Civil Aviation Order 29.4 - Air displays (02/12/2004)

The Order provides a bespoke regulatory framework for organised flying performed before a public gathering. The central concept is an air display, defined as organised flying including cross-country events, contests, exhibitions of flying or local flights made for the purpose of carrying passengers for hire or reward performed before a public gathering. This captures events ranging from air races and rallies (cross-country events are separately defined as air races, rallies, timed flight events and navigation contests) to commercial scenic flights that occur in the presence of a crowd. A public gathering means people assembled at a location on the basis of a general public invitation, with or without subscription or levy. The definition excludes private invitational events that do not involve a general invitation; however, a free community event that is open to anyone via a public notice would count. The organiser is a person appointed by the organising body to plan and conduct the display. That individual bears primary regulatory responsibility. The Order establishes several distinct concepts within the approval structure: general conditions (section 4.1), manoeuvring limitations (section 4.2), aerial application demonstrations (section 4.3), cross-country events (section 4.4), and pylon races (section 4.5). Each subcategory adds extra requirements. The concept of approval is central: the entire event, including its location and program, requires CASA sign-off. The Order also references aerial application operation with the meaning given by regulation 61.010 of CASR 1998, which ties the demonstration rules to the substantive licensing regime for agricultural spraying. The planning and control concept distinguishes between events where Air Traffic Control services are provided and those where they are not. If ATC is not provided, the approved location must be designated as a danger area for the duration of the display (section 5.2). The organiser must conduct a group briefing before the event covering the program, weather, airfield layout, circuit patterns, traffic control, emergency procedures, minimum heights and distances, ground handling, and procedures for non-participating aircraft. The indemnity and public risk insurance note introduces a risk-shifting concept for events on Commonwealth airfields, though the Order itself does not impose insurance as a mandatory condition of the CASA approval.

The Order directly imposes duties on organisers and participating pilots, but its reach extends to several other parties. Organisers bear the primary compliance burden: they must apply to CASA at least 28 days before the event, coordinate the briefing, and ensure that all requirements of the Civil Aviation Regulations 1988, CASR 1998 and the Order are met. This creates a significant administrative cost for smaller display organisers, particularly community flying groups or one-off events where the organiser may have limited regulatory experience. The requirement to appoint an organiser by the organising body means that liability is concentrated on a single natural person, not on the organisation itself. Pilots must comply with the height and distance restrictions unless they have specific approval as part of the program. Aerial application demonstration pilots need authorisation under Part 61, which restricts who can participate. CASA is the gatekeeper: it may approve or reject the application, impose conditions commensurate with the scale and nature of the display, and decide whether ATC services are required. That gives CASA substantial discretionary power over the viability of an event. Spectators are indirectly affected by the restrictions designed to protect them, but the Order creates no private right of action for spectators if harm occurs. The note about indemnity and public risk insurance signals that the Commonwealth (as owner of many airfields) will insist on being indemnified and may demand insurance, which raises the cost of hiring a Commonwealth aerodrome. Local authorities and residents are mentioned in the pylon race condition: the area must be such that the event would not constitute a nuisance to them. This imports a non-aviation standard into the aviation approval, potentially empowering local objections to influence CASA’s decision. Insurance companies are implicitly affected because the note suggests that public risk insurance will be required; this may create a market for specialist aviation event insurance, but also adds a cost barrier. For private commercial operators who carry passengers for hire or reward as part of a display, the Order restricts that activity unless specifically approved. This reduces the commercial freedom of display organisers to monetise flights during the event. Overall, the Order imposes disproportionate compliance costs on smaller, non-commercial displays because the fixed costs of preparing an application, briefing, and coordinating safety facilities do not scale down.

The Order creates a web of duties and a limited set of rights. The organiser has the duty to submit a written application to CASA at least 28 days before the display (section 3). The application must contain the date and locality, program of events, organisations participating, names of principal participants, and the name of the person proposed as organiser. For cross-country events, additional details must be supplied: the object or purpose, class of aircraft, proposed track, stopping places and reporting points, estimated times, and detailed organisation for control of activities. Pylon race applications require details of the area and the area must be suitable for low flying, not constitute a nuisance, and not endanger persons or property. The organiser also has an affirmative duty to conduct a group briefing covering at least nine enumerated items (section 5.3). More broadly, the organiser is responsible for ensuring that the display complies with the Civil Aviation Regulations 1988, CASR 1998 and the Order itself (section 5.4). That is a strict responsibility - the organiser cannot delegate liability. Once approval is granted, there are duties to keep spectators out of engine operating areas, to ensure spectator areas are not in approach or take-off zones, and to provide emergency rescue and first aid facilities on a scale approved by CASA. The Order imposes a duty not to fly below 500 feet above ground level except during take-off or landing or where specifically approved. Below 1,500 feet, aircraft must not track or manoeuvre towards spectators within 500 metres horizontally, or pass within 200 metres horizontally of spectators. For aerial application demonstrations, the pilot must be authorised under Part 61; toxic or noxious substances must not be released; dropped substances must not contact spectators; and equipment must be decontaminated before the demonstration in accordance with relevant State, Territory or Commonwealth regulations. The organisers’ rights are limited: they have the right to apply for CASA approval, and they have the right to seek approval for specific events that depart from the default restrictions (e.g., low-flying manoeuvres as part of the program, or carrying passengers for hire or reward). There is no right to a response within a set time - the Order only says that application must be submitted at least 28 days before, not that CASA must decide by then. That creates uncertainty for event planning. The note about indemnity and insurance suggests that the Commonwealth, as landowner, may exercise a contractual right to demand indemnity and insurance, but this is not a statutory right of the organiser.

The text of Order 29.4 does not itself specify penalties. Penalties for non-compliance are found in the parent regulations under which it is made: the Civil Aviation Regulations 1988 (CAR 1988) and the Civil Aviation Safety Regulations 1998 (CASR 1998). Regulation 156 of CAR 1988 is the enabling provision, and a contravention of a Civil Aviation Order is generally an offence under CAR 1988 or CASR 1998, depending on which regulation the order is made under. For instance, conducting an air display without CASA approval (section 2) would be a breach of the Order and therefore an offence under the civil aviation legislation, potentially attracting fines or licence suspension. Similarly, exceeding the 500 foot or 1,500 foot limitations without specific approval could be an offence. The organiser’s responsibility under section 5.4 is to ensure compliance; if the organiser fails in that duty, they could face enforcement action directly. CASA can also withdraw or suspend approval if conditions are breached, although the Order does not expressly state that power - it flows from CASA’s general regulatory functions. The note about indemnity and insurance is separate: it indicates that the Commonwealth may impose indemnity and insurance requirements as a condition of using a Commonwealth airfield. Failure to meet those could result in denial of access or contractual penalties, but not a direct statutory penalty. The enforcement mechanisms are therefore a combination of criminal or civil penalty provisions under the broader aviation regulatory framework and contractual remedies if the event is on Commonwealth land. The 2014 amendments were purely technical (definitions) and did not alter penalty provisions. Practitioners should note that the Order itself is only one layer; a breach might also be prosecuted under the general safety provisions of CASR 1998 (such as Part 91 or Part 101) depending on the nature of the flight. The Order’s requirement that the program must not include flying events likely to cause diversion of pilot attention or disorganised close-proximity flight gives CASA a broad discretion to refuse or condition a display, and a breach could be cited as a safety contravention.

The Order sits within a hierarchy of aviation legislation. It is made under regulation 156 of the Civil Aviation Regulations 1988 (CAR 1988). That means the Order must be read in conjunction with CAR 1988 and with CASR 1998, which are referred to throughout. For example, the definition of aerial application operation is imported from regulation 61.010 of CASR 1998, and the pilot authorisation requirement for aerial application demonstrations is tied to Part 61 of CASR 1998. The 2014 amendments explicitly substituted references to continued authorisations and new authorisations as defined in CASR 1998. The Order also explicitly requires compliance with the Civil Aviation Regulations 1988 and CASR 1998 (section 5.4). Beyond aviation law, interaction occurs with State, Territory, and Commonwealth regulations concerning decontamination of aerial application equipment: section 4.3(d) requires that equipment be decontaminated before the demonstration in accordance with relevant regulations. That imports external environmental or chemical safety standards. The pylon race condition that the area must not constitute a nuisance to local authorities or residents (section 4.5(b)) effectively imports general nuisance law principles into the aviation regulatory framework. This is unusual because aviation is normally a Commonwealth domain, and the provision forces CASA to consider local amenity when approving pylon races. The danger area designation under section 5.2 interacts with airspace management regulations under CASR 1998 (likely Part 101 or 201). The note about indemnity and public risk insurance points to contract law and tort law: the Commonwealth may require a contractual indemnity, and the insurance requirement affects the organiser’s ability to manage third-party liability. For events not on Commonwealth airfields, the organiser would still be subject to common law negligence duties and any state-based workplace health and safety laws, though the Order does not mention them. The Order does not override state planning or noise regulations directly, but the nuisance condition suggests that such matters are relevant to CASA’s decision. There is no mention of how the Order interacts with the Civil Aviation Act 1988 or the Airspace Act, but those would be the overarching statutes.

The original section 29.4 was replaced by the Civil Aviation Amendment Order (No. R24) 2004. That amendment substituted the entire section, effective from 8 December 2004. The amending order was notified in the Gazette on 8 December 2004 and was registered on FRLI as F2005B00835. The next amendment came from the Civil Aviation Order (Flight Crew Licensing) Repeal and Amendment Instrument 2014 (No. 1), registered on FRLI on 29 August 2014 and commencing on 1 September 2014. That instrument amended subsections 1 (definitions), 3 (application), 4 (conditions), and 5 (planning and control). The amendments were transitional: they imported definitions from CASR 1998 regarding continued authorisations and new authorisations, and made the Order apply to a continued authorisation as if it were the equivalent new authorisation. This was necessary because Part 61 of CASR 1998 introduced a new licensing structure for flight crew that superseded previous authorisations. The compilation notes show that sections 3 and 31 of the 2014 instrument contained these transitional provisions. No further amendments have been made up to the compilation date of 14 January 2015. The Order has thus been stable since 1 September 2014. The table of amendments indicates that subsections 1, 3, 4 and 5 were all amended by the 2014 instrument. The original 2004 substitution introduced the modern structure of approval, conditions, and planning control. The amendment history is relatively simple, with two events: a wholesale replacement and a subsequent definitional amendment. There is no evidence of any judicial review or disallowance.

The source text of Order 29.4 does not cite any litigation, and this compilation contains no references to court decisions. There is no mention of any case where the Order was considered or challenged. That does not mean no disputes have arisen, but the publicly available compilations of federal aviation legislative instruments rarely include case law. It is possible that disputes over CASA’s refusal to approve an air display or over conditions imposed could be reviewed under the Administrative Decisions (Judicial Review) Act 1977 or the Administrative Appeals Tribunal Act 1975, but no such cases are named in the source. Similarly, common law negligence actions arising from accidents at air displays might reference the Order as evidence of the standard of care, but no specific decisions are listed. The absence of litigation history in the source means the analyst cannot identify any judicial interpretation or precedent. Practitioners should therefore assume the Order has been applied administratively without significant legal contest. The nuisance condition for pylon races could potentially generate litigation if local residents seek judicial review of CASA’s approval, but again no case is cited. The note about indemnity and insurance might lead to contractual disputes if a loss occurs and the Commonwealth seeks to enforce the indemnity, but that would be a matter of private law, not administrative law. The lack of litigation history does not imply that the Order is uncontroversial; it may simply reflect that the aviation community complies or that disputes are resolved through negotiation rather than court.

Several features of the Order are easy to overlook. First, the definition of public gathering includes any assembly of people on the basis of a general public invitation, with or without subscription or levy. A free community open day with a barbecue and a flypast could therefore be an air display requiring CASA approval, even if no tickets are sold and the flying is not a formal show. Second, the absolute prohibition on carrying passengers for hire or reward during any part of the air display except where specifically approved as part of the program (section 4.1(f)) is strict. A scenic flight company cannot run joy flights from an airfield during a public event unless it obtains specific CASA approval for that element. Third, the 500 foot and 1,500 foot limitations apply except during take-off or landing or where specifically approved. A pilot who inadvertently flies below 500 feet while orbiting to set up for a display without explicit program approval could be in breach. The requirement for specific approval means that the program must clearly list each manoeuvre that will involve low flight. The organiser cannot simply rely on CASA’s general approval of the event. Fourth, the organiser’s responsibility under section 5.4 is expressed as a duty to ensure that the requirements of the Civil Aviation Regulations, CASR and the Order are met. That is a non-delegable duty that rests on the individual named as organiser, even if the organising body is a large organisation. The organiser may face personal liability for failures by participants. Fifth, the note about indemnity and insurance is not part of the Order itself but is attached as informational material. However, if the event is at a Commonwealth airfield, the Commonwealth’s contractual requirements will likely mirror the note. Organisers who fail to budget for insurance and indemnity may find themselves unable to use such airfields. Sixth, the aerial application demonstration condition requiring decontamination of equipment “in accordance with relevant State, Territory or Commonwealth regulations” creates an uncertainty: the organiser must identify which regulations apply and how to demonstrate compliance to CASA. Seventh, the pylon race condition that the area “would not constitute a nuisance to local authorities or residents” is vague. CASA may require noise studies, community consultation, or curfews, adding time and cost. Eighth, the 28-day minimum application period does not guarantee a decision by CASA within that time; organiser should file much earlier. Ninth, there is no provision for a simplified approval process for small or familiar events. Each display requires a full application, even if it is identical to one approved the previous year. Tenth, the “disorganised flight by aircraft in close proximity” prohibition in section 4.1(g) is subjective. A display that includes multi-aircraft formation work may need careful justification to satisfy CASA that the flight is not disorganised.

To conduct an air display within the framework of Order 29.4, an organiser should follow these steps. Step one: determine whether the event meets the definition of air display - if there is a public gathering and organised flying (including contests, exhibitions, or passenger-carrying flights), approval is required. If the event is purely private (no general invitation), it may not be an air display, but still requires compliance with other aviation rules. Step two: appoint an organiser. That person will be the point of contact for CASA and bears legal responsibility. Step three: submit a written application to CASA at least 28 days before the proposed date. The application must include the date and locality, a detailed program of events, list of organisations and principal participants, and the name of the proposed organiser. If the event includes a cross-country event, add the object, class of aircraft, proposed track, stopping places, reporting points, estimated times, and detailed control organisation. If it includes a pylon race, provide details of the area and demonstrate that it is suitable for low flying, will not constitute a nuisance to local authorities or residents, and will not endanger persons or property. Step four: ensure the location and program are approved by CASA. Request specific approval for any elements that deviate from the default restrictions, such as carrying passengers for hire or reward or flying below 500 feet or within 500 metres of spectators. Step five: arrange emergency rescue and first aid facilities on a scale that CASA considers commensurate with the display. There is no fixed standard; engage with CASA early to determine what is expected. Step six: implement physical barriers or marshals to prevent spectators from entering areas where aircraft engines are operating, and ensure spectator areas are not in approach or take-off zones. Step seven: if ATC services are not provided, the location must be designated as a danger area for the duration of the display - coordinate with Airservices Australia or the relevant airspace authority. Step eight: before the display, the organiser must conduct a group briefing of all participants covering the program, weather, airfield layout, circuit patterns, traffic procedures, emergency procedures, minimum heights and distances, ground handling, and procedures for non-participating aircraft. Document the briefing. Step nine: for aerial application demonstrations, ensure the pilot is authorised under Part 61 to conduct aerial application operations in that category of aircraft; decontaminate the equipment in accordance with applicable state, territory or Commonwealth regulations; do not release toxic or noxious substances; and ensure dropped substances do not contact spectators. Step ten: obtain insurance and, if using a Commonwealth airfield, be prepared to indemnify the Commonwealth. Even if not required by the Order, public liability insurance is prudent. Step eleven: maintain records of the application, CASA approval, briefing notes, and any conditions. Compliance is a continuous duty; the organiser must ensure all participants adhere to the approved program and restrictions throughout the event. Non-compliance could lead to enforcement action under the parent regulations.
