Civil Aviation Order 29.2 - Air service operations - Night flying training (02/12/2004)

Night circuit operations are not defined in the order itself, but from context they encompass take-off, circuit and landing sequences conducted after sunset or during night hours as defined elsewhere in the aviation regulatory framework, typically involving repetitive pattern flying for training purposes. The order applies only to aircraft operated by an operator authorised to conduct flying training at night, which means the operator must hold an appropriate Air Operator’s Certificate or flight training approval that explicitly permits night training. An aerodrome can be used for night flying training only if it falls within one of several categories: a military, certified or registered aerodrome that CASA considers suitable for night circuits; a landing area that both meets the general guidelines in CAAP 92-1 (a Civil Aviation Advisory Publication) and has received a specific CASA approval for night training; or, in the case of helicopters, an aerodrome or landing area meeting the previous criteria, or a helicopter landing site that meets the guidelines in CAAP 92-2. The CAAPs are advisory publications, but the order incorporates them by reference as mandatory standards for lighting and site suitability, converting guidance into binding requirements. Airspace limitations are strict: night circuits must not be flown below 1,000 feet above aerodrome elevation and must be conducted within a 3 nautical mile radius of the aerodrome reference point unless CASA grants an alternative approval. This can constrain training in terrain that forces departures from standard circuit patterns, or at aerodromes where surrounding obstacles, noise-sensitive areas or airspace classifications make such a radius impractical. The weather minima (ceiling 1,500 feet, visibility 5 kilometres) are absolute; operations cannot commence or continue if conditions fall below these values, even if the pilot holds a higher instrument rating or the operator could safely operate under different minima using other approaches (e.g., a GAF or special VFR clearance is not available to override these specific training minima). The supervision requirement is that night circuit operations must be conducted under the supervision of a flight instructor authorised by the operator to supervise night training. That creates a gatekeeping role: the operator must expressly designate which instructors are permitted to supervise, and those instructors must themselves hold appropriate night flying instructor ratings or endorsements. Lighting standards are tiered: for military, certified or registered aerodromes used by aeroplanes, lighting must match that described in CAAP 92-1(1); for other landing areas (including those separately approved by CASA), the applicable standard is CAAP 92A-1(0). For helicopters, the operator can meet either set of aeroplane standards or comply with CAAP 92-2. Ground facilities include a standby power supply for fixed electric lighting, or portable lighting that can be deployed in the event of a runway or helicopter landing site power failure, and a wind velocity indicator that is suitable (presumably a windsock or equivalent) for aircraft on the manoeuvring area and in flight. Aircraft must carry serviceable equipment per CAO 20.18 for night VMC aerial work and private operations, which typically requires navigation lights, anti-collision lights, instrument lighting, landing lights and certain instruments, plus serviceable radio communication equipment. The order does not define serviceability beyond referencing CAO 20.18, but the term implies that if an item is listed as required, it must be functional; deferred defects under a minimum equipment list may or may not be permissible depending on that CAO’s provisions.

The order directly affects any operator that conducts or intends to conduct night flying training, including flight training schools, flying clubs, helicopter training organisations, and any commercial operator providing night dual or solo circuits as part of a pilot licence or rating. For such operators, the order imposes capital expenditure on aerodrome lighting (or contractual arrangements for access to compliant aerodromes), standby power or portable lighting equipment, wind indicating devices, aircraft instrument and lighting upgrades, and radio maintenance. It also affects flight instructors who supervise night circuits, as they must be specifically authorised by the operator, which creates a personnel management obligation. Aircraft owners and lessors are affected because the aircraft provided for night training must be fitted and maintained to CAO 20.18 standards; older aircraft or those operated under a different certificate may need modifications to achieve compliance. Aerodrome operators and managers of landing areas (whether certified, registered or non-certified) face consequences from this order: if their aerodrome is used for night training, they must ensure lighting meets the applicable CAAP standards, that standby power or portable lighting is available, and that a wind indicator is installed and operational. For landing areas that are not military, certified or registered, the aerodrome owner must apply to CASA for a specific approval and demonstrate compliance with CAAP 92-1 guidelines, adding administrative and potentially inspection costs. CASA itself is affected through its approval role (subsection 2.1(b) and the airspace deviation in 2.2) and its enforcement oversight. Insurance companies underwriting aviation training operations will factor in compliance with these minima as a condition of coverage; a gap in certification, lighting or equipment may increase premiums or void policies. The transitional provisions in the 2014 amendment mean that operators who hold a continued authorisation under the old CAR 1988 licensing regime are treated as if they hold the equivalent new authorisation under CASR 1998, so the order continues to bind them regardless of which regulatory pathway they use. Lawyers advising training organisations must ensure that leases, contracts with instructors and maintenance agreements specifically address these obligations. Accountants and compliance professionals should note that the order’s requirements are fixed and do not allow for risk-based alternatives; this removes any flexibility to choose less expensive methods of achieving safety outcomes, directly increasing compliance cost. There is no small-business exemption, grandfathering of older aerodromes or transitional period for new operators, so the cost impact falls hardest on smaller schools or those operating out of low-traffic regional aerodromes that may not currently have compliant lighting or standby power.

The order imposes a set of clear duties on the operator. The operator must ensure the aerodrome used is one of the listed types (military, certified, registered, or a CASA-approved landing area), and in the case of helicopters, that alternative landing sites meet CAAP 92-2. The operator must ensure that night circuits are not conducted below 1,000 feet above aerodrome elevation or beyond a 3 nautical mile radius unless CASA has approved otherwise. The operator must not conduct operations when the weather ceiling is below 1,500 feet or visibility below 5 kilometres. The operator must supervise operations through a flight instructor it has authorised for that purpose; this likely requires written designation and a record kept. The operator must provide lighting that meets the specific CAAP standards for the entire duration of the operation, and must have either a standby power supply for fixed electric lighting or portable lighting available for immediate use upon a power failure, plus a wind velocity indicator. The operator must ensure each aircraft is fitted with serviceable instrumentation and lighting per CAO 20.18 for night VMC aerial work and private operations, and with serviceable radio equipment. The operator also bears the cost of maintaining all of the above and of training instructors to the required standard. The order gives the operator the right to apply to CASA for approval to use a landing area that is not military, certified or registered (subsection 2.1(b)), and to apply for approval to deviate from the 1,000 foot/3 nautical mile airspace restrictions (subsection 2.2). These approvals are discretionary; CASA is not obliged to grant them, and the order contains no criteria for how CASA should exercise that discretion or a right of review if approval is refused. The operator also has the right to choose which aircraft to use, as long as they meet CAO 20.18 requirements, and which instructors to authorise, as long as those instructors hold appropriate qualifications. The flight instructor has the duty to supervise the operations once authorised by the operator, but the order does not prescribe specific ratios or methods of supervision. In the absence of CASA guidance, the operator and instructor must determine what constitutes adequate supervision, creating legal uncertainty. The order does not grant any explicit rights to pilots undergoing training; they are not mentioned as duty holders or rights bearers. The wind velocity indicator must be suitable for aircraft on the manoeuvring area and in flight, which implies that the indicator must be readable from the air and from the ground, but the order does not specify accuracy or location requirements. The duties are framed as obligations on the operator, but due to the integrated nature of flight training, a breach may also implicate the pilot in command under other regulations (e.g., CAR 1988 regulation 233 regarding careless operation) if nighttime operations proceed without the required facilities. The transitional provisions (Table A) preserve the operator’s existing authorisation rights: a continued authorisation under the old regime is treated as the equivalent new authorisation for the purpose of the order’s application, so an operator does not lose its existing training rights solely because of the regulatory change.

This order itself does not prescribe specific penalties. However, it is made under regulations 5.11, 5.16 and 303 of the Civil Aviation Regulations 1988, which operate within a broader enforcement framework. A breach of a Civil Aviation Order is generally taken to be a contravention of a provision of the CAR 1988 (see regulation 302 if applicable, or the general enforcement provisions in Part XIII of CAR 1988). Penalties for substantive contraventions can include fines measured in penalty units (as of the order’s compilation, a penalty unit under the Crimes Act 1914 is AUD 222, so fines could range from several hundred to many thousands of dollars per offence). The Civil Aviation Act 1988 section 23A provides for continuing penalties: if the contravention continues after the day on which the person is convicted, the person may be liable to a further fine for each day the contravention continues. Enforcement actions can also include suspension, variation or cancellation of an Air Operator’s Certificate or flight training authorisation by CASA under CASR 1998 Part 11 or equivalent provisions. CASA may issue a direction under regulation 5.11 of CAR 1988 to cease operations, or a further direction under regulation 5.16, which is the specific power under which this order was made. Breaches relating to aircraft equipment (CAO 20.18 requirements) might also be enforced under regulation 233 of CAR 1988 (careless or reckless operation) if defective equipment contributes to an incident. The order contains no specific defence or due diligence exception. While an operator could argue that it took all reasonable steps to comply, the provisions are largely prescriptive (e.g., “the operator must ensure lighting is provided”), making strict liability a likely standard in enforcement. There is no explicit power for CASA to grant exemptions from this order (other than the airspace deviation in subsection 2.2 and the landing area approval in 2.1(b)); an operator seeking relief from other requirements would need to rely on general exemption powers in the Civil Aviation Act 1988 section 98 or similar. The absence of transitional arrangements for existing non-compliant aerodromes or aircraft means that an operator who had been using a facility that now fails to meet the standards could be forced to suspend night training immediately upon the order’s commencement, with potential retrospective liability if CASA audits past operations. The 2014 repeal of Appendix I and Appendix II (which presumably set out additional details or criteria) eliminates any previous safe harbours or grandfathering those appendices may have contained, tightening the enforcement environment.

This order is part of a hierarchy: its direct sources are regulations 5.11, 5.16 and 303 of the Civil Aviation Regulations 1988. Regulation 5.11 empowers CASA to make orders with respect to the operation of aircraft, the safety of air navigation, and related matters. Regulation 5.16 specifically deals with orders relating to the design, construction, maintenance and operation of aircraft. Regulation 303 relates to the licensing and rating of flight crew members. This order is therefore subordinate to those regulations and to the Civil Aviation Act 1988. It must also be read with the Civil Aviation Safety Regulations 1998 (CASR 1998), because the 2014 amendment introduced transitional provisions that apply the order to continued authorisations as if they were new authorisations under CASR 1998. This means the order now operates in parallel with CASR Part 61 (flight crew licensing) and Part 141 (flight training), although it retains its own prescriptive requirements. The order references CAO 20.18, which sets the detailed instrumentation and lighting standards for night VMC aerial work and private operations. Compliance with this order therefore depends on compliance with that separate CAO. The order references three Civil Aviation Advisory Publications: CAAP 92-1 (guidelines for aerodrome lighting and suitability), CAAP 92A-1 (for non-certified aerodromes) and CAAP 92-2 (for helicopter landing sites). These CAAPs are advisory in nature, but because the order states lighting “as described in” these publications, the CAAP descriptions become mandatory standards. An operator that uses lighting that CASA later deems not to meet the CAAP’s description has breached the order. The order interacts with airspace regulations under the Airspace Regulations 2007 (or equivalent) because the 3 nautical mile radius and 1,000 foot altitude constraints may conflict with controlled airspace boundaries, noise abatement procedures or other aircraft operations. An operator conducting night circuits near an airport within controlled airspace may need both a CASA approval under subsection 2.2 and an airspace clearance from Airservices Australia. The order interacts with state and territory planning laws indirectly: landing area approvals under subsection 2.1(b) may require local government permits for non-certified aerodromes, creating a dual regulatory burden. Insurance law implications have been noted: a policy covering night flight training may exclude operations conducted in contravention of a CAO, meaning a breach of this order could void cover. The order does not interact with workplace health and safety laws directly, but an incident during night training could trigger an investigation under a state WHS Act, where the order’s standards would serve as evidence of the required safety precautions. The transitional Table A provisions from the 2014 instrument define continued authorisation and new authorisation by reference to CASR 1998 regulation 202.261, so the order is now tied to the CASR licensing framework. Any future amendment to that regulation would flow through to this order’s applicability.

This order was originally substituted as section 29.2 of the Civil Aviation Orders by Civil Aviation Amendment Order (No. R22) 2004, which was notified in the Gazette on 8 December 2004 and commenced the same day. That substitution replaced the entire existing section 29.2 with the night flying training provisions that form the core of this compilation. The instrument number is F2005B00820. There are no other amendments listed between 2004 and 2014. On 1 September 2014, the Civil Aviation Order (Flight Crew Licensing) Repeal and Amendment Instrument 2014 (No. 1) (F2014L01177) made several changes: subsection 1 (Application) was repealed and substituted; subsection 2 (Operating limitations) was amended (not substituted); subsection 3 (Supervision) was repealed and substituted; subsection 4 (Aerodrome lighting and ground facilities) was repealed and substituted; subsection 5 (Aircraft equipment) was repealed and substituted; subsection 6 (which no longer appears in the order) was repealed; Appendix I and Appendix II were repealed. The compilers have removed those repealed sections from the text; the current order is therefore concise compared to the 2004 version. The 2014 instrument also included transitional provisions in sections 3 and 31 (Table A of the compilation). Section 3 defined continued authorisation and new authorisation, and clarified references to Civil Aviation Order numbers. Section 31 provided that the Civil Aviation Orders apply to a continued authorisation as if it were the equivalent new authorisation. This means that an operator who held a training approval under the old CAR 1988 licensing system does not lose that approval merely because of the 2014 amendments; the order continues to bind them as though they had obtained the new CASR 1998 equivalent. The repeal of Appendix I and Appendix II is potentially significant. Those appendices presumably contained additional detail on lighting specifications, approval procedures or transitional arrangements. Their removal eliminates whatever detail they provided, leaving only the main provisions and the CAAP references. This could increase uncertainty for operators who relied on the appendices for specific guidance. The compilation notes do not describe the content of the repealed appendices, so one must refer to the original 2004 instrument to determine what was lost. The amendment history also shows that this order is part of a larger series; the 2014 instrument repealed and amended many sections across the Civil Aviation Orders, not just this one. The impact on practitioners is that any advice or compliance manual written before 1 September 2014 that references the old subsections or appendices is unreliable and must be updated. There is no evidence of any court or tribunal challenge to the validity of the 2004 substitution or the 2014 amendments, so the order stands as a validly made legislative instrument.

The source document does not refer to any litigation, case law or administrative decisions involving this specific order. There is no mention of appeals to the Administrative Appeals Tribunal against decisions made under the order (e.g., refusal of a landing area approval under subsection 2.1(b) or refusal of an airspace deviation under subsection 2.2). Given the order’s technical and specialised scope, it is plausible that disputes would typically be resolved internally through CASA’s review mechanisms or by negotiation rather than through formal litigation. However, the absence of referenced litigation does not mean that the order has never been judicially considered. The order is a legislative instrument and could be challenged in the Federal Court or High Court on jurisdictional grounds (e.g., whether it is authorised by the enabling regulations) or on administrative law grounds when exercising a discretionary power. Because the order’s provisions are largely prescriptive, they leave little room for subjective interpretation, which reduces the likelihood of litigation over meaning. The more fertile ground for dispute is CASA’s exercise of discretion under subsections 2.1(b) (approval of a landing area) and 2.2 (approval of alternative airspace limits). An operator whose landing area approval is refused may seek judicial review under the Administrative Decisions (Judicial Review) Act 1977, arguing that CASA took into account irrelevant considerations or failed to consider relevant ones. The order does not specify what criteria CASA must apply in those approvals, which increases the risk of arbitrary or unreviewable decision-making, but also limits grounds for challenge. No reported decisions on this order were identified in widely available databases. Practitioners should note that the order may be considered in civil proceedings arising from an aircraft accident during night training, where a breach of the order could be relied upon as evidence of negligence per se under the Civil Aviation (Carriers’ Liability) Act 1959 or common law. Additionally, the order could be cited in workers’ compensation or employment disputes if an instructor or student is injured during a night circuit that did not meet the required standards. The lack of litigation history also means there is no authoritative judicial gloss on any ambiguous terms in the order, such as “suitable” (for lighting or wind indicator) or “authorised by the operator” (for instructors). This uncertainty creates compliance risk: what one operator considers suitable may differ from CASA’s interpretation, and without case law, there is no definitive test. Practitioners should therefore rely on conservative interpretations and maintain documentary evidence of their decision-making process.

Several traps in this order are not immediately obvious. First, the requirement that lighting be provided “for the duration of the operations” imposes a continuous duty. An operator cannot start circuits before full lighting is activated, nor continue after it fails, unless the portable lighting solution is immediately available. If the standby power supply fails and the portable lighting is in storage rather than ready for instant deployment, operations must cease. Second, the wind velocity indicator must be “suitable” for aircraft on the manoeuvring area and in flight. A windsock that is not illuminated or not visible from the circuit height may not meet the “in flight” component; operators should verify that the indicator is readable from the downwind leg at night. Third, the order does not define “night” or “night circuit operations”. Night may be defined elsewhere in CAR 1988 (e.g., regulation 2A or the meaning in CASR 1998 Part 1 definitions) as the period between sunset and sunrise, but errors could occur if the operator uses a different definition. Fourth, the airspace restriction “within a radius of 3 miles from the aerodrome reference point” is measured horizontally, not along the circuit path. A circuit that extends beyond 3 nautical miles at any point (e.g., due to cross wind legs or avoidance of terrain) is a breach unless CASA approval has been obtained. Fifth, the weather minima are absolute; a pilot with an instrument rating cannot rely on an instrument approach to descend below 1,500 feet ceiling or in visibility less than 5 kilometres during the circuit. The minima are not reduceable by ATC clearance or by use of radar. Sixth, the supervision requirement: the flight instructor must be “authorised by the operator to supervise the night flying training”. That authorisation must be documented and may require the instructor to hold a current night rating or endorsement. A verbal blanket authorisation may not satisfy an audit. Seventh, the order applies to “aircraft operated by an operator authorised to conduct flying training at night”. If the operator’s AOC or certificate does not explicitly include night training, any night circuit would be a breach. Eighth, the standby power requirement: the operator must have “either a suitable standby power supply for fixed electric runway or HLS lighting; or portable runway or HLS lighting that is available for use in the event of a runway or HLS lighting power failure”. “Available for use” likely means unboxed, fuelled or charged, and positioned for rapid deployment. Storing portable lights in a locked hangar 200 metres away would likely not satisfy enforcement officials. Ninth, the aircraft equipment requirement references CAO 20.18 “for night V.M.C. aerial work and private operations”. That CAO may contain its own list of required instruments, lights and electrical equipment, and the operator must ensure compliance with that entire list, which might be more demanding than the basic day VFR fitout. Tenth, the 2014 repeal of Appendix I and Appendix II removes any specific guidance those appendices contained. Operators who rely on historical operating practices approved under the appendices may now be non-compliant. Finally, the order does not explicitly require that the aerodrome be lit for the specific aircraft type being used. A light helicopter training school using a large certified aerodrome might find that the aerodrome’s lighting is designed for jet aircraft patterns, but the order only requires lighting “as described in” the CAAP, which may not match helicopter approach paths. The helicopter-specific lighting in CAAP 92-2 is optional; an operator could choose to use the aeroplane standard and hope it suffices.

Compliance with this order requires a systematic, documented approach by the operator. First, confirm that the operator’s authorisation (AOC or flight training approval) explicitly permits night flying training. If it does not, an application to CASA for an amendment is necessary before any night circuit operations begin. Second, ensure that every aerodrome or landing area used for night circuits meets either the military, certified or registered aerodrome classification and is suitable for night circuits (as determined by the operator, not necessarily by CASA, though CASA can challenge suitability), or that the landing area has been approved by CASA under subsection 2.1(b). For helicopters, a landing site meeting CAAP 92-2 guidelines is an alternative, but again, if it is not already within an approved category, separate CASA approval is needed. The approval process under 2.1(b) should be initiated in writing to the relevant CASA office, including evidence that the general guidelines in CAAP 92-1 are met (or CAAP 92-2 for helicopters). Third, review the airspace around each proposed circuit area to confirm that the circuit can be flown entirely above 1,000 feet AGL and within 3 nautical miles of the aerodrome reference point. If terrain, airspace restrictions or noise abatement procedures prevent this, apply to CASA for a written approval under subsection 2.2, describing the alternative limits and why they remain safe. Fourth, establish a system to monitor weather conditions before and during night circuit operations. Ceiling and visibility must be at or above 1,500 feet and 5 kilometres at all times. A dedicated weather report (e.g., from an on-site AWOS or a METAR from the nearest Bureau of Meteorology station) is recommended. Include a pre-flight weather check in the operator’s operations manual and require an in-flight check by the supervising instructor. Fifth, ensure that appropriate lighting is provided for the entire duration of night circuits. For aeroplanes at military, certified or registered aerodromes, the lighting must match that described in CAAP 92-1(1); for other landing areas, CAAP 92A-1(0). For helicopters, either the aeroplane standard or CAAP 92-2 lighting may be used. Purchase or lease lighting equipment that meets these descriptions, and install it in accordance with the CAAP’s specifications. Sixth, arrange standby power: either a fixed generator tied into the electric runway or HLS lighting system, or portable lighting units that are stored in a location accessible within the time it takes to land the aircraft safely, and that can be deployed without delay. Test the standby system at least annually, or if portable, after every battery recharge or fuel refill. Seventh, install a suitable wind velocity indicator. A lit windsock, a windsock with a light inside the sock, or a windsock near a floodlight, linked to a nearby anemometer, satisfies the requirement. Confirm it is visible from aircraft in flight on the downwind leg at 1,000 feet AGL. Eighth, verify that each aircraft used for night circuit training has serviceable instrumentation and lighting per CAO 20.18 for night VMC aerial work and private operations. This likely includes navigation lights, anti-collision lights, instrument lights, landing lights (if required by CAO 20.18), certain flight instruments (airspeed, altimeter, attitude indicator, heading indicator, vertical speed indicator, slip indicator, clock, compass with lighting) and electrical system redundancy. Also verify that radio communication equipment is serviceable (all required frequencies controllable). Perform a pre-flight inspection specifically checking all night equipment and have a maintenance release that lists the CAO 20.18 equipment as serviceable. Ninth, document the authorisation of each flight instructor who may supervise night circuits. This should be in writing, signed by the chief instructor or head of training, and include confirmation that the instructor holds the necessary night flying instructor rating or endorsement. Maintain a register. Tenth, incorporate these requirements into the operator’s exposition or operations manual, and include them in pre-flight, pre-course and periodic training briefings. Retain records of weather checks, lighting inspections, standby power tests, wind indicator calibrations, aircraft maintenance approvals under CAO 20.18, instructor authorisation letters and any CASA approvals under subsections 2.1(b) or 2.2. Schedule an annual compliance audit that reviews each aerodrome, each aircraft and each instructor against this order’s provisions, and correct any gaps immediately. Where the operator uses a contracted or shared aerodrome, the lease or access agreement should specify that the aerodrome owner must maintain lighting, standby power and wind indicator compliant with the order, and that the operator has the right to inspect and require remediation at the owner’s expense.
