What it does
This short Act (Church of England (Greensborough Land) Act 1961) changes the trust under which a specific parcel of land at Greensborough is held and confers express powers to the named trustee in relation to that land. The Act operates by (a) declaring that the lands described in the Schedule are to be held by The Church of England Trusts Corporation for the Diocese of Melbourne ("Trustee") subject to the new trusts and powers spelled out in s 3, and (b) conferring on the Trustee specific powers to permit uses, and to mortgage, sell, lease, exchange and otherwise deal with the land, subject to the consent and directions of the Archbishop of Melbourne acting under the advice of the Council of the Diocese (s 3(1)(a)-(b)). The Act also requires that any proceeds arising from mortgage, sale, lease or other dealing with the land be applied for such Church purposes or for the use of any institution conducted, controlled by, or connected with the Church as the Archbishop acting under the advice directs (s 3(2)). Definitions relevant to operation are confined to the Archbishop (including a person administering the diocese during vacancy) and the Trustee (s 2).
Mechanically, the Act overrides existing trusts and inconsistent enactments or conveyances in respect of the land (s 3(1) begins with "Notwithstanding anything in any Act or enactment or in any conveyance assurance or trust whatsoever"). The Schedule identifies the land by metes and bounds and by reference to the earlier conveyance memorials and plan. The instrument accordingly converts a historic school-site trust (originating with an 1855 conveyance described in the preamble) into a statutory framework permitting church use and disposition of the land and the application of proceeds as directed by diocesan authority. The Act contains no separate procedural prescriptions (for example, no statutory sale process, valuation requirement or public consultation obligation) and contains no penal provisions; its operational rules are the definitions and powers in ss 2-3 and the land description in the Schedule.
