108 Application—ch 8 (1) This chapter applies in relation to civil liability in tort. (2) This chapter extends to any such liability even if the damages are sought in an action for breach of contract or any other action. (3) However, this chapter does not apply to— (a) a claim to which the Motor Accident Injuries Act 2019, chapter 5 (Motor accident injuries—common law damages) applies; or (b) a claim under the Workers Compensation Act 1951.
