What it does
Mechanically, the Act alters the trust regime that governs a single parcel of land at Mount Shadwell in the Parish of Mortlake that was originally vested in The Ballarat Diocesan Trustees as a parsonage house and glebe. The core operative provision is s 3. It does three things in statutory form.
First, it redefines the permissible uses of the land by deeming that The Ballarat Diocesan Trustees (defined in s 2 as "trustee") hold the land upon trusts that permit the whole or any part of the land to be used for a broadened set of Church-related purposes. The permitted uses expressly include "such purposes of the Church of England in Australia or for such use of any institution conducted or controlled by the said Church or connected therewith or for such use of any Minister of the said Church as the Bishop of Ballarat acting under the advice of the Council of the Diocese of Ballarat directs" (s 3(1)(a)). This removes the prior constraint that the land be used solely as a parsonage house and glebe for the Minister or Ministers having spiritual charge of Mortlake.
Second, the Act grants express powers of disposition to the trustee, but only with the consent mechanism specified. Under s 3(1)(b), the trustee may mortgage, sell, lease (including building lease), exchange the land or any part of it, and may create easements or reserve roads. Those powers are exercisable "with the consent of the Bishop of Ballarat acting under the advice of the Council of the Diocese of Ballarat." The trustee’s power to dispose is therefore not unilateral; the statutory consent of the Bishop (acting under diocesan Council advice) is required.
Third, the Act prescribes the application of any proceeds arising from those dealings. Section 3(2) requires the trustee to apply proceeds from any mortgage, sale, lease or other dealing in accordance with the directions of the Bishop of Ballarat acting under the advice of the Diocesan Council, for "such purposes of the Church of England in Australia or for such use of any institution conducted or controlled by the said Church or connected therewith or for such use of any Minister of the said Church" as the Bishop directs.
