Subject to subclause L4.1the notification of an officer’s excess status may only be given when the consultation required under clause L3 - and the consultation required under subclause L4.2 has taken place. Following such consultation, where the chief executive is aware that an officer is excess, the chief executive must advise the officer in writing.
