Civil Aviation Order 29.5 - Air service operations - Miscellaneous dropping of articles from aircraft in flight (02/12/2004)

The instrument defines several key concepts that determine its application and the specific duties imposed. Aerial application operation is defined by reference to regulation 61.010 of the Civil Aviation Safety Regulations 1998 (CASR 1998), meaning operations involving the discharge of agricultural or other substances from an aircraft for pest control, crop spraying, fertilising, sowing, or similar purposes. Aerial application training operation means flight training for those operations. Because these two categories are expressly excluded by subsection 1, operators engaged in them must look to other instruments, not CAO 29.5. The residual category applies to anything else, which is a broad field covering parachute drops, supply drops, leaflet drops, water bombing practice, survey marker drops, and even dropping rubbish or survival gear.

Dropping operation is defined in a note to subsection 4.8 as the part of the flight during which the aircraft is on the final approach path to the dropping site or target, and during which only minor changes of heading, airspeed and altitude are made. This definition is important because it determines when the despatch rules in subsection 5 apply: during dropping operations, despatchers must wear approved restraint equipment that permits movement to but not through the dropping aperture (subsection 5.6), and other persons must be seated with safety belts or harnesses (subsection 5.3). Outside that phase, the less restrictive rules of subsection 5.5.2 apply (despatcher seated and restrained in turbulent conditions or below 100 feet).

Despatcher is not explicitly defined but is described as a person other than the pilot in command who controls the dropping of articles or substances (subsection 4.7). The instrument requires that the operator ensure the despatcher is properly instructed in his duties (subsection 4.10). The despatcher must maintain effective communication with the pilot in command and may only drop with the pilot's consent (subsection 4.8). This creates a clear allocation of responsibility: the pilot retains ultimate authority over the drop, but the despatcher handles the physical release.

Control zone and aircraft lane of entry are terms from airspace classification; dropping is prohibited within them without CASA approval (subsection 3). Similarly, dropping within 5 miles of a Government or licensed aerodrome requires CASA approval. Populous area is used but not defined in the instrument; it likely takes its meaning from the general aviation regulatory framework and case law. The instrument permits dropping over populous areas only at heights above 1,000 feet, unless an emergency makes lower flight essential (subsection 7.1). That provision creates significant operational constraints for operators who need to drop into built-up areas, such as emergency relief or law enforcement supply drops.

The general permit under subsection 6 is a notable concept: it is granted automatically by the instrument itself, not by individual application. It only covers dropping operations associated with search and rescue training. For aeroplanes, the permit allows flight as low as 100 feet; for other aircraft (helicopters, gyroplanes), it allows flight lower than 500 feet. The permit only applies over non-populous areas. This is a limited concession that reduces compliance cost for a specific subset of operations, but it does not extend to practice for other types of drops.

CAO 29.5 directly affects all persons and entities involved in operating Australian aircraft for the purpose of dropping articles from the air, except those already covered by the aerial application regime. This includes owners and operators of aircraft used for parachute dropping, banner towing that involves releasing banners, supply drops to remote areas, leaflet distribution, water bombing practice, wildlife management (such as bait drops), and any other non-agricultural dropping. The pilot in command bears specific duties under subsections 4.9 (ensuring no unsafe trim change), 4.8 (consenting to the drop), and 4.11 (holding proper authorisation under Part 61 of CASR 1998). The despatcher, though not necessarily a licensed pilot, must be properly instructed by the operator (subsection 4.10) and comply with carriage and restraint requirements in subsection 5. Passengers on board during dropping operations are affected by the seating and restraint rules in subsections 5.3 and 5.4: they must occupy a separate seat with an approved safety belt or harness, and where the dropping aperture is large enough for a person to fit through, they must remain seated whenever the aperture is open. This imposes a direct compliance cost on operators who carry photographers, observers, or trainees during drops.

CASA is the regulator that must grant approvals for certain activities: approval to drop within a control zone, lane of entry, or within 5 miles of an aerodrome (subsection 3); approval to carry persons other than those with duties relating to the operation (subsection 5.2); and permission to conduct dropping operations at night or out of visual flight rules (subsection 7.2). Operators face an application burden and potential delay for these approvals, which may discourage marginal dropping operations.

Land owners over which dropping occurs are indirectly affected. Note 1 explicitly states that the order does not confer any rights against the owner of land over which the operations are conducted, nor prejudice common law remedies for injury or property damage. This means the operator and pilot remain fully exposed to civil liability for trespass, nuisance, and negligence. The instrument does not create a defence or limitation of liability. This exposure is a real cost, particularly for operations that require repeated drops over the same property. Operators must either obtain land owner consent or accept the risk of litigation.

The instrument also affects persons on the ground who might be struck by dropped articles or substances. Subsection 4.5 requires that, for articles other than leaflets or substances not in liquid, powder or fine grain form, the dropping site must be clear of persons and stock. This rule reduces but does not eliminate risk; compliance requires prior surveillance of the drop zone. For leaflets, subsection 4.6 imposes a limit on size and number to ensure injury is not caused if they fail to separate. These provisions impose monitoring and control costs on operators.

Finally, the instrument distinguishes between categories of operations, meaning that search and rescue entities (such as police, emergency services, and defence forces) benefit from the general low-flying permit in subsection 6, while private operators conducting similar practice for other purposes do not. That distinction creates a regulatory advantage for state-affiliated operators, potentially distorting competition in areas such as parachute training or dropping practice.

The instrument imposes a set of positive duties on the operator, the pilot in command, and the despatcher, while conferring limited rights in the form of approvals and permits.

Operator duties: The operator must ensure the despatcher is properly instructed in his duties (subsection 4.10). The operator must also ensure that the carriage of articles before dropping complies with section 20.16.2 of the Civil Aviation Orders (subsection 5.1). These duties are ongoing and require the operator to maintain training records, instructional materials, and carriage procedures. Failure to do so is a breach of the direction under CAR 150.

Pilot in command duties: The pilot in command must ensure that movement of articles during flight preparatory to dropping, during dropping, and after dropping does not result in any unsafe change in aircraft trim or cause the centre of gravity to move outside permissible limits (subsection 4.9). The pilot must give consent before the drop occurs (subsection 4.8). The pilot must also hold the appropriate authorisation under Part 61 of CASR 1998 for the activity (subsection 4.11). This requirement may impose additional training or endorsement costs if the drop activity does not fall within the pilot’s existing rating. The pilot must also ensure that during dropping operations, the effective communication with the despatcher is maintained (subsection 4.8). The pilot retains the right to withhold consent, making them the final decision-maker, which is a significant responsibility.

Despatcher duties: The despatcher must be a person other than the pilot, unless the dropping can be carried out from the pilot’s normal crew station without affecting normal control (subsection 4.7). The despatcher must wear approved restraint equipment during dropping operations, which must permit movement to but not through the dropping aperture (subsection 5.6). Outside dropping operations, the despatcher must remain seated and wear a safety belt or harness in turbulent conditions or when flying below 100 feet (subsection 5.5.2). During take-off, landing, and instrument approaches, the despatcher must be seated and restrained (subsection 5.5.1). These duties restrict the despatcher’s freedom of movement and require specific restraint systems.

Rights: The operator and pilot have the right to apply for CASA approvals: approval to drop within a control zone, lane of entry, or within 5 miles of an aerodrome (subsection 3); permission to carry extra persons (subsection 5.2); and permission to conduct drops at night or out of visual flight rules (subsection 7.2). These are discretions, not entitlements, and CASA may impose conditions. The general permit under subsection 6 is a right that arises automatically from the instrument for eligible operations (search and rescue training) without the need for individual application. This reduces compliance cost for those operators. However, the note to subsection 8 clarifies that the right to release fuel is subject to the Air Navigation (Fuel Spillage) Regulations 1999 if paragraph 150(2)(d) of CAR 1988 does not apply, meaning fuel release remains heavily regulated.

The instrument does not grant a right to drop over land without the owner’s consent (Note 1). This separation of regulatory approval from property rights means that even if CASA permits a drop, the operator may still face civil liability. That is a significant limitation on the utility of the approvals.

CAO 29.5 does not itself prescribe penalties. Enforcement arises from the parent legislation, the Civil Aviation Regulations 1988. Subregulation 150(2) provides that the directions in the order must be complied with. Breach of a direction is likely to constitute a contravention of the regulations, which can result in criminal prosecution, civil penalties, or administrative action by CASA. Under the Civil Aviation Act 1988, CASA can issue infringement notices (on-the-spot fines) for certain breaches, suspend or cancel licences, certificates, or authorisations, and seek court orders. The specific penalty amounts are not stated in this instrument, but for reference, typical penalties for contravening a Civil Aviation Order can range from hundreds of penalty units (currently one penalty unit is $313) to imprisonment in serious cases involving reckless conduct that endangers safety.

Enforcement is primarily through CASA’s regulatory compliance programs. CASA may audit operators, investigate incidents, and take enforcement action if a dropping operation contravenes the directions. The instrument creates clear, objective standards (e.g., no dropping within 5 miles of an aerodrome without approval, dropping site must be clear of persons and stock, despatcher must be instructed), and these are easy to verify. This means the risk of detection and enforcement is higher for operators who attempt to cut corners.

The existence of the general permit for low flying under subsection 6 does not insulate operators from liability for other breaches. Even if the low flying is permitted, the operator must still comply with subsections 3, 4, and 5 as applicable. The transitional provisions from the 2014 amendment (Table A) indicate that continued authorisations under CASR 1998 must comply with the Civil Aviation Orders as if they were new authorisations, so pre-existing rights do not provide a shield.

Civil liability is expressly preserved by Note 1. The instrument does not limit or exclude liability for injury or property damage. That means an operator who drops an article that hits a person or object can be sued in tort, and the order provides no defence. This creates strong incentives for operators to go beyond mere compliance and carry insurance and risk management procedures. The cost of that insurance is a compliance burden that falls hardest on small operators.

The instrument does not create any private right of action for breach of statutory duty; it merely preserves common law rights. So a person injured by a drop cannot sue solely because the directions were breached; they would need to prove negligence or trespass independently. However, a breach of a direction may be evidence of negligence in a civil proceeding.

CAO 29.5 is made under the Civil Aviation Regulations 1988 and sits within a broader regulatory framework. It explicitly references several other instruments. The carriage of articles before dropping must be in accordance with section 20.16.2 of the Civil Aviation Orders (subsection 5.1), which deals with the stowage and restraint of cargo. Compliance with that section imposes additional design or procedural requirements on the aircraft and operator.

The pilot in command must be authorised under Part 61 of the Civil Aviation Safety Regulations 1998 (CASR 1998) to conduct the activity (subsection 4.11). Part 61 contains the flight crew licensing rules, including ratings and endorsements for specific operations such as aerial application, parachute dropping, and low flying. This means that even if an operator has a general commercial pilot licence, they may need a specific endorsement or rating to conduct dropping operations under CAO 29.5.

The release of liquid fuel is governed by the Air Navigation (Fuel Spillage) Regulations 1999 (subsection 8.1). These regulations impose separate procedural requirements, such notifying air traffic control and selecting an appropriate area, which add to the operator’s compliance obligations.

The general low-flying permit in subsection 6 is granted under paragraph 157(4)(b) of CAR 1988. That paragraph allows CASA to permit low flying below the minimum heights specified in regulation 157. The permit in CAO 29.5 is a blanket permission, but it only covers search and rescue training drops over non-populous areas. For other operations, operators must rely on individual permits from CASA or operate at or above standard minimum heights.

The instrument also interacts with airspace law. Dropping is prohibited within control zones, aircraft lanes of entry, and within 5 miles of an aerodrome without CASA approval (subsection 3). These are airspace classifications defined under the Air Navigation Regulations and the Aeronautical Information Publication. Operators must consult current airspace charts and obtain approval from the relevant Air Traffic Service provider if the drop is near controlled airspace.

At common law, note 1 preserves the rights and remedies of land owners and injured persons. This means that even if an operator holds all necessary CASA approvals, they may still be liable in trespass if they drop over land without consent, or in negligence if they cause harm. The instrument creates a regulatory safe harbour in the aviation sense but not a civil liability safe harbour.

The 2014 amendment deleted Appendix I from CAO 29.5 and replaced the definition of aerial application operation with a reference to regulation 61.010 of CASR 1998. This harmonises the definition with the new licensing framework. The transitional provisions in Table A of the amending instrument provide that continued authorisations (e.g., existing licences) are treated as if they are the equivalent new authorisation, so the Part 61 requirement applies to legacy authorisations as well.

CAO 29.5 was originally made by Civil Aviation Amendment Order (No. R25) 2004, notified in the Gazette on 8 December 2004 and commenced on the same day. That order repealed and substituted the previous section 29.5. The instrument as shown in this compilation reflects amendments made by the Civil Aviation Order (Flight Crew Licensing) Repeal and Amendment Instrument 2014 (No. 1), which was registered on FRLI on 29 August 2014 and commenced on 1 September 2014. That amendment substituted subsection 1 (application) to exclude aerial application operations and added the definition subsection 1A. It also amended subsection 4 (dropping requirements) and subsection 7 (operating conditions), and repealed Appendix I. The table of amendments shows these changes clearly. The transitional provisions in sections 3 and 31 of the 2014 instrument define continued authorisation and new authorisation, and provide that the Civil Aviation Orders apply to continued authorisations as if they were the equivalent new authorisation. This ensures that pilots holding old-style licences must meet the same requirements as those with new Part 61 licences.

The instrument has not been amended since 2014. There is no evidence of any later amending instruments in the compilation (which was prepared on 15 January 2015). Practitioners should check the Federal Register of Legislation for any subsequent amendments. The compilation includes a table of orders showing the two amending events. The absence of further amendment suggests that the regulatory design for dropping articles has been stable for over a decade, though this may also indicate that the instrument has not been reviewed in light of new technologies (e.g., drones, which are not covered by this order as it applies to manned aircraft only).

The source text does not mention any litigation concerning CAO 29.5. No cases are cited. This is not surprising given that the instrument is a relatively narrow technical regulation. Litigation may have occurred in civil courts regarding liability for dropped articles, but those cases would not have been decided on the interpretation of this order alone; they would more likely involve negligence, trespass, or breach of statutory duty with the order used as evidence of the standard of care. Without named cases in the source, it is not appropriate to speculate about specific judgments. The absence of litigation history in the source does not mean no disputes have arisen; it simply means the compilation does not reference them. For a full picture, subscribers would need to search case law databases for references to section 29.5 of the Civil Aviation Orders. Practitioners should be aware that enforcement actions by CASA are handled administratively and may not result in published court decisions.

Several provisions in CAO 29.5 create traps for the unwary. The most significant is the classification of the dropping purpose. Subsection 2.2 through 2.4 allocate different subsets of directions based on the purpose. If an operator misclassifies a drop (e.g., treats a non-search-and-rescue training drop as “other” when it could be considered search and rescue training, or vice versa), they will either miss required directions or comply with unnecessary ones. The instrument does not define search and rescue training operations, leaving scope for disagreement. An operator conducting practice for water bombing for bushfires, for example, might argue it is search and rescue training, but the instrument does not explicitly include that. The general low-flying permit in subsection 6 only applies to search and rescue training drops, so a misclassification could mean operating without a needed permit.

Another trap is the definition of dropping operation in the note to subsection 4.8. This definition is not in the operative text but in a note, which may have less legal force. Nevertheless, it describes the dropping operation as the final approach path with only minor changes. The carriage and restraint requirements in subsection 5 apply during dropping operations, but if a drop takes longer or involves manoeuvring, the operation may fall outside the definition, leading to uncertainty about when the rules apply. Operators who interpret the note strictly may find they are not in compliance if the flight path changes more than minor.

Subsection 4.5 requires that the dropping site be clear of persons and stock for articles other than leaflets or substances not in liquid, powder or fine grains. However, the exception for “substances not in the form of liquid, powder or fine grains” is ambiguous: does it mean substances that are not in those forms (i.e., solids) are exempt from the site-clearing requirement? The phrasing is poor. Read literally, the exemption applies to substances that are not in liquid, powder or fine grain form, meaning that liquid, powder, and fine grain substances do need the site to be clear. But that contradicts the phrase “other than leaflets or substances not in the form of liquid, powder or fine grains”. The confusion could lead operators to incorrectly believe that solid objects do not require a clear site. The safer interpretation is that the requirement applies to articles (other than leaflets and substances that are not in those three forms), meaning that solids like boxes, bags, or gear must have a clear site, while liquids, powders, and fine grains are exempt from the site-clearing requirement. This is a drafting quirk that may require CASA guidance.

Subsection 5.5.2 requires the despatcher to be seated and restrained outside dropping operations when the aircraft is below 100 feet. But subsection 6.1(a) allows search and rescue training aeroplanes to fly as low as 100 feet. That means during a search and rescue training drop conducted at 100 feet, the despatcher must be seated and restrained except during the dropping operation itself. Confusion can arise about when exactly the dropping operation begins and ends.

The instrument does not address the dropping of unmanned aircraft or other remotely piloted systems. It applies to Australian aircraft, and an unmanned aircraft is also an aircraft, but the provisions about despatchers and pilots are clearly designed for manned operations. Operators using drones to release payloads cannot easily comply with subsection 4.7 (pilot and despatcher requirement), subsection 4.8 (communication), or subsection 4.11 (Part 61 authorisation). This regulatory gap creates uncertainty for operators in the emerging drone delivery sector.

The extensive reliance on CASA approvals (subsections 3, 5.2, 7.2) means that any dropping operation that does not fit neatly into the prescribed categories may face delays or refusal. CASA’s discretion is not fettered by the instrument, so operators cannot rely on a right to approval even if they meet all safety criteria. This creates a risk of rent-seeking or inconsistency.

The low-flying permit in subsection 6 only covers search and rescue training. It does not cover practice drops for other purposes, even if those drops are necessary to maintain proficiency. This creates an uneven playing field and may discourage operators from conducting non-search-and-rescue training drops at low altitude, even where it is safe.

Finally, the instrument does not provide any grandfathering for existing operations or aircraft modifications. The transitional provisions only address licensing authorisations, not the physical arrangement of the aircraft or the dropping equipment. Operators who modify aircraft for dropping must ensure the modifications are approved by CASA under subsection 4.1 (carried inside or in manner specified in flight manual or otherwise approved by CASA). This can be a costly process.

Compliance with CAO 29.5 requires a systematic approach. First, determine whether the operation is an aerial application operation or aerial application training operation. If it is, CAO 29.5 does not apply. The operator must then identify the purpose of the drop from the categories in subsection 2: cloud seeding, search and rescue, search and rescue training, release of liquid fuel, or other. This classification determines which subsections apply. For cloud seeding or search and rescue: subsections 4 and 5. For search and rescue training: subsections 3, 4 and 5. For liquid fuel release: subsection 8, plus the Air Navigation (Fuel Spillage) Regulations 1999. For all other purposes: subsections 3, 4, 5 and 7.

Second, obtain any required CASA approvals. Subsection 3 requires approval to drop within a control zone, within an aircraft lane of entry, or within 5 miles of a Government or licensed aerodrome. Subsection 5.2 requires CASA permission to carry persons other than those with duties relating to the operation. Subsection 7.2 requires CASA permission to conduct drops at night or outside visual flight rules. The operator should apply early, with clear justification, and be prepared for conditions.

Third, comply with the dropping requirements in subsection 4. Ensure articles are carried inside the aircraft or as specified in the flight manual or by CASA approval (4.1). The opening for dropping must not allow articles to damage the aircraft on release (4.2). Individual articles must have sufficient size-to-weight ratio to drop readily (4.3). For articles other than leaflets or certain substances, the dropping site must be of sufficient dimensions and clear of persons and stock (4.4, 4.5). Leaflet drops must limit size and number to prevent injury if they fail to separate (4.6). The despatcher must be someone other than the pilot unless the pilot can drop without affecting normal control (4.7). Effective communication between pilot and despatcher must be maintained, and drop only with pilot consent (4.8). The pilot must ensure no unsafe trim change or CG exceedance (4.9). The operator must instruct the despatcher properly (4.10). The pilot must hold appropriate Part 61 authorisation (4.11).

Fourth, comply with carriage and restraint requirements in subsection 5. Carriage before dropping must follow section 20.16.2 of the Civil Aviation Orders. Extra persons require CASA permission. During dropping operations, non-despatchers must occupy separate seats with approved safety belts or harnesses (5.3). If the dropping aperture is large enough for a person to fit through, non-despatchers must remain seated when it is open (5.4). The despatcher must have a sitting position with approved belt or harness, and must be seated and restrained during take-off, landing, instrument approaches, and, outside dropping operations, in turbulence or below 100 feet (5.5, 5.5.1, 5.5.2). During dropping operations, the despatcher must wear approved restraint that prevents moving through the aperture (5.6).

Fifth, observe the low-flying and operating conditions. For search and rescue training, the general permit in subsection 6 allows aeroplanes to fly as low as 100 feet and other aircraft lower than 500 feet over non-populous areas. For other operations, subsection 7 prohibits flight below 1,000 feet over any populous area unless essential due to an emergency. Drops must be by day, in visual flight rules, and in continuous sight of the ground or water unless CASA permits otherwise (7.2).

Sixth, for liquid fuel release, comply with Air Navigation (Fuel Spillage) Regulations 1999 and subsection 8.

Finally, document all approvals, instructions to despatchers, maintenance of flight manual compliance, and despatcher training records. The operator should also secure land access rights and insurance, because the order does not protect against civil liability. Regular audits of procedures against the direction categories are advisable, as a change in the purpose of a drop may trigger different compliance obligations. For operators conducting multiple types of drops, it may be most efficient to comply with the strictest set of requirements (subsections 3, 4, 5 and 7) always, but that increases cost and may reduce operational flexibility. Each operator must weigh the compliance burden against the risk of enforcement or liability.
