#### 43 Representations to be taken into consideration 43 Representations to be taken into consideration > > (1) Without limiting the generality of section 79C of the Planning Act, in determining a development application relating to the carrying out of major development, the Planning Committee shall take into consideration any representations made in relation to the development to which the development application relates in accordance with section 42 by a Minister or public authority within 40 days after a copy of the application was forwarded to that Minister or public authority. > > > (2) Subsection (1) does not prevent the Planning Committee from taking into consideration any such representation made after the expiry of the 40-day period but before the development application is determined. > > **s 43:** Am 2006 No 123, Sch 2 \[8\].
