248 When Court may make order under this Division
(1) The Court may make a therapeutic treatment order in respect of a child if the Court is satisfied—
(a) that the child has exhibited sexually abusive behaviours; and
(b) that the order is necessary to ensure the child's access to, or attendance at, an appropriate therapeutic treatment program.

(2) In deciding whether or not to make a therapeutic treatment order in respect of a child, the Court must consider—
(a) the seriousness of the child's sexually abusive behaviours; and
(b) any previous history of sexually abusive behaviours of the child and how those behaviours were addressed; and
(c) the particular characteristics and circumstances of the child; and
(d) any other matters the Court considers relevant.
