What it does
The City and Environment Legislation Amendment Act 2026 makes targeted amendments to five ACT instruments: the Cemeteries and Crematoria Act 2020, the Electoral Act 1992, the Heavy Vehicle National Law (ACT) Act 2013, the Road Transport (Offences) Regulation 2005 and the Road Transport (Safety and Traffic Management) Regulation 2017. It does not set out a single regulatory scheme. Its practical effects differ across those areas.
The most detailed changes concern cremated remains. New s 25 of the Cemeteries and Crematoria Act requires a crematorium licensee to notify the cremation applicant within seven days that the remains are available, keep them available for three years, and take specified further steps if they remain uncollected. New ss 25A and 25B create offences for failures to notify or make contact as required, and for certain disposals. New s 63A requires a register recording notifications, collection details and, where applicable, disposal.
Other changes are narrower. Section 10 adjusts the timing language in s 37(1)(a) of the Electoral Act by inserting “and 1 month” after “2 years”. Sections 11 and 12 remove a qualification and delete s 21 concerning the mistake-of-fact defence under the Heavy Vehicle National Law (ACT) framework. Section 13 changes how certain corporation infringement notice penalties are calculated. Sections 14 and 15 prescribe accuracy tolerances of “2% or 2km/h” for specified speed-measuring equipment and police vehicle speedometers.
The Act says it commences on the seventh day after notification. It was notified on 5 June 2026, so the stated commencement mechanism points to 12 June 2026. The Act also notes that its naming and commencement provisions commence on notification day under s 75(1) of the Legislation Act. This account explains the supplied amending Act; it does not establish the complete current wording of every amended instrument.
