E27.5Where an employee’s pregnancy ends more than 20 weeks before the estimated date of delivery

Where an employee’s pregnancy ends more than 20 weeks before the estimated date of delivery of the child any surrogacy leave which has been prospectively approved must be cancelled. In this circumstance the employee may become eligible for compassionate leave in accordance with clause E12 - and/or special birth leave in accordance with clause E15 -.
