Children, Youth and Families (Children's Court Judicial Registrars) Rules 2021

These Rules prescribe which Children’s Court matters may be heard and determined by judicial registrars, delegate to registrars specified powers of the Court, and set a procedure for review of a judicial registrar’s determination by the Court constituted by a magistrate. The Objects (rule 1.01) are explicit: identify proceedings registrars may deal with, delegate Court powers to registrars, and establish review procedure. The Rules are made under sections 504(8) and 588(1AB) of the Children, Youth and Families Act 2005 (the Act) (rule 1.02) and commenced on 25 March 2021 (rule 1.03).

Mechanically, the Rules do three things. First, they set out specific categories of matters registrars may hear and determine either whether contested or only if uncontested (Orders 2.03-2.07). Those lists cross-reference numerous other Acts and sections, for example the Evidence Act 2008, Magistrates’ Court Act 1989, Bail Act 1977, Criminal Procedure Act 2009, Confiscation Act 1997, Firearms Act 1996 and a suite of family‑division provisions in the Act itself (see rules 2.03-2.06). Second, the Rules permit vertical and lateral referral: a judicial registrar may refer any matter to a Court constituted by a magistrate (rule 2.01), and a magistrate may refer matters to a judicial registrar when the magistrate considers it proper (rule 2.02). Third, the Rules establish a review mechanism: a party may apply to the review Court (a magistrate‑constituted Court) for a review by filing Form 1 within 14 days (rule 3.02(1),(4)); the review is heard de novo (rule 3.03(1)), and filing for review does not automatically stay the registrar’s order unless a stay is separately sought and ordered (rule 3.02(2)-(3)).

Operationally, the judicial registrar “constitutes the Court” when exercising these delegated powers and thereby carries the same powers that the Court would have for those matters (rule 2.08). The Rules also allow a judicial registrar to act in place of another judicial registrar when circumstances require (rule 2.10). They were subsequently amended in mid‑2021 and in July 2023 to add and adjust specified powers and revoke certain transitional or redundant provisions; the instrument will sunset ten years after making (Endnotes, Table of Amendments; Subordinate Legislation Act 1994 reference).

The Rules therefore change who decides particular interlocutory, procedural, uncontested and some substantive matters in the Children’s Court by enlarging the scope of judicial registrars’ authority, while preserving a pathway for magistrate determination and a de novo review by a magistrate‑constituted Court. Practitioners and parties must determine, from the lists in Orders 2 and 3, whether a proposed hearing falls within a registrar’s authority, whether the matter must be uncontested for a registrar to deal with it, and whether immediate application for stay is necessary because filing for review does not automatically stay a registrar’s order.

The Rules organise several core concepts: delegated judicial functions, referral and re‑referral, contested versus uncontested jurisdiction, specific lists of eligible proceedings, the nature of the “Court constituted by a judicial registrar”, and the review mechanism.

Delegation and constitution: Rule 2.08 provides that where a judicial registrar hears or determines an application, proceeding or matter under these Rules, the judicial registrar “constitutes the Court for that purpose” and is delegated “the same powers that the Court has” in relation to hearing and determination. That is a statutory mechanism by which a judicial officer who is not a magistrate performs Court functions, within the bounds the Rules set.

Referral mechanisms: Two directional referral provisions create interplay between registrars and magistrates. Rule 2.01 permits a judicial registrar to refer any matter to a Court constituted by a magistrate, without limiting s 542J(1) of the Act, and explicitly allows referral even if a party opposes the referral or even if the judicial registrar otherwise had power to determine it. Rule 2.02 allows a magistrate‑constituted Court to refer proceedings to a judicial registrar where it appears proper; the magistrate’s referral order may contain directions and the registrar can either hear and determine the matter subject to those directions or refer it back.

Contested v uncontested distinction: The Rules draw repeated lines between matters registrars may decide whether or not contested (see rule 2.03 and rule 2.04(1) and 2.06(1)) and matters registrars may decide only where uncontested (see rule 2.05 and rule 2.07). For example, certain Criminal Division powers under Division 3A of Part 5.2 of the Act are available to registrars only if uncontested (rule 2.05(2)), and confiscation or forfeiture orders under Confiscation Act 1997 or Firearms Act 1996 can only be exercised by a registrar if they are incidental to other registrar functions and the matter is uncontested (rule 2.05(3)).

Specific subject‑matter lists: The Rules inventory concrete proceedings and powers by source and section. Examples include adjournment powers under s 530 of the Act (rule 2.03(a)), warrant issuance powers under the Magistrates’ Court Act 1989 as applied to the Children’s Court (rule 2.03(b)-(c)), gaol orders under Corrections Regulations 2019 (rule 2.03(e)), bail extension under Bail Act 1977 (rule 2.04(1)(b)), mention and summary case conference powers under the Criminal Procedure Act 2009 (rule 2.04(2)), family division matters such as extension of interim accommodation orders (rule 2.06(1)(b)), and a series of search warrant powers to support emergency placement under various sections of the Act (rule 2.06(1)(ac) and 2.06(1A)). The lists are granular and cross‑referenced to other statutes.

Primary affected persons and entities are the Children’s Court, judicial registrars, magistrates (including the President where the Act allows), parties and their legal representatives, court staff who manage listings and service, and third parties whose rights or property may be the subject of warrants, forfeiture or removal orders. Indirectly affected groups include correctional institutions responding to gaol orders and Secretarial agencies exercising temporary assessment or emergency care powers whose search warrants are listed in rule 2.06.

Judicial registrars are the immediate beneficiaries of delegated authority. The Rules authorise registrars to constitute the Court and exercise specified Court powers (rule 2.08). They may also act for another registrar (rule 2.10). Judicial registrars are therefore obliged to understand the list of matters they may hear, both contested and uncontested, and the limits applicable to particular powers, such as restrictions on sentencing or rehearing charges in criminal matters (see rule 2.04(2) and rule 2.05(2)).

Magistrates are affected in two distinct ways. First, the Rules preserve magistrates’ authority to hear matters by allowing judicial registrars to refer matters to a magistrate (rule 2.01). Second, magistrates can refer matters to registrars when appropriate, specifying directions (rule 2.02). Magistrates therefore retain supervisory control and a pathway for reclaiming matters.

Litigants and their lawyers: Parties in Children’s Court proceedings face practical effects. If a matter falls within the registrar’s delegated list, a party may have their matter heard by a registrar rather than a magistrate. The Rules allow a party to seek review within 14 days in the review Court (rule 3.02(4)). Filing for review does not halt the registrar’s order absent a successful separate stay application (rule 3.02(2)-(3)), which affects litigation strategy. Where a registrar can only decide uncontested applications (rules 2.05, 2.07), a party’s decision to contest will change the decisionmaker, so parties and counsel must choose contested v uncontested strategies with that rule boundary in mind.

Administrative and enforcement agencies: Various statutory agencies will be affected where their powers intersect with the listed provisions. For instance, the Secretary who can exercise temporary assessment order powers will interact with the search‑warrant regime now expressly listed (rule 2.06(1)(ab) and (ac); rule 2.06(1A)). Police, correctional services and agency investigators must be operationally ready to recognise whether a warrant or order originates from a judicial registrar and to follow directions accordingly.

The Rules allocate duties and rights between parties, registrars and review Courts and set procedural obligations for review and service.

Duties of judicial registrars: When exercising delegated authority, a judicial registrar constitutes the Court and must act within the scope of powers specified in Orders 2.03-2.07 (rule 2.08). They have the duty to refer matters upward to a magistrate when the Rules permit or when considered appropriate (rule 2.01). If a magistrate refers a matter to a registrar, the registrar has the duty either to hear it subject to any directions in the referral order or to refer it back (rule 2.02(2)). Registrars must also observe limitations: for instance, they cannot exercise some powers such as rehearing charges, sentencing a child under certain diversion rules if a child fails to complete a diversion program (rule 2.04(2) and rule 2.05(2)).

Duties of magistrates and review Court: Magistrates have a duty to consider referring to registrars where appropriate (rule 2.02(1)) and may make orders that include directions when referring matters (rule 2.02(2)(a)). As the review Court (rule 3.01), a magistrate must hear applications for review de novo (rule 3.03(1)) and consider the interests of justice and applicable principles in Part 1.2 of the Act (rule 3.03(2)). The review Court also has the power to extend the 14‑day filing period before or after expiry (rule 3.02(5)) and to order stays where appropriate (rule 3.02(3)).

Rights of parties: A party to a proceeding determined by a judicial registrar may apply for review by a magistrate‑constituted Court (rule 3.02(1)), using Form 1. The party has the right to apply for a stay of the registrar’s determination in the review Court (rule 3.02(3)) but not an automatic right to a stay on filing (rule 3.02(2)). The party also has the right to be served with the application for review unless the review Court orders otherwise (rule 3.02(6)). Where a proceeding is referred by a magistrate to a registrar under rule 2.02, parties may expect the referral to be made by order and to be subject to any directions in that order (rule 2.02(1)-(2)).

Procedural duties relating to forms and service: Form 1 sets out required particulars for a review or stay application and notes that the registry will provide details of the hearing (Form 1). The applicant must cause a copy of the application to be served on all other parties unless the review Court orders otherwise (rule 3.02(6)). After determination, unless the review Court orders otherwise, the applicant must provide a copy of the review Court’s orders to parties who did not enter an appearance at the hearing (rule 3.04).

The Rules themselves do not introduce new standalone criminal penalties or fines; they instead create procedural allocations and delegate powers already established in primary statutes. Enforcement under the Rules works by enabling registrars to exercise substantive statutory powers that carry their own sanctions and enforcement mechanisms where applicable. The instrument therefore affects enforcement indirectly through who decides and how certain enforcement orders are made and reviewed.

Where the Rules permit a judicial registrar to issue warrants, remit property or make removal orders, the enforcement consequences arise under the originating statutory provision. Examples from the Rules include:

• Arrest, remand and seizure warrants: Rule 2.03(c) permits a judicial registrar, in accordance with s 57(4) of the Magistrates’ Court Act 1989, to issue warrants under s 57(1)(a), (b) and (d) of that Act. The underlying enforcement powers and any penalties associated with resisting or obstructing enforcement of such warrants are governed by the Magistrates’ Court Act 1989 and related enforcement statutes, not by these Rules.

• Gaol orders: Rule 2.03(e) permits registrars to deal with proceedings for a “gaol order” under regulation 23(1) of the Corrections Regulations 2019. The enforcement of such an order, removal from prison to the Court, will be carried out by correctional authorities under the Corrections Regulations and corrections legislation.

• Forfeiture and disposal: Rule 2.05(3) allows registrars to exercise powers under Div 1 of Part 3 and Part 10 of the Confiscation Act 1997 and s 151 of the Firearms Act 1996 but only where the power is incidental to registrar exercise under other provisions, the proceeding is uncontested, and the child has not given a notice of abandonment. Enforcement of forfeiture or disposal is effected under those Acts’ enforcement paths.

• Family Division emergency warrants: Rule 2.06 authorises registrars to issue certain search warrants under a range of sections of the Act for the purpose of placing a child in emergency care. Enforcement of those warrants and any related breach consequences are governed by the Act’s enforcement provisions.

Consequences of non‑compliance with procedural obligations under the Rules are administrative and judicial: courts may refuse applications, strike out matters, refuse relief for failure to comply with service or filing requirements, or otherwise exercise procedural controls. For example, where a party fails to comply with the 14‑day filing period for a review application, the review Court has discretion to extend time before or after expiration (rule 3.02(5)), but failure to seek or obtain such extension may foreclose the review remedy.

The Rules operate as subordinate instrumentary procedural law that cross‑references and enables exercise of powers from multiple statutes. They do not replace primary legislative provisions; rather, they allocate decision‑making authority within the Children’s Court ecosystem and specify procedural provisions for review. The Rules expressly incorporate and make subject to registrars’ authority a range of powers drawn from the following Acts and instruments:

• Children, Youth and Families Act 2005 (the Act): The Rules are made under ss 504(8) and 588(1AB) of the Act (rule 1.02). They interact with numerous provisions of the Act, including s 530 (adjournment powers, rule 2.03(a)), Part 5.2 Div 3A powers (diversion, rule 2.05(2)), Part 7.9 and Schedule 3 (CAYPINS, rule 2.04(1)(g)-(h)), and many family division sections (rules 2.06 and 2.07A). The review provisions require the review Court to have regard to, where applicable, the principles in Part 1.2 of the Act (rule 3.03(2)(b)).

• Magistrates’ Court Act 1989: The Rules repeatedly apply Magistrates’ Court Act powers to registrars. Rule 2.03(b) and (c) allow registrars to exercise powers under s 194 of the Evidence Act 2008 as applied by s 57A of the Magistrates’ Court Act 1989, and under s 57(1) of the Magistrates’ Court Act (warrants). Rule 2.03(d) refers to proceedings under Division 3 of Part 4 of the Magistrates’ Court Act in relation to warrants.

• Evidence Act 2008: Rule 2.03(b) imports s 194 of the Evidence Act 2008 as applied by the Magistrates’ Court Act 1989, so registrars may exercise relevant warrant powers connected to evidence obligations.

• Bail Act 1977: Rule 2.04(1)(b) allows registrars to hear applications for extension of bail under s 16 of the Bail Act.

• Criminal Procedure Act 2009: Multiple cross‑references appear. Rule 2.04(1)(c) and (2) permit registrars to exercise certain powers connected to Part 3.4 and to mention hearings and summary case conference powers under ss 53 and 54, but registrars are not given power to hear and determine charges. Rule 2.04(3) allows registrars to exercise powers under ss 101 and 102 (filing hearings).

• Confiscation Act 1997 and Firearms Act 1996: Rule 2.05(3) permits registrars to deal with forfeiture and disposal powers under these Acts only in narrow, incidental, and uncontested circumstances.

• Appeal Costs Act 1998: Rule 2.04(1)(a) allows registrars to consider indemnity certificate applications under s 17 of that Act when the proceeding relates to adjournment of a criminal proceeding.

The instrument as enacted on 24 March 2021 started life as the Children, Youth and Families (Children's Court Judicial Registrars) Rules 2021 (S.R. No. 22/2021) and commenced on 25 March 2021 (rule 1.03; Endnotes). The Table of Amendments included in the published version identifies two later amending statutory rules:

• Children, Youth and Families (Children's Court Judicial Registrars) Amendment Rules 2021, S.R. No. 90/2021, made on 22 July 2021 and commencing 23 July 2021 (Table of Amendments). This amending instrument substituted or inserted specific provisions in rule 2.06 and amended rule 2.07(2) (see annotations in the text indicating substitution and insertion by S.R. No. 90/2021 rule 5 and rule 6 respectively). It also amended rule 2.04(2) as noted in the main text.

• Children, Youth and Families (Children's Court Judicial Registrars) and (Children's Court Family Division) Amendment Rules 2023, S.R. No. 70/2023, made on 5 July 2023 and commencing (for Rules 4-7) on 10 July 2023 (Table of Amendments). That instrument inserted rule 2.07A (Further powers in Family Division) and added or modified search warrant powers and other family division powers in rule 2.06 (rules 5 and 6 of S.R. No. 70/2023). Rule 2.09 was revoked by S.R. No. 70/2023 rule 7. The text shows several insertions and revocations specifically referenced to S.R. No. 70/2023.

The published text contains marginal notes that record where specific subrules were amended or revoked and identify the amending statutory rule number and rule clause. For example, rule 2.03(c) is annotated as amended by S.R. No. 70/2023 rule 4; rule 2.06(1)(ab) and (ac) and subrule 1A were inserted by S.R. No. 70/2023 rule 5(1) and rule 5(2) respectively. These annotations are part of the legislative version history.

The Endnotes clarify that the Rules were made jointly by the President of the Children’s Court and two magistrates on 24 March 2021 under sections 504(8) and 588(1AB) of the Act and came into operation on 25 March 2021. They also record the instrument will sunset on 24 March 2031 under s 5 of the Subordinate Legislation Act 1994, unless remade. The Endnotes include a table identifying the date of making and commencement for the two amendment instruments and note specific commencement dates for parts of the 2023 amendments.

The explanatory details include a brief note that rule 2.03(e) references S.R. No. 27/2019 as amended by S.R. No. 46/2019, indicating the Rules incorporate or align with earlier subordinate instruments that modified related provisions.

The text provided contains no cases, judgments or reported litigation history concerning these Rules. The instrument’s Endnotes record only the making, commencement and amendment history; they do not identify any judicial decisions construing or applying the Rules. Therefore, as a matter of the source, there is no litigation history recorded in the material supplied.

Notwithstanding the absence of reported litigation in the text, the Rules themselves create a review pathway internal to the Children’s Court structure that can generate litigation and are explicitly cognisant of review and de novo hearing mechanics. Order 3 establishes that a party may apply to the review Court (a Court constituted by a magistrate) for review of a judicial registrar’s determination by filing Form 1 within 14 days (rule 3.02(1),(4)), and that the review Court must determine the application by way of hearing de novo (rule 3.03(1)). Those provisions anticipate intra‑Court contestation and a built‑in mechanism to obtain a fresh hearing before a magistrate where a party is dissatisfied.

Because the review is de novo, prior judicial registrar determinations are not binding on the review Court and raise potential for re‑litigation of the same matters in the review forum. That structural feature creates a predictable internal appellate trail that can lead to further applications, stay requests, and possibly subsequent appellate or judicial review proceedings in superior courts under the Act’s appellate or administrative law pathways, although those latter routes are not detailed in the Rules themselves.

Practical observations relevant to likely litigation patterns, drawn only from the Rules, are:

• Time‑limited review: The 14‑day limit (rule 3.02(4)) will concentrate early litigation activity and could generate contested extension applications under rule 3.02(5).

• Stay applications and enforcement activity: Because filing for review does not stay the registrar’s order unless the review Court orders a stay (rule 3.02(2)-(3)), parties may need to bring urgent applications for stays to prevent enforcement while the review proceeds. That mechanism can generate concentrated procedural litigation on stays in the review Court.

• De novo standard: The statutory de novo review (rule 3.03(1)) reduces the doctrinal weight of the registrar’s original decision as precedent before the review Court, potentially increasing the incidence of review applications where outcomes are contested.

Several practical pitfalls arise directly from the Rules’ text. These are the concrete procedural traps, timing constraints and scope limits that practitioners and parties should note.

1. Filing for review does not automatically stay the registrar’s order (rule 3.02(2)-(3)). Practitioners often assume an appeal or review halts enforcement; here it does not. To suspend enforcement, the applicant must also apply to the review Court for a stay using Form 1. Absent a stay order, the registrar’s order remains operational.

2. Strict 14‑day review window with limited but permissive extension (rule 3.02(4)-(5)). An applicant must file within 14 days of the determination unless the review Court extends time. The review Court may extend time either before or after expiry (rule 3.02(5)), but failure to seek extension promptly can foreclose review if the Court declines to exercise discretion.

3. Service obligations (rule 3.02(6)) and post‑hearing notification (rule 3.04). Unless the review Court orders otherwise, the applicant must serve the review application on all other parties and must provide copies of any review Court orders to parties who did not enter an appearance. Failure to comply can lead to procedural complications and possible adverse judicial rulings.

4. Registrars’ limits in contested criminal matters. Registrars may exercise powers connected to mention hearings and summary case conferences (Criminal Procedure Act ss 53 and 54) but “not otherwise the power to hear and determine the charge” (rule 2.04(2)). Practitioners must not assume authority to resolve charges simply because registrars can exercise certain interlocutory powers. Similarly, registrars cannot re‑hear charges in some contexts (rule 2.04(1)(c)).

5. Uncontested condition for some powers. Several powers are available to registrars only if the application or proceeding is uncontested (rules 2.05(1), 2.05(3), 2.07(2)). If a party elects to contest, the registrar may lack jurisdiction, triggering procedural tripwires if practitioners rely on registrar determination in contested circumstances.

6. Incidental power conditions for forfeiture/disposal (rule 2.05(3)). Registrars can deal with forfeiture and disposal under the Confiscation Act or Firearms Act only if the power is incidental to other registrar powers, the proceeding is uncontested, and the child has not provided notice of abandonment. Practitioners must check all three conditions before proceeding via a registrar.

To comply with the Rules, practitioners and parties should adopt a checklist and procedural protocol keyed to the Rules’ specific provisions and to the cross‑referenced statutes.

1. Identify whether the matter falls within a judicial registrar’s power. Before listing, check Orders 2.03-2.07. Distinguish contested (see rules 2.03, 2.04(1), 2.06(1)) from uncontested jurisdiction (see rules 2.05, 2.07). If a proposed order is in the Criminal Division or relates to forfeiture/disposal, confirm the additional limits in rules 2.04 and 2.05.

2. If a matter is to be listed before a registrar, advise clients on consequences and review rights. Inform clients that a judicial registrar constitutes the Court when hearing relevant matters (rule 2.08) and that they have a 14‑day right to apply to the review Court by filing Form 1 (rule 3.02(1),(4)). Explain that filing for review does not stay orders unless a separate stay application is made (rule 3.02(2)-(3)).

3. For applications requiring uncontested status, secure clear written evidence that the application is uncontested or that opposing parties have consented. Uncontested status is a jurisdictional precondition for certain registrar powers (e.g. rule 2.05(1)-(3)). If there is any risk of contest, list the matter before a magistrate or obtain directions from the Court.

4. Preserve review options early. If a party wishes to preserve the right to review, file Form 1 within 14 days and promptly seek service on all other parties unless the review Court orders otherwise (rule 3.02(6)). If enforcement is a practical risk, file a stay application concurrently under Form 1 (rule 3.02(3)).

5. Draft Form 1 carefully. The form requires identification of the child, details of the order sought to be reviewed, and a copy of the order or its particulars (Form 1). Ensure supporting material sets out why the review is necessary and whether a stay is sought.

6. Prepare for de novo hearing. Because the review Court hears de novo (rule 3.03(1)), assemble the full evidence record, transcripts, affidavits and submissions anew, and be prepared to contest both factual and legal elements. Anticipate that the review Court must have regard to the interests of justice and the Act’s Part 1.2 principles (rule 3.03(2)).

7. Serve documents and notify parties. Comply with rule 3.02(6): serve the review application on all other parties unless the review Court orders otherwise. After the review hearing, ensure copies of any orders are provided to parties who did not enter an appearance unless the review Court orders otherwise (rule 3.04).
