Civil Aviation Order 20.21 Instrument 2015

Several core legal and operational concepts structure the Order. Each is either an affirmative permission, a limitation attached to that permission, or an interaction point with other legal regimes.

• Permission for low-level flight: The Order operates as a specific carve-out to the normal 500 foot minimum height rule. Under s 3.1 it authorises flights below 500 feet over non-populous areas for rotorcraft engaged in authorised agricultural operations, related inspection flights, and limited transits to treatment areas (5 nautical mile limit). The permission is explicitly granted under CAR 1988 paragraph 157(4)(b).

• Safety-limited proximity to people and buildings: The Order places absolute and conditional proximity limits around occupied buildings. It prohibits flight within 100 metres horizontally of an occupied building that forms part of a city, town or populous area and prohibits flight below 350 feet above terrain within 100 metres horizontally of an occupied building in any other area unless specific notice conditions are satisfied (s 3.2). Even where the proximity minima are met, the rotorcraft must operate in a pattern and at an altitude that would permit avoidance of endangering persons or property in the event of an emergency (s 3.2).

• Notice to occupiers: For flights that would otherwise be within those proximity limits, the operator must give written notice at least 48 hours before the proposed flights and must proceed only if no objection is raised; where written notice is not reasonably practical, a verbal notice is acceptable if given before the flight and no objection is made (s 3.2). The Order therefore links permission to consent or at least non-objection by occupiers.

• Loading area siting: The Order requires that loading equipment and loading operations be sited at least 30 metres away from the manoeuvring area (s 4). This is an operational separation requirement tying agricultural loading activity to aerodrome manoeuvring safety.

• Interaction with regular public transport (RPT) operations: The Order establishes temporal and spatial restrictions preventing agricultural rotorcraft operations within 5 nautical miles of aerodromes used for regular public transport during specified windows around scheduled arrivals and departures (s 5.1). Two carved-out exceptions allow continuation if the rotorcraft is under Air Traffic Control (ATC) control or in two-way radio contact with the RPT aircraft (s 5.2).

• Conditional regulatory exemption: The instrument provides, for a limited period, an exemption from specified paragraphs of CAR 1988 in relation to CASR 1998 regulation 11.160, subject to conditions (s 6.1-6.2). The conditions include not turning at a height less than 100 feet AGL after take-off, not operating in a manner during take-off that causes danger to persons or livestock, and broadcasting the pilot’s intention on the local area frequency before conducting the operation. The exemption is expressly time-limited in the instrument (s 6.3).

• Circuit joining minima for specified aerodromes: When operating from military, CASR-established, or licensed aerodromes, rotorcraft conducting agricultural operations must join the traffic pattern before landing at a height of not less than 500 feet above the elevation of the aerodrome (s 7.1). The Order states this is in addition to existing CASR or AIP requirements (s 7.2).

• Pilot qualification requirement: The pilot in command must hold an aerial application rating and an aerial application endorsement in accordance with Part 61 of CASR 1998 (s 8.1). An exception permits persons undergoing training in accordance with Part 61 and the Order to conduct agricultural operations under supervision (s 8.2).

• Definitional cross-reference: The Order does not define "agricultural operations" itself but adopts the meaning given in CAR 1988 subregulation 2(1) (s 2A), making the scope of the Order contingent upon the external regulatory definition.

• Preservation of other legal regimes and remedies: The instrument contains two notes that are explicit about legal limits. Note 1 signals that state requirements relating to chemical handling, storage and health/welfare might impose stricter limitations than the Order, and Note 2 confirms the Order does not create rights as against landowners nor affect common law remedies for injury or damage (notes to s 3.2).

Together these concepts define a permission structure that is narrow in scope (specific aircraft type and activity), conditional in application (distance minima, notice, qualifications, ATC exceptions), and time-limited with respect to the specified exemption. The Order operates by layering these constraints onto a delegated permission drawn from CAR 1988.

The instrument’s subject matter and wording identify distinct categories of affected parties and decision-makers.

• Rotorcraft operators engaged in agricultural operations: The Order applies expressly to "rotorcraft engaged in agricultural operations and related inspection flights" (s 2). That label captures operators who are authorised by an Air Operator Certificate to undertake aerial agricultural work, including those conducting inspection flights related to those operations (s 3.1(a)-(b)). Operators who carry agricultural payloads for transit flights to treatment areas are also captured, but only within the defined 5 nautical mile radius from the relevant aerodrome or landing area (s 3.1(c)).

• Pilots in command: The Order places direct duties on the pilot in command. For example, pilots must hold an aerial application rating and endorsement under Part 61 CASR 1998 (s 8.1) unless they are undergoing training permitted by s 8.2. Under the exemption conditions, the pilot in command must broadcast their intention on the local area frequency before conducting the operation (s 6.2(c)). Pilots also face operational constraints in terms of turning height after take-off and conduct during take-off if relying on the exemption (s 6.2(a)-(b)).

• Aerodrome operators and users: Aerodromes used for regular public transport operations are implicated through the five nautical mile exclusion zone during specified times (s 5.1). Aerodrome owners and managers will be affected because operators must not carry out agricultural operations within 5 NM during the windows defined by s 5.1 unless exceptions apply. Additionally, operations from military, CASR-established or licensed aerodromes are subject to the 500 foot traffic join requirement (s 7.1).

• Occupiers of buildings: Occupiers of buildings are given a practical control point through the notice mechanisms in s 3.2. If a proposed flight would otherwise operate within the proximity limits, the operator must give written notice to the occupier not less than 48 hours before the flight and proceed only if no objection is made; verbal notice is permitted if written notice is not reasonably practical and no objection is made. Occupiers therefore effectively have a veto over flights that would otherwise infringe the 100 metre/350 foot proximity limits.

• Air Traffic Control and RPT aircraft operators: ATC personnel and RPT aircraft operators are named indirectly by the exceptions in s 5.2. ATC may control rotorcraft operations such that the five nautical mile temporal restrictions do not apply (s 5.2(a)). RPT aircraft in two-way radio contact with a rotorcraft engaged in agricultural operations create another exception (s 5.2(b)), thus placing a requirement on radio procedures and coordination between agricultural rotorcraft and RPT services.

• Loading and ground-operations staff: The 30 metre separation requirement for loading equipment and operations from manoeuvring areas (s 4) affects ground operations personnel, loading contractors and aerodrome safety planners. They must ensure loading equipment and loading operations are sited outside the 30 metre exclusion.

• Regulators and those administering CAR/CASR: The Order was made under powers in the Civil Aviation Act 1988 and relevant regulations. CASA, represented by the Director of Aviation Safety, is the issuer (instrument signed by Mark Skidmore and made on behalf of CASA). The instrument refers to CAR 1988 and CASR 1998 provisions, so regulators administering and enforcing those instruments are engaged, particularly where the Order provides an exemption from specified regulatory paragraphs (s 6.1).

• Owners of land and legal rights holders: Note 2 to s 3.2 emphasises that the Order does not create rights as against landowners or prejudice common law remedies for injury or damage caused by the operator. Owners and persons with property or personal injury claims remain external stakeholders unaffected in terms of losing legal avenues; the Order explicitly preserves their rights.

Who pays and who decides, in practical terms: Operators and pilots bear the direct compliance costs (training/endorsements, radio broadcasting, adjusting flight profiles, notifying occupiers, siting loading operations, maintaining distance minima). Aerodrome operators may incur indirect costs (managing access within 5 NM during RPT windows, coordinating ATC clearances). Occupiers incur minimal administrative involvement (receipt and response to notices). Regulators (CASA and ATC) make and exercise the delegated decisions that permit or restrict operations, and can withhold or withdraw authorisations in accordance with CAR/CASR enforcement mechanisms not specified in the text.

The Order allocates a set of concrete duties to operators and pilots, and it creates limited rights for occupiers of buildings by way of notice and non-objection. Each duty is expressed as either a prohibition, a required procedural step, or a qualification condition.

Primary duties on operators and pilots

• Operate within the scope of the permission: Operators must ensure rotorcraft flights are engaged in activities captured by the permission , agricultural operations authorised by an AOC, inspection flying related to such operations, or transit flights to a treatment area within 5 NM when carrying an agricultural payload (s 3.1). That is the scope condition for the low-flying exception.

• Maintain safety in proximity to occupied buildings: Rotorcraft must not be flown over, or in proximity to, an occupied building unless operated in a pattern and at such an altitude that, in the event of an emergency, they can avoid endangering persons or property on the ground (s 3.2). This is an operational risk-avoidance duty attached to low-level flight.

• Absolute and conditional distance minima: There are sharp minima. The rotorcraft must not be flown within 100 metres horizontally of an occupied building that forms part of a city, town or populous area (s 3.2). For occupied buildings in other areas, the rotorcraft must not be flown below 350 feet above terrain within 100 metres horizontally of the building unless notice conditions are satisfied (s 3.2).

• Notice and occupier non-objection: Where a planned flight would otherwise operate within the proximity minima, operators must give written notice to the occupier at least 48 hours beforehand and proceed only if no objection is received; if written notice is not reasonably practicable, verbal notice before the flight is acceptable and operations can proceed only if no objection is made (s 3.2). This creates a procedural duty to secure occupier non-objection.

• Loading-area separation: The operator must ensure that loading equipment and loading operations are not located within 30 metres of the manoeuvring area (s 4). This is a prophylactic separation rule to reduce risk between ground loading activities and aircraft manoeuvring.

• Aerodrome proximity during scheduled movements: Operators must not conduct agricultural operations from, or within, 5 NM of aerodromes used for regular public transport during specified periods surrounding scheduled arrivals and departures (s 5.1). The specified windows are 15 minutes before scheduled arrival until the RPT aircraft has landed (s 5.1(a)), and from when the RPT aircraft starts engines for take-off until 10 minutes after take-off (s 5.1(b)).

• Exceptions for ATC control and radio contact: The five nautical mile temporal restrictions do not apply if the rotorcraft is under ATC control (s 5.2(a)) or if the rotorcraft is in two-way radio contact with the RPT aircraft (s 5.2(b)). Operators therefore have an option: obtain ATC control or maintain two-way radio contact to continue operations within the exclusion window.

• Exemption conditions: To rely on the exemption from certain CAR 1988 paragraphs for regulation 11.160 of CASR 1998, the rotorcraft must comply with conditions: not to turn at a height less than 100 feet AGL after take-off (s 6.2(a)); not to operate during take-off in a manner that causes danger to persons or livestock (s 6.2(b)); and the pilot in command must broadcast intention before conducting the operation on the local area frequency (s 6.2(c)). The exemption itself is time-limited (s 6.3).

• Traffic pattern joining height: Rotorcraft operating agricultural operations from military aerodromes, CASR-established aerodromes, or licensed aerodromes must, before landing, join the traffic pattern at a height not less than 500 feet above the elevation of the aerodrome (s 7.1). The Order emphasises that this joins existing CASR/AIP requirements (s 7.2).

• Pilot qualifications and training: The pilot in command must hold an aerial application rating and an aerial application endorsement in accordance with Part 61 of CASR 1998 (s 8.1). A person undergoing training in accordance with Part 61 and this Order may conduct agricultural operations (s 8.2), but the text ties training to Part 61 compliance.

Rights and limitations for occupiers and third parties

• Occupier non-objection role: Occupiers of buildings have an effective right of non-consent for flights that would otherwise fall within proximity limits, because written or verbal notice must be given and no objection must be made before the flight may proceed (s 3.2). The Order does not define what constitutes an objection or the form it must take, beyond the requirement that no objection be made; operators must therefore manage this interaction.

• Preservation of common law remedies: The Order expressly states it does not confer rights against the owner of land nor does it prejudice the rights and remedies that any person may have in common law for injury or damage caused by the operator (Note 2 to s 3.2). That is a declaratory limitation on the Order’s capacity to displace civil liability regimes.

Duties on communication and coordination

• Broadcast intention on local area frequency: Under the exemption conditions, the pilot in command must broadcast intentions before conducting the operation on the local area frequency (s 6.2(c)). This is a pre-condition to relying on the exemption and creates a communicative duty that can be monitored and recorded.

• Two-way radio contact with RPT aircraft: Where operators seek to use the exception in s 5.2(b), they must be in two-way radio contact with the RPT aircraft. That presumes operational capacity and procedures for radio coordination.

Implementation and record-keeping duties (implicit)

• The instrument’s notice and broadcast requirements imply an obligation on operators to create and retain records of notifications and communications (s 3.2; s 6.2(c)). Although the Order does not state retention periods or evidentiary rules, practical compliance will require operators to maintain contemporaneous proof of written notices, logs of verbal notices, radio transmission logs and evidence of pilot qualifications and endorsements (s 8.1-8.2).

Rights retained elsewhere

• The Order preserves external rights and regulatory regimes: Note 1 highlights that state requirements on chemical handling and health/welfare may impose stricter limitations than the Order (note to s 3.2), and Note 2 retains common law remedies. Operators must therefore treat the Order as a federal aviation permission that does not displace other legal obligations or private rights.

In sum, the Order grants a narrow aviation permission but conditions it with multiple operational, communicative and human-consent duties. Compliance requires both flight behaviour changes and administrative processes (notifications, radio broadcasts, qualifications verification and loading-area siting).

The instrument itself is silent on express penalties or specific enforcement mechanisms; it operates as an order made under statutory powers and interacts with regulatory frameworks that carry enforcement regimes. From the text, several enforcement implications and practical enforcement pathways can be derived without introducing external legal rules.

Absence of express penalties in the Order

• The instrument does not include express sanctioning clauses, monetary penalties, or criminal offences. It grants permissions (s 3.1), establishes prohibitions and conditions (for example ss 3.2, 4, 5.1, 6.2), and provides an exemption subject to conditions (s 6.1-6.3), but contains no separate enforcement regime within its text.

Enforcement by reference to enabling legislation and regulations

• The Order is made under subsection 98(4A) of the Civil Aviation Act 1988 and under specified provisions of CAR 1988 and CASR 1998 (instrument preamble). That situates enforcement responsibilities with the regulators and enforcement mechanisms established under those parent instruments. Non‑compliance with duties or conditions in this Order will therefore typically be actionable as non‑compliance with the CAR/CASR or the Civil Aviation Act provisions reflected by the delegation, insofar as those instruments set out powers to enforce, inspect, suspend, revoke or penalise. The Order itself does not restate those enforcement powers.

Monitoring and evidence for enforcement

• The Order creates duties that are susceptible to monitoring: written-notice requirements (s 3.2) can be checked against proof of delivery; broadcasting intentions on the local frequency (s 6.2(c)) can be confirmed via radio logs or recordings; pilot qualifications (s 8.1) can be checked against Part 61 records; and the physical siting of loading equipment relative to the manoeuvring area (s 4) can be inspected. These are the practical compliance markers enforcement authorities would rely upon, although the instrument does not specify evidentiary standards.

Operational discretion points for regulators

• The exceptions that allow operations within the 5 NM restriction , Air Traffic Control control (s 5.2(a)) and two‑way radio contact with the RPT aircraft (s 5.2(b)) , introduce discretion into operation approvals and clearances during RPT windows. ATC control is by nature a regulatory process; ATC can allow or deny operations in its control. The instrument thus embeds ATC’s decision-making as an operational enforcement mechanism for managing space during critical periods.

Civil liability remains available to third parties

• Note 2 to s 3.2 explicitly states that the permission granted does not confer rights as against landowners and does not prejudice common law remedies for injury or damage caused directly or indirectly by the operator. That leaves private civil enforcement (tort claims, property damage claims, nuisance claims) intact outside the administrative enforcement regime. The Order therefore co-exists with private enforcement pathways.

Temporal expiry of the exemption

• The conditional exemption in s 6.1 is time-limited by s 6.3, which states the exemption expires at the end of August 2017 "as if subsection 6 had been repealed by another instrument." That creates an automatic cessation of the exemption’s effect as specified. Enforcement authorities and operators must therefore attend to the temporal limits and enforce or comply with the underlying obligations once the exemption ceases.

Practical enforcement burdens

• Because the instrument creates procedural duties (notice, radio broadcasts, qualifications), enforcement in practice will require oversight infrastructure: record checks, routine inspections, and possibly radio monitoring. The Order itself does not fund or create any enforcement mechanism; those are functions of the regulatory agencies empowered under the enabling statutes.

In short, the Order imposes duties and grants permissions without setting out a standalone penalty scheme. Enforcement will operate through the CAR/CASR and Civil Aviation Act frameworks into which this Order is embedded, through ATC operational control, and through ordinary civil remedies preserved by the instrument.

The Order is deliberately integrative; it cross-references multiple external legal instruments and preserves external legal regimes. The text makes explicit where it defers to or supplements other instruments, and it contains notes addressing interactions with non-aviation laws and common law rights.

Cross-references and deferrals

• Definitions and scope: The Order adopts the meaning of "agricultural operations" from subregulation 2(1) of CAR 1988 (s 2A). Therefore, the Order’s operational scope is contingent on the CAR definition; any change in that CAR definition would alter the population of activities the Order covers.

• Regulatory exemptions and modifications: The Order grants a specific exemption for regulation 11.160 of CASR 1998, exempting compliance with paragraphs 166A(2)(e) and (f) of CAR 1988 if conditions are met (s 6.1). That is an explicit interaction where the Order suspends, for a period and on conditions, certain CAR obligations insofar as they would otherwise apply under CASR regulation 11.160.

• Supplement to CASR/AIP traffic rules: The requirement in s 7.1 that rotorcraft join the traffic pattern at not less than 500 feet above aerodrome elevation when operating from specified aerodromes is expressly stated to be in addition to any other requirement specified in CASR 1998 or AIP relating to the operation of rotorcraft within the vicinity of aerodromes (s 7.2). The Order therefore supplements, rather than supplants, existing CASA promulgations and AIP rules.

Preservation of state law and common law rights

• The instrument contains Note 1 (to s 3.2) which cautions that the Order’s distance limits are based on operational safety and noise considerations and "do not take into account the possible environmental and health hazards from handling, storage, application or jettisoning of agricultural chemicals." The note explicitly instructs operators to ensure compliance with relevant State requirements, particularly those associated with health and welfare, which "may impose stricter limitations than those in this Order." This establishes that state health and environmental regimes are independent constraints that may be more stringent and will take precedence in their respective spheres.

• Note 2 (to s 3.2) declares the Order does not confer rights as against landowners nor prejudice any common law rights or remedies relating to injury or damage caused by the operator. This is a textual confirmation that civil obligations and remedies (tort, nuisance, property damage) remain available regardless of the federal aviation permission granted by the Order.

Interplay with ATC and RPT operations

• The Order defers operational management during critical periods to ATC and RPT aircraft communications. The s 5.2 exceptions (ATC control and two-way radio contact) mean that ATC’s directives and the operational protocols between RPT and agricultural rotorcraft will govern whether operations that would otherwise be restricted may proceed. This embeds the Order within the operational decision-making processes controlled by air traffic regulations and procedures.

Temporal interaction , expiry of the exemption

• The Order’s temporary exemption (s 6.1) is explicitly time-limited by s 6.3, which states it expires at the end of August 2017 "as if subsection 6 had been repealed by another instrument." That creates a timed interaction: before expiry, the exemption modifies CAR/CASR obligations subject to its conditions; after expiry, the exemption ceases and the underlying CAR/CASR provisions resume full force. The Order therefore alters the regulatory landscape only for the period specified.

Repeal of prior instrument

• Section 1C repeals the Civil Aviation Amendment Order (No. R20) 2004 insofar as it included section 20.21 of the Civil Aviation Orders as set out in that instrument’s Schedule 1. This is an internal federal law interaction: the 2015 Order replaces text previously set out in the 2004 instrument. The repeal is an instance of federal-level legislative housekeeping and ensures there is a single operative provision.

Practical consequences for operators and lawyers

• Compliance with the Order requires attention to multiple legal layers: federal aviation regulations (CAR/CASR), air traffic control procedures and AIP provisions, state environmental and health frameworks related to agricultural chemical use, and common law liabilities. The Order expressly preserves other regimes, so operators must coordinate aviation operational compliance with non-aviation legal obligations.

• Because the Order adopts external definitions and standards (for example, aerial application ratings under Part 61 CASR 1998), changes in those external instruments will flow into the Order’s operation. Legal advisers must therefore monitor amendments to CAR, CASR and Part 61 to understand the Order’s practical scope.

Overall, the Order is not a standalone regime but a federal aviation instrument designed to operate in a multilayered legal environment; it modifies some regulatory obligations conditionally and temporarily while explicitly leaving other legal regimes and private rights intact.

The instrument contains explicit provisions concerning its own nomenclature, commencement, repeal of a predecessor instrument and an express temporal expiry for one of its subsections. The text provides the following amendment- or history‑related facts.

• Date and maker: The instrument is dated 5 May 2015 and was made by Mark Alan Skidmore, Director of Aviation Safety, on behalf of CASA (signature block at head of instrument). This is the originating instrument and maker information.

• Name and citation: Section 1A establishes the instrument’s title as Civil Aviation Order 20.21 Instrument 2015 and permits citation as "Civil Aviation Order 20.21." It also states that a reference to section 20.21 of the Civil Aviation Orders is a reference to this instrument (s 1A(1)-(3)).

• Commencement: Section 1B provides that the instrument "commences on the day of registration." That gives a clear operational start point tied to registration rather than a later date or a retrospective date.

• Repeal of a predecessor instrument: Section 1C repeals the Civil Aviation Amendment Order (No. R20) 2004 (also known as F2005B00804), including section 20.21 as set out in Schedule 1 of that instrument, "as amended." That indicates the 2015 Order replaces the earlier federal instrument that had previously occupied the same position in the Civil Aviation Orders.

• Time-limited exemption clause: Section 6.3 provides an explicit temporal limitation by stating the exemption granted in subsection 6 (i.e. s 6.1-6.2) "expires at the end of August 2017, as if subsection 6 had been repealed by another instrument." This is a self-contained expiry mechanism for that specific exemption. The instrument thereby creates a built-in sunset for the exemption rather than relying on external amendment action.

• No other amendments contained in the text: The text supplied does not include any subsequent amendment instruments, repeal of other sections, or later saving clauses. The instrument itself repealed the prior 2004 instrument’s relevant section and created the new 2015 provision; beyond the built-in expiry at s 6.3, the text contains no further amendment history.

Interpretive implications

• The repeal of the earlier 2004 Order’s section 20.21 and the adoption of this instrument suggest a deliberate replacement of the prior federal provision with the 2015 text. Practically, operators and advisers should treat the 2015 instrument as the operative Civil Aviation Order 20.21 from the date of registration forward.

• The specific sunset on the exemption is significant: any operational practice that relied on the exemption should have been adjusted by the end of August 2017 unless a subsequent instrument extended, replaced, or otherwise modified the exemption. The instrument itself signals an intent to limit the duration of that exemption.

Because the supplied text includes only the original instrument and its repeal of a predecessor, the instrument’s amendment history as contained in this document is limited to the 2015 enactment, the repeal of the 2004 provision, and the express expiry date for the exemption in s 6.3.

The instrument text does not record any litigation, case references, or judicial interpretations. The Order includes two notes that refer to common law rights and state regulatory requirements, but it contains no litigation history or published decisions.

What can be taken from the absence of litigation references in the text

• No cases named in the instrument: The Order itself names no cases and cites no judicial authorities. It contains operational provisions, cross-references to regulations and preserves common law remedies, but does not summarise or record any adjudicative material.

• Litigation likely to occur outside the instrument: Note 2 to s 3.2 preserves common law remedies for injury or damage caused by the operator. That note implies the potential for private litigation (tort, nuisance or property claims) against operators in the event of injury or damage, but the instrument does not reference any existing cases nor does it provide a statutory claims pathway. Any litigation arising would therefore be the usual civil litigation in courts under state and common law, not in this instrument.

• Administrative enforcement cases fall under CAR/CASR or the enabling Act: Because the Order was made under the Civil Aviation Act and related regulations, disputes over enforcement, revocation of permissions, or sanctioning for non‑compliance would be processed under the enforcement machinery of those instruments and the Act. The instrument does not report any such proceedings.

Practical implications for researchers and advisers

• Absence of textual litigation history means legal advisers must search external case law and tribunal decisions for any judicial treatment of activities covered by this Order. The instrument itself provides no judicial gloss on ambiguous terms such as the meaning of "city, town or populous area," what constitutes an "objection" from an occupier, or evidentiary standards for compliance with notice and broadcasting requirements.

• Where the instrument preserves common law remedies, litigation over damage from agricultural aerial operations would proceed under ordinary civil procedure. The Order’s notes provide a textually stated preservation, but offer no guidance regarding causation, standards of care, or apportionment of liability in incidents involving agricultural rotorcraft. Those matters would be determined by courts applying general tort and property principles.

In brief, the instrument contains no litigation record. Legal practitioners should therefore treat the supplied Order as a regulatory instrument whose interpretation and enforcement will be developed in the field and in court or tribunal decisions, none of which are identified within the instrument’s text.

The Order is concise but contains several traps for operators and advisers where non‑compliance risk is not immediately obvious from a surface reading. The following points derive directly from the instrument’s text and its notes; they indicate practical and legal pitfalls.

1. Permission does not displace private or state obligations (Note 1 and Note 2 to s 3.2)

• The Order grants an aviation permission but expressly warns that state requirements related to chemical handling, public health and welfare may impose stricter restrictions (note to s 3.2). Operators cannot rely on this Order to clear them from state environmental or health obligations; those separate rules may prohibit or limit particular treatments regardless of aviation permissions.
• The Order explicitly preserves common law remedies (note to s 3.2). Thus, even if an operator complies with the Order’s distances and notice requirements, they remain potentially liable in private law for injury or property damage caused by their operations.

2. The occupier-notice mechanism can functionally veto flights (s 3.2)

• The requirement that written notice be given at least 48 hours before a proposed flight, and that no objection be made, makes occupiers a practical gatekeeper for flights within proximity limits. The Order does not define what form an objection must take, the method of receipt, or how to resolve disputes about whether an objection exists. Reliance on verbal notice when written notice is "not reasonably practicable" invites factual disputes about what was reasonably practicable and whether verbal notice occurred.

3. The 5 nautical mile transit limit and RPT exclusion are operational constraints (s 3.1(c) and s 5.1)

• Transit flights to treatment areas are limited to a 5 nautical mile radius when carrying an agricultural payload (s 3.1(c)). That can materially constrain treatment logistics and repositioning when agricultural treatment zones are further afield.
• Agricultural operations must not be conducted within 5 NM of an RPT aerodrome during defined windows around scheduled arrivals and departures (s 5.1). Operators who work close to regional airports must coordinate with ATC or RPT aircraft to use the exceptions (s 5.2).

4. Exemption time-limited and conditional (ss 6.1-6.3)

• The exemption from specified CAR paragraph obligations is both conditional and time-limited. s 6.2 contains operational conditions (e.g. not turning below 100 feet AGL after takeoff). s 6.3 causes subsection 6 to expire at the end of August 2017 "as if subsection 6 had been repealed by another instrument." Operators relying on the exemption must track expiry and any successor instruments; failure to do so risks operating without exemption.

5. Loading-area separation applies to equipment and operations (s 4)

• The 30 metre exclusion from the manoeuvring area applies both to the location of loading equipment and to where loading operations are carried out. The distinction matters for fixed equipment, temporary setups and contractors: moving loading activity closer than 30 metres would breach the Order.

6. Pilot qualification and training nuance (ss 8.1-8.2)

• Pilots must hold an aerial application rating and endorsement under Part 61 CASR 1998 (s 8.1). The Order allows trainees to conduct operations while undergoing training in accordance with Part 61 and the Order (s 8.2). Advisers should ensure training records and supervision conform precisely to Part 61 requirements, because the Order ties the training exception to compliance with Part 61.

7. Circuit joining minimum is additive (s 7.2)

• The 500 foot join height for traffic patterns at indicated aerodromes is stated to be in addition to any CASR or AIP requirements. Operators must therefore satisfy both the Order’s joining height and any higher or additional local procedures or AIP instructions.

8. The instrument contains no penalty schedule or enforcement detail

• Because the Order does not itself set out penalties, operators might be uncertain about the consequences of breach. Non-compliance will be enforced under the enabling Act and regulations (as the instrument was made under those powers). That transfers legal uncertainty to enforcement practices outside the Order text.

9. “City, town or populous area” is a categorical limit without definition in the instrument (s 3.1 and s 3.2)

• The Order prohibits flight below 500 feet over a city, town or populous area, and sets 100 metre horizontal minima for occupied buildings that are part of such an area. The instrument does not define these geographic categories. Operational disputes will arise over classification, especially in peri-urban or mixed-use areas.

10. Evidence and record-keeping expectations are not specified

• The Order requires notices and broadcasts but does not specify record retention or proof standards. Operators must determine and maintain adequate records (written notices, radio logs, qualifications) to demonstrate compliance, but the Order itself provides no guidance on what will suffice.

These are practical "gotchas" that derive from the instrument’s text. They indicate areas where operators must adopt conservative procedures, retain contemporaneous evidence, and coordinate with state regulators, ATC and occupiers to mitigate legal and operational risk.

The Order creates a discrete compliance checklist composed of operational practices, communications procedures and record-keeping. The following steps map the instrument’s requirements into concrete compliance actions tied to the specific sections cited.

1. Confirm activity falls within the Order’s scope (s 2; s 3.1)

• Verify the flight activity qualifies as "agricultural operations" as defined in CAR 1988 subregulation 2(1) (s 2A). Ensure that any inspection flights are demonstrably related to the agricultural operation and that transit flights with agricultural payloads remain within the 5 NM radius specified in s 3.1(c).

2. Ensure appropriate AOC authorisation and pilot qualifications (s 3.1(a); s 8.1-8.2)

• Operate only under an AOC that authorises the relevant agricultural operations (s 3.1(a)). Verify that the pilot in command holds an aerial application rating and an aerial application endorsement in accordance with Part 61 CASR 1998 (s 8.1). For trainees operating under s 8.2, maintain training records that demonstrate compliance with Part 61 requirements and appropriate supervision.

3. Plan and document proximity compliance and occupier notification (s 3.2)

• Map flight tracks relative to occupied buildings and urban boundaries to ensure compliance with absolute minima (do not fly within 100 metres of occupied buildings in cities, towns or populous areas) and vertical minima (do not fly below 350 feet above terrain within 100 metres of an occupied building in other areas), unless the notice and non‑objection conditions are satisfied (s 3.2).
• For flights that would otherwise operate within proximity limits, give written notice to the occupier at least 48 hours before flights. Create templates and a delivery and receipt method to document that written notice was provided. If written notice is not reasonably practicable, contemporaneously document the circumstances that made written notice impracticable, and record the verbal notice (who was spoken to, date/time, contact details), including any confirmation that no objection was made (s 3.2).

4. Maintain loading-area separation from manoeuvring area (s 4)

• Site loading equipment and conduct loading operations at least 30 metres from the manoeuvring area. Produce and retain site plans, photographs and operational checklists demonstrating the 30 metre separation for inspection.

5. Manage operations near RPT aerodromes and use exceptions where appropriate (s 5.1-5.2)

• Maintain a calendar and schedule of RPT movements at aerodromes used for operations. Avoid conducting agricultural operations within 5 NM during the windows defined in s 5.1, unless one of the explicit exceptions applies.
• If operations within the 5 NM window are necessary, seek ATC control and written confirmation of acceptance of control, or establish and document two‑way radio contact with the relevant RPT aircraft (s 5.2). Retain radio logs, ATC clearances and any recorded guidance as evidence.

6. Comply with exemption conditions where relied upon and track expiry (ss 6.1-6.3)

• If relying on the exemption under s 6.1, ensure compliance with its conditions: do not turn at less than 100 feet AGL after take-off (s 6.2(a)); do not operate in a manner during take-off that causes danger to persons or livestock (s 6.2(b)); and the pilot in command must broadcast the intention to conduct the operation on the local area frequency before commencing (s 6.2(c)).
• Note the exemption’s expiry at the end of August 2017 as stated in s 6.3, and ensure operations do not rely on the exemption beyond that date unless a subsequent instrument extends it. Maintain records of any broadcasts and of the decision process to rely on the exemption.

7. Join traffic patterns at the required height when operating from relevant aerodromes (ss 7.1-7.2)

• When conducting operations from military aerodromes, CASR-established aerodromes, or licensed aerodromes, join the traffic pattern before landing at not less than 500 feet above aerodrome elevation (s 7.1). Also check and comply with any CASR or AIP requirements that might impose additional constraints (s 7.2).

8. Maintain robust communications and logs

• For broadcasts required by s 6.2(c), use standard local area frequency procedures and log broadcasts to show compliance: frequency used, time, channel, content of broadcast, and the pilot identity. Retain radio logs, voice recordings (where permitted), or contemporaneous written logs to evidence broadcasts and two-way communications.

9. Record-keeping and documentation

• Maintain an organised compliance file for each operation that includes: AOC authorisation; pilot endorsements and licences; Part 61 training records (if trainees involved); written notices to occupiers and any replies; contemporaneous records of verbal notices and occupant responses; radio transmissions and ATC clearances; loading area site plans; and any risk assessments linking flight profiles to chemical handling obligations under state law.
• Given the Order does not specify retention periods, adopt a conservative retention policy aligned with regulatory practice and commercial risk mitigation (for example, retain for a minimum period consistent with insurance and incident exposure timelines).

10. Coordinate with state regulators and manage chemical safety

• Because the Order’s notes (note to s 3.2) highlight state requirements on chemical handling, check all state environmental, agricultural chemical and public health requirements that apply to the materials being transported or applied. Integrate those state-imposed restrictions, buffer zones, notification obligations and licences into operational planning.

11. Operational risk assessments and insurance

• Conduct flight profile risk assessments demonstrating how pattern and altitude choices permit avoidance of endangering persons or property in the event of an emergency (s 3.2). Ensure insurance coverage aligns with both aviation risks and potential common law liabilities preserved by the Order (note to s 3.2).

12. Regular compliance reviews

• Because the Order cross-references external regulations (CAR and CASR) and Part 61 qualifications, implement a process to review regulatory updates in those external instruments. Changes to definitions, qualifications or radio procedures in the referenced instruments can affect the Order’s practical compliance obligations.

Following the steps above will align an operator’s practices with the Order’s provisions. The instrument places importance on procedural evidence (written notices, radio broadcasts, qualifications and site plans). Therefore, compliance is both behavioural (flight altitudes, joining heights, separation) and documentary (records of notices, communications and qualifications).
