What it does
The Church of England (Port Fairy) Land Act 1938 changes the legal trusts and disposal powers attaching to a specific parcel of land in Port Fairy that had been held as a site for a minister's dwelling. Mechanically the Act does three things.
First, it declares that, notwithstanding any prior statute, conveyance, assurance or trust, from the commencement of the Act the land described in the Schedule is to be held by The Ballarat Diocesan Trustees (the "trustees") on new trusts set out in the Act. The opening words of s 3(1) expressly override earlier instruments and laws, stating "Notwithstanding anything in any Act or enactment or in any conveyance assurance or trust whatsoever" the trustees shall be "deemed to hold" the land on the trusts provided in the Act.
Second, the Act substitutes decision-making and permissible uses for the land. Under s 3(1)(a) the trustees are to hold the land on trust to permit its whole or any part to be used for "such purposes of the Church of England or for such use of any minister or officer thereof or of any institution conducted or controlled by the said church or connected therewith" as the Bishop of Ballarat directs, where the Bishop is to act under the advice of the Council of the Diocese of Ballarat. The definition of "Bishop of Ballarat" in s 2 includes the person authorised to administer diocesan affairs during any vacancy of the See.
Third, the Act authorises disposals and other dealings that were previously constrained by the original trust. Under s 3(1)(b) the trustees, with the consent of the Bishop of Ballarat acting under the advice of the Council of the Diocese of Ballarat, may mortgage, sell, lease (whether on building lease or otherwise) or exchange the land or any part of it; the trustees may also create easements over or reserve roads on the land. Section 3(2) then prescribes the application of any proceeds from mortgages, sales, leases or other dealings: the trustees must apply the proceeds towards the cost of erecting a minister's dwelling on other land in the town of Port Fairy and towards such other purposes in connexion therewith as the Bishop acting under the advice of the Council from time to time directs.
