110 Offence to supply beverage without supply arrangement with Scheme Coordinator and container approval

(1) A person must not supply or offer to supply a beverage in an eligible container to any other person unless—

(a) a supply arrangement is in force between the person and the Scheme Coordinator; and

S. 110(b) substituted by No. 35/2023 s. 17(1)(c).

(b) the eligible container is approved as a suitable eligible container.

(2) A person who contravenes subsection (1) commits an offence against that subsection and is liable to a penalty not exceeding—

(4) Subsection (1) does not apply to any supply, or offer to supply, in relation to which the person is not required to notify the Head, Recycling Victoria under section 98(1).
