Civil Aviation Order 29.11 - Air service operations - Helicopter winching & rappelling operations (02/12/2004)

The CAO fixes a set of interlocking concepts that determine when, where, by whom and how helicopter winching and rappelling may be carried out.

Definitions. The instrument defines the key activities at the outset. “Winching” is the pick-up or lowering of objects or a person by means of a winch or hoist fitted to the helicopter (s 2). “Rappelling” covers several varieties: self-lowering on a rope, lowering of an object by controlled release, lowering where descent is controlled by a person on the ground, and use of a flexible ladder to come from or go to an airborne helicopter (s 2). “Winch or hoist” means equipment approved by CASA for picking up or lowering persons or equipment between helicopter and surface (s 2). The CAO also establishes the “course of training” concept as training covering normal and emergency procedures appropriate to the endorsements or certificates listed (s 2).

Permissions and exemptions. The CAO operates as a conditional permission and limited exemption instrument under the Civil Aviation Regulations 1988. CASA “permits” winching and rappelling provided the CAO conditions are met (s 3.1) and “exempts” helicopters conducting such operations from specified regulatory paragraphs where conditions are satisfied (s 3.2). The instrument is explicit that these exemptions do not create property rights to land or limit common-law remedies for damage or injury caused by helicopter operations (s 3 note).

Classification. The CAO classifies winching and rappelling as private, aerial work or charter operations as appropriate, but restricts person-rappelling to private or aerial work. For aerial work and charter operations the activity must be entered in the AOC as a specific authorised operation (s 4).

Operating area geometry and exceptions. The baseline operating area is specified numerically: at least 30 metres diameter or twice the helicopter length, whichever is greater; no obstructions higher than 3 metres within limits; a central obstruction-free zone of at least 5 metres diameter for winching/rappelling only (s 5.1). Multiple exceptions exist for rescue/emergency operations and for advanced operational training , with different conditions depending on whether operations occur over land, vessels, or involve emergency service personnel (s 5.2-5.8).

Aircraft/equipment and night/low-visibility operations. The CAO requires approved flight manual supplements for aircraft that will conduct winch/rappel operations (s 6.1). All equipment, fittings, harnesses and lines must conform to Part 21 of CASR 1998 (s 6.2). Helicopters conducting winching/rappelling over land at night must carry specific lighting and intercom equipment (s 6.3); operations over water at night where external visual references are inadequate must meet further avionics and lighting requirements (s 6.4). Specific lighting and control features, and intercom continuous communication, are prescribed (s 6.3(b)-(c)).

Operational performance rules. For certain operations , in particular charter passenger operations to/from land and any winching over offshore platforms or vessels , the CAO requires multi-engine helicopters capable of hovering out of ground effect with one engine inoperative during the actual winching operation (s 7.1). The CAO specifies how to account for wind in hover-out-of-ground-effect performance calculations (s 7.2). The instrument allows deviation from the multi-engine requirement in actual rescue or urgent emergency situations and for some training or demonstrations when life-saving need is demonstrated (s 7.3).

Rappelling permissions. Certain rappelling activities are “restricted rappelling operations” (s 8.1) and must either be authorised by CASA in writing under s 8.2 or be emergency/rescue operations undertaken by emergency service personnel with advanced training (s 8.1(d)). CASA’s written permission must identify time, place, occasion and conditions (s 8.3).

Personnel and training. Pilots must be authorised under Part 61 of CASR 1998 for winch/rappel operations (s 9). Aircrew/winch operators must complete an approved course and be certified by an approved person, with an endorsed logbook in the format in Appendix III; the CAO identifies who counts as an “approved person” for different company structures (s 10; Appendix III).

Operational command and documentation. The pilot in command has enumerated responsibilities for crew qualifications, briefings and precautions (s 12.1), and the operator must populate the operations manual with detailed procedures, checks and recency requirements (s 12.3). For non-emergency operations in urban/populous areas, additional conditions apply including complying with CAAP 92‑2 and clearing persons from the site (s 12.2).

Transitional and amendment context. The CAO includes amendment and transitional notes linking to later instruments affecting flight crew licensing (Table A , ss 3 and 31) and records which subsections and appendices have been amended, substituted or repealed across the 2004-2014 instruments.

Together these concepts form a rule set that balances standardised baseline dimensions/equipment/training requirements with a set of targeted exceptions for emergencies and training, and with a discretionary CASA permission process for activities the instrument treats as higher risk (restricted rappelling) or raising public-safety concerns.

Primary regulated parties

• Helicopter operators: Any person or company conducting winching or rappelling must operate within the CAO conditions. Where the operation is aerial work or charter, the operator must have the activity specified in the air operator’s certificate (s 4).
• Pilots (pilot in command): Must hold the Part 61 authorisation to conduct winch/rappelling operations (s 9). The pilot in command carries specific responsibilities for crew competency, briefings and safety precautions (s 12.1-12.2).
• Aircrew/winch operators: Must have completed an approved course and hold the certificate/endorsed logbook entry in the format prescribed in Appendix III (s 10.1; Appendix III). The CAO describes who may certify trainees (s 10.2).
• Approved training organisations and company check-and-training pilots: They supply the courses and certification and either act as the “approved person” who provides logbook endorsements, or they must obtain CASA approval to certify others (s 10.2).
• Air operator certificate (AOC) holders and their operations manual authors: Obliged to include detailed procedures covering equipment checks, normal and emergency drills, crew duties, intercom phraseology, and recency/training (s 12.3).

Secondary affected parties

• Emergency services: Distinctly treated in the CAO. Emergency service personnel may be the only persons authorised to be winched/rappelled in certain training regimes and emergency responses. The CAO refers repeatedly to “emergency service personnel” and provides relaxed operating area and equipment conditions for emergency/rescue tasks (s 2 definition; s 5.2, 5.5-5.8; s 8.1(d)).
• Owners/occupiers of land and vessel operators: The CAO explicitly states that its exemptions do not confer any rights against owners or occupiers of land over which operations are conducted (s 3 note). For operations over vessels, the CAO imposes specific conditions (s 5.7-5.8) tying approach/departure flight paths and deck arrangement to operation allowances.
• Aircraft maintenance and modification providers: Must implement flight manual supplements and conform equipment fittings to Part 21 of CASR 1998 (s 6.1-6.2).
• Regulators and CASA decision-makers: The CAO empowers CASA to issue written permissions for restricted rappelling operations (s 8.2-8.3) and operates as a source of permitted conduct under specified Civil Aviation Regulations (s 3.1-3.2). CASA also approves the flight manual supplements and may approve persons for training endorsement under s 10.2.

Who pays

• The economic costs fall primarily on operators and AOC holders. They must:
  • Equip helicopters with approved winches/hoists and associated harnesses, lights and intercom systems required for night or low-visibility operations (s 6.2-6.4).
  • Prepare and obtain CASA approval for flight manual supplements tailored to winch/rappel operations (s 6.1).
  • Provide training courses and maintain proficiency and logbook endorsements for aircrew/winch operators (s 10; Appendix III).
  • If engaged in charter passenger work to/from land or offshore platform/vessel winching, maintain or procure multi-engine helicopters with specified hover capability or otherwise accept the operational restrictions and contingency planning required by s 7.1-7.3.
  • For restricted rappelling, obtain CASA written permissions which may carry administrative cost and operational conditions (s 8.2-8.3).
• Indirect costs land with owners/occupiers if operators seek to use their land for operating areas; the CAO does not confer access rights (s 3 note), so operators commonly bear negotiation and any indemnity/compensation expense.

Who decides

• CASA decides: approval of flight manual supplements (s 6.1), certification/approval of training persons (s 10.2), whether to grant written permission for restricted rappelling (s 8.2-8.3), and whether the conditions for exemptions/permissions are satisfied for regulatory purposes (s 3.1-3.2). Operators decide operational details within the CAO guardrails: establishing operating areas (s 5), staffing and briefings (s 12.1, s 12.3), and technical fitment consistent with Part 21 requirements (s 6.2).

Behaviour changes required

• Operators must document and implement procedures in operations manuals (s 12.3), maintain certified equipment (s 6.2), ensure personnel training and endorsements (s 10, Appendix III), and comply with operating area dimensions or the applicable exception criteria (s 5). Pilots must secure the Part 61 authorisation (s 9) and impose limits on carriage of non-essential persons (s 11). For restricted rappelling, operators must seek and obey CASA’s written conditions (s 8.2-8.3).

Duties on operators and pilots

• Obtain and maintain necessary approvals and authorisations:
  • Operators conducting aerial work or charter must have winching/rappelling explicitly authorised in the AOC (s 4).
  • Aircraft must operate in accordance with approved supplements to the aircraft’s flight manual for winch/rappel operations (s 6.1).
  • Winch/rappelling equipment and associated harnesses and lines must conform to Part 21 of CASR 1998 (s 6.2).
• Duty to staff operations with qualified personnel:
  • The pilot in command must ensure an appropriately qualified aircrewman/winch operator is carried (s 12.1(a)); all operating crew must be properly qualified for their duties (s 12.1(b)).
  • The pilot in command must be authorised under Part 61 of CASR 1998 to conduct winch/rappelling operations (s 9).
  • Aircrew/winch operators must complete a course of training and hold an endorsed logbook entry signed by an approved certifying person per Appendix III (s 10.1; Appendix III).
• Duty to brief and plan:
  • The pilot in command must ensure all personnel are properly briefed prior to commencement and that adequate safety precautions are taken for everyone involved (s 12.1(c)-(d)).
  • For winching and rappelling in cities, towns or populous areas, the operator must meet the guidelines in CAAP 92-2, exclude bystanders from the site, and clear floors beneath rooftop operations to levels specified (s 12.2(a)-(c)).
• Duty to adhere to operating-area geometry and conditions:
  • Unless a stated exception applies, the baseline operating area requirements in s 5.1 must be observed (s 5.1). The CAO provides detailed exceptions and conditional rules for training, emergency services, and vessel-based training (s 5.2-5.8).
• Duty to observe equipment and night/low-visibility requirements:
  • Helicopters must comply with the lighting and intercom fitment specified for night operations and for low-visual-reference operations over water (s 6.3-6.4).
• Duty to limit carriage and define essential persons:
  • The pilot in command must not permit persons in the helicopter other than flight crew, crew under training, persons performing essential functions for the operation, or persons to be winched/rappelled (s 11).

Operator and pilot rights or permissions

• CASA-granted permissions:
  • CASA may permit winching and rappelling operations under the conditions in the CAO (s 3.1).
  • CASA may exempt such helicopters from specified paragraphs of the Civil Aviation Regulations 1988 where CAO conditions are met (s 3.2).
  • CASA may grant written permission for restricted rappelling operations if satisfied that persons are appropriately trained and operations are not likely to endanger life; the permission must detail time/place/occasion and conditions (s 8.2-8.3).
• Use of prescribed exceptions:
  • The CAO allows deviations from the baseline operating area or from other requirements in clearly enumerated circumstances (rescue/emergency, advanced training subject to conditions) (s 5.2-5.8; s 7.3).
• Operational discretion within the manual:
  • The company operations manual is required to set out procedures, checks and recency/training requirements (s 12.3), and within that approved manual the operator has discretion to tailor procedures so long as they comply with the CAO and any CASA conditions.

Limited rights not conferred

• No property access right: The CAO explicitly states that the exemptions do not confer any rights against the owner or occupier of any land over which operations are conducted, and do not prejudice common-law rights and remedies in respect of injury or damage caused by the helicopter (s 3 note). Practically, operators must secure landowner consent or otherwise accept legal exposure when operating over private property.

Recordkeeping and certification duties

• Training and logbook endorsements: Aircrew/winch operators must have their logbook endorsed in the format specified at Appendix III (s 10.1; Appendix III). Approved persons who may sign off include company check-and-training pilots, certain aircrew who have demonstrated training proficiency and been approved by CASA, or officers approved by CASA (s 10.2).

Interaction duties with other regulatory instruments

• The CAO’s duties are explicitly linked to other regulatory regimes that determine certification and equipment standards: Part 21 (equipment conformity) and Part 61 (pilot authorisations) of CASR 1998 are invoked directly (s 6.2; s 9). Operators therefore carry duties to ensure compliance with those instruments as well as the CAO.

Statutory context for enforcement

• The CAO operates as a permissions and exemptions instrument under the Civil Aviation Regulations 1988 (s 3.1-3.2). Enforcement action for non‑compliance is a matter of the wider statutory regime in the Civil Aviation Regulations and the Civil Aviation Safety Regulations; the CAO itself does not list discrete monetary penalties or criminal sanctions. Instead, it creates conditions the breach of which would produce non‑compliance with the regulatory framework invoked by the CAO. The CAO identifies the specific Regulations from which exemptions are granted (paragraphs 157(1)(b), 251(1)(a) and 251(1)(c) , s 3.2), signalling that compliance is assessed against both the CAO and the referenced Regulations.

Regulator responsibilities and discretionary enforcement

• CASA is the decision-maker for permissions, approvals and certifications under the CAO:
  • CASA permits winching/rappelling operations under s 3.1 and grants specified exemptions under s 3.2.
  • CASA approves flight manual supplements required by s 6.1.
  • CASA may authorise persons to certify training and may itself approve or disapprove check-and-training persons under s 10.2.
  • CASA may grant written permissions for restricted rappelling operations under s 8.2; such permissions will specify conditions that are binding on the operator (s 8.3).
• Non-compliance with the CAO conditions will therefore expose operators and individuals to CASA administrative action and to whatever civil or criminal enforcement powers are available under the Civil Aviation Regulations 1988 and CASR 1998. The CAO itself does not enumerate specific penalty provisions.

Administrative and operational remedies

• Possible administrative consequences for non-compliance, under the broader legislative framework, include withdrawal or suspension of authorisations, administrative fines or directions, and enforcement action under the Civil Aviation Regulations and CASR 1998. The CAO’s requirement that certain operations be entered in the AOC (s 4) links compliance to the operator’s certification status: failure to obtain or comply with AOC entries or CASA-imposed conditions would be an AOC compliance matter.

Civil liabilities and third-party remedies

• The CAO expressly preserves common-law remedies for damage or injury caused by helicopter operations; its exemptions do not confer any rights against landowners or occupiers and do not prejudice a person’s common-law rights and remedies in respect of injury or damage caused by the helicopter (s 3 note). Practically, a breach of CAO conditions does not remove civil liability exposure; indeed, failing to meet CAO conditions could be evidence of negligence or regulatory breach in civil proceedings.

Enforcement of training, equipment and procedural obligations

• The CAO delegates several compliance points to recordable actions (logbook endorsements, approved flight manual supplements, operations manual content). These records create discrete compliance markers that CASA may inspect or audit. The CAO requires logbook endorsements in the Department of Transport and Communications publication logbook format (Appendix III), which is a recordable and auditable artifact (Appendix III).

Limits of the CAO’s own sanctioning language

• The CAO itself does not create its own set of penalties or specify enforcement mechanisms; it functions by imposing conditions and tying them to the regulatory status conferred by the Civil Aviation Regulations and CASR 1998. Therefore, enforcement action and sanctions must be sought in and through the parent regulations and CASA’s statutory powers rather than through the CAO’s text.

Direct regulatory cross-references

• Civil Aviation Regulations 1988: The CAO is made under (and operates in relation to) specific subregulations and regulations of the Civil Aviation Regulations 1988. It invokes regulation 151 and subregulation 250(2) for permitting (s 3.1) and regulation 308 for exemptions (s 3.2). It identifies specific paragraphs from which it exempts compliant operators , paragraph 157(1)(b) and paragraphs 251(1)(a) and (c) , subject to the CAO conditions (s 3.2). These cross-references mean that compliance analysis must read the CAO together with the cited regulations.
• Civil Aviation Safety Regulations 1998 (CASR): The CAO requires conformity of winching/rappelling equipment to Part 21 of CASR 1998 (s 6.2) and requires pilots to be authorised under Part 61 of CASR 1998 (s 9). CASA’s approval of training personnel and flight manual supplements occurs within the administrative architecture established by CASR.
• Internal CAO references: The CAO refers to other CAO sections and appendices (for example Appendix VII and V of section 20.18 for night/low-visibility fitment in s 6.3-6.4, and Appendix I of section 20.3 for standard hand signals referenced in Appendix III). Practitioners must consult those CAOs for complete technical equipment and procedural requirements.
• Civil Aviation Advisory Publication (CAAP) 92‑2: For operations in cities, towns or populous areas, CAAP 92‑2 guidelines must be met (s 12.2(a)). CAAPs are advisory guidance documents produced by CASA; the CAO makes compliance with the CAAP conditions mandatory in this context.

Transitional and legislative amendments

• Flight Crew Licensing Repeal and Amendment Instrument 2014 (No. 1): The CAO’s Notes/Table A show that amendments and transitional provisions were made to account for repeal and amendment of flight crew licensing instruments. Table A reproduces sections 3 and 31 of that instrument which define “continued authorisation” and specify that Civil Aviation Orders apply to a continued authorisation as if it were the equivalent new authorisation (Table A , s 31). Practically, this means operators and pilots transitioning between authorisations should read those transitional provisions alongside the CAO.

Interaction with common law and property rights

• The CAO explicitly disclaims any effect on private property rights: the exemptions granted do not confer rights against any owner or occupier of land over which operations are conducted, and do not prejudice any common-law rights or remedies for injury or damage caused by helicopter operations (s 3 note). This is an explicit statement that regulatory compliance under the CAO does not displace civil liability or the need to secure permission from landholders.

Record-keeping and documentary interfaces

• The CAO requires logbook endorsements in a Department of Transport and Communications publication format and references logbook publication 408 Revised 6/85 (Appendix III). Practitioners must reconcile historical logbook formats and any updates under CASR or CASA guidance when preparing or auditing training records.

Broader statutory and regulatory landscape

• The CAO is part of a network of aviation safety instruments. Equipment conformity references to Part 21 tie into standards and certification processes for aircraft modifications and equipment. Pilot authorisation references to Part 61 tie training and licence privileges to national flight crew licensing standards. Where the CAO requires CASA written permission or CASA approval, those decisions will typically be reviewable within the administrative law framework applicable to CASA decisions under the Civil Aviation Act and administrative law principles (note: the CAO itself does not state judicial review rights).

What the CAO does not address directly

• The instrument does not set separate criminal penalties or civil remedies; these are left to the Civil Aviation Regulations, the Civil Aviation Safety Regulations and general law. It also does not set workplace safety or occupational health and safety obligations explicitly; those remain in their respective statutory regimes and may interact with the CAO in practice (the CAO does not itself cite workplace safety statutes).

Recorded compilation and amendment timeline

• Compiled date: The compilation of CAO 29.11 provided here was prepared 16 January 2015 and takes into account amendments up to the Civil Aviation Order (Flight Crew Licensing) Repeal and Amendment Instrument 2014 (No. 1) (Notes).
• Table of Orders: The CAO lists successive instruments and dates:
  • CAO 2004 No. R29 , notified 8 December 2004 and commenced 8 December 2004 (s 2).
  • CAO 29.11 2006 No. 1 , registered FRLI 5 April 2006 and commenced 6 April 2006 (s 2).
  • CAO (Flight Crew Licensing) Repeal and Amendment Instrument 2014 (No. 1) , FRLI 29 August 2014, commenced 1 September 2014 and identified as affecting Sections 3 and 31 (Table A).
• Table of Amendments: The CAO’s Table of Amendments records that s 29.11 had several subsections substituted, amended or repealed across the instruments listed:
  • It indicates that parts of s 29.11 , including subs. 2, subs. 5, subs. 6, subs. 9, subs. 10, Appendix I and Appendix II , were either repealed, substituted or amended by CAO 2004 No. R29, CAO 29.11 2006 No. 1, and F2014L01177 (the Flight Crew Licensing instrument).
  • The table explicitly lists “rs. CAO 2004 No. R29” next to certain items, “am.” for CAO 29.11 2006 No. 1, and “F2014L01177” references for 2014 changes including substitutions and repeals (Table of Amendments).
• Table A (Application, saving or transitional provisions) reproduces the specific transitional provisions from the Flight Crew Licensing Repeal and Amendment Instrument 2014 (No. 1). Section 3 of that instrument defines “continued authorisation” and “new authorisation” by reference to regulation 202.261 of CASR 1998, and s 31 provides that Civil Aviation Orders apply to a continued authorisation as if it were the equivalent new authorisation. Together these entries govern the treatment of pre-existing authorisations and their equivalence under the new CASR system (Table A , ss 3 and 31).

Implications of the amendment record

• The Table of Amendments signals multiple editorial and substantive changes across the CAO lifecycle through 2014. Practitioners must consult the CAO as amended and the transitional provisions in the 2014 instrument for an accurate picture of which older references remain live and how licences/authorisations migrated under CASR changes.
• The presence of repeals and substitutions in appendices means some cross-references to other CAOs or to logbook formats may have been updated; in particular, references to Department of Transport and Communications logbook forms (Appendix III) should be reconciled with current CASA forms or CASR-prescribed formats where applicable under the 2014 instrument’s transitional provisions.

Documentation of amendments in the instrument

• The CAO’s amendment table records which specific parts were added, amended, substituted or repealed and by which instruments. Practitioners should consult the FRLI instrument numbers cited (e.g. F2014L01177) for the authoritative text of amendments when tracing precise changes.

Absence of cases or adjudicative excerpts in the instrument

• The text of CAO 29.11 as provided contains no judicial decisions, case citations, tribunal determinations or administrative appeals. The instrument does not itself set out any litigation history or describe prior judicial interpretation. The internal “Notes” and “Table of Amendments” record legislative amendments but do not reference any court proceedings.

Consequences of the absence of litigation references in the source

• The absence of litigation history in the instrument means that, from the instrument alone, there is no recorded case law specifically construing CAO 29.11’s provisions. Practitioners relying on this CAO must therefore:
  • Interpret the CAO textually and by reference to the parent regulatory instruments cited (the Civil Aviation Regulations 1988 and the Civil Aviation Safety Regulations 1998).
  • Seek any relevant CASA guidance materials (e.g. CAAPs) or administrative decisions (which may be subject to judicial review) for interpretive assistance. The CAO itself mandates compliance with CAAP 92‑2 for urban operations (s 12.2(a)), which indicates a regulatory reliance on non‑legislative guidance.
  • If contentious enforcement or authorisation decisions arise (for example CASA refusal to grant a restricted rappelling permission under s 8.2), legal remedies would be sought under administrative law avenues and by reference to the Civil Aviation Act and judicial review principles; those remedies are not detailed in the CAO text.

What a user should do when litigation or precedent is required

• Because the instrument provides no internal litigation history, practitioners needing precedential interpretation should:
  • Search public tribunal and court databases for CASA-related decisions about winching/rappelling operations, AOC conditions, or training certification under CASR Part 61 and Part 21.
  • Review CASA administrative guidance, determinations and published reasons for decisions (if any), and CAAPs for operational interpretation.
  • Consider the administrative-law pathway for contesting CASA decisions under the Civil Aviation Act and relevant judicial review principles, taking care to assess whether a CASA permission or refusal under s 8.2 gives rise to reviewable administrative action.

Limits of reliance on the CAO alone

• The CAO functions within a web of civil aviation regulation and administrative practice. Because no cases are cited in the CAO itself, legal reasoning about enforcement, implied duties or standard-of-care questions in civil litigation will require supplementation from broader aviation case law, overarching regulatory texts and administrative law jurisprudence outside the CAO.

Practical traps and specific textual pitfalls

• Exemptions do not confer land access rights (s 3 note). A common practitioner error would be to assume that regulatory permission allows landing on or operating over private land without consent. The CAO expressly preserves owners’ and occupiers’ rights and common-law remedies (s 3 note). Operators must secure landowner permission separately.
• Rappelling of persons is limited (s 4). The CAO restricts person-rappelling to private or aerial work; it expressly prevents person-rappelling as a charter operation unless the regulatory classification allows it. For aerial work or charter, the operation must be entered in the AOC (s 4).
• “Operating area” geometry is exacting (s 5.1). The default rule uses a numeric alternative: at least 30 metres diameter or twice the helicopter length, whichever is longer, plus an inner 5-metre obstruction-free zone. Miscalculating helicopter length or misapplying the “whichever is longer” rule can result in non-compliance. Additionally, any obstruction within the limits higher than 3 metres invalidates the area (s 5.1(a)-(b)).
• Training and “weights only” exceptions are narrow (s 5.3 and 5.4). Advanced operational training may be exempted from s 5.1, but only if certain criteria are met and in some cases only weights are winched (s 5.3(c)). Assuming an exception applies without satisfying its narrow conditions (e.g. winching real persons during advanced training over land without meeting the “weights only” limitation) creates liability and regulatory non-compliance.
• Night fitment prescriptions are specific and require pilot/winch operator controls (s 6.3). Night operations require two white lights controllable by the aircrewman/winch operator and two trainable white lights operable by the pilot without removing hands from the controls (s 6.3(b)(i)-(ii)). Notes allow single light with two filaments or approved hand-held torches in particular circumstances, but operators must confirm acceptance by CASA rather than assuming alternatives are compliant.
• Multi-engine requirement for certain operations (s 7.1) has limited emergency exceptions (s 7.3). For charter passenger carriage to/from land and any offshore platform/vessel winching, the CAO requires multi-engine helicopters capable of hovering out of ground effect with one engine inoperative during the actual operation (s 7.1). However, s 7.3 permits single-engine aircraft in actual rescue/emergency situations or where urgent demonstrated need exists; treating that as a general exemption would be incorrect.
• Wind assumptions for hover performance are capped (s 7.2). Operators must use up to 50% of forecast wind or 80% of the wind measured at the ship/site when determining hover OGE performance, but the derived figure must not exceed 20 knots. If no valid forecast or measurement exists, calculations must assume nil wind (s 7.2). Misapplying wind percentages or ignoring the 20-knot cap is a calculation error with operational safety implications.
• Restricted rappelling requires CASA written permission and is narrowly defined (s 8.1-8.3). Rappelling types described in s 8.1 are “restricted” and may only occur with CASA permission (s 8.2) or as emergency operations by qualified emergency personnel (s 8.1(d)). CASA’s permission must specify time/place/occasion and conditions (s 8.3). Operating outside those authorisations risks regulatory action.
• Certification of trainers and logbook endorsement form can be old (Appendix III). Appendix III references Department of Transport and Communications publication 408 Revised 6/85 for logbook format. Practitioners should confirm whether CASA requires a current form or whether older references remain acceptable under transitional instruments (Table A , ss 3 and 31).
• CAAP compliance is mandatory in urban/populous areas (s 12.2). CAAPs are usually guidance, but the CAO makes CAAP 92‑2 a mandatory requirement when operating in cities and populous areas (s 12.2(a)). Assuming CAAPs are always advisory would be a mistake in this context.
• Operators must include specific items in operations manuals with no delegation (s 12.3). The operations manual must cover equipment checks, drills, crew duties, intercom procedures and training/recency. Omitting items may expose the operator to regulatory non-compliance and liability.

Record and cross-reference risk

• Multiple cross-references to other CAO sections and CASR parts create a fragmentation risk. For example, night/low-visibility fitment references Appendix V and Appendix VII of section 20.18 (s 6.3-6.4). Practitioners must consolidate the CAO text with those other CAOs and CASR parts to ensure complete compliance.
• Transitional treatment of authorisations (Table A , s 31) means that historical licences and authorisations migrated under the Flight Crew Licensing Repeal and Amendment Instrument 2014 may be treated as equivalent new authorisations. Failure to consult the 2014 instrument’s transitional provisions can lead to incorrect assumptions about current licence status.

Documentation pitfalls

• Relying on oral assurances or ad hoc endorsements. The CAO requires an endorsed logbook entry in the format of Appendix III and approval by an “approved person” or CASA officer (s 10.1-10.2; Appendix III). Informal training sign-offs without appropriate CASA approvals will leave an aircrewman uncertified under the CAO.
• Failure to obtain CASA written permissions for restricted activities. Because CASA must specify time, place and conditions in writing (s 8.3), operators cannot rely on implied or oral permissions.

Practical compliance checklist and recommended sequence

1. Confirm the operation type and AOC entries

   • Determine if the operation is private, aerial work or charter per s 4.
   • If aerial work or charter, ensure winching and/or rappelling are expressly authorised in the air operator’s certificate (s 4).

2. Review applicable authorisations and transitional status

   • Check whether pilot and crew authorisations are current and whether any “continued authorisation” transitional treatment applies under the Flight Crew Licensing Repeal and Amendment Instrument 2014 (Table A , ss 3 and 31).

3. Aircraft and equipment approvals

   • Obtain CASA approval for supplements to the aircraft flight manual that specify winch/rappel operating criteria (s 6.1).
   • Ensure all winching/rappelling equipment, fittings, lines and harnesses conform to Part 21 of CASR 1998 (s 6.2).
   • For night operations over land, fit the helicopter as required by s 6.3 (lighting, intercom). For operations over water where external references are inadequate, confirm the additional avionics and equipment per s 6.4 and the referenced CAO appendices.

4. Assess operating area and secure permissions/landowner consent

   • For routine operations, establish an operating area meeting s 5.1 dimensions (30 m diameter or twice helicopter length, central 5 m obstruction-free zone, no obstructions >3 m).
   • Apply the exceptions in s 5.2-5.8 only where all the exception criteria are satisfied (e.g. weights-only training; emergency service personnel training; vessel-deck training conditionalities).
   • Obtain express landowner or occupier consent for use of private land or vessel deck access, because the CAO does not displace property rights (s 3 note).

5. Personnel,pilot and aircrew qualifications

   • Ensure pilots have the required Part 61 authorisation under CASR 1998 for winch/rappel operations (s 9).
   • Enrol aircrew/winch operators in a “course of training” that meets the CAO definition and have them certified by an approved person with logbook endorsement in the Appendix III format (s 10.1; Appendix III).
   • If using company certifiers, ensure the certifier meets the definitions in s 10.2 and, where required, has CASA approval.

6. Operations manual and briefings

   • Update the company operations manual to include the matters listed in s 12.3: pre-flight and serviceability checks, normal/emergency drills, operating crew duties, intercom procedures and phraseology, and training/recency requirements.
   • Ensure pilots and aircrew conduct full briefings of all personnel prior to each operation (s 12.1(c)) and document those briefings.

7. Night and low-visibility operations

   • For night over-land winching/rappelling, fit and test specified lights and intercom; ensure pilot-control of trainable lights without removing hands from the flying controls (s 6.3(b)(ii)).
   • For over-water operations with inadequate visual references, confirm automatic pilot/attitude/height displays meet the note in s 6.4 and fit the specified lights and intercom (s 6.4).

8. Performance planning for winching

   • For charter passenger transport to/from land and all offshore platform or vessel winching, use multi-engine helicopters capable of OGE hover with one engine inoperative during winch operations (s 7.1) unless legitimately operating under an emergency exception (s 7.3).
   • Apply wind-assumption rules for hover OGE performance calculations: use up to 50% of forecast wind or up to 80% of wind measured at ship/site, but the derived figure must not exceed 20 knots; if no valid forecast or measurement is available, assume nil wind (s 7.2).

9. Restricted rappelling handling

   • For rappelling activities captured by s 8.1 (restricted rappelling), do not proceed without obtaining CASA written permission under s 8.2. Prepare the application to include the persons who will rappel and their training credentials (s 8.2(a)-(b)) and proposed mitigations to demonstrate operations will not endanger life.
   • If permission is granted, ensure operations adhere strictly to the time/place/occasion and conditions enumerated by CASA (s 8.3).

10. Urban and populous-area operations

    • For operations in cities, towns or populous areas, ensure compliance with CAAP 92‑2 (s 12.2(a)), remove non‑essential persons from the area (s 12.2(b)) and, for rooftop operations, evacuate floors per s 12.2(c) in non‑emergency cases.

11. Training, recency and records

    • Maintain up-to-date logbook endorsements in the required format (Appendix III) and retain records of training, approvals and CASA permissions.
    • Establish and document recency requirements and schedule refresher training consistent with the operations manual obligations (s 12.3(e)-(f)).

12. Insurance, civil liabilities and stakeholder coordination

    • Because CAO compliance does not eliminate civil exposure and does not grant access rights to property owners (s 3 note), confirm insurance coverage and negotiate property access/indemnities with landowners, building owners and vessel operators as required.
    • Document landowner agreements in writing and coordinate local authorities and emergency services as appropriate.

13. Engage CASA early for novel operations

    • For operations that approach the “restricted” definition (s 8) or where the physical operating environment is marginal to the CAO’s operating-area geometry, seek CASA guidance and written permission early to avoid operational stand-downs, and ensure any approvals are captured in writing as required by s 8.3.

14. Audit and compliance checks

    • Implement an internal audit program addressing flight manual supplements, equipment conformity with Part 21, lighting and intercom fitments, training endorsements and operations manual contents. Keep evidence ready for CASA inspections.

Practical notes on documentation and forms

• Use the Appendix III certificate text as the template for logbook endorsements, but confirm with CASA whether any updated logbook forms or electronic formats are required under current CASR practice (Appendix III; Table A transitional provisions).
• Keep a record of any CASA written permission for restricted rappelling specifying the conditions, and ensure operating staff have immediate access to these permissions during operations.

Conclusion for compliance planning

• Compliance with CAO 29.11 is procedural and documentation-heavy. Operators must coordinate aircraft equipment, pilot and aircrew authorisations, operations manuals, CASA permissions and third-party consents. Where the CAO invokes CASA approval or written permission, secure those documents in advance, and apply the exceptions narrowly in accordance with the explicit criteria in s 5, s 7 and s 8.
