36 Breaking glass or other material (a) the person breaks glass or other material; and (b) the pieces of the glass or other material are on public land; and (c) the pieces of the glass or other material result in a foreseeable risk of injury to a person or animal. (3) It is a defence to a prosecution for an offence against clause (1) if: (a) the breakage was accidental; and
