What it does
The Anglican Church of Australia (Diocese of North West Australia) Act 1961 is a Western Australian statute that performs three mechanical functions: it statutorily vests a specific portfolio of land parcels in the corporate trustee of the Diocese of North West Australia; it establishes a mechanism for certifying the diocese's territorial boundaries; and it changes the corporate name of the trustee body. The land vesting operates automatically upon commencement of the Act unless the Synod resolves otherwise, meaning no separate conveyance or transfer is required to pass title from the Crown or prior holders to the trustees. Section 3(1)(a) provides that the schedule land "shall, by force of this section, vest in The Trustees of the Northern Diocese when elected" under the separate Anglican Church of Australia Diocesan Trustees and Lands Act 1918. This is a direct statutory vesting, analogous to a compulsory acquisition but for the benefit of a private religious corporation. The boundaries of the diocese are not fixed by legislation but are to be shown on a map certified by the Bishops of the Northern Diocese and of Perth, and that certification is declared to be conclusive evidence of the boundaries as at the date of certification. Section 5 deals with the corporate name change: the corporation originally constituted as "The Trustees of the Northern Diocese" was preserved and continued under the new name "The Trustees of the Diocese of North West Australia" by the 1962 amending Act, with no interruption to its legal identity, rights, powers, liabilities or duties. The Act also imposes duties on the Registrar of Titles and Registrar of Deeds to register the trustees as proprietors upon application and proof, and to note the name change on certificates of title free of charge. The schedule lists approximately 80 separate parcels of land across towns such as Broome, Carnarvon, Geraldton, Derby, Port Hedland and Roebourne, many with specific volume and folio references. The Act does not create any ongoing regulatory regime; it is a one-time vesting and machinery statute that has been amended only to update names and references.
