60 Legal disabilities
(1) A claimant is not required to comply with an obligation under this
chapter while the claimant is under a legal disability.
Note If the claimant is a child, under s 51 (4) a parent or guardian of the child
may give the notice of claim for the child.
(2) The period within which the obligation must be complied with begins
when the claimant’s legal disability ends.
(3) This chapter applies to the claimant as if—
(a) a reference to the day the accident giving rise to the personal
injury happened were a reference to the day the claimant’s legal
disability ends; and
(b) all other changes were made to give effect to this section.
(4) This section does not prevent a claimant, or a person acting for a
claimant, from complying with an obligation under this chapter while
the claimant is under a legal disability.
legal disability—a claimant is under a legal disability in the
circumstances in which a person is under a disability for the
Limitation Act 1985.
