257 Powers and duties of guardian
(1) A guardian of a child—
(a) may take into the guardian’s custody, and may manage, the
child’s real and personal property (other than property held by a
trustee under a trust) until the guardian stops being the guardian
of the child; and
(b) holds any of the child’s real and personal property that comes
into the guardian’s custody as trustee for the child; and
(c) may bring a proceeding necessary to give effect to all or any of
the guardian’s powers under this section, including the
guardian’s powers as trustee for the child; and
(d) is responsible for accounting to the child, when the child
becomes an adult, for the guardian’s custody and management
of the property.
(2) Subsection (1) does not apply in relation to—
(a) the director-general responsible for administering the Children
and Young People Act 2008, when the director-general has long-
term care responsibility for a child because of that Act; or
(b) a testamentary guardian of a child.
