356E Acknowledgement of responsibility and consent to diversion by the child (1) An adjournment must not be granted under section 356D(1) unless the child— (a) acknowledges to the Court responsibility for the offence; and (b) consents to the Court adjourning the proceeding for the purpose of the child participating in a diversion program. (2) A child's acknowledgement to the Court of responsibility for an offence is inadmissible as evidence in a proceeding for that offence and does not constitute a plea. (3) A plea withdrawn under section 356D(2) is inadmissible as evidence in a proceeding for the offence and does not constitute a plea. S. 356F inserted by No. 43/2017 s. 59.
