To amend an error where the wording at clauses E10.3.12 and E10.3.13 reverts to its prior wording to be consistent with the provisions in the Holiday Act 1958 which sets out the public holidays for the ACT and uses the word ‘and’ instead of the phrase ‘or one of the following’ when referring to the days on which Christmas Day and Boxing Day fall. This was sought by the following amendments:

• Clause E10.3.12 to read “The 25 December (Christmas Day) and:”
• Clause E10.3.12 (a) to read “If Christmas Day falls on a Saturday, the following Monday; or”
• Clause E10.3.13 to read “The 26 December (Boxing Day) and:”
• Clause E10.3.13 (a) to read “If Boxing Day falls on a Saturday – the following Monday; or” [8] It was put that the matters sought to be amended by the variations would not result in detriment to any employees covered by the Agreement. [9] The views of the AEU were sought in relation to the proposed variations. The AEU had no objection to the proposed variations. [10] I am satisfied that the proposed variations deal with obvious errors in the Agreement. The making of the variations will remove those obvious errors. It is appropriate in the circumstances to approve the variations.
