260F Buyer action if no disclosure update notice
(1) This section applies if a seller under an off-the-plan contract—
(a) is required under section 260B to provide a disclosure update
notice to a buyer; and
(b) does not provide the notice.
(2) The buyer may rescind the contract by written notice given to the
seller at any time before the contract is completed.
(3) However, if the requirement mentioned in subsection (1) (a) relates
to a material change that is a type 2 matter, the buyer—
(a) may only take action under subsection (2) if the buyer is
significantly prejudiced because of the material change; and
(b) if taking action under subsection (2)—must include in the
written notice to the seller a summary of the significant
prejudice suffered by the buyer because of the material change.
