Civil Aviation (Unmanned Aircraft Levy) Regulations 2021

The instrument is short and organised into two parts: a Preliminary Part containing identification, authority and a single definition, and a Part 2 containing the amount of levy (contents and headings at head of compilation). The key statutory concepts appearing in the text of the Regulations are the Act, the prescribed amount of levy, and the weight-based distinction for an RPA. Those concepts are implemented as follows.

• Authority linkage. The Regulations are made under the Civil Aviation (Unmanned Aircraft Levy) Act 2020 (reg 3). The Regulations therefore operate as subordinate legislation that supplies the prescribed amount required by the parent Act. The Regulations themselves define only the term Act to mean the parent Act (reg 4); no other definitions are supplied.

• Levy quantum. The only operative provision is regulation 5 which, for the purposes of subsection 6(1) of the Act, prescribes the amount: $40 for an RPA weighing more than 500 grams, and nil for RPAs weighing 500 gram or less (reg 5). The structure is categorical and flat: a single dollar amount for the heavier category, zero for the lighter category. The regulation uses the term RPA and a strict numerical cutoff at 500 grams.

• Referential operation. The prescription is expressly for the purposes of subsection 6(1) of the Act (reg 5). The Regulations do not purport to set out the operation of subsection 6(1) itself, nor do they replicate any other provisions of the Act. They thus operate as a delegated specification of one parameter the Act requires.

• Compilation and amendment record. The compilation includes endnotes that provide the legislation history and amendment information. The Regulation was registered and commenced in July 2021, and was amended by the 2023 Measures No. 1 Regulations which altered regulation 5 (Endnote 3; Endnote 4). The endnotes also record that editorial changes may be authorised under the Legislation Act 2003, and that any uncommenced amendments are not shown in the compiled text.

Because the Regulations supply only a monetary amount and a two-band weight threshold, the main statutory concept to focus on for downstream compliance and operational design is the weight threshold and its interaction with the Act’s requirements for when a levy is payable. The Regulations do not prescribe how weight is to be measured, the point at which measurement must be taken, how to treat modular or removable components, or any exemptions. Those are matters for the Act or other instruments.

The Regulations affect parties who are subject to the unmanned aircraft levy framework established by the Civil Aviation (Unmanned Aircraft Levy) Act 2020. The Regulations themselves do not define the universe of liable persons; they prescribe, for the purposes of the Act, the amount payable in relation to an RPA and the breakpoint by weight. Concrete consequences for specific actors therefore depend on the Act’s liability rules, but from the text of these Regulations a set of primary affected actors can be identified.

• Holders of levy liability in relation to an RPA. Regulation 5 applies "for the purposes of subsection 6(1) of the Act" and prescribes amounts "payable in relation to an RPA" (reg 5). That means any party who, under the Act, is required to pay the levy in relation to a particular RPA will be affected by the monetary specification in these Regulations. The Regulations do not state who that party is; the identity of the payer must be determined by reference to the Act.

• Manufacturers, importers and sellers. Because the Regulations set a weight-based threshold at 500 grams, entities involved in design, manufacture, importation, or product configuration are indirectly affected. The flat $40 amount for devices over 500 grams and nil for devices of 500 gram or less creates a discrete financial discontinuity at that weight point. Although the Regulations do not expressly regulate design or sales practices, those commercial actors face a predictable economic signal where an RPA just over 500 grams triggers a $40 levy per RPA where the same model at 500 gram or less attracts no levy, subject to the Act’s allocation of liability.

• Owners and end users. If the Act allocates liability to owners or operators of RPAs, owners and users of RPAs that weigh more than 500 grams will bear the $40 levy for each RPA for which levy is payable under subsection 6(1) (reg 5). The Regulations themselves do not set timing of payment, registration processes, or exemptions; such processes, if any, will be set out in the Act.

• Public sector or institutional purchasers. Government agencies, research institutions and businesses that hold fleets of RPAs will be able to calculate levy exposure using the flat rate specified in reg 5. The impact on cost per unit is directly calculable from the regulation’s single dollar figure.

• Secondary market and used devices. The Regulations do not distinguish between new or used RPAs. Any levy rule in the Act that applies to sales, transfers, or registrations of used RPAs will interact with this monetary prescription. The Regulations themselves do not address transfer timing or point of liability; those points must be sought in the Act.

The Regulations therefore have immediate effect on the marginal economic cost associated with owning or transacting RPAs above the 500 gram threshold, while leaving the allocation of who pays and when to the Act. The clear weight cutoff and the flat dollar figure mean affected parties can calculate per-unit cost exposure once they identify whether the Act places the levy on them in relation to a particular RPA.

The Regulations are narrowly framed and do not, of themselves, create new duties other than prescribing the amount of the levy for purposes of subsection 6(1) of the Act. Key duties and rights therefore arise by reference to their interaction with the parent Act. From the text of the Regulations the following duties and rights can be extracted or inferred, with caution where the Act must be consulted for full particulars.

• Duty to pay the prescribed amount in relation to an RPA. Regulation 5 prescribes an amount payable in relation to an RPA for the purposes of subsection 6(1) of the Act. The operative duty to pay, the timing of payment, penalties for non-payment, and the person on whom the duty rests are matters allocated by the Act; the Regulation fixes the amount that will be payable when the Act’s conditions are met (reg 5).

• Right to nil liability at or below the threshold. The Regulations give a statutory basis for nil levy for RPAs weighing 500 gram or less. If pursuant to the Act an RPA falls within that weight band, then the applicable prescribed amount is nil, and the relevant person has a right not to pay a levy amount under the monetary specification in reg 5. The Regulations themselves do not create an exemption; they are the price schedule that yields nil in the lighter band.

• Predictability of quantum. For RPAs that satisfy the heavier weight condition, the Regulations create a predictable, single-dollar liability figure: $40 per RPA for which levy is payable under the Act (reg 5). Where the Act imposes a per-RPA levy, the regulation fixes the dollar quantum so that estimations of aggregate levy obligations can be made by counting liable RPAs.

• No procedural or remedial rights in the Regulations. The Regulations are silent on refund mechanisms, dispute resolution, appeal rights, or remission of levy; they do not confer procedural rights or duties beyond prescribing the amount. Any such rights and duties will need to be located in the Act or other instruments administered under the Act’s framework.

• Delegated power context. The Regulations are made under authority granted by the Act (reg 3). The Regulations’ scope is therefore constrained to what the enabling Act allows the Governor-General or the responsible Minister to prescribe. The definition provision in the Regulations only defines the term Act itself (reg 4); the Regulations do not purport to expand or alter substantive definitions that would affect duties and rights.

• Amendment and temporal effect. The compilation shows that reg 5 has been amended (Endnote 4). Rights and duties that hinge on the prescribed amount will therefore change prospectively or as specified by the amending instrument. The Regulations do not by themselves specify transitional or saving arrangements for changes in the prescribed amount; those will be found in amending instruments or the Act.

In sum, the Regulations function as a price schedule. The primary duty created by the Regulations is a contingent one: when the Act makes a levy payable in relation to an RPA, the dollar amount to be paid is that which the Regulations prescribe. The Regulations confer no standalone procedural rights or exemptions.

The Civil Aviation (Unmanned Aircraft Levy) Regulations 2021 do not set out penalties, enforcement mechanisms, or criminal offences. The Regulations are limited to prescribing the amount of levy for the purposes of subsection 6(1) of the Civil Aviation (Unmanned Aircraft Levy) Act 2020 (reg 5) and do not include provisions addressing collection, compliance monitoring, sanctioning, or enforcement processes. The instrument’s Preliminary Part contains the authority clause linking the Regulations to the Act (reg 3) and a single definition of Act (reg 4), but no enforcement clauses.

Because the Regulations do not address penalties or enforcement, the following observations are confined to the text and the structure of the regulatory instrument and its compilation.

• Location of enforcement provisions. Any civil or criminal enforcement provisions, collection powers, interest on unpaid amounts, assessment procedures, or recovery mechanisms must be sought in the Act or other regulations or instruments made under the Act. The Regulations supply a monetary figure for the levy; they do not implement the administrative or sanctioning architecture necessary to collect or enforce the levy.

• Amendment history does not add enforcement content. The compilation and endnotes show that regulation 5 was amended by the Civil Aviation Legislation Amendment (2023 Measures No. 1) Regulations 2023 (Endnote 3; Endnote 4). The amendment history as recorded in Endnote 4 notes that s 5 was amended, but the endnotes do not indicate that the amendment introduced enforcement machinery into the Regulations.

• Practical consequence for enforcement design. Administrators and counsel designing compliance systems must therefore map the Act’s enforcement provisions to the monetary figures supplied by these Regulations. The Regulations will factor into enforcement only as the prescribed dollar amounts to be applied when the Act’s enforcement tools are used.

• Publication and notice. The compilation records registration and commencement dates (Endnote 3). Public notice and the law’s entry into force are recorded in the published instrument. Any enforcement action taken by an administrator will depend on the Act’s provisions regarding notice, assessment dates, and retrospective application, none of which appear in the Regulations.

• No administrative discretion in the Regulations. The Regulations do not grant operational discretion such as waiver powers, remission, or alternative payment schedules. If the administering authority is to have such discretion, it will be conferred by the Act or other instruments and not by this regulation.

Because the Regulations do not set enforcement measures, anyone seeking to advise on penalties, redress, or compliance consequences must consult the parent Act and any administrative guidelines or associated instruments that implement collection and enforcement in practice.

The Regulations operate as subordinate legislation and are explicitly made under the Civil Aviation (Unmanned Aircraft Levy) Act 2020 (reg 3). The text of the Regulations repeatedly references that relationship: regulation 5 prescribes the levy amount "for the purposes of subsection 6(1) of the Act" (reg 5). The compiled instrument’s endnotes also identify amendments and the legislative instruments that changed the Regulations, recording interaction with subsequent instrument-making processes (Endnote 3; Endnote 4). From the text and compilation, the following interaction points with other statutory material are evident.

• Direct dependency on the parent Act. The Regulations do not operate independently; their effect depends on the operation of the Civil Aviation (Unmanned Aircraft Levy) Act 2020. They supply the numerical parameter the Act requires. Any duty, liability allocation, enforcement power, or exemption referenced in the Act will interact with the dollar amounts prescribed by these Regulations. The Regulations therefore have legal effect only within the scope authorised by the Act (reg 3; reg 5).

• Referential dependency for definitions and mechanism. The Regulations define only the term Act (reg 4). Terms such as RPA, levy payable, person liable, measurement methods, or administrative process are not defined here and must be sourced from the Act or possibly other subordinate instruments or the relevant legislative dictionary. This means the Regulations rely on the Act and potentially other instruments to provide operative meaning for the terms they use.

• Amendment instruments and subordinate interactions. The compilation records that regulation 5 was amended by the Civil Aviation Legislation Amendment (2023 Measures No. 1) Regulations 2023 with commencement on 26 May 2023 and that the compiled instrument shows the text as amended to 26 May 2023 (Endnote 3; Endnote 4). That demonstrates interaction between regulations in the broader civil aviation legislative regime. The Regulations may therefore be subject to further amendment by future subordinate instruments authorised by the parent Act or by other amendment-making powers.

• Editorial changes under the Legislation Act 2003. The compilation endnotes explain that editorial and presentational changes may be made under the Legislation Act 2003 and that such changes do not alter the law’s effect (endnotes, "Editorial changes"). The Regulations as compiled may therefore include editorial refinements; for legal interpretation the underlying legislative language remains authoritative, subject to the Legislation Act’s authorised editorial changes.

• No explicit cross-reference to taxation or customs statutes. The Regulations make no express reference to taxation acts, customs, consumer protection, import duties, or other economic statutes. If interactions with taxation, import procedures, or consumer law exist, they must be identified by cross-referencing the Act or other instruments.

• Location of enforcement and procedural law. Because the Regulations do not address enforcement, they must be read with the parent Act to determine how the amount interacts with procedural laws such as assessment, recovery, objection and review procedures. The Regulations supply only a monetary input to the broader statutory machinery.

In short, the Regulations function as a delegated numerical specification that must be read in conjunction with the Civil Aviation (Unmanned Aircraft Levy) Act 2020 and any other instruments that define RPA, levy incidence, collection and enforcement. The endnotes record the regulatory amendment path and provide the formal legislative history for tracing any changes in interactions with related instruments.

The compilation includes a legislative history and an amendment history in the endnotes. The Regulations were initially registered as the Civil Aviation (Unmanned Aircraft Levy) Regulations 2021 on 27 July 2021 and commenced on 28 July 2021 (Endnote 3). The amendment history recorded in the compilation shows that Part 1, s 2 was repealed (as noted in the amendment table), and that regulation 5 in Part 2 was amended by the Civil Aviation Legislation Amendment (2023 Measures No. 1) Regulations 2023 (Endnote 4).

Key points in the amendatory record supplied in the compilation:

• Original registration and commencement. The instrument’s registration date is recorded as 27 July 2021 (F2021L01028) with commencement on 28 July 2021 (Endnote 3). That marks the original operative life of the Regulations.

• 2023 amendment. The endnotes list the Civil Aviation Legislation Amendment (2023 Measures No. 1) Regulations 2023 as an amending instrument, registered 25 May 2023 (F2023L00606) with commencement of Schedule 1 (items 73, 74) on 26 May 2023 (Endnote 3). The amendment history table in Endnote 4 specifically records that s 5 was amended by F2023L00606.

• Nature of the amendment to s 5. The main text as compiled shows the current content of regulation 5: $40 for RPAs weighing more than 500 grams and nil for RPAs weighing 500 gram or less (reg 5). The amendment history indicates that the numerical or structural content of s 5 has changed since original enactment; however, the compilation does not reproduce the prior text as an annotation. To see the prior variant of s 5 or transitional arrangements one must consult the amending instrument as published in the Federal Register of Legislation.

• Editorial and presentational changes. The compilation endnotes state that under the Legislation Act 2003, First Parliamentary Counsel can make editorial changes to a compiled law that do not affect legal effect, and that any such editorial changes are noted in the endnotes. The compilation contains that advisory material in the endnotes.

• Uncommenced amendments. The compilation warns that the effect of uncommenced amendments is not shown and that underlined text in the endnotes indicates whole or part not commenced. The endnotes instruct readers to consult the Legislation Register for uncommenced amendments.

• Misdescribed amendments. The endnotes include a description of the process for dealing with misdescribed amendments under the Legislation Act 2003, indicating "md not incorp" will be used if a misdescribed amendment cannot be given effect. The compilation itself does not indicate that any amendment to these Regulations is misdescribed.

For practitioners tracing changes to levy amounts or threshold policy, the compilation provides the immediate amendment record showing that regulation 5 has been subject to amendment and points to the specific amending instrument by schedule and item. Users who require the historical variants and transitional arrangements must consult the amending Regulations (F2023L00606) and the Federal Register entries cited in Endnote 3.

The compiled Regulations and their endnotes do not record any litigation or judicial consideration of the Civil Aviation (Unmanned Aircraft Levy) Regulations 2021. The instrument’s text and the included endnotes contain registration, commencement and amendment metadata, but they do not include references to cases or judicial review decisions. The compilation does not name any court proceedings, appeals, or judgments arising under these Regulations.

From the content provided, the following observations can be made strictly on the basis of the compiled instrument:

• No cases named in the compilation. The Regulations’ body and endnotes do not cite any judicial authority or decision that interprets or applies these Regulations. The absence of named cases in the compilation means that, within this document, there is no recorded case law that clarifies disputed points such as the interpretation of "weighs more than 500 grams", the identity of a liable person under the Act, or enforcement of levy obligations.

• Limitations of the compilation as a litigation source. The endnotes explain the composition of the compilation and the inclusion of amendment history and editorial notes. They do not purport to provide a comprehensive treatment of external legal materials, such as administrative decisions or court judgments. Therefore, the absence of litigation references in this compilation does not necessarily mean that disputes have not arisen in practice; it indicates only that no litigation history is recorded in this compiled instrument.

• Where to look for litigation. For practitioners seeking adjudicated points of law relating to the levy or its practical application, relevant authorities would be found in court and tribunal databases, Federal Court judgments, administrative appeal bodies, or publicly available litigation registers. Such searches are outside the scope of this compiled instrument, which only reproduces the Regulations and their legislative history.

• Potential for future litigation. The Regulations prescribe a monetary rule with a clear weight threshold. Where the Act allocates levy liability, disputes could arise about measurement techniques, treatment of modular attachments, or allocation of liability between buyers and sellers. The Regulations themselves do not pre-empt those disputes or provide interpretative guidance that would be binding on courts.

In short, the compilation contains no litigation history. Any litigated questions about the levy’s operation, the Act’s scope, or administration would need to be researched from external judicial sources beyond this compiled legislative text.

The Regulations are terse and narrowly focused. That brevity creates particular practical pitfalls for lawyers, accountants and compliance officers relying on the Regulations alone. The following are concrete "gotchas" derived from the Regulation’s text and the compilation material.

• Threshold precision. The cutoff is expressed as "more than 500 grams" for the $40 tier and "500 gram or less" for nil (reg 5). The asymmetry in wording places strict significance on exact weight measurements. This invites disputes about the moment of measurement, measurement standards, and whether rounding conventions apply. The Regulations do not specify whether weight is measured with or without accessories, batteries, detachable payloads, or packaging. The Act must be checked for measurement method; absent that, parties face uncertainty.

• RPA undefined in these Regulations. The Regulations use the term RPA in reg 5 but the only definition provided in these Regulations is Act meaning the parent Act (reg 4). Practitioners must not assume the meaning of RPA from this instrument; they must consult the Act or other instruments that define RPA. Relying solely on the Regulations risks misclassification of devices and erroneous levy treatment.

• Single flat amount for all heavier RPAs. The Regulations prescribe a single flat amount of $40 for any RPA weighing more than 500 grams (reg 5). There is no graduated scale based on weight, complexity, or commercial use. That creates a cliff effect: a device that weighs 501 grams attracts the same levy as a device weighing many kilograms, at least insofar as these Regulations fix the amount. Cost calculations that assume proportional scaling will be incorrect.

• No administrative detail in the Regulations. The Regulations do not provide payment schedules, timing, collection agencies, registration systems, or auditing powers. Practitioners and administrators must therefore locate those procedures in the Act or in other instruments. Relying on the Regulations alone for compliance will leave procedural gaps.

• Amendment without transitional text in these Regulations. The endnotes show s 5 was amended in 2023 (Endnote 4). The Regulations, as compiled, show the current text but do not include any transitional or saving provisions within themselves. If clients or organisations made business decisions based on an earlier quantum, attention must be paid to the amending instrument to determine whether transitional arrangements apply.

• Editorial changes may mask drafting nuances. The compilation alerts readers that editorial changes authorised under the Legislation Act 2003 may be applied to compiled laws. These editorial changes are not supposed to change legal effect, but where tight drafting around numeric thresholds matters, practitioners should verify the original instrument and any amending instruments on the Federal Register of Legislation.

• No express carve-outs or exemptions in the Regulations. The Regulations do not list exemptions, concessions or corrections. Any claimed exemption must therefore be located in the Act or other subordinate instruments. Misreading the nil amount for ≤500 gram as an exemption that applies regardless of context would be a mistake.

• Dependence on the Act for enforcement and liability. Without consulting the Act, it is unclear who bears the levy, when it is payable, and how the amount relates to registration or importation events. Mistaking the Regulation as setting collection procedures could lead to incorrect compliance actions.

• International shipments and import moments. The Regulations do not address import duty interactions or the point at which levy becomes payable for imported RPAs. If liability attaches on import, customs, or sale, this is determined elsewhere. Assuming importers are automatically liable would be a risky assumption absent statutory text elsewhere.

These are concrete attention points that arise directly from the Regulations’ narrow content. They indicate where supplementary legal materials must be consulted to develop complete compliance or advisory responses.

Because the Regulations prescribe only the monetary amounts and a weight threshold, compliance planning requires integrating these Regulations with the Civil Aviation (Unmanned Aircraft Levy) Act 2020 and any administrative instruments promulgated under the Act. The Regulations themselves do not state procedures for payment, registration, timing or verification. The following steps are a practical compliance checklist grounded in the text and compilation.

1. Identify the applicable statutory liability under the Act. Regulation 5 sets amounts "for the purposes of subsection 6(1) of the Act" (reg 5). The first compliance step is to read subsection 6(1) of the Act and related provisions to determine who is liable for the levy in relation to an RPA, the triggering events that create liability (for example, manufacture, sale, import, possession or operation), and any defences or exemptions.

2. Determine whether the device is an RPA within the Act’s definitions. The Regulations use RPA and have no definitional text other than defining "Act" (reg 4). Consult the Act to confirm whether the device in question falls within the Act’s definition of RPA and whether any subclassifications apply.

3. Establish the relevant weight measurement. The Regulations assign the monetary outcome by reference to weight bands: more than 500 grams attracts $40, 500 gram or less attracts nil (reg 5). Determine the authoritative method for measuring weight under the Act or any implementing instruments: net weight versus gross weight, whether batteries and removable payloads are included, and whether rounding conventions apply.

4. Apply the prescribed amount per RPA determined liable under the Act. Once liability and measurement are settled, apply the Regulation’s dollar figures: $40 for each RPA that weighs more than 500 grams for which levy is payable under subsection 6(1) of the Act; nil for those at or below 500 gram (reg 5).

5. Review amending instruments and commencement dates. The compilation notes that regulation 5 was amended by the Civil Aviation Legislation Amendment (2023 Measures No. 1) Regulations 2023 with effect 26 May 2023 (Endnote 3; Endnote 4). Check whether the amendment changed the amount or threshold and whether any transitional arrangements apply, particularly for stock on hand or transactions spanning the amendment date.

6. Look to the Act for payment timing and administrative processes. The Regulations do not specify payment dates, registration systems, or agencies responsible for collection. Identify in the Act where payment is due, how the levy is to be remitted, and what records are required to be kept.

7. Recordkeeping and audit readiness. Even though the Regulations do not state recordkeeping requirements, the use of a numeric charge tied to weight suggests that a defensible compliance position will require contemporaneous documentation proving the RPA’s weight and the basis on which any levy liability was calculated. Retain weight certificates, product specifications, and transaction records that permit reconstruction of the liability position.

8. Coordinate with commercial partners. If the Act allocates liability across parties in a supply chain, address contractual allocation of levy exposure (for example between manufacturer, importer and reseller) so commercial arrangements reflect the $40 risk for RPAs above 500 grams. The Regulations do not address contractual allocations; this is a commercial step to manage statutory risk.

9. Monitor for further regulatory change. The Regulations have been amended once; future amending instruments could alter the amount, the threshold, or introduce payment modalities. Use the Federal Register references in the endnotes to monitor official amendments (Endnote 3; Endnote 4).

10. Seek authoritative guidance where necessary. Because the Regulations are narrow, administrative guidance, the parent Act’s Explanatory Memorandum, or official policy documents will be necessary to operationalise compliance. The compilation indicates where to find amendment history and editorial notes but does not provide operational guidance.

In short, compliance under these Regulations requires first mapping the Act’s substantive liability rules and then applying the prescribed monetary figures in regulation 5 to each RPA that the Act identifies as subject to levy. The Regulations themselves provide the tariff schedule; the Act provides the operational rules for payment and enforcement.
