Civil Aviation Amendment Order (No. R11) 2004 - Civil Aviation Order 20.10 - Hot refuelling - Helicopters (02/12/2004)

The text defines a small set of core concepts that structure who decides and what actions must occur. First, "hot refuelling" is defined in straightforward operational terms as refuelling with the helicopter’s engine or engines running (paragraph 1.1). The definition expressly contemplates refuelling with rotors rotating (paragraph 1.2). That binary definition , engine running versus not , is the central threshold that triggers the duties in the remainder of the section.

The Order builds around three institutional roles: the operator, the pilot in command, and persons engaged in refuelling on the ground. Each role comes with discrete responsibilities. The operator must authorise and document the circumstances and procedures under which hot refuelling may take place, assess helicopter configuration and fuel system locations, and address fuel quality arrangements (paragraphs 2.1-2.4). The pilot in command must verify safety immediately before refuelling, prevent passenger carriage during hot refuel except where disembarkation is unsafe or medically inadvisable, ensure a valid licence holder is at the controls unless an exception in another order applies, and maintain intercommunications or visual contact with ground refuelling personnel (paragraphs 3.1-3.4).

Operational controls are specified in procedure and equipment terms. Personnel must be trained in normal and emergency hot refuelling procedures (4.1). Readily available, suitable and maintained firefighting equipment is required during hot refuelling (4.2). Specific permissions are required to refuel on offshore platforms, vessels or drilling ships (4.3). For fuel loading, operators must decide fuel quantity before refuelling commences, may use closed or open systems, and must provide means to quickly cut off fuel supply at the tank entry for open systems (5.1-5.3). Static‑electricity risk is addressed by an earthing requirement for refuelling equipment and the helicopter before removing the filler cap (5.4).

Communications and avionics are constrained during hot refuelling: radio transmissions from the helicopter must be restricted as far as practicable (6.1), and HF transmitters or radar must not be operated during hot refuelling (6.2). Finally, fuel‑quality and contamination risk is handled by a post‑refuelling obligation on the operator to ensure the pilot inspects and tests the fuel system for water after each hot refuelling, subject to a limited exception where short continuous operations and supplier audit/monitoring arrangements exist (7.1-7.2). The Order also explicitly incorporates most of section 20.9, excepting specified paragraphs, and draws attention to the pre‑flight water checks in section 20.2 paragraph 5.1 (1A.1 and Note), thereby connecting hot refuelling rules to other fuel and inspection requirements in the Orders.

The Order allocates primary legal obligations to a set of actors directly involved in helicopter operations. Operators: the Order expressly places initial and continuing responsibilities on the helicopter operator. Operators must authorise any hot refuelling (paragraph 2.1), be satisfied in advance that refuelling can be done safely with attention to helicopter configuration, fuel system locations, refuelling equipment and the flight manual (paragraph 2.2), and incorporate operational circumstances, procedures, and relevant flight manual instructions in their operations manual (paragraphs 2.3-2.4). Operators also carry the burden of ensuring post‑refuelling inspections/testing are completed by the pilot unless limited exceptions in paragraph 7.2 apply.

Pilots in command: pilots carry duties at the refuelling moment. The pilot in command must confirm safety before hot refuelling commences (3.1), ensure passengers are not on board except in narrowly defined situations (3.2), keep a pilot holding a licence valid for the helicopter at the controls unless Civil Aviation Order section 95.7 subsection 7 applies (3.3), and maintain communication with the refuelling ground person by electronic intercom or visual contact with agreed signals (3.4).

Ground personnel and refuellers: persons engaged in hot refuelling must be trained and familiar with both routine and emergency procedures (4.1). Where an open refuelling system is used, equipment must include a quick cutoff at the tank entry (5.3). Refuelling equipment must be able to be earthed and connected to the helicopter so both are at the same electrical potential before removal of the filler cap (5.4). Firefighting providers or on‑site safety infrastructure must ensure suitable firefighting equipment is readily available (4.2). Platforms, rigs and vessels: where refuelling occurs on offshore installations or other vessels, the operator must obtain approval from the master or operator of that installation or vessel (4.3).

Fuel suppliers and operators’ fuel quality systems: the text imposes conditions on fuel suppliers indirectly. The inspection exception in paragraph 7.2 requires either that the fuel used is supplied by a person with a fuel quality audit program whose regular audit reports are checked by the operator (7.2(b)(i)(A)-(B)), or that when the supplier lacks such a program the operator maintains a monitoring system for fuel quality (7.2(b)(ii)). This brings suppliers into the compliance chain through audit reporting or obliges operators to construct monitoring systems when suppliers lack audits.

Passengers and clients: the rule restricting passengers from being on board during hot refuelling (3.2) affects operators who carry passengers in operations that might include hot refuelling. An exception exists only where, in the pilot’s opinion or on medical advice, the passenger cannot be safely disembarked (3.2). This will affect planning for passenger movements in offshore transfers, survey operations, or other missions where hot refuelling might be considered.

Regulatory administrators: the Order is made under subregulation 235(7) of the Civil Aviation Regulations 1988, so it affects the legal framework used by CASA and other aviation safety regulators, who will interpret and apply the new section alongside other Civil Aviation Orders and the Regulations themselves.

The Order establishes specific duties for operators, pilots, and ground personnel; it does not create express private rights of action or civil remedies within its text. Major duties are as follows.

Operator duties

• Authorisation: Hot refuelling must not be carried out unless authorised by the operator (paragraph 2.1). That places decision‑making authority in the operator.
• Safety assessment: Before authorising, the operator must be satisfied that refuelling can be carried out safely and must have regard to helicopter configuration, fuel‑system component locations, the refuelling system and its components, and the helicopter’s flight manual (paragraph 2.2).
• Documentation: The operator must include in the operations manual the circumstances in which hot refuelling may occur, the procedures to be followed, relevant flight manual requirements, and instructions to ensure fuel quality if applicable. These matters must be set out separately for each helicopter type covered by the operations manual (paragraphs 2.3-2.4).
• Fuel quality assurance: The operator has a duty to check supplier audit reports if the supplier has a fuel quality audit program, or to maintain a fuel quality monitoring system if the supplier has no audit program, for the purpose of qualifying for the inspection exception in paragraph 7.2(b).

Pilot duties

• Pre‑refuel safety: The pilot in command must ensure that the refuelling can be carried out safely in accordance with the section and the operator’s procedures before allowing hot refuelling to commence (paragraph 3.1).
• Passenger control: The pilot must prevent passengers being on board during hot refuelling except for those who cannot be safely disembarked (paragraph 3.2).
• Control occupancy: Unless an exception in another Civil Aviation Order applies, a pilot with a licence valid for the helicopter must remain at the controls for the duration of the refuelling (paragraph 3.3).
• Communication: The pilot must maintain communication with the ground refueller via electronic intercom or visual contact and agreed signals (paragraph 3.4).
• Post‑refuel inspection: On completion of each hot refuelling, the pilot must inspect and test the helicopter’s fuel system for the presence of water unless the exception in paragraph 7.2 applies.

Ground personnel duties

• Training: All persons engaged in hot refuelling must be trained and familiar with the procedures and any emergency responses (paragraph 4.1).
• Firefighting readiness: Suitable and properly maintained firefighting equipment must be readily available to respond to emergencies during refuelling (paragraph 4.2).
• Approval for offshore: Prior approval of the operator or master is required before hot refuelling on offshore rigs, platforms, drilling ships or other vessels (paragraph 4.3).
• Equipment safety: For open refuelling systems, equipment must provide a quick cutoff at the tank entry point (paragraph 5.3), and both equipment and helicopter must be earthed and connected to equalise electrical potential before removal of filler caps (paragraph 5.4).

Fuel supplier/monitoring interaction

• Audit/monitoring link: The duty to inspect after each hot refuelling can be waived where the helicopter has been engaged in operations during which hot refuelling has taken place for not more than five continuous hours, and either the fuel supplier has a fuel quality audit program whose regular audit reports are checked by the operator, or the operator has its own fuel quality monitoring system (paragraph 7.2). That creates an operational incentive for suppliers to implement audit programmes and for operators to review supplier audits or build monitoring systems.

Rights and omissions

• The Order does not create express private enforcement rights, monetary entitlements, or civil remedies within its text. It prescribes regulatory duties. The Order itself does not lay out penalties; it is made under powers in the Civil Aviation Regulations 1988 (preamble). Enforcement and penalties, if any, will be matters governed by the enabling Regulations and broader aviation safety enforcement regime not set out in the substituted section.

The substituted section 20.10 as reproduced in this Order does not itself set out penalties, monetary fines, or the administrative enforcement processes that apply for breach. The Order is made under subregulation 235(7) of the Civil Aviation Regulations 1988 (preamble), which is the statutory source of power used to issue this Civil Aviation Order. The instrument therefore functions as a regulatory standard; however, this text does not specify how non‑compliance will be policed or sanctioned, nor does it list infringement notices, pecuniary penalties or licence suspensions.

Because the Order does not prescribe enforcement mechanisms within its own text, the practical enforcement architecture , whether criminal or civil penalties, administrative sanctions, or regulatory notice regimes , will derive from the Civil Aviation Regulations 1988 and associated enforcement policies and procedures held by the regulator. The absence of penalty clauses in the substituted section means readers must consult the Regulations and enforcement instruments to determine consequences of contravention, including who has investigative authority, what notices or sanctions are available, and whether contraventions amount to offences attracting fines or licence actions under the Regulations.

From an operational perspective, this absence implies that compliance will be judged against the prescriptive duties in the Order (for example operator authorisation, operations manual content, training, firefighting equipment readiness, earthing, and post‑refuelling inspection/testing) and any enforcement action will proceed under the statutory enforcement mechanisms available under the Civil Aviation Regulations 1988 or other secondary instruments. Practitioners should note the legal source cited in the preamble (subreg 235(7)) as the starting point for locating applicable enforcement powers and sanctions, because the Order itself does not describe them.

The substituted section explicitly cross‑references other Civil Aviation Orders and therefore operates as part of an interlocked regulatory framework rather than in isolation. Paragraph 1A.1 requires that hot refuelling be carried out in accordance with the requirements set out in section 20.9 except for specified paragraphs (it excludes paragraphs 4.1.1.1, 4.3.1, 4.3.8, 4.4.1, 4.5.1 and 5.1.4 of section 20.9), and also in accordance with this new section (1A.1(a)-(b)). That means compliance requires reading both section 20.10 as substituted and section 20.9 together, accounting for the listed exclusions.

The Order includes a Note directing operators and pilots to the provisions of paragraph 5.1 of section 20.2 relating to inspections and tests for the presence of water in an aircraft's fuel system before the start of each day’s flying, stating those provisions are applicable to helicopters to which this section applies. This links the hot refuelling rules to pre‑flight inspection duties elsewhere in the Orders and makes clear that daily water testing obligations remain part of the compliance bundle for helicopters subject to hot refuelling (Note to 1A.1).

There are other cross‑references that introduce potential conditionality. Paragraph 3.3 states that unless subsection 7 of Civil Aviation Order section 95.7 applies, a pilot with a licence valid for the helicopter must be at the controls during refuelling. The Order therefore defers to section 95.7(7) for any specific alternative rules relating to pilots at the controls, creating a conditional interaction that practitioners must check when applying the hot refuelling rule in contexts where section 95.7 may apply.

The inspection exception at paragraph 7.2 creates an interaction with fuel supplier practices and operator quality systems. It conditions the waiver of post‑refuelling inspection on either a supplier's fuel quality audit program whose regular audit reports are checked by the operator, or the operator’s own system for monitoring fuel quality where the supplier lacks an audit program. Thus, compliance with this Order may require contractual, auditing, or monitoring arrangements with fuel suppliers and may intersect with competition, contract law and supplier audit practices.

Because the Order is made under the Civil Aviation Regulations 1988 (preamble), it must be read and applied in that regulatory hierarchy. The Order does not restate enforcement mechanisms, permissible sanctions or administrative procedures; those are to be found in the Regulations and other Orders. Practitioners should therefore read the substituted section alongside: section 20.9 (with the listed exclusions), section 20.2 paragraph 5.1, section 95.7(7), and the Civil Aviation Regulations 1988 for enforcement and offence provisions.

This instrument is explicitly titled the Civil Aviation Amendment Order (No. R11) 2004 and records the following mechanical amendment: it omits the existing section 20.10 of the Civil Aviation Orders and substitutes a new section 20.10 as set out in Schedule 1 (clauses 1 and 3). The Order records its date and authorising signature: it is signed by William Bruce Byron, Director of Aviation Safety and CEO, and dated 2 December 2004 (preamble). Clause 2 provides that the Order commences on gazettal.

The Order contains no further history of prior amendments to section 20.10 within the text supplied. It does not narrate earlier versions or provide a legislative history beyond stating the immediate action of omission and substitution. There are no transitional or savings provisions included in the text; the Order simply substitutes a new section and commences on gazettal.

Because the instrument replaces section 20.10 wholesale and cross‑references other Civil Aviation Orders, any historical or subsequent amendments to sections 20.2, 20.9 or 95.7 may meaningfully affect how the substituted section operates in practice. The Order itself records only the substitution and the date of issuance. Practitioners needing a comprehensive amendment track should therefore consult the formal gazette notice and the compiled Civil Aviation Orders to locate the replaced text of section 20.10 and to identify any earlier or subsequent amendments to the related Orders referenced in the new text.

The substituted section 20.10 provided in this Order contains no mention of litigation, judicial interpretations, or administrative appeals. The instrument itself does not recount any cases, determinations, or enforcement actions arising under the prior section 20.10, nor does it identify any disputes or precedent bearing on the meaning or application of the new provisions. The text supplies only the regulatory content; it does not record or indicate any litigation history.

From the absence of litigation information in the instrument, the text does not identify any binding judicial interpretation or tribunal decisions that clarify ambiguous phrases such as "satisfied that the refuelling can be carried out safely" (paragraph 2.2), "suitable and properly maintained fire fighting equipment" (4.2), or the conditions for the paragraph 7.2 inspection exception. Consequently, practitioners should treat the language in this Order as requiring administrative interpretation by the regulator and factual assessments by operators and pilots unless and until a court or tribunal provides authoritative construction.

For legal practitioners working on disputes or compliance questions, the lack of litigation history in the instrument means analysis will require: (a) locating any relevant enforcement decisions or prosecutions under the Civil Aviation Regulations 1988 that invoked the substituted section; (b) reviewing administrative guidance, advisory materials, or inspectorate interpretations issued by the regulator; and (c) checking whether subsequent cases have addressed ambiguities or procedural compliance. Those materials are not included in the Order itself and must be obtained from regulatory records, court databases or administrative tribunals.

The Order contains several provisions that create practical risks of non‑compliance or operational friction if not read together with the referenced Civil Aviation Orders. These are concrete traps rather than abstract warnings.

Cross‑references and exclusions: Paragraph 1A.1 requires compliance with section 20.9 except for six specified paragraphs. Unless the operator expressly checks which parts of 20.9 are excluded (4.1.1.1, 4.3.1, 4.3.8, 4.4.1, 4.5.1 and 5.1.4), they may mistakenly apply incompatible provisions from 20.9. The Note also directs attention to section 20.2 paragraph 5.1 for daily water inspection/testing , failure to account for that will leave an operator exposed to missing pre‑flight obligations in addition to post‑refuel tests (Note to 1A.1).

Operator authorisation and subjective satisfaction: Paragraph 2.2 requires the operator to be "satisfied" that hot refuelling can be carried out safely, and to "have regard to" specified factors. These are fact‑intensive and leave room for subjective judgment. Without clear internal standards, operators may fail to document the basis for satisfaction and so be unable to show regulatory compliance. Paragraph 2.3 mandates inclusion of procedures in the operations manual and separate material per helicopter type (2.4), so failure to document will be a compliance gap.

Passenger carriage exception narrowness: Paragraph 3.2 bars passengers during hot refuelling except where, in the pilot’s opinion or on medical advice, the passenger cannot be safely disembarked. This is a narrow operational exception; misinterpreting it (for example, assuming commercial passenger flights can routinely carry fare‑paying passengers during hot refuelling) will breach the Order.

Licence exception reference: Paragraph 3.3 defers to section 95.7(7) for any exception to the requirement that a pilot with a licence valid for the helicopter be at the controls. Practitioners must check section 95.7(7) before relying on any alternative arrangements; failing to do so risks non‑compliance.

Ambiguity in equipment standards: Terms such as "suitable and properly maintained fire fighting equipment" (4.2), "trained and familiar" personnel (4.1) and "means of quickly cutting off the fuel supply" (5.3) are functional but unspecified. Without regulator guidance or industry standards, operators must decide the level of equipment, maintenance intervals and training content themselves, and these choices may be second‑guessed by inspectors after an incident.

The post‑refuelling inspection exception has several concrete timing and proof requirements. Paragraph 7.2(a) requires that the helicopter has, for a continuous period of not more than five hours' time in service, been engaged in operations during which hot refuelling has taken place. The wrinkle is the coupling of a temporal operational threshold with supplier audit or operator monitoring evidence (7.2(b)). Operators who rely on the exception must have systems to track continuous time in service, hot refuelling episodes, and documentary evidence of fuel audit reports or monitoring records. Absent those records, the operator cannot validly rely on the exception and must ensure post‑refuelling water testing.

Radio and avionics constraints: The requirement that HF transmitters and radar not be operated during hot refuelling (6.2) may conflict with operational communications needs, especially offshore. Operators must plan for alternative communications (electronic intercom or agreed visual signals under paragraph 3.4) and guard against inadvertent activation of prohibited transmitters.

Offshore/platform approvals: Paragraph 4.3 requires approval of the operator or master of a rig, platform or vessel prior to carrying out hot refuelling there. This is an external approval right of the platform operator/master and can introduce delays or denials; logistic arrangements need to be in place to secure such approvals in advance.

Fuel supplier audit reliance: The inspection exception links to the supplier having a "fuel quality audit program" and the operator checking "regular audit reports" (7.2(b)(i)). Operators that poorly define what constitutes an audit program or fail to check reports will lose the exception. If a supplier lacks an audit program, the operator must implement a system for monitoring fuel quality (7.2(b)(ii)) , creating cost and operational requirements that may be overlooked.

Record‑keeping and proof: Although the Order does not state specific record‑keeping requirements, many of its permissions and exceptions hinge on documentation (operator satisfaction, operations manual content, supplier audit reports, the tracking of continuous time in service). Failure to keep contemporaneous documented evidence is a practical trap when subject to regulatory inspection after an incident.

Build a practical compliance package that mirrors the structure of the Order and documents the factual basis for discretionary judgments.

1. Policies and authorisation

• Implement a written hot refuelling authorisation policy approved by the operator. Record the factual basis for authorisation in each instance, referencing helicopter configuration, engine/rotor status, fuel‑system component locations, the refuelling system to be used, and any relevant flight manual instructions as required by paragraph 2.2 and 2.3. Ensure this policy is reflected in the operations manual and separated by helicopter type (paragraphs 2.3-2.4).

2. Operations manual updates

• Amend the operations manual to include: the operational circumstances permitting hot refuelling, step‑by‑step procedures for hot refuelling, emergency response actions, any flight manual instructions relevant to hot refuelling, and fuel quality assurance instructions where applicable (paragraph 2.3). Keep separate sections by helicopter type (2.4).

3. Training and competency

• Train all personnel involved in hot refuelling , ground refuellers, flight crew, and supervisory staff , in both standard procedures and emergency responses, and maintain training records (4.1). Define training curricula to match likely scenarios encountered in operations.

4. Equipment and firefighting

• Ensure suitable and properly maintained firefighting equipment is readily available at all hot refuelling locations (4.2). Establish maintenance intervals, storage, and accessibility protocols. Ensure refuelling equipment provides a quick cutoff at the tank entry point where open systems are used (5.3), and maintain earthing/ bonding equipment and procedures so that the refuelling equipment and helicopter are of the same electrical potential before the filler cap is removed (5.4).

5. Communication procedures

• Provide an electronic intercommunication system or a documented visual‑signal protocol linking the pilot at the controls and ground refueller (3.4). Restrict radio transmissions from the helicopter to the greatest extent practicable during hot refuelling and prohibit use of HF transmitters or radar equipment during hot refuelling (6.1-6.2). Document contingency communications for offshore and remote operations.

6. Passenger handling

• Institute a passenger policy that requires disembarkation during hot refuelling except in the limited circumstance where the pilot reasonably believes or medical advice indicates disembarkation is unsafe (3.2). Record any exception decisions contemporaneously.

7. Pilot at controls / licensing

• Ensure rostered pilots at refuelling are holders of licences valid for the helicopter or verify that any potential exception under section 95.7(7) applies before relying on alternative arrangements (3.3). Document licence verification and any applicable exception.

8. Fuel quality assurance

• Implement supplier engagement protocols: require fuel suppliers to provide evidence of a fuel quality audit program and produce regular audit reports, which the operator must check to qualify for the paragraph 7.2 exception (7.2(b)(i)). Where suppliers lack an audit program, put in place an operator monitoring system for fuel quality that provides the requisite assurance (7.2(b)(ii)). Document checks and monitoring outcomes.

9. Inspection and testing

• Require pilots to inspect and test the fuel system for the presence of water after every hot refuelling unless the narrow 7.2 exception applies (7.1). Establish test procedures, acceptable tests, record forms and retention policies. If relying on the exception, maintain documentation of continuous time in service (not more than five hours' continuous period), supplier audit reports or operator monitoring records, and any other factual basis.

10. Offshore and vessel coordination

• For hot refuelling on offshore rigs, platforms, drilling ships or other vessels, obtain prior written approval from the operator or master of that installation or vessel (4.3). Establish coordination templates and pre‑approved safety certificates where possible.

11. Cross‑references and audit

• Review sections 20.9 and 20.2 paragraph 5.1 and section 95.7(7) to ensure full compliance with the integrated regime (1A.1 and Note; 3.3). Incorporate checks into internal audits and safety management systems to verify that the excluded paragraphs of 20.9 are not being applied in error.

12. Documentation and record retention

• Although the Order does not specify retention periods, retain authorisations, operations manual versions, training records, firefighting maintenance logs, fuel supplier audit reports, operator monitoring records, post‑refuelling inspection/test records, and records of passenger exceptions and offshore approvals. These contemporaneous documents will support claims of compliance and are necessary where the inspection exception is relied upon.

13. Incident response and review

• Integrate hot refuelling into emergency response plans, including firefighting and evacuation procedures, and conduct post‑event reviews to update procedures and training where necessary, consistent with paragraph 4.1 and 4.2.

Following these steps will align organisational practice with the duties and exceptions set out in the substituted section 20.10. Practitioners should also ensure they consult the Civil Aviation Regulations 1988 and other Civil Aviation Orders for enforcement, licensing and ancillary obligations not reproduced in this Order.
