Civil Aviation Order 82.0 Amendment Instrument 2014 (No. 1)

The instrument revolves around EDTO as the central operational construct. EDTO is redefined to focus on flights by multi turbine‑engined aeroplanes that, given specified cruise speed assumptions and atmospheric conditions, have a flight time from a point on the route to an adequate aerodrome that exceeds the "threshold time" (item 5). The definition is tiered by aeroplane engine configuration:

• For two turbine engines the calculation is normally at the approved OEI cruise speed, subject to a special provision where the Cargo Fire Suppression System (CFSS) is the most time‑limiting EDTO significant system and then the AEO cruise speed is used (item 5(a) and (b)).
• For aeroplanes with more than two turbine engines the calculation uses approved AEO cruise speed (item 5(c)).

Threshold time is a defined numerical trigger. The instrument substitutes "certified" for "certificated" in key places (items 6, 17, 18) and reduces one threshold value from 90 minutes to 60 minutes in the definition of threshold time for certain certified twin turbine‑engined aeroplanes certified to carry more than 19 passengers or having a payload capacity exceeding 3 410 kg (items 6-9 and notes). It also expressly caps a class of operations at 180 minutes for aeroplanes with MTOW in excess of 5 700 kg engaged in passenger‑carrying operations but not certified to carry more than 19 passengers (item 9).

Maximum diversion time is a new operational variable, to be approved by CASA for each airframe/engine combination, and must not be exceeded by threshold time for eligibility (item 27, item 33). For twin turbine‑engined aeroplanes, the maximum diversion time is tied to the time limit of the most time‑limiting EDTO significant system identified in the AFM, less a 15 minute operational safety margin (item 27(a)). For aeroplanes with more than two engines a similar approach applies but may draw on the AFM or OEM operations manual (item 27(b)).

Operational and planning constructs added or clarified include:

• Approved OEI and AEO cruise speeds, which must be approved by CASA in safety operational specifications and may differ from the speeds used to calculate maximum diversion time or threshold time (item 10, notes; item 22).
• EDTO alternate aerodrome planning minima requirements, which set meteorological forecast minima and require that cross‑wind components including gusts be no more than the lowest of specified AFM/OEM values and that landing distance availability meet CAO 20.7.1B subsection 11 (item 4). Table 1 in clause 7 of Appendix 5 is referenced for standard planning minima (item 4(d)(i)).
• Communications requirements for EDTO beyond 180 minutes, for example additional communications such as voice, SATCOM or ACARS, and CASA's expressed concern about SATCOM limitations in polar operations (insertions in Appendix 4 paragraph 5.2(b)(iv), Appendix 4 paragraph 7.2(b)(iii), and Appendix 5 subclause 4.1).

The instrument also introduces or clarifies administrative and documentation concepts: cockpit documentation is defined (item 10), dispatch is defined as the aeroplane first moving under its own power for the purpose of taking off (item 11), and cockpit documentation requirements for listing departure, destination and alternate aerodromes differ between twin and more‑than‑two engine aeroplanes (item 48). Reporting obligations are adjusted to permit CASA‑approved EDTO Reliability Programs to replace standard quarterly reporting (item 63).

Additional technical allowances include CASA discretion to approve GPS‑based IAP minima and lower minima for precision approach runways CAT II or CAT III under specified conditions (item 59). The instrument also removes several previously inserted paragraphs and changes headings and wording across multiple clauses to align language and operational tests with the new definitions and approval processes (numerous schedule items).

Primary decision and regulatory authority: CASA. The instrument repeatedly places approval, specification and discretion with CASA. Examples include approval of EDTO operations, approval of "approved OEI cruise speed" and "approved AEO cruise speed" in safety operational specifications issued to an operator (item 10), CASA approval of the maximum diversion time for a given airframe/engine combination (item 27), CASA approval of the AOC holder's EDTO Reliability Program and exemptions from quarterly reporting if that program requires quarterly reliability reporting to CASA (item 63), and CASA discretion to approve GPS‑based minima and lower minima for CAT II/III precision approach runways (item 59). The instrument also contains notes that indicate CASA will take into account polar SATCOM limitations when considering approvals (items 37 and 45 notes).

Operators and AOC holders. The instrument imposes new or clarified duties on AOC holders. These include the requirement to ensure dispatch only when CMP standards are met for twin turbine‑engined aeroplanes (item 47), to list required take‑off, destination and alternate aerodromes in cockpit documentation (item 48(a)), to list nominated EDTO alternate aerodromes for more‑than‑two engine aeroplanes (item 48(b)), to ensure meteorological forecasts meet nominated EDTO alternate aerodrome requirements (item 49), and to ensure communications and MEL and training programs are in place and approved commensurate with the maximum diversion time sought (items 43 and 51). AOC holders are required to ensure landing distance availability and cross‑wind constraints at nominated EDTO alternate aerodromes (item 4(e) and (f)).

Flight crew and pilot in command. The instrument defines cockpit documentation and narrows planning/dispatch obligations that affect the pilot in command; it explicitly states that the definition of EDTO alternate aerodrome applies for flight planning and does not limit the discretion of the pilot in command during flight (item 4, final Note). The dispatch definition (item 11) creates a specific operational moment when obligations tied to dispatch occur.

Aeroplanes and manufacturers. The instrument affects aircraft type approvals and the content of AFM and type certificate data sheets. EDTO type design approval must be contained in the AFM or in the type certificate data sheet or supplemental type certificate for twin turbine‑engined aeroplane eligibility (item 30). The instrument references OEM operations manuals as sources for time‑limiting EDTO significant systems for aeroplanes with more than two engines (item 27 and item 28 insertion).

Aerodrome operators and air traffic services. Aerodromes nominated as EDTO alternates must meet meteorological forecast minima and landing distance requirements (item 4(d) and (f)). Appendix references require additional communications to be available to provide effective direct communication between flight crew and air traffic services and between flight crew and operator (items 37, 45 and 51).

Time and scope. The instrument is effective generally from 1 January 2015 but defers application of most amendments affecting aeroplanes with more than two engines until 1 July 2015 (items 2, 3 and 4). The reduction of the threshold time for certain twin engines from 90 to 60 minutes (item 7) is likewise delayed until 1 July 2015 (item 4 and accompanying note). The transitional note also clarifies that on 1 July 2015, certain provisions will apply only to passenger‑carrying operations in aeroplanes with more than two engines (item 3 note).

Indirectly affected parties. Entities involved in training, MEL drafting, communications provisioning (SATCOM/ACARS vendors), and maintenance/configuration maintenance and procedures (CMP) standards providers will see demand for compliance services due to the instrument’s requirements that AOC holders have approved MELs, training programs and CMP compliance for EDTO flights (items 43, 47 and definitions in item 10).

Duties imposed on AOC holders and operators are the main compliance vectors. The instrument sets out specific dispatch and operational preconditions for EDTO, approval requirements, documentation obligations and reporting duties.

Dispatch and planning duties

• Dispatch moment defined: an aeroplane is dispatched, and aeroplane dispatch occurs, when the aeroplane first moves under its own power for the purpose of taking off (item 11). That moment anchors when cockpit documentation and planning requirements must have been complied with.
• Meteorological forecast requirement: an aeroplane may be dispatched on an EDTO only if the meteorological forecast from the earliest to the latest expected landing time at the EDTO alternate aerodrome meets the nominated EDTO alternate aerodrome requirements (item 49). These nominated requirements include the Standard EDTO alternate aerodrome planning minima in Table 1 of clause 7 of Appendix 5, and, for flight planning, the aerodrome must meet those minima as applicable for available facilities (item 4(d)(i) referencing Table 1).
• Cockpit documentation: for twin turbine‑engined aeroplanes, required take‑off, destination and alternate aerodromes, including EDTO alternate aerodromes to be used in the event of engine shutdown or aeroplane system failure that require a diversion, must be listed in cockpit documentation (item 48(a)). For aeroplanes with more than two engines, nominated EDTO alternate aerodromes must be listed in cockpit documentation (item 48(b)). Cockpit documentation itself is defined and includes documents taken into, or downloaded into, the cockpit for flying and navigation (item 10).

Approval and equipment duties

• Approved cruise speeds and CASA approval: AOC holders must operate using approved OEI and approved AEO cruise speeds as specified in safety operational specifications issued by CASA; these approved speeds may differ from the speeds used for other metrics such as maximum diversion time and threshold time (item 10 notes; item 22). CASA must approve the EDTO operation and the maximum diversion time for the airframe/engine combination (item 27; item 33).
• EDTO type design approval: for twin turbine‑engined aeroplanes to be eligible, each aeroplane must have an EDTO type design approval contained in the AFM or in the type certificate data sheet or supplemental type certificate (item 30).
• MEL and training program requirements: for aeroplanes with more than two turbine engines applying for EDTO approval to exceed 180 minutes, the AOC holder must have an approved operations training program addressing factors with respect to the maximum diversion time requested and an approved MEL appropriate to the maximum diversion time requested (item 43( a)(i ) and (ii )). The threshold time for the aeroplane must not be greater than the CASA‑approved maximum diversion time (item 43( a )(iii )).
• Communications and APU/CFSS requirements: EDTO beyond certain diversion times requires additional communication capability such as voice, SATCOM or ACARS providing effective direct communication between flight crew and air traffic services and flight crew and the operator (items 37, 45 and 51). If the APU is required for OEI, depressurisation procedures or for the time‑limiting EDTO significant system, it must be available with required electrical and pneumatic supply (item 44). The CFSS may be required and is specifically referenced where relevant for aeroplanes with more than two engines or where CFSS is the most time‑limiting system (items 27, 45).

Reporting duties

• Quarterly reporting and EDTO Reliability Program: the instrument keeps quarterly reporting requirements for twin engine aeroplanes (Appendix 5 clause 11 heading change, item 60) but allows an AOC holder to be exempt from standard quarterly reporting if the holder has an EDTO Reliability Program approved by CASA that includes quarterly reliability reporting to CASA and the holder complies with that Program’s reporting timeframes (item 63). The Program must include the reports listed in subparagraphs 11.1(a)‑(i) or any additional information specified by the Program (item 63(b)).

Rights and CASA discretion

• CASA’s approval discretion: CASA is given multiple explicit approval roles. CASA approves the OEI and AEO cruise speeds in safety operational specifications, approves maximum diversion times for an airframe/engine combination (item 10, item 27), may approve AOC holders’ use of GPS‑based IAP minima and reduced minima for precision approach runways CAT II or CAT III (item 59), and will take into account SATCOM limitations in polar operations when considering approvals (items 37 and 45 notes).
• AOC holders’ options: an AOC holder may seek CASA approval for EDTO operations, apply for approval of an EDTO Reliability Program to replace quarterly reporting, and may apply for CASA recognition to use GPS‑based minima or CAT II/III lower minima where the operator and aeroplane meet the specified requirements (items 59 and 63).

Interplay of numerical limits and approvals

• Threshold time must not exceed maximum diversion time: for twin turbine‑engined aeroplanes the instrument substitutes an express condition that the threshold time is not greater than the maximum diversion time approved by CASA for that aeroplane (item 33). The maximum diversion time itself is limited by the time limit of the most time‑limiting EDTO significant system from AFM or OEM material, reduced by no less than a 15 minute operational safety margin (item 27). This creates a mechanical relationship between AFM/OEM technical limits, CASA approved maximum diversion time, and the operator’s chosen threshold time for EDTO classification.

Other specific duties

• Landing distance: the EDTO alternate aerodrome must have a landing distance available not less than that required under subsection 11 of Civil Aviation Order 20.7.1B, for expected runway surface, wind, landing configuration and landing weight (item 4(f)).
• Crosswind limitations: planning for crosswind component including gusts must not exceed the lowest of AFM maximum demonstrated, OEM demonstrated, or OEM maximum operational cross‑wind components (item 4(e)).
• Polar operations consideration: several notes alert CASA and operators to SATCOM limitations in polar areas which CASA will take into account when considering approvals (items 37 and 45 notes and Appendix 5 subclause 4.1 note).

The instrument itself contains no express penalty provisions or enforcement steps; it embeds compliance within the CASA AOC and safety operational specification framework and delegates approval decisions and operational conditions to CASA (items 21, 22 and multiple appendix provisions).

The instrument does not introduce or specify discrete penalty provisions or criminal sanctions. It operates by creating and modifying operational conditions, approvals and documentation obligations that are binding on AOC holders under Civil Aviation Order 82.0 as amended (item 6). Enforcement mechanics apparent from the instrument are administrative and regulatory rather than penal in the instrument text itself.

Administrative enforcement and regulatory leverage

• CASA’s approval and specification powers are the primary enforcement lever. The instrument repeatedly frames substantive requirements as conditions of EDTO approval, conditions in safety operational specifications and matters to be shown on an AOC holder’s documentation and training/MEL approvals (for example items 10, 21, 22, 30, 43, 47 and 48). This structure gives CASA the capacity to grant, withhold, or condition EDTO approvals and safety operational specifications, and to approve or disapprove an AOC holder’s EDTO Reliability Program. Non‑compliance with conditions attached to an AOC or safety operational specification can be enforced by CASA through its regulatory powers under the Civil Aviation Act 1988 and the Civil Aviation Regulations 1988 which appear in the instrument preamble as the enabling provisions; the instrument itself does not restate the enforcement powers from those Acts and Regulations (preamble).

• Removal or amendment of operational privileges: several new or revised eligibility and documentation requirements are directly linked to whether an AOC holder may conduct EDTO for a given aeroplane or route. For example, twin turbine‑engined aeroplane eligibility requires EDTO type design approval in the AFM or type certificate data (item 30). For aeroplanes with more than two turbine engines, the instrument ties EDTO approval to approved training programs, MELs and communications systems (item 43 and item 45). Failure to meet these conditions would logically affect the holder’s ability to obtain or retain CASA approval to conduct EDTO.

No express infringement or monetary penalties in instrument text

• The instrument contains no clause creating an infringement notice scheme, pecuniary penalty, or specific criminal offence. It therefore relies on CASA’s administrative controls through AOC conditions and safety operational specifications to effect compliance. Any penalties applicable for non‑compliance would derive from the Civil Aviation Act 1988, the Civil Aviation Regulations 1988, or other instruments or enforcement actions under CASA’s statutory powers; the instrument itself does not incorporate those penalty provisions.

Monitoring and reporting enforcement

• Reporting obligations and the approved EDTO Reliability Program operate as compliance monitoring tools. The instrument requires quarterly reliability reports unless the AOC holder has an approved EDTO Reliability Program that provides CASA with specified reports within program timeframes (item 63). CASA’s approval of such a Program and receipt of reports provides CASA with oversight information that it may use to check compliance with operational conditions.

Operational discretion and safety operational specifications

• Many requirements are stated to be subject to CASA approval or to be specified in safety operational specifications issued to the operator (for example approved OEI/AEO cruise speeds, maximum diversion time, CMP standards, approved MEL and training programs). This embeds enforcement through the grant, renewal, modification and potential suspension or cancellation of those specifications and approvals. The instrument amends subsection 4 heading to "General AOC conditions , safety operational specifications" to emphasise that safety operational specifications are the repository for approved operational parameters (item 21).

Implementation and administrative risk

• Because the instrument allocates many matters to CASA approval and safety operational specifications, enforcement and compliance outcomes will depend on CASA’s application of its approval processes and any conditions it attaches. The instrument includes multiple instances where CASA discretion is explicitly referenced (for example CASA may approve GPS‑based IAP minima and will take into account SATCOM limitations in polar areas), signalling that enforcement will be mediated through administrative decision‑making (item 59; items 37 and 45 notes).

In sum, the instrument enforces compliance by conditioning EDTO permissions and AOC holder operational activities on CASA approvals, safety operational specifications, documented procedures and reporting rather than by new, instrument‑specific penalty clauses. The instrument itself does not set out enforcement mechanisms beyond those administrative conditions.

The instrument is an amendment instrument made under the Civil Aviation Act 1988 and the Civil Aviation Regulations 1988, as stated in the preamble. It operates by modifying Civil Aviation Order 82.0; therefore it functions within the regulatory architecture established by those enabling instruments.

Explicit statutory and instrumentary connections

• Enabling instruments: The instrument invokes paragraph 28BA(1)(b) and subsection 98(4A) of the Civil Aviation Act 1988 and subregulations 5(1) and 209(1) of the Civil Aviation Regulations 1988 in its preamble as the power under which it is made. The instrument itself does not reproduce provisions of those Acts and Regulations but relies on them as the statutory basis for making delegated legislation (preamble). Any enforcement or sanctioning powers used to address breaches of the amended CAO 82.0 would be those in the Act and the Regulations; the amendment instrument does not restate those powers.

• Interaction with other Civil Aviation Orders: The instrument specifically references Civil Aviation Order 20.7.1B subsection 11 in relation to required landing distance availability at EDTO alternate aerodromes (item 4(f)). That creates a direct cross‑reference to another CAO and requires operators to comply with subsection 11 of CAO 20.7.1B for landing distance when planning EDTO alternate aerodromes.

• AFM, OEM operations manual and type certificate data: The instrument places reliance on technical materials produced by manufacturers and certification authorities. For example, maximum diversion time calculations refer to the time limit of the most time‑limiting EDTO significant system identified in the AFM or OEM operations manual (items 27 and 28). EDTO type design approval for twins is to be contained in the AFM or the type certificate data sheet or supplemental type certificate (item 30). These references create bridges between regulatory approval, operational practice and type certification material prepared under the broader civil aviation regulatory framework.

Operational publications and guidance

• AIP references: The instrument refers to communication systems "in addition to any mentioned in the AIP" when prescribing additional communications capable of providing effective direct communications between flight crew, air traffic services and operator (items 37 and 45). This aligns EDTO communication expectations with Aeronautical Information Publication content and situational communications availability.

• Standard EDTO alternate aerodrome planning minima: The instrument references Table 1 in clause 7 of Appendix 5 for standard EDTO alternate aerodrome planning minima (item 4(d)(i)). Operators will need to consult Appendix 5 Table 1 as amended to plan EDTO alternates. The instrument also gives CASA discretion to approve GPS‑based IAP minima or lower minima for precision approach runways CAT II or CAT III in specified circumstances (item 59).

Administrative and approval frameworks

• Safety operational specifications and AOC conditions: The instrument recharacterises subsection 4 heading as "General AOC conditions , safety operational specifications" and lists items to be included in paragraph 4.1 notes such as maximum diversion time and approved OEI/AEO cruise speeds (items 21 and 22). This formalises the place of these operational variables within the AOC and safety operational specification framework created by the Civil Aviation Act and Regulations.

Scope limits and temporal interaction

• Transitional application and prior amendments: The instrument references a prior Civil Aviation Order 82.0 Amendment Order (No. 3) 2007 as the first instrument that created EDTO rules, and notes that the 2007 amendment contained a transitional provision delaying application to aeroplanes with more than two engines until 1 July 2015 (item 3 note). The 2014 amendment continues the same transitional approach for most items affecting more‑than‑two engine aeroplanes, preserving alignment with the earlier transitional timing and thereby interacting with the prior amendment’s temporal structure.

Matters not altered in this instrument

• The instrument does not repeal or restate general enforcement powers, civil penalty regimes or administrative review provisions found in the Civil Aviation Act 1988 or the Civil Aviation Regulations 1988; those remain the locus of legal enforcement and remedy outside the instrument’s text. The instrument instead modifies operational criteria, definitions and approval pathways that are implemented and enforced through CASA’s exercise of powers under those enabling laws.

In short, this amendment functions as a piece of subordinate legislation that modifies operational norms within CAO 82.0 and links regulatory approvals and planning obligations to materials and approvals governed elsewhere in the civil aviation regulatory system, namely AFMs, OEM manuals, the AIP, CAO 20.7.1B and CASA’s safety operational specifications delivered under the Civil Aviation Act and Regulations.

This instrument is itself an amendment instrument titled Civil Aviation Order 82.0 Amendment Instrument 2014 (No. 1), signed 10 December 2014 and commencing 1 January 2015 unless otherwise stated (items 1 and 2). It amends Civil Aviation Order 82.0 by Schedule 1 and contains numerous insertions, omissions and substitutions across the body of CAO 82.0 and its Appendices. The instrument includes transitional provisions that mirror earlier transitional arrangements from a 2007 amendment in relation to aeroplanes with more than two turbine engines (item 3 and the note referring to the Civil Aviation Order 82.0 Amendment Order (No. 3) 2007).

Key catalogue of changes and timings

• Transitional provisions: Items 3, 4 and 5 in the instrument establish transitional timing. Item 3 delays application of most of the Schedule 1 amendments to AOCs authorising operation of aeroplanes with more than two engines until 1 July 2015, but preserves the immediate application on 1 January 2015 of amendments to subsections 3B and 3BA. Item 4 delays amendment number 8 in Schedule 1 (the reduction of threshold time from 90 to 60 minutes for certain twin engine aeroplanes) until 1 July 2015. Item 5 delays amendment number 21 in Schedule 1 until 1 July 2015. The instrument’s notes explain the linkage to the 2007 amendment and delineate passenger‑carrying scope from 1 July 2015 (item 3 note).

• Definitions and terminology: Schedule 1 makes numerous definitional changes, including insertion of new technical definitions such as ACARS, AEO, AFM, approved OEI/AEO cruise speeds, cockpit documentation, CFSS, CMP, GPS, IAP, MEL, MTOW, OEI, OEM and SATCOM (item 10). It also changes terminology from "aircraft" to "aeroplane" in specified places to align wording (items 12 and 13) and corrects "certificated" to "certified" in several clause places (items 6, 17 and 18).

• EDTO redrafting and threshold changes: Item 5 substitutes the EDTO definition to rely on approved OEI or AEO cruise speeds and ISA/still air conditions, rather than earlier wording. Items 6-9 change threshold time definitions; item 7 specifically replaces 90 minutes with 60 minutes in a sub‑subparagraph, with the delayed commencement noted in item 4. Item 9 substitutes a new 180 minute benchmark for certain aeroplanes with MTOW above 5 700 kg engaged in passenger carrying but not certified to carry more than 19 passengers.

• Maximum diversion time: Appendix 4 gains a definition of maximum diversion time (item 27), linking CASA approval to AFM/OEM time limits and requiring a minimum reduction of 15 minutes as an operational safety margin. Item 28 inserts an additional clause for aeroplanes with more than two turbine engines clarifying that the time limit of the most time‑limiting EDTO significant system, if any, may be identified in the AFM or OEM operations manual.

• EDTO approval criteria and tiers: The instrument reorganises Appendix 4 into eligibility and approval requirements with clear headings and clauses for twin turbine‑engined aeroplanes, more than two turbine‑engined aeroplanes, and the 180 to 240 minute and greater than 240 minute cases (items 30-42 and 34-41). It tightens eligibility criteria for twins (item 30), substitutes and clarifies multiple paragraphs about cruise speeds, MELs, training programs, communications, APU requirements and CFSS carriage (items 30-46).

• EDTO alternate aerodrome planning and meteorological minima: The EDTO alternate aerodrome definition is expanded (item 4) to require that forecasts at the aerodrome be at or above aerodrome planning minima in Table 1 of clause 7 of Appendix 5 for flight planning purposes, that predicted landing minima be at or above approved aerodrome landing minima before passing the EDTO entry point, and that cross‑wind and landing distance criteria be met (item 4(d)-(f)). Appendix 5 clause 8 adds CASA discretion to approve GPS‑based IAP minima and to allow lower minima for CAT II or CAT III precision approach runways under specified conditions (item 59).

• Operational and reporting clarifications: Appendix 5 is extensively amended to create specific twin engine and more‑than‑two engine carve outs for dispatch and documentation requirements (items 46-59). The instrument modifies the quarterly reporting regime for twins by permitting an approved EDTO Reliability Program to replace standard quarterly reporting (items 60-63).

• Cosmetic and editorial changes: The instrument changes headings (e.g. subsection 3B heading in item 14), rewords items for clarity (for example replacement of "handflown" with "hand flown" in Appendix 7 item 65), and substitutes the phrase "maximum certified passenger seating capacity" for "maximum certificated passenger seating capacity" (item 23).

Prior amendment referenced

• The instrument notes that the 2007 CAO 82.0 Amendment Order (No. 3) first created EDTO rules and that its transitional timing for aeroplanes with more than two engines is mirrored here (item 3 note). The 2014 instrument therefore builds on the EDTO framework introduced in 2007 and modifies thresholds, approval requirements, definitions and reporting mechanisms.

Effective dates and staged implementation

• Effective general commencement is 1 January 2015 (item 2). Several amendments affecting aeroplanes with more than two engines and the reduction in threshold time for specified twin engine aeroplanes are deferred to 1 July 2015 (items 3 and 4). The schedule item numbers referenced in the instrument indicate which parts are subject to the staged implementation.

Overall, the instrument represents an extensive reworking of EDTO-related parts of CAO 82.0 with new technical definitions, explicit CASA approval roles, changed threshold numeric standards and administrative reporting and documentation changes. The instrument records the immediate and deferred effective dates and situates itself as an amendment within the existing CAO regime.

The instrument text contains no references to litigation, case law, judicial decisions or administrative appeals. It does, however, create multiple decision points and CAS A approvals which are administrative acts that could, in practice, give rise to disputes subject to review or challenge under the general administrative law framework applicable to CASA decisions; those review mechanisms and any litigation avenues are not set out in the instrument.

What is in the source

• The instrument explicitly cites its enabling provisions in the Civil Aviation Act 1988 and the Civil Aviation Regulations 1988 in the preamble, but it does not refer to any court or tribunal determinations, nor does it name any precedent or litigation history (preamble).
• The instrument contains notes that explain policy sequencing and prior amendments, specifically referencing the Civil Aviation Order 82.0 Amendment Order (No. 3) 2007 as the instrument that first created rules for EDTO and describing transitional alignments (item 3 note). Those notes are explanatory and do not reference litigation.

Practical legal friction points the instrument creates

• Administrative decision points: CASA’s role in approving OEI and AEO approved cruise speeds, maximum diversion times, EDTO approvals, MELs, approved training programs and EDTO Reliability Programs creates numerous administrative determinations. The instrument places these decisions within CASA’s authority (items 10, 27, 30, 43, 63), and administrative determinations of this kind are commonly the subject of review applications or judicial review in other statutory contexts. The instrument itself does not frame any appeal or review rights.
• Interpretive ambiguities: The instrument introduces several technical terms and relational constraints, for example the interplay between threshold time, maximum diversion time and AFM/OEM‑identified EDTO significant system time limits (items 27 and 33). Such interplay can give rise to disputes about technical interpretation, the adequacy of supporting documentation (AFM, OEM manual or type certificate), and CASA’s exercise of discretion when approving speeds and diversion times. Those are practical sources of potential dispute but the instrument contains no litigation history or adjudicative guidance.

Absence of recorded litigation

• Because the instrument itself is an amendment instrument without appended judicial commentary, and because it contains no statutory appeal or case citations, there is nothing in the instrument that records litigation history or prior judicial treatment of its provisions.

In short, the instrument does not document litigation history. It creates multiple CASA decision points where disputes or reviews may arise in future, but it does not specify appeal channels or reference any prior judicial determinations within the text provided.

The instrument contains several technical changes and transitional oddities that can catch operators, pilots and compliance advisers if not carefully tracked. These items are drawn directly from the amendments and notes in Schedule 1 and the transition clauses.

Timing and transitional traps

• Staggered commencement: although the instrument commences generally on 1 January 2015, several important amendments affecting aeroplanes with more than two turbine engines do not apply until 1 July 2015 (item 3). Amendment number 8 (reduction of threshold time from 90 to 60 minutes for some twin turbine‑engined aeroplanes) is delayed until 1 July 2015 (item 4). Practitioners must map which specific schedule items are subject to the 1 July delay. The instrument’s note reproduces transitional arrangements from the 2007 amendment and warns that on 1 July 2015, certain provisions will apply only to passenger‑carrying operations in aeroplanes with more than two engines (item 3 note). Failing to track the staging may cause operators to err on incorrect planning minima or threshold figures at dispatch.

• Exceptions for subsections 3B and 3BA: item 3 states the amendments in Schedule 1, other than to subsections 3B and 3BA, do not apply to AOCs authorising operation of aeroplanes with more than two engines until 1 July 2015. Therefore the amendments to 3B and 3BA apply from 1 January 2015 to all aeroplanes; operators must check how those particular subsections have been changed (items 14 and 15 indicate some relevant substitutions).

Definitions and calculation details

• Approved cruise speeds versus calculation speeds: the instrument introduces "approved OEI cruise speed" and "approved AEO cruise speed" that CASA will approve and notes that these approved speeds "may differ from the speed used for the maximum diversion time and the threshold time" (item 10 notes). This creates potential mismatch between the speed used for route planning and the speeds recorded in safety operational specifications. Operators must ensure the appropriate speeds are those used for the intended calculation and accepted by CASA; otherwise the flight may be classified incorrectly with respect to EDTO thresholds.

• Threshold time versus maximum diversion time: the instrument requires that the threshold time not be greater than the maximum diversion time approved by CASA for twin engine aeroplanes (item 33). Maximum diversion time is itself an approved time limit, derived from AFM/OEM time limits reduced by at least a 15 minute margin (item 27). The arithmetic relationship means that operators cannot unilaterally select a threshold time exceeding an approved maximum diversion time and must verify CASA approvals when setting operational thresholds.

• CFSS as time‑limiting EDTO significant system: the definition of EDTO includes a special case where CFSS is the most time‑limiting system, triggering use of AEO cruise speed for the OEI calculation (item 5(b)). The Appendix 4 definition of maximum diversion time notes that for certain twin turbine‑engined aeroplanes CFSS may be the most time‑limiting EDTO significant system (item 27 note). Determining whether CFSS is the time‑limiting system will likely require detailed AFM/OEM analysis.

EDTO alternate aerodrome planning

• Meteorological forecast window: item 4(d) requires that forecasts for the earliest to latest expected landing time meet specified planning minima. That creates an obligation to check forecast windows rather than a single epoch MET report. Operators must ensure forecast coverage for the entire estimated period of use.

• Crosswind and landing distance tests: item 4(e) and (f) set planning limits. Crosswind, including gusts, must be not more than the lowest of AFM maximum demonstrated, OEM maximum demonstrated or OEM maximum operational cross‑wind component. Landing distance available must meet subsection 11 of CAO 20.7.1B (item 4(f)). Both tests may require specialist performance calculations and careful reference to AFM/OEM documentation.

Communications and polar operations

• SATCOM limitations in polar areas: several notes state CASA will take into account limitations of SATCOM in polar areas (items 37 and 45). For polar operations the instrument signals additional scrutiny of communications capability; operators proposing polar EDTOs must be prepared to demonstrate that alternative communications or mitigations exist.

Documentation and cockpit listing differences

• Different cockpit documentation requirements for twin and more‑than‑two engine aeroplanes: item 48 distinguishes the documentation to be listed in cockpit documentation for twins versus more‑than‑two engines. For twins, required take‑off, destination and alternate aerodromes including EDTO alternates that require a diversion must be listed (item 48(a)). For more‑than‑two engines only nominated EDTO alternates must be listed (item 48(b)). Operators must ensure they apply the correct requirement to each aeroplane type.

Reporting substitution pitfalls

• EDTO Reliability Program substitution: item 63 allows an AOC holder with a CASA‑approved EDTO Reliability Program to substitute the standard quarterly reporting regime, but the Program must require specified reports and the holder must provide them within the Program’s timeframes. Operators may incorrectly assume that being on a Program eliminates reporting; in fact it substitutes but still requires quarterly reliability reporting under the Program.

Words and terminology changes

• "Certificated" to "certified" and "aircraft" to "aeroplane": several substitutions are editorial but materially important when reading regulatory texts; items 6, 12, 13, 17 and 18 change the exact drafting. Practitioners should ensure consistency in compliance documents to match the revised CAO wording.

EDTO type design and eligibility

• EDTO type design approval locations: item 30 requires EDTO type design approval to be contained in the AFM or type certificate data sheet or supplemental type certificate for twin turbined aeroplanes. If an AFM or type certificate data sheet lacks an explicit EDTO type design approval, the aeroplane will not be eligible until the relevant document is updated.

Appendix and table cross-references

• Standard EDTO alternate aerodrome planning minima are set out in Table 1 in clause 7 of Appendix 5, which the instrument references but does not reproduce in full in the amendments. Operators must consult Appendix 5 Table 1 to confirm minima and be aware that CASA may approve alternatives such as GPS‑based IAP minima under conditions in clause 8 (item 59).

In summary, the principal "gotchas" are the staged commencement, interplay between approved speeds and calculation speeds, the requirement that threshold time not exceed CASA‑approved maximum diversion time, the technical performance and meteorological planning additions for EDTO alternate aerodromes, and the CASA‑dependent character of many approvals and reporting substitutions. Each of these is directly traceable to specific schedule items and appendix insertions in the instrument.

Compliance requires a programmatic approach that aligns aeroplane technical documentation, operator procedures, CASA approvals, cockpit documentation, communications capability and reporting. The following actions are grounded in the amendments in Schedule 1 and the inserted or amended Appendix provisions.

1. Map effected aircraft and dates

• Identify all affected aeroplanes and whether they are twin turbine‑engined or have more than two turbine engines. Note that many amendments apply from 1 January 2015 but significant items affecting aeroplanes with more than two engines and the reduction of the threshold time under amendment number 8 do not take effect until 1 July 2015 (items 2, 3 and 4). Operators should prepare separate compliance timelines for the 1 January and 1 July commencement dates.

2. Update AFM/type certificate documents and check EDTO type design approval

• For twin turbine‑engined aeroplanes ensure that each aeroplane for EDTO has an EDTO type design approval contained in the AFM or supplement, or in the type certificate data sheet or supplemental type certificate (item 30). If absent, initiate required modifications with the manufacturer and certification authorities to obtain the EDTO type design approval in the relevant documents.

3. Seek CASA approvals for cruise speeds and maximum diversion time

• Submit applications to CASA to obtain approved OEI cruise speed and approved AEO cruise speed in the operator’s safety operational specifications, noting that approved speeds may differ from speeds used in maximum diversion time or threshold time calculations (item 10 notes; item 22).
• Apply for CASA approval of maximum diversion time for each airframe/engine combination; calculate these times from the time limit of the most time‑limiting EDTO significant system identified in the AFM or OEM operations manual and apply the minimum 15 minute operational safety margin as required (item 27). Ensure that the threshold time sought is not greater than the CASA‑approved maximum diversion time (item 33).

4. Revise operational documentation and cockpit documentation

• Update cockpit documentation to include required take‑off, destination and alternate aerodromes as required for twin engine aeroplanes and nominated EDTO alternate aerodromes for aeroplanes with more than two turbine engines (item 48). Ensure cockpit documentation meets the definition in item 10 and is carried or downloaded into the cockpit prior to dispatch as dispatch is defined in item 11.

5. Ensure CMP, MEL and training program compliance

• For twin engine aeroplanes ensure dispatch only if the aeroplane meets CMP standards document requirements for the EDTO flight (item 47). For operations seeking more than 180 minutes for aeroplanes with more than two turbine engines, obtain CASA approval for operations training programs that specifically address operational factors with respect to the maximum diversion time, and for an MEL appropriate to the maximum diversion time requested (item 43(a)(i) and (ii)). Ensure these programs and MELs are formally approved by CASA and reflected in safety operational specifications.

6. Confirm communications capability and APU/CFSS carriage

• For EDTOs beyond 180 minutes ensure that an additional communications facility will be available at all stages of flight to provide effective direct communication between flight crew and air traffic services and between flight crew and the operator, for example voice, SATCOM or ACARS, and be prepared to show how limitations (for example in polar operations) are mitigated (items 37, 45 and 51 and accompanying notes).
• If an APU is required for OEI, depressurisation procedures or to support a time‑limiting EDTO significant system, ensure the APU, including electrical and pneumatic supply to its designated capability, is available (item 44). For operations where CFSS is required, ensure CFSS is carried and usable as demanded by the relevant EDTO approval (item 45 and item 27 note).

7. Plan EDTO alternate aerodromes and perform performance calculations

• Use Table 1 in clause 7 of Appendix 5 for Standard EDTO alternate aerodrome planning minima in flight planning and aeroplane dispatch contexts, as inserted into the EDTO alternate aerodrome definition (item 4(d)(i) and item 59 references). Ensure that forecasts for the entire estimated period of use at the aerodrome meet these minima (item 49).
• Verify crosswind and gust components for expected landing runways do not exceed the lowest of AFM/OEM demonstrated or operational limits (item 4(e)).
• Confirm that landing distance available at the aerodrome for expected runway surface conditions, wind conditions, aeroplane
