161 Receipt of carrier for increased charge
(1) If a person pays or agrees to pay a common carrier an increased
charge for transport of schedule 2 packaged goods, and the person
asks for a receipt, the carrier must give the person a receipt stating
that the goods are insured.
(2) If the carrier does not give the person the receipt—
(a) section 159 (2) (Liability of carriers for certain goods worth
more than $20) does not apply to the carrier; and
(b) the carrier is liable under the common law for the loss of, or
damage to, the goods; and
(c) if the person has paid an increased charge for the transport—the
carrier must refund the increased charge.
