121 Certain actions prohibited if undertaking is complied with (1) If a person complies with the requirements of an undertaking under section 119(2), no further proceedings may be brought for any offence constituted by the contravention or alleged contravention in respect of which the undertaking was given. (2) If an approved provider complies with the requirements of an undertaking under section 119(3), the Regulatory Authority must not (as the case requires)— (a) suspend the provider approval under section 27 in relation to a matter that is the subject of the undertaking; or (b) suspend the service approval under section 72 in relation to a matter that is the subject of the undertaking; or (c) give a prohibition notice under section 123 in relation to a matter that is the subject of the undertaking. (3) If a person complies with the requirements of an undertaking under section 119(4), the Regulatory Authority must not give a prohibition notice under section 123 in relation to a matter that is the subject of the undertaking.
