#### 9J Action against a State Party to the 1999 Montreal Convention which undertakes carriage by air (1) If, at a particular time, an action under the Convention is brought in a court in Australia to enforce a claim in respect of carriage undertaken by a State Party to the 1999 Montreal Convention, the State Party is taken to have submitted to the jurisdiction of the court, unless: (a) the action relates to carriage that is the subject of a declaration by the State Party under Article 57 of the 1999 Montreal Convention; and (b) the declaration is in effect at that time. (2) Nothing in this section authorises the issue of execution against the property of a State Party to the 1999 Montreal Convention.
