260A Disclosure statement provided late or not at all
(a) 2 parties have entered into an off-the-plan contract; and
(b) the seller did not give the buyer a disclosure statement as
required under section 260 (1) before the parties entered into the
contract.
(2) The buyer may, by written notice, rescind the contract—
(a) if the seller has not given the buyer the disclosure statement—at
any time before the contract is completed; or
(b) if the seller gives the buyer the disclosure statement after the
contract is signed—within 21 days after the day the disclosure
statement is given to the buyer.
