195 Referral by tribunal for mediation or neutral evaluation
(1) A tribunal may, by order, refer any proceeding, or any part of a
proceeding, before it for mediation or neutral evaluation, and may do
so either with or without the consent of the parties to the proceeding.
(2) Mediation is to be undertaken by a mediator appointed by the tribunal,
and neutral evaluation is to be undertaken by an evaluator appointed
by the tribunal.
Note The Court Procedures Act 2004, pt 5A (Mediation) applies to a mediation
in relation to an application to the ACAT.
