benchmark for determining whether an assessment is misleading, incorrect or grossly inadequate. Subsection 3(2) directly ties the Determination to those guidelines: an assessment is deemed problematic if classifiable elements are identified as having a lower impact than the guidelines suggest. This means that any amendment to the classification guidelines automatically affects the operation of the Determination, without any need for amendment to this instrument.

The Administrative Appeals Tribunal Act 1975 governs the review of decisions under sections 7 and 9 of the Determination. The AAT has jurisdiction to review the merits of the Director's decisions on revocation and barring notices. The Determination does not set out any special procedural rules for these reviews, so the standard AAT procedures apply, including the possibility of a stay of the Director's decision (under section 41 of the AAT Act), though the Determination itself does not provide for one.

There is no direct interaction with state or territory classification laws, as the Commonwealth Act and its instruments are uniform national laws. However, the enforcement of classification decisions (e.g., prohibiting the sale or exhibition of unclassified or refused classification material) is typically handled by state and territory enforcement agencies under their own legislation. The Determination does not address enforcement; it only addresses the classification process.

The Legislative Instruments Act 2003 (now the Legislation Act 2003) applies to the Determination as a legislative instrument. It is registered on the Federal Register of Legislative Instruments, and is subject to parliamentary scrutiny and disallowance. The compilation endnotes confirm registration under FRLI.

The Determination was originally made in 2008 and commenced on 1 January 2009, on the commencement of Schedule 2 to the Classification (Publications, Films and Computer Games) Amendment (Assessments and Advertising) Act 2008. As originally enacted, the Determination contained no requirement for consumer advice in assessments. Section 10(e) was introduced by the Classification (Authorised Television Series Assessor Scheme) Amendment (Consumer Advice) Determination 2014, which was registered on 19 December 2014 but backdated to commence on 11 December 2014. This is the only amendment to date. The amendment history (Endnote 4) shows only that paragraph 10(e) was amended (actually inserted) by the 2014 instrument.

The 2014 amendment was minor in scope but significant in effect. It added the requirement that an assessment must include "a recommendation on the appropriate consumer advice for the television series film". Consumer advice is the descriptive label that accompanies a classification (e.g., "Mature themes, violence") and is used by consumers to make informed choices. Prior to this amendment, the assessment only needed a classification recommendation; the Board would determine consumer advice separately. Now the assessor must also propose the consumer advice, which reduces the Board's workload but also shifts more responsibility onto the assessor.

The compilation endnotes indicate no uncommenced amendments, no modifications, and no misdescribed amendments as of the compilation date (2 December 2014, with effect from 11 December 2014). The legislation history shows only the two instruments. No further amendments appear in later compilations within the source provided.

The source provided does not reference any litigation or tribunal decisions involving the Determination. The Determination itself includes provisions for AAT review (sections 7 and 9), but there is no information about whether any decisions have been challenged. Given the relatively narrow scope of the scheme and the small number of authorised assessors (which is not specified in the instrument), it is plausible that few decisions have been reviewed. However, the AAT may have made decisions that are not recorded in the instrument. The endnotes contain no miscellaneous information that would indicate reported cases.

In the absence of cited cases, one can infer potential litigation risks. The definition of "misleading, incorrect or grossly inadequate" in subsection 3(2) could be contested in a merits review if the assessor argues that the assessment complied with the classification guidelines but the Director formed a different view. The AAT might need to consider the meaning of "lower impact than the classification guidelines suggest" and whether the Board's own interpretation of the guidelines is the correct benchmark. There may also be disputes over whether an applicant's barring notice under section 8 can be issued if the Director revoked the assessor's authorisation but the assessor successfully overturned that revocation at the AAT. The Determination does not address this scenario; it only requires that the Director "revoked the authorisation" under section 5. If the revocation is set aside on review, it might be arguable that the condition for the applicant's barring notice is no longer met.

Another area of potential dispute is the 14-day period for additional submissions under section 11. The Director must give notice of disagreement and invite submissions within 14 days after receiving the notice. If the Director fails to give notice, or if the applicant fails to receive it, the Board may proceed. The Determination does not specify what happens if the applicant misses the 14-day deadline due to circumstances beyond control. A challenge could be mounted on procedural fairness grounds, arguing that the Board should have allowed more time.

Several provisions in the Determination contain traps for the unwary assessor or applicant.

Trap one: the deeming provision in subsection 3(2) is strict and broad. An assessment is taken to contain misleading information if classifiable elements are not identified, or if they are identified as having a lower impact than the classification guidelines suggest. There is no requirement that the Director prove any harm, intention, or negligence. If an assessor misses a scene of drug use or understates the impact of violence relative to the guidelines, that alone deems the assessment flawed. Even an honest, careful assessor can fall foul if the Board later takes a stricter view of the guidelines.

Trap two: revocation on a single flawed assessment. Condition 5(2)(a) does not require multiple failures. A single assessment that fails to bring classifiable elements to the Board's attention, or that brings them but in a misleading way, is enough to revoke an assessor's authorisation. There is no warning system, no threshold of materiality, and no requirement that the deficiency actually caused a wrong classification. The Director may act immediately upon satisfaction.

Trap three: barring an applicant for the failures of others. Under section 8, an applicant can be barred if it has submitted two or more applications with assessments containing misleading information, and the Director has revoked the authorisations of the assessors who prepared them. The applicant's own conduct is irrelevant; it can be barred even if it chose a reputable assessor who turned out to be incompetent. This creates a moral hazard: the applicant has no direct control over the accuracy of the assessment but bears the consequence. The only safeguard is that the Director must have actually revoked the assessor's authorisation; if the Director chooses not to revoke (e.g., for a first minor error), the applicant cannot be barred.

Trap four: no grace period for barring notices under sections 6 and 8. The notices take effect from the date specified, which could be the date of issue. There is no obligation on the Director to give advance warning or allow the person to voluntarily withdraw from the scheme before the notice takes effect. The notice continues in force for up to three years, and the Determination does not provide a mechanism for early termination even if the person later demonstrates compliance.

Trap five: the 14-day submission period in section 11. The applicant only has 14 days after receiving the notice to make additional submissions. This period may be insufficient if the applicant needs to consult with the assessor or obtain legal advice, particularly if the disagreement is complex. The Determination does not allow the Director to extend the period. If the applicant misses the deadline, the Board will decide without the additional input.

For assessors, compliance begins with completing and maintaining approved training. The Director may request further training at any time, and failure to complete it is an independent ground for revocation (section 5(2)(b)). Assessors should keep records of training completion.

The core compliance obligation is preparing assessments that meet the strict requirements of section 10. Assessors must view every episode and all series-related material in full. They must systematically identify each classifiable element (themes, violence, sex, language, drug use, nudity) and assess its impact. The impact must be recorded with specific reference to the classification guidelines. If the guidelines indicate that a particular element at a certain intensity should result in an M classification, the assessor cannot recommend PG without explaining why the element is less impactful. But the deeming provision in subsection 3(2) does not allow room for subjective judgment if the Board would consider the guidelines differently; the assessment must match the Board's likely interpretation.

The assessment must state the cumulative impact across the entire product, not just the highest impact episode. The recommended classification must be at the level of the highest impact content, and the consumer advice must correspond to the elements present. The assessor should document the location of each classifiable element to enable the Board to verify the analysis.

Assessors should establish internal quality control processes before submitting assessments. A second assessor or a checklist based on the guidelines can help catch omissions or understatements. If an assessor discovers an error after submission, they should immediately notify the applicant and the Director to mitigate the risk of the assessment being used for classification.

For applicants, compliance means selecting assessors carefully. The applicant should verify that the assessor's authorisation is current and that the assessor has completed the required training. The applicant should also request a copy of the assessment before submission to check for completeness and plausibility. Engaging the same assessor repeatedly increases the risk of cumulative failures that could trigger a barring notice under section 8. If an assessor prepares two flawed assessments, the applicant can be barred even if the flaws were not the applicant's fault. Therefore, applicants should diversify their assessors and monitor the Director's decisions regarding revocations of assessor authorisations.

Applicants should also establish a procedure for handling disagreement notices under section 11. The 14-day period is short, so the applicant should have legal or regulatory advice readily available. The additional submissions should address the specific particulars of the disagreement, potentially including expert evidence from a different assessor or detailed explanations of the classifiable elements.
