Where the employee disagrees with a direction to participate in formal counselling, the employee may provide a written request to the chief executive seeking a formal investigation of the alleged inappropriate behaviour or alleged misconduct that required the formal counselling. Where a request is received, the chief executive must refer the matter to the Public Sector Standards Commissioner for review.
